evening edit" starts right now. ♪ ♪ elizabeth: welcome to the show, you're watching the fox business network. we begin with the breaking news, president biden speaking a short time ago at the white house officially announcing federal workers will have no choice but to be vaccinated or face termination. he's also pushing for vaccine mandates for private sector workers as well. edward lawrence has more in washington. >> reporter: hey, liz. president biden says it's not about freedom or personal choice, it's about protecting those around you and others as well as yourself. the president made these comments as he outlined the six-pronged approach that includes mandates, as you said, federal workers and contractors now have 75 days to get vaccinated, or they could lose their job. the president if also pushing public p venues to follow the se route. listen to this.o >> to those of you running large entertainment venues and sports arenas, concert venues to movie

theaters, pleasele require folks to get vaccinated or show a negative test as a condition of entry. >> reporter: the plan the president laid out continues maskingnd mandates for travel across state lines. it would double the fines for anyone breaking that mandate. the plan directs osha to mandate that any company with 100-plus eeemployees insure vaccinationsr have weekly tests. the cost would be on the company, and it would affect 80 million workers. on schools the plan requires people to be employed in head start and those programs that are government funded to be vaccinated. the president then calls on statements to require schools -- states to require school employees, including teachers, to be vaccinated. school systems should have regular testing for all kids aged kindergarten through 12th grade. >> we know that if schools follow the science and implement the safety measures like testing, masking, adequate ventilation systems which we

provided the money for, social distancing and vaccinations, children can be safe from covid-19 in schools. >> reporter: the osha rule could go in effect in the next couple of weeks, it could be $14,000 in fines per violation if they're found to be breaking it. back to you. elizabeth: let's welcome to the show fox news contributor dr. marty makary, former labor secretary nominee andy puzder. first to you, doctor. this is plainly a supreme court fight. the public health dictates belong to the states according to the supreme court. that's a century-old ruling. do you see this fight forcing osha to get public -- excuse me, private sector workers vaccinated, do you think this is headed to the supreme court? >> well, it does sound like there is some authority with medicareed requiring nursing hos and hospitals as a condition of participation to require vaccinations and maybe with osha. that side of it i'm not as familiar with.

but i can tell you i believe in vaccines, but that speech today framed the issue incorrectly. we don't have a pandemic of the unvaccinated, we have a pandemic of the non-immune. and the way in which natural immunity was never mentioned once despite the fact that maybe a third or half of those unvaccinated, that's something we've got to recognize, and people have a good reason maybe to avoid vaccination especially from my health care workers who were out there getting covid when they were taking care of patients last year. elizabeth: andy, osha does not have the legal authority to require privatere sector workers to get vaccinated. the supreme court has already ruled that. district court rulings show that. this is going to be a major legal fight. how do you see it playing out? >> i think it's another, it's another attempt by the biden administration to try and get something done before the supreme court rules, remember, they did that very recently with their attempts to extend the eviction moratorium. and i think they know that this

isn't constitutional. they know they don't have the authority to do m this. but at least, you know, at least biden's tryingut to look like hs doing something. he was very critical of president trump during the campaign, he said it's been eight months and, you know, what plan do you have? we're still having problems with covid. well, in a couple of weeks it'll htbe eight months that he's been president, and this is the first plan he has come up with that wasn't something president trump didn't i have in the works. i think he's trying to look like he's doing something, but i don't think he looks very good coming out of this. elizabeth: to what andy is saying, doctor, you know, after president biden won the election, and he said this in december 2020, he said, quote: i don't think covid vaccines should be mandatory. the press secretary said, quote: it's not the role of the federal government to mandate vaccinations. now the press secretary is saying, yeah, the labor department does have that power. we hear what you're saying about medicare rules, but the

sweeping, across-the-board forcing private sector companies to do this or be fined, that violates constitutional powers given to the states, doctor. >> everybody thought that a vaccine mandate outside of essentiall workers, say in the hospital, was excessive until dr. zeke emmanuel represented it in a new york times op-ed. that op-ed came out the day that j&j was pulled off the shelf, so it became sort of a low-level conversation, and it resurged now with the delta variant. let's say you put a mandate in place. it's goingante to take at leasta few weeks for people to get it, then itt takes time for the immune system to kick in. delta is projected to peak any day now, it's peaked already in missouri and arkansas, so it may be too little too late. elizabeth: the president's saying, andy, that many are frustrated 80 million are still not vaccinated. we have public health officials like dr. fauci, andy, going on

