"the evening edit" starts right now. ♪ ♪ elizabeth: we begin tonight on capitol hill where a suspect was shot dead after ramming his car into a barrier, and he attacked capitol police with a large knife. one officer now dead, another injured. hillary vaughn was on the scene as it unfolded. hillary, thanks for joining us. what did you see? >> reporter: liz, it was quite the ebb scene here on capitol hill as we saw capitol police officer laying on the ground while other capitol police officers tried to give him medical care until he could be put on a stretcher and loaded into an ambulance. but we also saw the suspect being wheeled away on a stretcher into an ambulance as

well while he was bleeding profusely. and in response to this attack, the president has now to ordered flags at the white house to be lowered to half-mast in honor of the two u.s. capitol police officers that were attacked this afternoon at the capitol. and this evening we also are getting new information about the identity of the man who was behind this attack. he ran over those two capitol police officers with his car, he charged at them with a large knife. one of those officers is now dead, the other still in the hospital fighting for his life. police say they believe this man was a lone wolf. he was a virginia resident. he was just 25 years old, and he is now dead after police fired shots at him to stop the attack. an investigation is underway, and capitol police are still looking for answers as to what this man's motive was. >> and it is with a very, very heavy heart that i announce one of our officers has succumbed to

his injuries. this has been an extremely difficult time for u.s. capitol police. after the events of january 6th and now the events that have occurred here today. >> reporter: the police say they believe there is no tie to terrorism but would not say what his mental state was, if he appeared drunk or on drugs or had other weapons with him besides the knife in his car. police officers also say the two capitol police officers that were injured before crashing into the barricade one of them has died, and that officer has been identified as officer billy evans. he's been a member of the capitol police force for 8 years, and told -- 18 years and today people on capitol hill are mourning the losses of his life. most of the members of congress, though, were away from capitol hill in their home districts on spring recess, but the attack hit close to home for them and their staff. there's been an outpouring of reaction to the violence.

speaker pelosi saying, quote: congress stands ready to assist law enforcement with a swift and comprehensive investigation into the heinous attack. senator might be yore chime -- marco rubio tweeting this: we are all horrified by this tragic and cowardly attack on u.s. capitol police, and this evening we are hearing from president biden himself who said in this in a statement: we send our heartfelt condolences to officer evans' family and everyone grieving his loss. we know what a difficult time this has been for the capitol, everyone who works there and those who protect it. and, liz, the investigation is ongoing. president biden says he is getting frequent updates from his homeland security adviser as this investigation proceeds. liz? elizabeth: thank you, hillary vaughn. and reports coming in that it's noah green, 25 years old, may have been living in virginia. reportedly from indiana. described himself as a follower of louis farrakhan on his facebook page. hillary, thank you so much for joining us. we're going to move on to this

story. national border patrol council president brandon judd is now joining us. okay. we've got illegal immigrant arrests at a 15-year high at the border. democrats kamala harris, argument oc say there's no crisis -- aoc. unaccompanied children the size of the population of fort lauderdale possibly crossing by the fall. sure sounds like a crisis. >> as somebody who goes out and patrols the border as well as represents all of the rank and fail border patrol agents, i can't tell you how frustrated i am to hear political rhetoric instead of actual solutions. they want to put blame on other people instead of coming up with what can be done to actually secure the border. it's not rocket science. it's been done in the past, and we can do it again. there's just no political will from this white house right now to actually do what the american people want them to do to secure that border once and for all so we can stop talking about this.

elizabeth: okay. we've got the young toddlers who are dropped over, literally, by human smugglers over the border wall. worder patrol saying they're doing -- border patrol saying they're doing fine. now we've got this fight between al of course cez and senator ted cruz. aoc is trying to claim ted cruz created the problem. what do you say? >> he didn't. and it's disgusting to know that if this would have been under the trump administration when these two children were dropped, let's be clear, they were dropped from about 15 feet. look up at your ceiling, double the height of that ceiling, and those children weren't dropped onto a nice, grassy surface. they were dropped onto rocks. they could have been seriously injured, if not killed. yet we don't hear a peep from the aoc talking about these are the policies that are -- the democrat policies are allowing the criminal cartels to generate all these profits to drop these children on the ground from 16 feet in the air. it's disgusting, it's, it's

immoral. the fact that they're not coming out and discussing this issue with clarity and truthfully. elizabeth: yeah. well, they're politicizing it for their own selfish interests. that's what border guys keep telling me for the last four years, that the democrats have routinely politicized this. they broke the border, and now it's wide open to human traffickers and drug smugglers, but they don't want to anytime to that. democrats don't want to admit to their own culpability. tom homan is going after alexandria ocasio-cortez. let's listen. >> she needs to come down and talk to the men and women who put the uniform every day -- >> she came down when trump was president. >> absolutely. but you haven't seen her since. look, the men and women of the border patrol say it's a surge, a crisis. the men and women of the border patrol know that these cartels are are using these children to

