the world, welcome to this historic leaders summit on climate. i want to thank you for being here. and for your leadership. i have spoken with a number of but the climate crisis. elizabeth: well make you feel good, jason they wanted to kick it off this way and overturn the economy with climate change policies. what do you think of that? >> you would think they would have the whole zoom thing done, figured out by now given how we had to communicate world leaders getting together to communicate about important issues is always laudable, it is a good idea but what the united states under kamala harris and joe biden are proposing is one of the most radical ideas to ever face the planet t will cost american jobs. it will naturally drive up the cost of energy which is the goal of the biden-harris

administration t will hurt the economy and hurt world politics a united states dependent on other countries to fuel its energy future is not good for the united states. donald trump got us out of this. biden and harris are putting us back into it. elizabeth: climate activists, they're saying you know, the biden administration you're not doing enough. they dumped wheelbarrows full of manure at the white house today. jason, that is on that side of the aisle. we also have now 45 house republicans. they're accusing climate envoy and the president, climate envoy and the president of blatant abuse of power. behind the scenes pressure campaign to get u.s. banks to cut lending, cut loans, to oil and gas companies, basically defund them that would wipe out millions of jobs, no? what do you think of this pressure campaign? >> those lawmakers are right, it is a step too far.

to try to cut them off using regulatory might of the executive branch to put pressure on banks that would normally do business with legitimate energy companies and energy providers is fundamentally wrong. it is an abuse of power. i believe it is outside the scope of the law but when you have the regulator that is run by joe biden and kamala harris, that has to authorize what banks do and how though do it, at the same time they're telling you, you better not do this, they will listen to that. so even without passing a piece of legislation they can use the financial pressure of a penetrating audit or the regulatory schemes that will drive these companies away. say, you know what? there is too much resistance here. that is fundamentally wrong. if it is exposed in its totality people will understand that is an abuse of power. elizabeth: yeah. there is, could cause prices to rise as well and slam the

economy. that is the charge by the republicans. you know we have senator pat toomey, leading senate republicans sending a letter to john kerry, stop it, stop pressuring banks to defund, debank energy oil and gas companies. tough senate democrat, runs senate finance, tax committee in the senate, ron wyden is moving to cut tax breaks for oil and gas there is that happening too. i want to get to john kerry's climate change hypocrisy. kerry tweeted, basically we will lead by example. he is, john kerry is comparing climate change to the women's sufficient a get movement, to civil rights. fox news is reporting his family poured 116 metric tons of to put solution into the atmosphere over the last year flying their private jet to places like sun valley, idaho and martha's vineyard. what is going on with john kerry here?

>> the same old john kerry. this has been the problem with john kerry for a long time. it's a big reason why he didn't become the president of the united states when he ran. he failed in his leadership on this issue. i don't think he understands it. he was quoted saying he wants to get rid of all carbon dioxide. going to kill all the plants in the world. i mean he just doesn't understand the basic science. he doesn't care. he thinks he is above it. he was on an airplane. wasn't wearing his mask. didn't seem to care about that, even though he was part of an administration dictating that they had to do it. now he uses these private jets. i'm in favor of people using private jets but don't go out and use the power of that white house and being one of these czars, try to shame people and advocate for things that you are not willing to do yourself. that is the hypocrisy that drives people nuts. elizabeth: jason, love having you on. always great to see you. come back soon.

a 570 billion-dollar infrastructure plan. that is about what would be spent, probably less on roads and bridges. but now we've got the biden administration saying you know what? we'll do a one trillion dollar family care, family care, new plan, a new deal. so are they conceding they were gaslighting americans by saying, family care, paid leave was infrastructure? is, seems like they're backtracking on this? >> well, i don't know how much they're backtracking, liz. it was always a bogus sale. they know there is an appeal for infrastructure and they know it is popular to say we're taxing the rich and corporations. that is never what they were going to do. to pay for the 2 1/2, $3 trillion in tax increases they want they could never limit it to just a 6 or 7% increase in corporate taxes, even though that itself would kill jobs. it always will be a tax plan to tax all americans across the board. this is just the latest piece of

