"the evening edit" starts right now. ♪ elizabeth: okay. welcome to the show. you're watching the fox business network. let's kick it off with fox news contributor ari fleischer. ari, here is what it going on with john kerry. let's break it down. senator chuck grassley sends a letter to secretary of state antony blinken saying give me emails about state department officials talking about potential conflicts of interest by biden's climate envoy john kerry. how bad is this for biden's infrastructure and climate change agenda? it is not a good look. >> it is not a good look. when you go back in time with john kerry, he is pig pen from peanuts he leaves messes behind he is so wealthy and rich he is not like pig pen that way.

his business life has a myriad of conflicts of interest. people coming out of government temporarily in the private sector have conflicts. they have to disclose them all. they have to show them all, sell all the assets so any conflict is therefore gone, null and void. he hasn't done that yet. he is in some trouble here, people are learning about what investments what holdings he had, depending on what actions taken on climate change, it could enrich john kerry, could enrich the positions he used to hold. elizabeth: he hasn't fully done it. he is starting to. we're seeing he made tens of millions of dollars off of divesting investments in oil and gas but chuck grassley wants to know this, he is referring to an ethics pledge john kerry signed where john kerry will recuse himself from participating in certain climate change policy discussions. so what is that about? senator grassley wants to know is john kerry getting any waivers around this too.

>> senator grassley is asking the exact right questions. the person in charge of international negotiations of climate change who can't participate in important meetings to deal with climate change why is he there? and if he is dragging his feet, or if he is seeking waivers, what good are the conflict of interest provisions? grassley is doing what he should do. he is digging. the problem i've got, liz, we've seen this story before especially when democrats are in the white house. republicans on capitol hill blow whistles, they try to dig, they just get agencies to give them a red light, not cooperate, not turn over documents, slow walk it. the press kind of looks the other way. so i have seen this story before and to grassley's credit he is doing the right thing but i don't have high confidence the agencies will respond to grassley in any meaningful or speedy way. elizabeth: so, here is the thing. he still has links to climate change organizations and entities that would be affected

by future legislation and regulation that he could weigh in on. so the state department is accused of slow walking, ari, for weeks and weeks of kerry's financial disclosures. he got a 5 million-dollar salary what critics say a no-show job at bank of america on advisory council pushing banks to make loans that result in zero emissions. he says invests in oil and gas are national security threats what oil and gas what their business model is doing but he made millions of dollars of investments in them. there is a lot of controversy surrounding john kerry right now. the question will it throw a wrench in biden's climate change push? >> i don't think it will throw a wrench, frankly, the democrats are too devoted like it is a religion getting this done. if one member after choir has a hiccup in his voice it will not stop democrats from singing this song. elizabeth: he is a big member of the choir. he is the leader of the choir.

he is the leader of the choir. >> he is leader of the international negotiations. he is the leader -- elizabeth: that is a big deal. >> domestically -- elizabeth: seen on airplanes not wearing a mask. >> continues to push this throughout the whole federal government. my issue with john kerry though the disclosure provisions. he has got to comply with the rules that apply to everybody in government. i don't begrudge people who had investments who go into the government. there is nothing wrong with investments but once you go into the government you have a moral obligation to get rid of everyone of those investments. so you only hold cash. therefore you cannot have any conflicts of interest. that is what kerry needs to do. he needs to do it yesterday. elizabeth: i mean the climate czar is taking hits to his credibility. he is on a plane not wearing a mask. flying a private family jet around the world to vacation spots in martha's vineyard. he will recuse himself from certain policy discussions. we don't know who he is

connected to, who he will be able to weigh in on with legislation. ari, we hear what you're saying. this is an on going story. great to have you on. we'll continue to pursue it, talk with you in the future. ari fleischer. bring in former vice president pence's chief of staff marc short. you heard what we were talking about. what is your opinion about this? >> i don't begrudge, liz, people making money, and you don't either. at the same time coming back in government with a salary cap they want to put giant tax increases on the rest of america. typically federal salaries are under 200,000-dollar threshold. the magic number which receive massive tax increases according to the biden administration is 400,000 or above. reality every american will see their taxes increase. elizabeth: we don't begrudge people making money. here is the point.

