"the evening edit" starts right now ♪. elizabeth: welcome to the show. you're watching the fox business network. we start with the irs and treasury inspector general now investigating a major privacy leak, a suspicious leak to "propublica." 15 years of tax returns each for jeff bezos, warren buffett, and other top bracket americans right when president biden and democrats are demanding higher taxes saying people ought to pay their fair share. look who is back with us, heritage foundation legal fellow hans von spakovsky. talk about the timing of this. we're not sure who leaked it. this is serious stuff. leaking of confidential tax documents, it's a crime. americans are feeling vulnerable about this. what do you say? >> they should.

it's a felony under federal law for an employee of the irs to leak it, punishable up to five years in jail, a quarter of a million dollars in fines it is not just they released information on one particular individual but "propublica" says it has a vast cache of information. that is something that should be easily found out by inspectors and fbi agents. so the real question here is, will the fbi launch an active real investigation to find out who did it? that is a test of the biden administration, whether this was intentional or whether it was done by some employee without permission. elizabeth: yeah. this is a heck of a felony is what you're saying. >> it is. elizabeth: the tax system has been built for decades on a promise returns will be confidential. that has been undercut and rocked again. this is the same irs that pursued a vendetta against

non-profit conservative groups during the obama administration, lois lerner. dating back through fdr, kennedy, clinton and obama. >> no, that's right. don't forein 2014, not that long ago the irs paid a settlement of $50,000 to the national organization of marriage after an irs employee disclosed their tax information which ended up being publicized by the "huffington post," it went to the human rights campaign which at the time was going after the national organization for marriage. urn fortunately the employee they discovered through it was, was not prosecuted for releasing that information. elizabeth: so, here's what the question is though. so the biden administration, they want to give tens of billions of dollars more to the irs to go after uncollected

taxes. they want irs to get everybody's bank account information on gross inflows and outflows. >> right. elizabeth: elizabeth warren wants a wealth tax. they want higher capital-gains taxes. "propublica" got it from anonymous source. they say they don't know who provided them. why now is this happening now? >> well, it is awfully suspicious given the push by the biden administration and democrats in the congress to increase taxes but, again, the irs should have an easy ability to find out who did this. they have a very elaborate internal security system to trace who accesses files through their computer system. so they should be able to find out who did it. that is why conducting a serious investigation is very important and if they don't do it, that itself will lend support to the suspicions that this might have

been intentional. elizabeth: hans von spakovsky, thanks for joining us. let's bring congressman jody hice for his reaction on this. what was your reaction when you heard this story? >> here we go again. one of the reasons i'm in congress is because as a pastor i was harassed by the irs for years over the johnson amendment, speaking certain so-called political issues from the pulpit, being threatened for potentially losing tax-exempt status and so forth. we've seen the irs target conservative groups and here we go again where the irs appears to be weaponized yet again on behalf of an administration to get what they want to. the question here, without any doubt this is an attempt to try to influence the debate in congress as it relates to the biden administration trying to raise taxes and the whole mantra that the rich don't pay enough an here we go. they're using the irs as a

weapon. elizabeth: the pro-h "propublica" reporting they paid little or no taxes critics felt it was tenditious based on percentage of wealth they, showing the rate was lower when wealth is tied up in unrealized capital gains in the stock of companies that they, these individuals built and made successful. so the irony is congress wrote the law lowering capital gains taxes, right? clinton lowered them. that set off the dot-com and tech boom. that is how these guys got their wealth. this feels really like an an unconstitutional illegal move because elizabeth warren wants a wealth tax. that is unconstitutional. the constitution only allows for income tax. it smells really suspicious all around. what do you say? >> i couldn't agree anymore. look at timing of this. this is right on the heels of the biden administration trying to raise taxes, in fact he ran a