camera talking about variants but not telling the american people that the u.s. government has only yes netically tested -- genetically tested 1.7% of covid samples for variants. we rank 22nd in the world, behind latvia, slovenia and the democratic republic of congo in testingam for variants. people are concerned about the dangers and the side effects of vaccines. so when he says 80 million are still not vaccinated and many are frustrated, what's your reaction to that, andy? >> well, you know, i agree with dr. makary. i think he's ignoring the fact that a lot of those people in the 80 million probably have natural immunity which is probably better than the advantagehe seen, and the delta variant, the research i've seen, it's not more deadly. given the number of people that have been vaccinated, we've actually got the death rate and hospitalizations downat from whe they were at the peak of the

original covid virus. so, look, this -- a lot of -- this covid thing has been political from the beginning, a lot of this is political, and i'm aur little surprised presidt biden went this far because i think what he's doing is going to have a negative impact on employment which is already a big problem for him. so, look, i think he's trying to do the best he can, but i just don't think he has any idea what todo do, and he's way beyond his powers as president to try and look like he's doing something. we'll see what happens. elizabeth: scientists understand and people say, yes, vaccinations work, there's just at lot of questions out there about that. and, doctor, the question is why now? we have democrat strategists telling politico that president biden was supposed to be, quote, a return to normalcy. polls show voters feel the u.s. is going in the wrong direction. there's a lot of i chaotic decision making going on. let's watch president biden again suggest he's not calling the shots. watch this. >> now, i'm supposed to stop and walk out of the room here.

♪ elizabeth: the taliban letting other foreign nationals leave afghanistan. security experts warning this is a potential hostage crisis in the making. many americans are still stuck there unable to evacuate. trey yingst iss in qatar with more. >> reporter: liz, we have some positive news. 113 foreign citizens landing here in doha today after escaping afghanistan. if onboardni that flight were american, canadian, ukrainian, german and british citizens, the passengers landing in qatar after a treacherous journey to get to the airport, but sources do tell fox news the ca qataris helped to create a safety corridor to get these people out of country.

reports indicate the hamid karzai international airport could be operational for international flights within three days. this comes after tense negotiations behind the scenes between the taliban, qatar and turkey. there are major obstacles to having the taliban in control of entry points and the terminals. according to "the wall street journal," americans who are stuck in the northern city of mazar-e-sharif were told to come to the afghan capital of kabul today. it's unclear though how many people made that journey to this flight that ended up in doha. protests continue in cities across afghanistan. out of kabul yesterday, disturbing images of taliban fighters hitting journalists and womenur who were simply trying o protest. it gives you a sense of what the demonstrators and civilians are now dealing with on the ground with the taliban in control. liz? elizabeth: trey yingst, thank you so much. joining us now, senator marsha a

blackburn, senate armed services. those images are really graphic streaming out on the internet. the president's approval ratings have collapsed to 39%, that's according to an economist/u-gov poll. democrats don't approve of what the president is doing. so we don't know how many americans are still stranded there. what do you m say to all of thi? >> i say it is completely unacceptable that we are this far into this, and they still cannot tell you how many americans are there, how many of our siv holders are there, how many applicants are there, who among our nato allies are there. people just do not know. and thed good work that is being done is now being done by individuals who are veterans who are going in to get americans, to get these siv holders and get them out of the country and away

from the violence and the terror and potential loss of life that isis-k, the taliban, al-qaeda are planning to take out on people that were friendly to the nato countries, that were friendly to the united states, that worked with us and helped in this war on terror. elizabeth: you know, the administration's still unclear on the number of americans trapped. voters out there are saying to each other, you know, according to the polls, why did you leave dand not know how many americas were still behind, and the white housee is still blocking 26 senate republicans including susan collins and tom cotton from finding out how many americans are still trapped rebehind terror lines. we've got the pentagon chief and joint chiefs chair testifying before your senate armed services committee coming up in a couple weeks. what do you want to ask them? >> oh, i'm going to be asking was there a withdrawal plan, did

that plan include leaving americans, our afghan partners and our allies behind enemy lines? did it include turning over bagram airfield and all of the equipment, the billions -- tens of billions of dollars in equipment? did it include giving that to the taliban to arm them up? did they think about the implications of having a war on terror, fighting an ideology and terrorists and now what do you do? you give them a country where they can say now we have a safe haven. we can begin to export terrorism. did you think about china and the ties to china? and china wanting those rare earth minerals that we put time into doing all the mapping on where they're located? did you think about that? did you think about giving china a t direct route into tehran?

did you think about china, russia, iran, north korea being the axis of evil, and who do they support? they support the taliban. elizabeth: yeah, we hear you on that, senator. you know, it's the rhetoric that americans are reacting negatively to in the polls against the white house. watch this. >> with regard to the composition of this government or interim government, i noted the fact that it certainly does not meet the test of inclusivity, and it includes people who have very challenging track records. >> i do think that the historic evacuation of 120,000 people was remarkable, and i commend the administration for that. this is never easy. it's not always complete right rifrom the start, but it was remarkable even though it got off to a hazy start.

