violate one of president biden's biggest red lines, don't tax the middle class. i'm liz beth mcdonald. the"the evening edit" starts rit now. ♪. elizabeth: welcome to the show. you're watching the fox business network. we begin with the horrific crash at at border in texas. at least 10 dead and overloaded human smuggling van, it was packed with 29 illegal immigrants. it crashed. 20 others injured. now we had 30 illegals killed in two separate human smuggling crashes back in march. that happened in california and texas. back with us now, texas attorney general ken paxton. great to have you back on, sir. can you explain what is going on here? human smugglers recruiting young illegals to drive the smuggling vehicles? what's happening? >> so that is what is happening and it is pretty sad that people are having to die in these car

crashes. it is not necessary that this happened. the president of the united states invited this. he is largely responsible for the fact this is happening. we'll see more of this. as time goes on you will see more crashes. these cartels do not care about the safety of these people. they will do what it takes to make as much money and these people are expendable and the te biden administration knows it will happen and more of it will happen and they're responsibility for it. elizabeth: sir, the smugglers are saying to the young illegals we'll cut your fee we will charge you to come in to cross the border as long as you drive these vans and cars. but if you're caught you're going to get in trouble with us. why they're turning texas and border states, neighborhoods and communities into car chases, right? is that is what is happening? >> absolutely. we're becoming a cartel states. any of the border states are being pretty much invaded by cartel people, whether people they have hired or the cartels

themselves and that's, that is how it is when the border is open. they're making so much money doing this, billions of dollars. and that, the fact that texas is experiencing this is not the end for the country. we're going to see more of this in other states just as ron desantis said in florida. it is coming to the rest of the country. elizabeth: all right the border is a disaster area. it is a war zone too, florida, texas, your governor, they have had it with the white house. there is a big legal fight with the white house with your state and also with florida. human smugglers, homeland security official john condon testified up to 6 billion-dollar human smuggling business for the cartels. that is higher than expected. that is why you're seeing increase in human smuggling crashes. sir, how does this square with the governor of texas' executive order that the biden administration is suing to stop? the governor is saying we want the police to stop these vehicles crossing with migrants from over the border.

how does this fit into this story? >> you know the governor of texas, governor abbott is merely trying to protect the citizens of the state of texas from what president biden is allowing which is a lot of crime, and the spread of covid and so he has authorized our local law enforcement and our state police to stop these people from coming into our state and too take them back if they're not with other law enforcement. it is merely designed to protect our citizens from the spread of covid which is actually happening at a high rate now. elizabeth: the white house is saying this violate the constitutional supremacy clause for the federal government to decide what happens with the border but this fight could end up in the supreme court. you know, sir, i would like your reaction to florida governor ron desantis, he is going after the white house. the biden said governor desantis if you're not helping get out of

the way. desantis said the president is facilitating the pandemic. >> this guy who ran for president would shut down the virus. he would not shut down the economy or america but shut down the virus. what is he doing? he is bringing people from over 100 different countries across the border. every variant on the planet, some we don't even know about, they are absolutely coming into here. they are farming them out all over the united states and putting them on buses and planes. when he is lecturing people on covid restrictions and lockdown policies on the one hand, not only doing nothing to stop the border surge, but actually facilitating it on the other hand he loses all credibility when it comes to covid. elizabeth: what is the white house telling texas about that, about what the governor of florida is now saying? because the homeland security secretary alejandro mayorkas testified to congress the

administration is not testing or tracking migrants crossing the border for covid? >> well the governor of florida, ron desantis is actually right. he actually has been on our state. he has been on the border more than the president of the united states. would you think the florida governor would be here less. reality he has been here, seen what is going on. he is absolutely right. the president i think is a superspreader of covid. there is no bigger spreader than the president. when you create open border, health risk and covid variants and allow people to cross over, if you're an american citizen you can't cross the border with covid. you are tested. if you have covid you can't come into your own country yet the president, our superspreader president is letting these people in and then once they're in, spreading covid all around the country. elizabeth: got it. thank you attorney general ken paxton. it is good to see you. bring in national border patrol council vice president art del

cueto. let's stay on this story. where it president and where is dr. fauci. they're saying we're at war with this virus. dr. fauci says variants are coming into the country but where are they on the border? >> they're pretty much on open borders. they're allowing individuals into the united states untested. i tell you how it works when individuals cross into the united states illegally, they get looked at, checked right away to see if they have any symptoms. if they don't have toms they go through the process, go through i.c.e. and in essence released into the united states. there have been cases where days after these individuals have been in the detention facilities of border patrol, agents are getting notice, hey however you arrested three or four-days ago, guess what? he was covid positive. they were still released into the united states. however going back into the economy and everything else getting destroyed, people that are going to cross legally through our ports of entries and