senator chuck grassley is saying sign an ethics pledge, recuse yourself from climate policy discussions. kerry has connections to climate change groups. he wants to know who is involved. he wants to know if john kerry will get waivers on this, getting legislation that affects the u.s. economy that is the issue. >> if waivers are extended this should be divulged to the american people so they can look at it, and evaluate it. probably there is a lot don't think john kerry's position should exist in the first place. elizabeth: the other thing too is, we've got this story. biden's top aides, you know, let me back up. the president and vice president doing a big pr push with blue-collar working class and middle class workers to push for big government spending. people out there, the folks out there are seeing his top aides have multiplied their wealth since working under obama. again we understand your point of view, that we don't begrudge

people making money but we're talking like, you know, susan rice, jeff zeints, ron claim making millions of bucks leaving the obama administration, coming back into the biden administration what are your thoughts on that? >> i don't begrudge them making money and adding value for their clients and investment funds. i don't want everybody else to get massive tax increases and american blue-collar jobs are sent overseas. one of the provisions in the bill they're looking to push, basically american taxpayers will be forced to subsidize american purchase of electric vehicle batteries. they're made in china. so as they begin to say they're here for blue-collar worker in america, they're taxing americans, force us to buy products from china made in china, creating jobs in china. elizabeth: yeah. i guess you know people out in the heartland, people in

new york, and east and west coast they see people going to d.c., coming out bazillion airs or millionaires, what we call the swamp. we never use the term on the show but that is the accusation. they are making tons of money off the system and they don't like it. the other thing with john kerry, leaked audio where he reportedly told iranian foreign minister told him about israeli airstrikes in syria, john kerry is denying that. john, your take on house republicans, senate republicans say should he get the security clearance removed and should he resign from the national security council what do you say to that? >> i think they need to verify the validity of the allegations. i know john kerry has refuted them but certainly if any way he breached any confidence of the american people with the mullahs in iran who actually look to use the american dollars, the obama

elizabeth: okay. you're not alone if you're wondering why is president biden spending $6 trillion when the economy is already turning around? let's bring in texas republican brian babin. okay. so here's the thing. it is good to see you, congressman. the economy is growing, good to see you. economy is booming, growing the fastest since 1951. did the president paint a false picture after faltering economy with fdr collapse when that is not true? the economy is starting to boom. he wants six trillion dollars in new spending. what do you make of this debate? >> it is typical democrat policies, liz. great to be with you. they spend like drunk sailors, 6 trillion bucks. we had a 660 billion-dollar deficit in this last month or so, rather, in march, i should say. and, i think that is the third largest deficit we've had on

record. the biden administration is simply going it to raise taxes and these bills he is proposing a 6 trillion-dollar bills are simply what i would call trojan horses to get green new deal policies, pay off their cronies and in blue counties, blue states, blue cities and these tax hikes that are going to have to be implemented to, enacted rather to pay for these huge bills are going to hurt the middle class, the very, very ones that biden said he was going to be representing. elizabeth: yeah. >> and let me just say this. the, the economy that we had under the trump administration was nothing less than astounding. 19 straight months of growth. elizabeth: right. >> the lowest unemployment rate in history for many parts of our population. the best economy in 50 or 60 years. and -- elizabeth: that's right.

when biden sat down, when biden sat down he did not inherit a fdr style collapse. the economy was booming. it was growing 4% in the fourth quarter, of 2020. 33% annualized in third quarter quart of 2020. 6% annualized in the first quarter. we're seeing, markets are bracing, blockbuster, a really good jobs report, 980,000 potential jobs this friday. covid cases and deaths are down big double digits since january. 100 million already vaccinated. biden wants 160 million vaccinated by july. treasury secretary janet yellen is warning today the economy could overheat and interest rates could rise from all the new spending. people are talking like jimmy carter double-digit inflation. we don't know if that will happen. the irony to fix what democrat politicians did. they willy-nilly shut down their local economy. >> they absolutely did, under the cover of the great covid

excuse, they have locked their own states down. you know my own state should be the model for how to, you know, get out of this rut that we're in. of course the best stimulus plan ever for covid is just to open up the economy and get kids back in school but, let me tell you, i serve on transportation and infrastructure committee in the house of representatives. and liz, let me tell you something, we have passed great infrastructure bills over the years. i voted for a good one back in 2015. it was $300 billion. that sounds like a lot of money back in those days. now here we're talking trillions and trillions of dollars, reversing the tax cuts and jobs act, raising the corporate income tax on one million u.s. small businesses. it can't help but hurt the economy in the long run. and these are -- elizabeth: we hear you. we hear you. the iron think -- irony here is

