"the evening edit" starts right now. ♪. elizabeth: welcome to the show. you're watching the fox business network. let's get right at it with texas congressman michael burgess. your reaction to the president saying that the border is sick, it is dangerous but now we got texas democrats gonzalez saying the border is not in chaos. that the geoff should focus on the texas power grid instead. what do you say about that? >> the photos that you have been showing, the b-roll you've been showing clearly the border is not secure. people are passing across the border with virtually no one interfearing with their passage. it is good that the former president is down on the border.

wall, make its own arrests, guard its own border. you have at least five states including south, dak, florida, nebraska having to send law enforcement to help out. what do you say? >> it should not be texas' responsibility to provide the defense for the remainder of the nation. again governor abbott is stepping up to do what is required of him to do. requiring finishing wall or building the wall, i flew over vast portions of that just a few weeks ago after the biden administration withdrew all the activity with building the wall. literally walked off the job. contractors walked off the job leaving equipment and tools on the ground. now texas is going to take the responsibility for securing those portions that had been almost finished but not quite. look the border wall is, it does work in the areas where it is continuous. the president, the last president, president trump was correct in identifying it as a national security crisis,

securing funding for it. the current administration is wrong to arbitrarily abdicate that. the consequences. here is the problem. every time the decision like that is made in washington, d.c., the cartels, the child traffickers down in central america they monetize that. they use that to induce and encourage people to make that dangerous journey to the southern border saying we'll get you across to the land of plenty where then they will take care of you. but the poor people who have pictures of people left stranded on the side of the road, that is just wrong. elizabeth: we hear you. you know the house democrats are moving to defund $2 billion away from the border wall that was already appropriated by congress. they're moving to take about $930 million away from the border patrol, also about 1 1/2 million away from i.c.e. so you know, this is at a time

from prison after his sexual assault conviction was overturned by pennsylvania's highest court. jackie deangelis has been following the story all day and joins us now. jackie. reporter: good evening to you, liz. bill cosby is free indeed released from prison. cosby was silent at a press conference but his representatives spoke on his behalf. >> this is justice to come to say we'll vacate his entire conviction. not another trial. they said he had immunity. this is a guy who settled out of court for $3.8 million. waived the fifth amendment rights. no warrants filed for his arrest. he freely came in spoke openly to his detriment. he was being honest. andrea constant lied. reporter: pennsylvania supreme court overturned his conviction. that they basically did not give

him due process, essentially it was not fair. at the retrial five additional accusers were allowed to testify, that didn't testify at the first trial. evidence was used at the civil case. the court said the evidence violated cosby's fifth amendment right to self-incrimination. theres were reactions on both sides of the fence. montgomery county district attorney said he was quote, found guilty by a jury and goes free on a procedural issue irrelevant to the facts of the crime. felicia rashad, known as claire huxtable, is miscarriage of justice has been corrected. liz, three judges joined the decision. one was in the middle filing a concurring and dissenting opinion. one filed an out right descent. think about the precedent this sets. cosby was one of the first big cases of "me too" movement. it leaves doubt whether

shut them down and that's crazy. that is unacceptable. that is quite scary. because that is a taking of people's property, that was not needed. science shows lockdowns did not work. in the states with the most stringent lockdowns, the death rates for covid were the highest that should be enough in itself showing that, that shuttering doors, locking down people, it is clearly not the answer. elizabeth: we hear you. let's listen to dr. marty makary talk about this delta variant. he thinks there is fear-monger about it. watch this. >> you're going to hear a lot of fear mongering about the delta variant so let me break it down. it is about 40 to 60% more transmissible but no evidence it is more deadly. we were told the b-117 mutation was more deadly. research came in showing it is not. we're testing too many people

to look into the covid outbreak? let's welcome back to the show dr. bret giroir and iowa's representative mariannette miller-meeks. both of you were at the gop house panel yesterday. thanks for joining us. dr. giroir, first to you, reports coming in from nbc and other networks yes, the chinese military for years has been working on secret coronavirus research at the wuhan lab. that the wuhan lab has top connections with chinese military officials. what do you say to this report? >> i would say you just about said it all. we heard yesterday from dr. asher who is in the state department and had significant intelligence agency ties, the wuhan lab, as many labs in china are intricately intertwined with the chinese military and yes, the chinese have offensive biological weapons program and it seems very clear that they were using coronavirus as part of that program.

elizabeth: well this is terrifying. congresswoman, you and i were talking about this yesterday. representative michael mccaul says there is evidence the chinese military took over, seized control of the wuhan lab earlier than thought in 2019. why were they doing that? >> i think it is because there is a lack of transparency and the chinese communist party was trying to cover up the fact that a virus that was in the laboratory that they had amplified and modified, was let loose and that people were getting sick and they wanted to cover that up. as we know they pressured the w.h.o. to deny there was human-to-human transmission early on. then they also you know, pressured the w.h.o. to not make it known publicly this was a pandemic and it was a serious public health emergency. elizabeth: you know, dr. giroir, what was china's military doing with this coronavirus? what are you hearing?