tie up assets. 40% of the border patrol is no longer on the line, so these cartels are moving drugs and bad people through unguarded areas. this is a national security crisis. elizabeth: when you break the border, you risk millions of people coming here illegally being abuse ld, assaulted and killed by human traffickers and drug smugglers. that's the bottom line. what do you say? >> politicians like aoc, they're unwilling to have an open and honest conversation with the american public. they don't want them to be able to form their own opinions based upon the facts. they want to use rhetoric to scare people against the conservatives that actually want to protect them. instead, they're going to talk about kids in cages when it's president trump instead of recognizing that those same facilities were built under obama. now that it's happening under biden, she's saying something to the effect of, well, they're already there, we might as well use them. again, she's not being honest, and the left isn't being honest with the american public to

allow them to form their own opinions. elizabeth: let's listen to tucker carlson on this. watch tucker carlson. >> it's interesting to come to a place where a low iq race baiter like that has an important voice in national policy. who cares what she thinks? she's totally reckless, and she's a racist, like, openly. i think the key to this though is to think what's best for the united states. obviously, the border policy is now a disaster. to be fair, it's been disastrous for a long time. people like that use the magic word, which is racism, to cow the rest of the country into submission until decent people, like, shed their fear of being smeared by someone whose preponderance you really shouldn't care about. we're never going to have a rational immigration policy. elizabeth: you know, critics keep saying enough already with the race attacks. america's not racist.

reprehensible. biden pushed major league baseball to yank its all-star game out of georgia, and mlb did that today. what's your reaction to this story? >> well,s this is absolutely outrageous, elizabeth. this is mob rule at its best, and the president's being absolutely deceitful. he hasn't read the bill. you know he hasn't read the legislation was if he had, he wouldn't say what he has said. the legislation itself actually provides for 17 days of early voting, more than many states including new york, allows for drop boxes or absentee ballots in every single one of 159 counties in our state, something that the president's state, delaware, doesn't do, makes it so that no excuse absentee voting is allowed, again, something that many states don't do including delaware, the president's home state, and provides for an id, requiring an id for voting, for absent see voting, something that 35 other states do. sos this is just, this is absolute mob rule and nonsense.

and whatever happened to the time when we said we may disagree with what you say, but we'll fight to the death for your right to say it. no state is going to be pure with these as their guidelines, and the president has gone way off the deep end on this. and the deceitful activity of this president is absolutely unacceptable, and i agree, morally reprehensible. elizabeth: it also looks like they ignored georgia democrat stacey abrams who was begging companies, don't boycott georgia. we've got at least 16 companies attacking the new law, and as you know, it actually expands early voting and keeps ballot boxes. but their attacks are so vague and so off the wall, they don't even have the facts with it. because georgia's law is even more lenient than blue states, than biden's home state of delaware. >> you right. elizabeth: so when you see that, what's your reaction to these

companies here in. >> well, the companies are, they're just weak. they've got no spine whatsoever. and when was it the company's role to get into this without saying a thing before the vote in the legislature? without saying anything at all and then after the fact saying, oh, by the way, we think this is reprehensible. but stacey abrams isn't without fault. this is the logical conclusion, this is where things go when you have mob rule and when you have individuals say that you ought to boycott this or boycott that based upon what somebody believes. this is extremely dangerous. this isn't un-american, this is not democratic, small d democratic. if we continue to march down this road, what we'll have is absolute chaos, and mob rule is the end of the order if, in fact, this is the road that we're going down. elizabeth: well, "the wall street journal" calls it, quote, one of the most dishonest campaigns in recent political

history. georgia is enacting rules less onerous. the fight is getting so nasty, you know, georgia did move doing lawmakers tried to yank delta's tax breaks, but even the delta ceo after he criticized it said, you know what? it does have ballot boxes in every county. we hadn't seen that before. and hot of other stuff like early voting. so even the ceo is admitting that the voting system georgia wants now the pretty decent. >> yes. he finally read the legislation. our two united states senators were supportive of this boycott, of moving major league baseball's all-star game out of the state. what kind of representation is that for the state? this, as i say, this has gone a long way down the wrong road, and what state is pure? i ask is you, what state is pure

in there's no state in the nation that has lawed that are consistent with what every single individual believes. all these laws come about through representation, individuals who compromise through that process. that doesn't mean that you harm the individuals. who's this harming? this is harming the small businesses9 and the workers at the stadiums and the individuals in those small businesses surrounding the state yum who would -- this is so wrongheaded, it just doesn't make any if sense at all, and it's dangerous not just to our economy, it's dangerous to our nation. elizabeth: you're right, 35 states did say yes to voter id laws. the supreme court has upthey would that. tom price, it's good to see you. next up, more government waste we are finding in president biden's infrastructure spending blowout. little to no money, though, to