it. this giant new plan to actually provide 100% increase in your capital-gains tax is going to kill jobs. it is going to quill businesses. it will prevent people from being able to pass along or sell family farms. it is a terrible policy but to go back to your first question, when you look at the initial biden infrastructure plan, they're forcing the subsidization using american tax dollars to force you to buy electric vehicles. we'll subsidize them. who produces those? electric vehicle batteries are produced more in china than anywhere else. elizabeth: right. >> 60% of our solar panels is produced in china. the notion we're doing it for better good of the environment, what they're doing sending jobs to china with their energy plan, their climate plan, but also their tax plan. elizabeth: the world's worst polluter is china in terms of gse. marc, stay on this for one last

question. biden is going to say, let's raise the capital gains rate to 39.6% on those who make a million and more. effectively with the investment surtax it would go to 43%. so if he wants to take that money out of the economy, to pay for a family care plan, right? we get it. we understand what the needs are here but how about just get focused on getting america fully reopened and back to work? get the economy moving again? >> liz, that is obviously what would help most. america is beginning to get back to work. if anything one of the things stifling there is so much federal handouts in the system we hear time and again employers cannot get employees to come back because there is so much largess in the system. to your point, go to 43%, the current rate is 20%. that is 100% increase in the capital-gains tax. it will impact a lot more people. if transactions stop and selling

equipment, selling small businesses that will actually stop the job growth. you will end up hurting many more jobs. while they're saying one trillion dollar in the particular piece of the spending, overall the infrastructure spending as you mentioned before, 325 billion on roads and bridges. it is mostly other social projects forcing to subsidize electric vehicles. they're sending jobs where they are produced is china. taxing americans to pay for products being made in china. elizabeth: it is almost like they're in a bell jar a bubble. you know what i mean, mark? we've been doing these stories. you have wonderfully broke it down, i mean i just don't understand the lack of common sense here. marc short, so good to see you. great insight. come back soon, marc short. former michael allen,

♪. elizabeth: let's welcome to the show former national security council official michael allen. it's great to have you on. okay, we're kind of seeing this big power play by house speaker nancy pelosi, all house democrats back her plan to stop all presidents from doing travel bans to protect u.s. citizens. they're going after what trump did. what do you say to this? >> the latest in a series of moves by the democratic majority to limit things that president trump did of course but this one is unconstitutionally impinge upon the president's national security powers. let me give you an example. it would require that we harness the executive branch with meeting a bunch factual-based proclamations before a president could ban certain people from coming into the united states. why is that bad you might offer? what if the cia came in with

non-specific fragmentary intelligence, intelligence by its very nature sometimes vague and unspecific and so the president's team might not be able to implement this as a policy response, that is some sort of a ban of a region or a group because congress tied the hands of the president. elizabeth: so the cia gets word terrorists are going to come in and there is a terrorist hot spot in the middle east and this going to travel in. pelosi would say, you got to come to us first and get our approval, and then we'll sign off on it but that would take a long time, could be foot-dragging. >> yeah. elizabeth: there is other weirdness, foreign nationals could sue the government claiming they were harmed by the president's decision if they don't get congress' approval. looks like that is in there too, what do you say to that? >> you're right. we can't have 535 members of

congress making operational national security determinations. the constitution, all of our laws, our history contemplated that the president is the sole organ of foreign affairs and national security. we can't hinder the operation or hampering that operation of these national security privileges to the president has by a bunch of laws that require lawyers to get in and interfere with the national security of the united states. elizabeth: so trump says travel ban on terror hot spots. pelosi that's it's a religious ban because it is muslim countries this has proven to be erroneous what pelosi's thinking is here. but she wants to undo all of that. so by the way the president biden already stopped that part of the trump travel ban but here's the thing, president obama issued about 18 travel bans on individual from the

middle east, iran, countries in africa, libya, ukraine, venezuela, north korea. would pelosi go after obama's travel bans too? this would fail at the supreme court. the supreme court already rejected this. >> we won at the supreme court in the trump administration. i don't think as a political matter she would not criticize a democrat who did a travel ban but certainly would for a republican president. you know either way the law is written would hamper republican or democratic national security officials from recommending to the president a bonafide course of action this is just the type of thing that happened when president bush was in office. i served on the national security council staff. you want more options, not fewer options to give to the president so he can protect us. if you get fragmentary information and you can't absolutely swear it is 100% true but the american people expect you to act on it, we don't need

the congress of the united states getting in the way. elizabeth: yeah. and so, we hear exactly what you're saying. by the way let me back up. trump put travel bans on terror hot spot countries. he didn't put a travel ban on egypt. egypt is a muslim majority country. he didn't do it on indonesia. that disproves, undercuts the push by the democrats for a new restriction trying to handcuff any president from doing a travel ban, if they see terrorists coming in, your final word, sir? >> any president needs a rational basis. any president doesn't want to put it in a travel ban if it doesn't make sense because we have limited resources. so they only want to do it for specific groups intelligence might suggest, hey, we have a problem or an inbound terrorist coming here and we need some sort of prophylactic, we need