>> well, we really don't know but the, the extent of the chinese offensive biological weapons program really cannot be underestimated. you can even look in their public doctrine, even in some of their documents about the biological weapons convention back in 2011 where they talk about synthetic biology and its ability to create weapons and even to create ethnic weapons. what i mean by that is actually being able to target a biological weapon against certain ethnic groups. so we should not underestimate the extent of their biological program. i'm sure they were using coronavirus and any other virus they can get their hands on. not that this was yet weaponized but it is likely part of the program. elizabeth: interesting what the doctor just said, congresswoman, because scientists including scientists who wrote an op-ed in "the wall street journal" have repeatedly said they cannot find the genomic sequence, the dna inside of the sars-cov-2 virus.

that genomic sequence has not been found in nature. they tested 80,000 samples from more than 200 species. it is not found in nature. what are your thoughts about that? >> that underscores we needed to have the hearing yesterday and why it is really disappointing that our democrat colleagues are not at the hearing with us and are not pushing for an investigation into this. there are very valid reasons, one as dr. giroir stated that the chinese communist party has a, you know, bio weapon and they're working on that with the chinese military. that is one reason to investigate this. but there is other reasons to investigate this as well. we do think it eminated from the lab. whether it was a virus that was found in nature and then amplified and modified through gain of function research or whether it was a man-made virus we don't know the answer to that but we do know it came from the laboratory and not found in nature. as you indicated over 80,000

♪. elizabeth: joining me "the federalist" senior editor chris bedford. chris, it is great to have you back on. experts at the gop house hearing on the outbreak yesterday were really slamming facebook and google as being gatekeepers an censoring information about the pandemic. how bad did this get? >> it was incredible. it didn't just impact regular people who were trying to share their stories about the pandemics. it even censored doctors. it censored nurses. it censored media outlets like the federal it. it also censored some of the congressman and some of our senators. it ended culminating censoring the president of the united states. they're deciding what is allowed to be said in the public space. now over and over again, whether tom cotton saying this could have been a weapon or could have come with a lab which turned out to be very likely view or whether vaccine stories about possibly extreme adverse side effects shared by senator ron

johnson this week, google and twitter censored them, saying scientists claimed they are false. you can find a different scientific opinion on anything. that is really what science is. completely expected my field of journalism are so stupid not to understand that, people on twitter or google should science comes from questioning and experimenting. they're trying to decide what the truth is for all of us to see. elizabeth: you know google is probably the most powerful search engine in the world. now there is talk of what it is doing with its algorithm, google is saying putting up warning, search on breaking news, may not be reliable because information is rapidly changing on subject. it is throttling down on search results of wuhan lab leak. i'm not sure people really realize what happens at google or facebook and how they

basically raise up in their search results certain topics and bury throttle down, other topics. go ahead. >> google is not just a very power if you recall search engine. companies like the easteast india companies that had bigger arms than england, one of most powerful men in the world donald trump. this is extremely dangerous. who are making these decisions? a lot of times they rely on outside fact-checkers. i look at some of the fact checks come at "the federalist" called us false or misleading, they are written by literal interns at "usa today." those people are allowed to be arbiters of truth? that is not how a democracy can function and be successful. elizabeth: chris bedford.

talking about big tech or whose building some of the power systems like solar panels and you say they have huge influence in huge investment in countries like china, they don't want to see any talking bad about china, the origins of covid for stealing intellectual property for f35 or anything else, they don't want to talk about those things and they want to get members of congress to not talk about those things, why they might hurt their investment in the huge market of china that's why i look at this as emerging into the we see them pander to big tech and is not surprising there pandering to big climate in the same way. elizabeth: we hear you, why china why would china benefit, there is already green climate fund and i think congressman meeks is talking about 4 billion in 202,022 and 2023 another 4 billion china has already

pulled out 100 million bucks from that fund, they were thought to be using it to cut greenhouse gas emission, nobody has evidence of that, again and again, it seems like democrats are rolling over about china. >> that are rolling over but you're seeing this as they've got so much already why would they try to get more, the answer is always more the answer is global domination it's like the game of risk in their plane that very, very well whether it's getting the dollars out of the un or taking from ports around the world or expanding their blue water navy they are playing the serious game of risk and their taking any asset that they can get their hands on there is not an answer that there's never enough, if they can get $10 billion more out of the un/fun then they're happy to take it it strengthens china and weakens united states of america the 3,030,000,000,000,000 in debt.

elizabeth: there needs to be enforcement action taken against $260 billion in waste that is gone out of the sba and the ppp loan for the pandemic and the $30 billion in jobless benefit fraud coming out of california. there needs to be criminal action taken in those instances of fraud and waste, something needs to be done because the american people have had it there sick and tired of what's going on now you have nancy pelosi focusing on the capital rights committee but not relaunching her own committee that she did last year to look into the origins of the pandemic, it feels like hypocrisy all over the place and they're talking again and again, about defunding cops, the american people are over it. >> let me's. any anticipation of a will change in direction and go 180 degrees the other way, they're not going to do that they're gonna double and triple down on these policies and defended the police and supporting china because follow the dollars, when you talk about
