be an impediment here. >> no i think you are exactly right. of course it's par for the course. president obama who famously also said he did not have the power to grant asylum to the doctorate recipients, the dreamers. but then famously turned around and granted them amnesty. and so it is a tricky situation. here's the thing, if ron desantis does not have the power to tell communities they cannot force mandates on schoolchildren, then the president of the united states adeptly does not have the power to do it he is talking about doing. as you point out, it's probably wise to keep an eye on this. because of their track record here. >> 's out desantis does have the authority as the governor of the state. we can have a discussion of

it's the right judgment call for him to take. but kevin, with her after doing a floor is interesting. with the policy is there allowing parents to make this call for their own children on masks. but if school districts want to require or encourage mask wearing broadly in their district they are allowed to do that so long as there's an opt out option for parents. what is wrong with that? that sounds pretty sensible to me. >> i'm a small conservative on the someone to empower small communities to decide for themselves with their policies for massing in the classroom. what works in that particular community. coded infection rates in those particular areas. to trust the parents? the parents in conjunction with signs on the ground and determining what is best for the kids. there's a reasonable explanation that science will

pull a role in it. i think at the end of the day everybody wants to protect her kids. we are seeing growing trends of young people admitted to icus for the highest rate was seen thus far in the course of the pandemic because of this. i think it's problematic when we put mandates out across the board. also this mask conversation is we just need everybody to get vaccinated. we saw double the number of doses of the vaccine upfront last month. that is a good positive sign. like to see is more focused on vaccinations than these debates on the mask but. >> am on board the vaccine stuff. with the masks it's important to point out the lack of a government mandate is not a ban. think people get that confused but steven here's the thing. if you want to talk about science find let's talk about it. what is the data? what is the strong evidence that points to little kids wearing masks in school being a successful policy? if you can prove it works well and very much open to it.

yesterday but start here on the masking debate where the data is, reading and studying about it. if you had a governor in the elevator with you for 30 seconds or eight minutes. what would your counsel be to that governor? >> look i would say masks may slightly reduce transmission of the virus. before we say 56 million kids have to do this some kids really struggled with the masks. some kids have community already. many kids that live areas with us very little background and infection. vermont, new hampshire the list goes on and on. so masks really should be reserved for when we think they might provide some benefit. that probably ranks number five in mitigation steps if it

had any benefit in reducing transmission it's never been studied. >> we are now hearing more there's data starting to come out on the efficacy of these vaccines which it may not be quite as strong when it comes to preventing transmissions are still good but maybe not as strong as we had seen against previous variance. some people are freaking out about that. what is the trip understanding and is this an argument potentially for booster shots? especially among elderly or vulnerable populations? >> the fda probably tomorrow or the next day will issue a label or recommendation for those who are immunosuppressant do not have good antibiotics after the second dose to go along to a third dose that's based on research at my institution.

that something he needs a very good criminal defense attorney already on trial. these civil cases can mushroom but we've seen multiple people brought down the "me too" movement. he faces that as well. guy: on the civil side he may be happy he made money in a book till he might need some of that money some these lawsuits proceed on he is on the hook for them. but you mention the nursing home scandal in the criminal side of that. maybe expound on that a little bit further for theirs is peace i mentioned in the open when i was introducing you about allegations in the process of writing the stroke of a book self-congratulatory book the allegations he misused state resources in the process one thing leads to another in this explosion of promise for him. >> that is it ps multiple legal fires to put out. it's not just the civil side.

the biggest apparel he faces is on the criminal side. we know prosecutors like going after politicians and celebrities and people like that because there is a prophylactic impact when you do that. we all want good government. we have a high profile example like this somebody using resources to get paid $5 million to write a book during a pandemic it is a real problem for them. the problem for governor cuomo as he keeps asking for a politician and set up a potential defendant. i think is going have a comeuppance in the very near future. >> do you think briefly that by resigning he takes any of the sting out of this and maybe some of the lawyers back off a little bit? or truly good the worst trouble still be ahead? >> i think the worst trouble is still ahead. i think his resignation will embolden people. and now he does not have his power base. the bully pulpit he no longer has that. he is in grave legal danger