♪. elizabeth: let's welcome to the show the former chief nominations counsel to senate judiciary. back with us is greg nunziata. greg, great to see you again. >> thanks for having me back. elizabeth: here is the story. good to see you. we have democrats on house and senate judiciaries saying supreme court justice amy coney barrett, you have to step down from this case, you have to recuse yourself. it is a case coming out of california, it would force non-profits, notably conservative non-profits to reveal names of big money donors who give money to them. what do they want? this they want personal docs revealed so they can protest at

homes? you see the privacy issue, right? >> the underlying case is asking for, how we strike a balance between first amendment rights including rights to privacy and how we express our first amendment rights to speech and association and whatever the government's interest in requiring disclosing information. on one hand we require people who give donations to candidates above a certain level to disclose that. the court said that is reasonable. helps us guard against corruption. on the other hand supreme court case, naacp didn't need to reveal its donors to southern states during the civil rights era because there is an important privacy right in association and expression. this case is somewhere in between. about whether charities regulated by states attorneys general should to disclose donors for the ag's office to do

investigations. i think three out of 50 states currently require that. one of which is california which is the one that is at issue in this case. elizabeth: so basically this case says, a non-profit would have to attach to their state tax return the names of the donors who have given to that non-profit? courts already found california's state database has been vulnerable to hacking. donor names on home addresses repeatedly put up on the internet, even names of their childrens schools. serious harrassment posted online with threats of violence against donors. this is spinning out of the koch brothers american for progress donating a million dollars in a national campaign to get amy coney barrett seated. the supreme court, gregg, she didn't personally take the money. it doesn't mean, you know what i mean? they have already ruled in cases like this she doesn't have to step down. >> yeah. the supreme court justice or any judge has to recuse themselves

only if a reasonable, informed person, knowing all the facts would believe that their partiality would be in question or they would be biased in this case. i personally i think it is quite a stretch to suggest that justice barrett will change her view on the contours of the first amendment and rights that affect all americans just because one group of americans may have expressed their first amendment rights in support of her nomination. it doesn't seem like a very tight argument to me. remember this argument is not being made by a watchdog group. it is being made by three members of congress who have been very outspoken. they are critics of justice barrett. they opposed her confirmation, suggested it was illegitimate. hostile to the supreme court. they're very hostile to the idea of conservative legal groups being involved in politics. in fact two of the members who signed this letter actually filed an amicus brief in this very case. so they have an interest in

this. they're involved. this is part of a broader. elizabeth: stay on that. wait. i want to know those names because we're talking about democrat senator sheldon whitehouse, richard blumenthal, congressman hank johnson. they all signed this letter to amy coney barrett saying you have got to recuse yourself. they oversee key judiciary committees starting with court oversight. who filed the amicus brief in this? >> there are many amicus briefs in this case because many people care about the issues involved. elizabeth: but any of these individuals? >> there is a brief from senate democrats a number of democrats, two of the signatories of that brief are senators blumenthal and whitehouse. elizabeth: got it. didn't want her seated. now they're going after her to force her to recuse herself from cases they themselves were involved in, seems like. it feels really circular. by the way colleges and

universities don't have to reveal their donors. we see what is going on with academia, what middle-class families pay in tuition and, the blatant stupidity flying out of academia, hitting our society today. your final word, gregg. >> it will be up to justice barrett whether she recuses herself or not. i doubt she would. she would be worried sending a message to bow because of political intimidation. when she recurses herself, the court is 4-4. could change outcome of a case. this is not like another judge could simply be replaced a supreme court justice has to be very reluctant to recuse herself, not here. it will be a very interesting case to be argued next case, monday morning. elizabeth: i want to make you laugh. i think your cat wants to visit. >> perils of homes.