irony here is the democrats could lose house seats because of the census and house redistricting. irony they could lose the house seats, nancy pelosi could lose the gavel, possibly next year, we don't know, blue states, democrat run states are chasing people out of their states with higher taxes. that is the irony. they don't have a mandate. they have the slimmest majority since world war ii. looks like house democrats know all of this. they are at risk of losing 32 house democrats next year are demanding more pork spending. democrats are trying to ram through the system, gaming the system. get rid of the filibuster. call the filibuster jim crow. define infrastructure as human beings. redefining bipartisanship not including republicans. it is crazy town down there in d.c., house democrats throwing fastballs by the american people. >> they don't call it the swamp for nothing, liz, and quite frankly the democrats, eye are

us, former federal prosecutor jim trusty. jim, let's break this down. the fbi raids rudy giuliani's home and office. basically rudy giuliani is saying he is being framed. rudy giuliani claims he has evidence of biden family is involved in quote, money laundering. that is a big heavy-duty charge. what do you make of that? >> well, liz, you and i talked about hunter biden and all the different financial entanglements that look pretty bad, so you can't be immediately dismissive of what rudy says. it is not mutually exclusive. there could be something getting rudy in trouble at the same time that the hunter biden or joe biden are valid. there are a couple flags. the fara statute, foreign registration act, was enacted in 1938 to stop nazi propaganda. it was used two dozen times in world war ii, quietly went back

to the shelf and collected dust for 70 years. it has been trotted out in a couple high-profile situations, attorney greg craig, paul manafort, immediately rudy. that is a suspicious start to dust off the old statute to use it in select cases is troublesome. the fact that the southern district of new york operating without main justice where they have the fara unit. there is a lot to look at this. elizabeth: the foreign registration act effectively kicked off the trump-russia probe. peter strzok and james comey's fbi used it to start looking into general michael flynn for lobbying on behalf of turkey. the al gauges with rudy giuliani is that he was basically lobbying the trump administration to fire the u.s. ambassador to ukraine. the allegation too is that he got ahold of hunter biden's laptop and that the fbi was investigating hunter biden's

laptop for evidence of money laundering and also we're looking attacks evasion. the justice department, the u.s. attorney in delaware investigating hunter biden on this too. so that's, that's the, this is a very layered story, jim. we want you to take a listen to rudy giuliani on this, on what happened. listen to rudy giuliani here. >> there is a clear money laundering violation involving the biden family. it is on paper from, from ukraine to latvia, to cypress, to a hidden bank account. the reality is that warrant is completely illegal. the only way you can get a search warrant is if you can show there is some evidence that the person is going to destroy the evidence or is going to run away with the evidence. i have had it for two years and i haven't destroyed it.

they also got it from the icloud in the middle of the impeachment defense. they invaded, without telling me, my icloud. they took documents that are privileged and then they unilaterally decided what they could read and not read. so the prosecutors, justice department, spied on me. elizabeth: that means william barr's doj spied on him. that is also a story angle here. but stay on the, stay on the allegation of the biden family allegedly committing money laundering. that is what rudy giuliani is claiming. you heard the countries he was citing. this is a heavy charge. he says he has evidence on paper. what could that be? >> well, i don't know. obviously as a personal attorney traveling the world, having some meetings with perhaps foreign law enforcement. they might have shown him documents or given him access to

things but to me, stepping back to kind of the big picture of this, liz, this is a huge integrity test for the attorney general and for the director of the fbi. i mean all of this. what is going to happen with rudy? will they treat him like any other individual in the criminal justice system around make decisions based on evidence, or is it going to be, is it the rudy rule? the same thing with hunter biden. is this going to be the president's son, we all know what he wants to have happen or look on it dispassionately to decide on the evidence. next six months we'll have a real good gauge whether this attorney general is politically malleable or a stand-up guy to do the right thing despite pressure. he will feel pressure. elizabeth: hunter biden. we hear you, the hunter biden laptop reportedly showed that hunter biden was getting paid by the chairman of the cefc with a