they have the legal documents to do so are not allowed to cross into the u.s., they're not allowed to help the economy. those individual come for a couple hours or a couple days and they go back. they're not allowed to cross. however if you are illegal and you are doing criminal acts you're allowed to come in and stay here regardless of covid. elizabeth: okay. in south america peru is calling lambda variant the alpha dog of covid. you know what is striking? a former homeland security secretary is saying under obama saying the unvaccinated should be on a no-fly list like terrorists then we see what is happening at the border. it is striking. now the biden administration is talking about demanding vaccine passports for foreign travelers but this is happening. move on to this. we were showing a full screen before u.s. court sentence ad chinese national for 7 years in prison for his role in a international drug trafficking

scheme. that exploded at border. a massive illicit drug and financial network spans the world and operating at the border with china doing the money laundering. >> it is a complete domino effect. when you send the message that lawlessness is okay, and all the undocumented individuals are entering the country and releasing them. the drug cartels are very much aware agents are moved from areas where they patrol the line in both the southern and northern borders so they can process individuals, take care of unaccompanied juveniles. they're taking advantage of this to bring drugs into the united states and make tons and tons of dollars off of it. elizabeth: yeah. they're working working with the powerful sinaloa cartel in mexico. they're doing things like trying to bribe dea agents to get fake passports. they're doing things like dropping babies over border walls or abandoning them in

deserts or in highways in order to distract the border patrol away from parts of the border to move massive amounts of fentanyl in, 2400 pounds seized since the beginning of the year. two milligrams can kill you. china is in on this, is that true? they're using casinos and front companies to launder the profits for these drug cartels. that is what chinese nationals are doing. >> there is different countries throughout the entire world they're involved in. i will tell you this the amount of drugs entering the united states right now, the sex trafficking that is going on, the unaccompanied juveniles, everything that is happening right now, down to the covid and agents died of covid, it all falls on the hands of this administration and their lack of enforcement. instead rewarding criminals for coming into the united states. that is what is happening. they're rewarding the criminals. elizabeth: you just gave news there, border patrol agents dying of covid while working at

♪. elizabeth: check out this airplane flying a banner calling for governor cuomo's resignation. it has been flying over the new york state capital of albany. andrew cuomo remains holed up in the governor's mansion trying to figure out how to stop an impeachment probe bearing down and impeachment is possibly coming within weeks. also four separate criminal probes into sexual harassment charges and allegations brought

by the new york state ag. polls show the majority of new yorkers including democrats say he should leave. joining us congresswoman claudia tenney, and a member of the new york state assembly, jared gandolfo. thanks for joining us. what is the update on the news that we broke last night that the legislature will impeach cuomo? there is a deadline he has to respond by august 13th. what is the update now? >> so that was reported today that the assembly judiciary impeachment committee did set a hard deadline for the governor and his team to provide documents to their defense. which is a little frustrating because a lot of us felt like this impeachment committee was a way to buy the governor more time. they said it would take longer and longer. now suddenly that the attorney general's report they're able to kind of wrap this up. and the governor's spokesperson put out a statement saying they will cooperate with it. i don't think they really have a choice at this point.

elizabeth: yeah, we hear you. congresswoman, the new york attorney general found that cuomo sexually harassed 11 women, nine of them current or former state workers but you know andrew cuomo appears to be trying to stop any charges brought against him by trying to ramp up reasonable doubt by gaslighting and attacking his accusers and investigators too. what is your take on that story? >> what he is doing may be criminal. similar to covering up the nursing home scandal. he is retaliating against state employees, potentially civil liability you're talking about a hostile work environment that was described which is one of the key factors in sexual harassment but at this point this is cuomo does. he is a bully. he has been bullying members of the assembly and senate for year. when i served in the state assembly he bullied everyone in the moreland commission that he

created. when it came too close and he shut it down. he terrorized the commission which is unconstitutional in my opinion. he will double down. he is holed up in the governor's mansion, paid for by the taxpayers with his staff trying to come out with some kind of a strategy. unfortunately the people got him into the mess are people helping him to stratguys. elizabeth: we hear it democrat legislature handling impeachment. she recruit ad straight top trooper to join his security team. she was in her 20s. and then he groped her. the congresswoman brought up about retaliation. how this is factoring and driving impeachment. now we see news coming in his accuser lindsey boylan is the first one to step up and say she will sue the governor and his team for retaliating against her for leaking her personnel files

to the media. apparently a facebook officially, danny lieber reportedly was involved in that according to the state attorney general as well. what's your take? >> so that whole situation, it probably is also criminal. what the governor and his team have done is anytime a woman steps forward they have done everything in their power to try to destroy them. he famously leaked personnel files, shopped them around to the press, facebook helped them out with that. not only morally bankrupt but just contributing to such a hostile work environment. you know, one of the reasons why a lot of people are having issues trusting big tech companies, some media companies, when you see they're carrying water for some of their preferred politicians. so i think, i'm happy to see lindsey boylan file that suit. i hope more do. he really needs to be held accountable for his actions. his staff as well. they enabled this and contributed to this.