♪ elizabeth: joining me now is former white house communications director alyssa farah. it's great to have you on. we see a lot of government waste in the biden infrastructure plan for things like a climate change civilian corps but little to no money to protect the nation's energy grid? what's going on there? >> absolutely, liz. it's great to be with you. a quick review by senate republicans found actually less than 6% of this nearly $2 trillion proposed infrastructure package actually goes to traditional infrastructure. so think repairing roads and brings. on top of that, as you mentioned, not dealing with our cybersecurity infrastructure. one of the most crucial aspects of our national defense at a time when china and russia are getting closer than ever, the iranian threat persists. this is not a serious infrastructure package, and it

ends up looking a lot more like a liberal wish list if you look at what's actually included in it. i'd also note that the pay-fors are just additional taxes on the american people. elizabeth: yeah, i mean, let's stick on this for a second because you mentioned tax hikes. you know, brian wesbury, economist, said if you tax the upper bracket 100%, you're going to raise about $618 billion. this is a $2.25 trillion. he's going to have to raise taxes on the middle class. we're seeing nickel and dime taxes hitting the middle class in the stimulus package ifings. so do you see that coming? i think democrats are going to be nervous about losing the house next year. what do you think's going to happen? >> i think the biden white house is has made a calculation much like president obama did that they would rather ram through their liberal priorities and lose the midterms when they're

still able to have both houses of congress. one thing i would note on these interesting tax hikes that certainly hurt the middle class, secretary buttigieg with suggested he wanted a mileage tax. what that amounts to is a tax on rural americans, mostly middle income if not low income americans who live in places like south bend, indiana, where mayor pete was from before he came to washington. not to mention it's going to trickle down to other consumers using ride-sharing apps, etc. so this is the really, you know, this is kind of under the guise of infrastructure, but what it is is a lot of liberal priorities and a wish with list they want to ram through. elizabeth: and they're talking about carbon taxes, fuel taxes, that's going to hit the middle class. already gas prices have doubled since the trump administration. the other thing too, alyssa, lots of green energy products like solar panels are made in china, but china emits two times

why would we buy your book, james comey? >> well, look, i agree with that. while he may able to evade reporters' questions, if he is questioned directly by the federal agents, federal investigators on this, he's not going to be able to give that kind of an evasive answer. he's either going to have to give a yes or a no, or he's going of to have to take the fifth amendment and give an answer one way or the other, you know? you can potentially lie to a reporter and not get this trouble. you cannot lie to a federal agent. elizabeth: okay. let's listen to hunter biden with cbs. watch this. >> quite certainly, there could be a laptop out there that was stolen from me. it could be that i was hacked. it could be that it was, that it was russian intelligence. it could be that it was stolen from me. elizabeth: i guess he's been in d.c. so long that he thinks it's okay to do the could be routine the, the rhetorical could be

routine. you know, serious pushback on these incomprehensible answers. the thing is the laptop had information about joe biden meeting burisma executives the year before biden president bushed ukraine and has e-mails about his business dealings overseas with china. so, you know, and just so, you know, he remembers all sorts of things but not that. go ahead, hoons. >> i was just going to say the evasive answers he's giving are just not believable. i just have a hard time with the idea that he doesn't remember whether he dropped off that laptop to be repaired or not. instead it might have been stolen? well, if that was the case, did he file a police report about it being stolen? clearly, he just doesn't want to admit that, yes, it's his laptop because it has potentially very

little girls right now. what do you say? >> look, i think that these people and a lot of democrats in washington as well simply do not care about people at the border, do not care about this issue, they don't care about american sovereignty the, the idea that we have a border and we can enforce it. we have never in modern times seen a presidential decision that led more directly to a catastrophe in this country that includes a humanitarian crisis as well as all the other things like the trampling of american sovereignty. but literally the humanitarian crisis at the border, you have smugglers throwing children over the border wall? you have smugglers throwing children into the rio grande in order to -- and, of course, these smugglers are making massive, massive amounts of money doing all of this. and all of it is the a direct result of the decisions that joe biden made in the white house.