diamond that is the allegation we heard from fbi sources and former fbi officials, you see payments in diamonds, that is a red flag, could involve money laundering we don't know what is happening here. the other story angle too, jim, we want to talk to, but giuliani, this is a separate story, saying to nbc, "the washington post," "new york times," reveal your anonymous sources that you used for your erroneous stories that i was target after russian disinformation campaign to hurt joe biden. cnn have not corrected stories about this too, pundits at cnbc and "washington post" still not deleting tweets about this. this is still going on, jim. what is your take on this story? >> if he wasn't such a public figure he would have a nice defamation case but it gets much tougher to win against defamation. look, "the washington post," "new york times," they can't get

yesterday's weather right but when you look what they're doing, there is always a mistake in one direction. that i think is the basic argument rudy has. they're willing to break their own internal rules, their own guidelines to accept single source, anonymous or shaky source information when it feels good, when it is the right kind of information for them. that is the problem he is running into. elizabeth: you know, getting back, we just want to stay on this, there is just a quick irony here we want to talk about. they're going after rudy giuliani based on a fara violation. you point out other trump officials manafort, general flynn, that was used to go after those guys. hunter biden circumvented according to the laptop emails fara violations by using off-balance sheet shell companies in order to get money from overseas business dealings with china and russia. there is an irony there. your final word, jim trusty.

cuomo saying to new yorkers, you got to get vaccinated because you could wind up kissing your grandmother and killing her? what was your take on that? >> this is another perfect example, liz of liberal hypocrisy. when governor cuomo made the inexplicable and deadly decision early in the pandemic to readmit, mandate readmitting seniors to nursing homes it was probably the worst single response during any leader in the pandemic and maybe the most deadly decision in american public health history when you think about the thousands of new york seniors who were killed as a result of that terrible decision. and so once again, here is the hypocrisy. it had devastating consequences for america's seniors, for, and it is an example, liz of how the big government top-down approach

of blue state and city leaders was much worse than the decisions of many of the red state leaders in this country. >> yeah. >> these bad decisions -- had devastating effects for seniors, our kids and for small businesses. elizabeth: got it. critics are saying he is the guy who killed grandparents. janice dean lost her in-laws due to covid-19 in new york nursing homes. she is saying, he has some nerve shaming others. 15,000 elderly are no longer with us because of his order putting patients back in and then he basically, his administration was tracking and logging the death toll in nursing homes whether they were in hospitals or happening in nursing homes and then he pressured state workers to cover it up for months on end. "new york times" reporting that. you know, this is the same time he got a four million dollar book deal. just seems so unseemly. now, sir, he is saying, it's not

my fault. it is the trump administration's fault. he is playing a blame game here. your reaction to that? >> he was blaming the trump administration but it was his own decision that resulted in the deaths of these senior citizens. meanwhile the trump administration and red state governors were doing the right thing, requesting a targeted response and the right common sense response. ppe, looking for more personal protective equipment in the nursing homes, more testing equipment in nursing homes but not sending back infected patients into nursing homes. the trump administration in my home district helped us get personal protective equipment and testing equipment for our nursing homes. in florida republican governor ron desantis was requesting personal protect sieve equipment. he was not putting infected seniors back into the nursing homes. we knew because of the outbreak in the washington state early in the pandemic that was very

platform. even bernie sanders and angela merkel agree he should be reinstated but whether he is reinstated or not, liz, i question big tech, particularly facebook's commitment to free speech and the first amendment. frankly whatever they do, i still think they need to be regulated much like senator hagerty of tennessee suggests. elizabeth: yeah. basically facebook kicked off donald trump, off of facebook and also instagram. twitter did the same after the capitol riots. but you're saying the time to bring him back on. that will be a hot debate whether that happens. for the other thing coming up too is, the word is out that the biden administration would enlist private cybersecurity firms to track people on their social media accounts. you know what? ford, let's have you take a listen to senator josh hawley on this. hear what he has to say. watch this. >> this is a great example how the government, big government, return by the left is partnering up with big tech to try to trample on the first amendment that is the whole point here.

of course the left can't use government directly to spy on americans without a warrant. i will point out they did lie repeatedly to the fisa court during the donald trump administration to get warrants to wiretap trump and others, at least on trump associates. told all kinds of lies the fbi did. now they're going beyond that. why bother with the fisa court when you can get big tech to do the spying for you to report back to the government? elizabeth: so they are spying on americans. who are they spying on and why? that is the allegation? >> what senator hawley is talking about is exactly right because basically big tech can go around your civil rights. they don't have to respond. they can do things to american citizens that the government can't. they can turn around and report to the government. look, for years on this network i've been saying that big tech is a bigger threat to america and her values and her people than china and emac, you would be hard-pressed to find a bigger hawk on china than me.