♪ elizabeth: joining us now, gop strategist ford o'connell. ford, president biden is facing questions over why now, why is he now firing 11 trump appointees from military advisory boards including generall jack keane, sean spice, kellyanne conway? why now? >> well, look, there's no question about it, this is very petty and vindictive. ande, customarily, appointees to these boards serve three years. when it comes down to it, this just happens to be a raw political power move so the biden administration can steer attention away from afghanistan. elizabeth: youab know, president trump, it's been said is, didn't fire obama appointees, right? i mean, now you've got general jack keane, kellyanne conway saying, no, we're not going to quit, and kellyanne conway is saying you, mr. president, you should be fired. >> well, they should absolutely not quit, and they should fight this. ii believe that there's never been a case of this situation

that's ever been adjudicated, so tip my hat to jack keane and to kellyanne conway. to your point, e. mac, the biden administration says this is not about partyty registration, but it's about qualifications. if that's the case, i think you'd be hard pressed to ever find two more qualified than four-star general jack keane and former national security adviser h.r. master.at i'm willing to bet they are probably the two most qualifieds people to ever serve on these boards. elizabeth: yeah. theye won multiple distinguished awards as well. you know, the fight's going to be whether the president even has the power to do this. he's trying the fire them and kick them off boards like the west point academy -- air force academy, west point. russ vaughn saying you can't do this, and sean spicer is joining reportedly a lawsuit against this. do you think that'lldl work? >> look, i hope it does work. and i think that this is a very underreported story because there's also another narrative going on underneath.

there's a real raging battle in thee military about how the woke agenda harms military readiness, and i think the biden administration wants to chuck theru 11 trump appointees and appoint their own people and, frankly, regardless of your political partisan space, as americans we should be more concerned about a military who's prepared to engage the enemy rather than what politics and pronouns they may use. elizabeth: you know, you make an interesting point. so you're saying that there's a military reason for why the biden white housen is trying to do this purge, because they don't like the positions of those they're trying to get rid of, right? is thatig what you're trying to say? because you see these elbow shots coming out, the white house press secretary, for example, saying people can debate whether or not sean spicer and kellyanne conway, they can decide if those two individuals were qualified to be on these boards. you're saying, you know, set the elbow shots aside, that this is

a deeper story about what the biden administration doesn't like in terms of the positions of these appointees, right? >> that's exactly right. they're holding out sean spicer and kellyanne conway as scapegoats because people know them who are partisans. but -- and the reality is, again, within the military there's raging debate about readiness and whether or not we are capable particularly in the navy of being able to fight the gchinese should it come to that. and the reason why there's some doubt about it is because of the woke, p.c. agenda that you often talk about that's taking place in boardrooms and is taking place in colleges and high schools across this country. it's, unfortunately, seeping into the s military as well. and many of these appointees, particularly jack keane, he's been vocal about the dangers of that in terms of military readiness. elizabeth: all right. ford o'connell, great stuff there. we're going to have you back again soon. up next, congressman tim burchett from foreign affairs,

function research, constructing genetically-engineered viruses in china, and republicans are demanding probes. everybody knows it's happening, why still try to deny this? >> i don't know. it's clear, though, that hillary clinton's not advising this white house, because she would have is already deleted these emails. look, my buddy, rand paul, he ought to get a pulitzer prize, because he really uncovered this weeks ago, and if you remember, they tried to degrade and denounce him just like they have every time somebody's tried to come out with something against this white house or fauci for that matter. the c communist government coved it up, doctors disappeared, researchers disappeared, press people disappeared. fauci said it couldn't break out are from a lab but, of course, it did. i guess you've got to ask yourself why are american taxpayers paying for research on a disease that formerly did not exist and to create one that could leak from animals to humans? and they even have lists in the lab, apparently, of people that

were bitten by the lab bats. so it's totally out of control. elizabeth: yeah. >> and congress needs to investigate, get to the bottom -- if we will, i don't know, because speaker pelosi, of course, she does not want any more bad press -- elizabeth: 650,000 americans are dead. okay, sars and a mers is, they found a natural origin of those viruses. they haven't found the covid-19 virus yet in nature. haven't found it yet. this is ten times the speed of infectiousness than those other viruses. "the washington post," the intercept getting hundreds of pages of government documents showing, i yeah, dr. fauci and e nih did approve millions of dollars in u.s. funding of this dangerous, supervirus research. at minimum, why does it need -- why doin you need to have foia documents and requests? why do you need to pry this information out when it's u.s. taxpayer money, and it's u.s.