elizabeth: okay. separate case, lots of misinformation about georgia's new voting law. it actually extends early voting by 17 days. it codifies into law ballot box withs in all counties. it extends the hours that people can do early voting. georgia election official gabe sterling he said, joe biden, you're doing economic blackmail. it's morally reprehensible and disgusting that you pushed mlb and mlb caved to yank the all-star game out of georgia. that hurts worker. what do you say to that? >> it's truly incredible. and, you know, of course, the biggest lie that came out of all the coverage was this idea that people weren't allowed to give water to people standing in line to vote. well, first of all, that's to not true. and second of all, not only is it not true, but the law specifically says that election officials can provide water to

people waiting in line. so the question is why do democrats, why does the media glom on to some ridiculous lie like this thing about the water bottles? well, the answer is this: because if you actually talk about the issues of the bill, the idea that georgia republicans passed a law that they want a secure election with photo id, an issue that is a 60, 70, 80 popular move in order to secure elections, democrats realize they can't win on that. so what do they do? they go in and they make up these lies, they tell these complete fabrications in order to malign the effort to secure the elections. elizabeth: yeah. and they -- >> and the media, of course, they're in bed. yeah. elizabeth: right. so, okay, what's going on with texas? no drive-through voting, no unsolicited mail-in ballots. a lot of these laws, when you hook at them -- look at them,

okay, we hear what they're doing, but watch rachel maddow go full tilt hysterical saying more companies should do more to push back against these laws that she calls, quote, that cone january. watch this. >> and in texas, watch this, we'll see, they are well on their way to passing their draconian anti-voting rights bill as well because they can. which is going to put these big, powerful, influential corporations like coca-cola, american airlines, delta airlines, dell computers, it's going to put them in the position of having to decide what they're going to do next. elizabeth: okay. you know, critics might say your iq literally drops 50 points listening to that coverage -- [laughter] because draconian anti-voting rights? we're talking about no drive-through voting, we're talking about texas early voting stops at 7 p.m. versus 10 p.m.

prior. she's calling it anti-voting rights. we're talking about codifying common sense into the law, and to do bullying like that and to do race baiting as other anchors have done without reading the law is really misleading the american people. your final word, charlie. >> yep. it's lying to, lying to the american people. and, you know, this republic does not stand without an informed electorate. and if we are relying on these people to inform the electorate, we're in deep trouble. it's, it maligns the history of things that, you know, when they talk about how this is racist and these are jim crow laws, i'm sorry, you don't understand jim crow laws if you think securing an election is like jim crow laws. elizabeth: yeah. we get it that these people are great broadcasters but, please, just play it straight. stop with the topspin. charlie hurt, you're terrific. thanks for joining us. next up, sheriff joe frank

facility and actually we took them to the port of entry, to the international boundary line and cut 'em loose there. i think that that's a smart move on his part, and i don't think that these individuals need to be released into law-abiding communities, especially if they're criminal aliens x. we're going to do everything we can in our county to take care of our citizens. elizabeth: you know, sheriff, border patrol and america's citizens, we have we've had on the show say why is it okay for the democrats and president biden to victimize, you know, american citizens who pay their paychecks by making moves like this? because governor desantis is writing that potentially 200 criminal illegal aliens could be released into florida communities over the next six months. those are 200 criminal illegals. what do say to that? >> i think that's outrageous. you know, here in our county

we're, you know, we've been busy. so releasing these vims into our communities is not -- individuals into our communities is not, it's not safe. and our jail, it's costing our taxpayers in the last ten days our taxpayers have had to come up with $6500 out of our tax base. so if this kind of activity continues over the next 90 days, you're talking about $66,000. but over a year's time, you're looking at a little over a quarter million dollars that may be a drop in the bucket to d.c., but that's a huge chunk of change to our county. so releasing these individuals into our communities, i don't think that it's safe. the individuals that are coming, these immigrants that are coming through here, they're not coming here to stay. they're going to go elsewhere within the united states. so, you know, i applaud the florida governor for taking the

steps that he elizabeth: we hear what you're saying loud and clear, president biden ordered i.c.e. agents to not pursue for illegal aliens for deportation until they have been convicted of things like aggravated felony like murders, abuse, sexual abuse of a minor, trafficking, firearms and beth, when you saw president biden do that what was your reaction, we have florida's attorney general saying already biden has released back into florida criminal illegals who were accused of robbery, cocaine, heroin, trafficking and grant auto theft, this is not just for this is all states, is that your take two? >> it is all states one of the individuals being released and are counting was for aggravated assault, family violence that the top individual that is being released or was going to be released into our community,

thanks to our border patrol partners we got help in getting for others handled in a different manner that were potentially going to be released into our community. elizabeth: can you tell us what is happening right now in your community, what are you hearing from local homeowners and residents about how they feel what's going on. >> some of our citizens that live along the bank of the rio grande their concern, their great they don't know what's taken place, i had a meeting two weeks ago with them to try te's their fear, the area that were talking about honduras, guatemala, the cubans are coming from, for the most part their family units. so we were able to ease their
