away from local community issues and applying them to federal agents and federal law enforcement and order to get some of these spoils of narco terrorists, sometimes people aren't guilty and they have their houses take away. one young man in indiana had his range rover taken away the family got it back. >> one of the most pernicious developments in criminal justice is when government started tasking police departments with raising revenue. this is common through fines and fees in civil forfeiture as you mentioned when you put police out in the field and tell them that they have to participate in a revenue raising it essentially makes the police a shadow tax system. so they are out there forfeiting vehicles and cash they are out there issuing citations and fines that should be helping people. and so partly it's their fault they have a very powerful political lobby they could ship the produce of they want to but they don't part they're out on the field taking

the president weighing in. derek chauvin may claim it made a fair trial impossible so what's next to minneapolis customer here to discuss emily compagno, welcome back emily. >> thanks kenny hi great to be here. let's talk a little bit about some of the sentencing guidelines that this judge has. what could chauvin face what will he most likely face from this judge? >> from the second degree murder term we have the maximum available 40 years but sentencing guidelines recommends 12 and a half or the also recommend 12 and half as well for the third degree murder. now for the manslaughter they recommend for with a maximum of ten. but here's the thing. we know their aggravating factors of the prosecution is pushing for. here in this child's going to be up to the judge and the convicted felon, derek chauvin had the judge consider ultimately ruled the

aggravating factors. though if he, the judge determines are aggregated factors including for example wearing a uniform at the time and children watching, i protect the most he will get with minnesota statistics as a double sentencing guideline principle ultimately taken from 12 and a half to about 25 years. because it's one act upon which these convictions are based on that's why the sentencing then only has to do with the most severe charge and conviction of second-degree murder. kennedy: will yes we watch that eight weeks obviously x marty starting to work on an appeal, how does that work? i have read 90% of appeals do not take. his chances are not good. but what are some factors here? what is he relying on in terms of how the jury might have been prejudiced? and maxine waters? in the shooting death of daute wright?

>> right, you are correct one in every ten appeals is actually successful. it's further complicated minnesota on the appellate court their elected officials that make up the majority of it. that's not quite the same insulation you might expect to receive in other states. now here, all in the motions during the trial and the mistral at the end those are sort of the roadmap for what to expect. so juror biases going to say the judge refuse not only to move the venue of the trial he did not sequester the jury. also his gag order only appealed to officials and they limited them from washing the news. they did not limit that from engaging in social media, watching talkshows. this case as you said in the beginning permeate our entire fabric for year. certainly the jury was exposed to many of that as well jury instructions. we do one of these convictions is based on a felony murder rule. minnesota is unique as it includes insults as there is a

crime there is similar to getting a speeding ticket. it is not better your intent you did it so you're guilty. instructions are a little bit odd sort of blended the intent aspect there. that's another avenue that likely he will move to appeal on. the bottom line, he has a lot of options. i doubt it will be successful. the one to note however remember in the third degree murder turned on the issue of whether the imminent dangerous act was applied to one person or many. at the time, then the officer was convicted on that to define to one person. so the judge hears that okay were going to bring back in that charge and he was convicted of it. will that is in front of the supreme court of minnesota right now. so it is that ruling is overturned and if that supreme court determines that charge should only be applied to groups instead of one person, that i would say is most successful chance he has of an