elizabeth: you know, congresswoman you talked about this too, it seems like it turned toxic pretty quickly according to the state attorney in the cuomo office. in other words this became a matter of a powerful man attacking and personally and verbally abusing, sexually assaulting women and people don't understand how scary it is for women in that environment to be you know, set upon by a serial predator in power. that is what the state ag is saying. what are you saying? >> think about how damning it is for him to be out there talking about this, putting out as a lawyer, i'm just shocked he is out there talking about the fact that well, you know, we don't have a 9:00 to 5:00 office. it is rigorous here. because it is rigorous doesn't mean it has to be a the hostile work environment where people are sexually harassed or even assaulted as some of the claims r he is putting himself out there in almost a state of derangement. i'm really surprised at his

behavior. that he doesn't have a lawyer maybe his brother chris, the cnn commentator, giving him advice. the advice he is getting is bad. i don't know why he is talking. he should be holed up somewhere, probably in his home not at the governor's mansion at the taxpayer expense at this point. elizabeth: we hear you. governor cuomo calling for the resignation of other officials accused of sexual harassment. watch this. >> no one is above the law and the law will be justly and swiftly prosecuted. whether you're the attorney general, whether you're the head of a large corporation, whether you're a media big shot, it does not matter. i think the way they are handling it is disgusting. there is a disrespect for women that this administration chronically exemplifyies. elizabeth: this statement coming at the same time as reportedly

infrastructure package. they don't like it that they're not getting their wish-list. can they do that? can they spoil that win? >> well, we'll see how it unfolds but i'm not very happy with it, either, liz. we had the cbo come out, it will add quarter of a trillion dollars to the deficit. that is what i've been concerned about so long. they tried to put it through so fast. they tried to put it through without any text. and now we got the scoring. washington math can be troubling and perplexing. it is hard to understand but i understand this of the this will be inflationary and add to the debt and deficit our children and grandchildren will continue to bear. elizabeth: senator, how many other senators are joining you saying they don't like the cbo score that it will ad a quarter of a trillion to the debt? how many senators will join you to say no? >> it is hard to say, liz, but

as we're studying it, we got the scoring a few hours ago, more and more of the tier of the senate this isn't as it was billed. we were told all along it would pay for itself. cbo came through with the scoring, not so fast. over a quarter of a trillion short fall. we'll see how this unfolds but certainly not billed as it has been before. certainly none of us want to add to the deficit, the burden on our children, i've been concerned about this, we talked about this before, liz, about the inflationary impact happening now. elizabeth: when trump was president, even though republicans controlled both chambers he could not get through a 1 1/2 trillion dollar infrastructure bill either. the progressives are talking about delaying this for weeks and weeks until they get what they want. now, sir, internal polling, the democrats are looking at it right now that shows they could lose control of the house in next year's midterms. they're down by staggering 6 percentage points versus republicans.

that, saying you're a conspiracy nut if you even ask that question. our own media, our own tech fell into that. many of our political leaders fell into that and they did that because of the influence in china in our public discourse. now look, you don't have to be an intelligence official to look at that seems to me we ought to at least consider the possibility that this virus came from the lab. anyone with any common sense would at least ask that question and yet china was able to pressure organizations like "the new york times" as we know, to not even ask the question, not even allow the other people to ask the question. when marco says they will dominate and influence our own political discussion, there is no question they have already done that, pretty successfully. elizabeth: yeah. they're building ports and they're seizing giant sections of the economies in africa, ports throughout asia, myanmar, pakistan, middle east, they're trying to claim rights to the arctic.

in pretty tough shape at times. we do know what will work because president trump showed us, implementing title 42 restrictions from the cdc that prevent people from coming in, the migrant protection protocols, remain in mexico policy, the trump administration had in place that the biden administration canned immediately when he got into office, and, of course, the other work that trump was doing with the leaders of those countries of origin to try to stem the flow. look, this is not easy, and it has bedeviled several administrations, but why would you go back from procedures that were working and were working well and now create this amount of crisis? as far as the vaccines go, i was the one in 2014 that got the obama administration to consider giving all of the usual childhood vaccines to all of the kids that were in hhs custody, and there were a lot of them back then, if you'll remember.