♪ elizabeth: back with us now is former acting ice director ron vitiello. okay, ron, help us out here because we've got pew research and also harvard harris doing two separate new polls saying majority of americans say, yeah, about 7 out of 10 say the biden administration is botching and mishandling the border crisis, but the white house press secretary jen psaki today says it is turned control, but then she blames donald trump. so what's going on here? >> i'm not surprised. you know, the american people for quite some time have asked their government to give them a secure border. i started in the border patrol in 1985, and for a lot of my clear, no one really cared what we were doing on the border. we did. we took pride in the work that we did, and we knew that border communities appreciated our presence, but the larger public it was unknown to them until 9/11. the situation that's happening on the border now is totally out of control. we've seen these images since

january of the overcrowded facilities and these large numbers of people just walking across the border. so it's far from in control. and i just, i feel bad for the work force, you know, they've a had to sort through this several times in the last couple of decades. and here we are again, a completely preventable crisis that could have been prepared for better x. to say that it is under control is not believable. elizabeth: yeah, how is it under control if the number of border crossers this year is expected to be the size of dallas, texas? even the hawaii democrat senator mazie hirono says it's a crisis, and the vice president needs to go there. last decade or a couple decades ago obama, biden, hillary clinton, chuck schumer, dianne feinstein said, yeah, it's a crisis. and it's still a crisis. and now we've got, you know, the border towns, they're having to protect themselves, sir. you already know this. the police department is using

drones to go over neighborhoods to catch potential criminal illegal aliens. many people are using the amazon ring service on their doorbells that connects to police departments. they're doing things like high-tech using long distance license plate readers and more. so the border towns are having to step up to protect themselves. also facial recognition technology. what do you think of this development? >> yeah, good for them. that's the first department, i think, to be authorized to use drones for preresponse to police calls. they're protecting their citizens because they live on the border. they know how important it is to patrol the streets and keep the community safe, but they're right next to the border so there's added risk. and now with the situation that cbp and the border patrol is in, they're distracted from being able to be on the line because they're doing so much time for care and comfort of these migrants. i applaud these departments and these cities and municipalities that are on the borderrings because the more that they do, that kind of fills in the gap

where border patrol needs to be. and, obviously, for being in the border patrol for such a long time, we always appreciate help from state and locals, no matter the jurisdiction. elizabeth: so it's up clear about why the white house press secretary is saying it's under control when we have a massive smuggling industry right across the border driving record numbers to the u.s. border. drug cartels at the border, right across the border from u.s. towns and cities. are we going to see more boats capsizing like the one off the coast of san diego, increasingly more dangerous crossings here? >> yeah, it's very unfortunate what happened there. the smugglers will stop at nothing to make a profit. so the real upside here is if you're a criminal smuggling operation. if you're a cartel. because the cartels control the pipeline. they control everybody that moves through the border and up to the border. so they're the ones that are profiting from these smuggling schemes. and the individual smugglers themselves, they take no care in protecting people. they treat these people like

their a commodity -- they're a commodity. capsized boats, leaving people in the desert, leaving sick people behind, that's what smugglers do. large stash houses with overcrowded positions -- elizabeth: yeah. hundreds of stash houses. hundreds of stash houses from texas to california. we hear you. i need to ask you this quick one. two dozen house democrats want to defund an i.c.e. program that catches criminal illegal aliens. they want to stop i.c.e. from working with local law enforcement to catch criminal illegals. do the cartels see democrats and other -- and activity like this in d.c., are they tracking it? >> well, see what happens when state and locals are prohinted from participating with sies -- prohibited? the community that's involved is always less safe. cartels know where to go to be -- to not have immigration enforcement a threat to their activity. elizabeth: all right. ron vitiello, thank you so much