largely on this what you're talking about, trying to raise taxes on wealthy, on high income earning individuals. isn't it interesting right on the heels of that push that we have this anonymous leak coming from the irs, showing that that some of these wealthy people paid little to know taxes over last couple years for different individuals. this is going to add fuel to the fire of the biden administration to call for higher taxes and go after them. so as far as i know, i'm not seeing anything that is illegal about what these individuals have done. yes they're able to hire a lot of attorneys to protect themselves from paying taxes but, yes, these are tax laws that congress passed and to my knowledge, there is nothing been found that is illegal bp this. it is all weaponizing the irs to advance a political agenda, the

biden administration. for that reason we need an investigation into this. elizabeth: critics are saying this is really scary stuff. michael bloomberg had his tax returns revealed, he is saying doesn't matter if you're a republican or democrat, whatever your political party is, you should be really worried that this happened. confidential tax information was released. the irs is supposed to be the fort knox of everybody's tax information. the confidence, that is how the tax system is built on confidence. that is shattered once again. we talked to the rank-and-file of irs. the workers don't like to be involved in politics. they don't like it at all. they want to be seen as a straight tax collector. when you see the dog whistles coming out of different administrations, the irs budget, their paycheck comes from you know, approved by senate finance or house ways and means, you got to believe, yeah these irs workers are going to say yeah, we're listening to what those in power say, what they want, even

if it is not explicitly emailed or sit down in a memo. they hear it, they know what is going on in d.c. what do you say? >> this is exactly right. look, we all know that it is criminal to release tax information of private citizens in the united states. that is information that is private, that is supposed to be confidential. we need to know number one, who leaked this. we need to know number two, why. we need to know was the the bidn administration involved in this? are they using the irs to target certain individuals for the purpose of advancing their own political agenda? yes. everyone should be shocked by this. it doesn't matter which party they fall on. this is an issue of a, a major agency being used to go after american citizens that cannot be tolerated. we need an investigation to get to the bottom of this and wherever that investigation leads us, even if it goes to top

elizabeth: joining us now texas congressman pat fallon from armed services. congressman we're happy to have you on. vice president kamala harris, now she says she will go to the border but she is not saying when she is going to go, right? she laughed this off multiple times saying not getting involved in quote, grand gestures. this is unnecessary political theater. do you think she is going to go? >> i don't know but definitely necessary to go. she was anointed, appointed the border czar 77 days ago. the very first thing you should do is go to the border. hive been there several times. you have to ask the people on the ground what's happening. she has, she is blaming this, not on biden's insistence on canceling policies that worked under president trump, like the wait in mexico policy, increased

people from mexico to central america. they're working for cartels when they get here. this is human smuggling, sexual trafficking operation unlike seen by humanity before. for her to laugh off, folks get here, say come on over, they take care of you, they don't send us back. that is what is happening here. elizabeth: the fbi says effectively this is a crime zone what is happening at the border. put out a statement that the border is multibillion-dollar industry of crime. drug smuggling, human trafficking even murder and extortion, drugs are pouring in, fentanyl, overdose deaths are up 25% in new mexico. the southwest and west coast is getting hit hard with drug overdoses and opioid and fentanyl trafficking. when you listen to what the vice president is saying she is talking about vague deals with mexico, she is admitting talking about mexico taking back illegal

immigrants. mexico, guatemala, el salvador, saying yeah the biden administration policies created the border crisis. what is the result of this trip. >> the guatemalan president blamed the border crisis on biden. the president of mexico, obrador blamed the border crisis on biden. the numbers don't lie. under president bush, i'm sorry under president trump in 2020 there were 46,000 border crossings. there have been already 171,000 illegal border crossings in the first four months. we're on track for 2.6 million this year. it is unsustainable. we have, the real reason she doesn't want to come to the border is because just like senator cruz said, the press will follow them. they will have to address the crisis. the mainstream media is ignoring it and so is the white house. elizabeth: you know, is this just about optics? they could have picked up the phone, said, central america be keep the strong border policies