still rising. covid cases in texas dropping by more than half but didn't president biden say the governor's decision there to fully open up, stop the mask mandate was quote, neanderthal thinking? >> that's right. there is no reason, liz, at this point every state in america shouldn't be fully reopened. the data is very clear, these lockdowns don't do much to stop the spread of covid. they are devastating to the economy. it is obvious to the democrats the lockdowns were not about keeping people safe and healthy, they were about power. covid-19 offered politicians and bureaucrats drunk with power the opportunity to enact major power grabs while invading people's privacy, growing the size and growth of the state. it is shameful. it has been devastating, people lost their businesses, livelihoods, everything. we see depression and other mental illnesses on the rise.

we have to reopen the illnesses around the country. a lot of people wake up, especially they get vaccinated and back to normal life. i think we're seeing push back against some of the leaders who refuse to let up on the lockdown policies. elizabeth: we're showing the university of michigan study showing no impact on covid-19 from the lockdowns. we've got the death rate in the u.s. declined steeply in february and march. flat lining in april. yesterday seven-day moving average, looks like the lowest since around mid-october. but then you have things like the university of michigan saying that and the governor of michigan saying, she still wants to target bars and restaurants even though the covid cases coming out of there are something like 2%. >> right. well the same people who say they believe in data and science are ignoring the data and science. these democrats in charge, they don't believe in science. they believe in power wrapped in veneer of the label of science. i mean look at new york state.

they have some of the harshest lockdown measures put in place in the nation, yet they have the nation's second highest death per million rate. they have one of the highest job loss rates. compare that to florida and texas where i am. we have been fully reopened. people are fine here. people going back to work and normal lives. elizabeth: mentioned texas, you listen to dr. fauci, can't explain why texas cases are dropping. listen to this with jim jordan last week. what explains why texas is so low than compared to the rates. lockdown states have much higher case rate than state of texas. a month ago said we'll not lock down with all the mandates you have to have. >> yeah, there is difference between the lockdown and people obeying the lockdown. you know, you could have a situation where they say, we're going to lock down, and yet you have people doing exactly what they want to do.

>> is that happening in the top eight states of the country? they're not following what has been told? they're not listening to dr. fauci. elizabeth: so he is saying they're not following the rules but they're so much more mitigating factors against what fauci said. you have got a quick reaction here. we have another sound bite we want you to listen to. what do you think, kristin. >> that is ridiculous. places like florida got it right with the targeted approach. we protect the elderly and vaccinate people with underlying conditions. everyone else go back to normal. elizabeth: lockdown states, michigan, minnesota, new jersey, pennsylvania, new jersey, washington state. all the covid cases are going up. you stay indoors covid cases will go up. the cdc we did not vote for people at the cdc. we did elect leaders that create policy. we elect the five of you. we chose you to make difficult decisions for our children. we chose you to make decisions that would be in our children's best interests. elizabeth: she is saying the masks are really harming children. the w.h.o. says masks for up to age five. you know what i mean, kristin. she sees it. she is a mom. sighing kids wearing masks seven hours in school. that is dangerous. people don't know the science is really there that the covid-19 is hitting children. you know what i mean, kristin? she is saying are you aware of the harm you're doing? your final word. >> right. there is a lot of data covid is not particularly dangerous to children. children just aren't getting very ill when they get covid in general. but these complaints are only applicable to kids lucky enough to be back in the classroom. there are still kids around the

♪♪ elizabeth: joining us now, former dhs oversight counsel michael howell. hey, mike, it's good to see you. so the biden administration, it looks like dealing with the border crisis is so far on the back burner, it's fallen off the stove. and, you know, they're not going to do anything, it looks like, for now. they're doing things at the margins. but then the we have republican senator from texas john cornyn and democrat arizona senator kyrsten sinema saying, wait a second, we've got a new bipartisan bill to deal with the crisis. this is kind of embarrassing for the biden administration. are they going to step up? >> i think it's a giant gift from cornyn to the biden administration, because what it does is it rewards the crisis

they created by allowing them to throw out all the enforcement mechanisms and keep them off, what caused the crisis, and it formalizes the process by which we're releasing and processing. the overall numbers won't go down because of this. and so -- they'll skyrocket. they'll go through the absolute roof. so what cornyn's doing with this bill is losing all the leverage that the senators and the congressmen have over the white house to go back on what we know works, what was going on in the trump administration. elizabeth: that's interesting. i hear exactly what you said. here's what we're hearing from the border town officials and mayors and people who are at the border. they're saying, you know what, mr. president and your team, you're failing in your duty to protect. they are being personally harmed. this, what's happening to them, mike, is so unfair. and now it's going to another level. we've got a border mayor warning that he and the folks down there, their seeing illegal