hacked materials and maybe they aren't real. maybe this is russian propaganda. all of that, these are lies. it is all real. it definitely was real. forensics have been done on the laptop. emails are real. this is hunter biden's laptop. the material is authentic. entirely partisan politics this story is being ignored. i think it is one of those textbook cases of hypocrisy. you and i both know if done j had a laptop that contained this many racial slurs somebody would figure out a way to imprison him already. that is not the case with hunter biden. elizabeth: hollywood is silent on this too. the media is pretty silent on this. the text messages are surfacing days after president biden, made statements about the u.s. being systematically racist. you know, critics are pushing back on that speech saying you can't legislate or litigate out of existence stupids like racism, but we have the best

strategies to sell access inside of the u.s. government to get bribery charges dropped against the founder of burisma. it goes on and on. the question how come he is not yet hit with foreign lobbying law violations? >> that is a great question. this comes right down to whether or not the justice department is ever going to be able to restore faith in itself as an institution. think about this. the obama-biden administration had a justice department that launched an out of control investigation, a partisan witch-hunt against the last president of the united states, dogged that guy with russian collusion nonsense that was completely invented by democratic political party operatives. a lot of people lost confidence in the justice department. now is the perfect opportunity for the justice department to prove it will respond without fear or favor. that it will actually enforce the law as written. so we'll see what happens. if this gets buried which it may

♪. elizabeth: let's welcome to the show johns hopkins infectious disease expert dr. amesh adalja is with us. so really great to have you on. dr. marty makary wrote an op-ed. he had good news. he is pushing back on the con sin sus about shutdowns. he is saying herd immunity is here. citing studies from washington university, university of pennsylvania, mount sinai university school of medicine. what do you say? >> i think we're getting closer and closer to herd immunity in

some geographic areas. people vaccinated with those with prior infection you're right around that number. many cdc models did not predict the precipitous drop in cases. their underestimating the natural immunity in the population and it is real and something we can count on in certain circumstances. elizabeth: it is really interesting. he said in february, nearly half of los angeles cases had natural immunity. even a year of a people are infected they still have antibodies. this is strong stuff. why are the fights in blue states about shutdowns like in washington and oregon. >> they're trying to be cautious and don't want to make an error, they want to error on the other side, looking at vision numbers without counting immunity from

prior infection. why states like florida and texas they were doing a lot better than people thought. they didn't get hard because they had so many natural infections among young people. that is one hypothesis. when we look at the whole picture we have to account for natural immunity because it is clearly playing a role in declining cases we're seeing. we want vaccines as high as possible. the many people vaccinated is better it is and vacs sign immunity is better than when it comes to saints like the b-151 variant discovered in south africa. natural immunity is not nothing. it is really significant in certain circumstances. >> that is an important point you're making, right? the human body fighting and working against it. dr. fauci said in august of last year, when you have fewer than 10 cases per 1000 you should be able to open up safely and open up. dr. makary said the u.s. hit that point in mid-may. should we stop the fear-mongering and level with

the american people? >> i think we're in a totally different phase of this pandemic. we basically tamed the virus in terms of removing its ability to put hospitals into crisis because the vaccine as well as natural immunity has an impact on preventing serious disease hospitalization and death. we basically decoupled cases from hospitalization and deaths. that is what we're going to do. we're not getting to covid zero. our goal is to make this much more manageable respiratory virus to manage hospital capacity. i think we're there now. i think we need to move into the new phase of the pandemic where the public health emergency largely passed. elizabeth: we'll have to live with it largely like aids and hiv, right? last word. >> more like influenza. we'll have baseline level of cases and hospitalizations but it will never be a crisis because we've done so well vaccinating high-risk people. elizabeth: thanks so much. dr. amesh adalja good to have

supremacy clause of the constitution says the federal government has the power and the authority over immigration law, the state or senior inflicting damage to our communities and towns and under the constitution we have a right to protect ourselves, what is your take on the constitutional fight. >> the states have a case to be made here it's absolutely correct the federal government should enforce immigration laws, they're not enforcing it, there choosing to look the other way there choosing only to enforce certain laws, that is in the interior in cities across this country and dangerous individuals, states have a case to say the federal government is not fulfilling its mission in his job to enforce border security and immigration law without prejudice in states like texas, arizona and others are challenging that they had limited success in the early days of the administration but
