chief of staff is facing criticism, he said the biden plan is to work around to get 80 million vaccinated, jonathan charlie says what does that mean i work around around the constitution, jonathan causes breathtakingly aghast this could be the basis of lawsuits against us. what do you say. >> it is going to be and were already hearing and seeing lawsuits being filed around this. to me let's take a different approach. let's take a positive approach. the threats don't work. if you threaten people to get vaccinated they will not do it. why don't you start with a positive message that seems to work a lot better. the other thing that i would say that the government needs to do the american people have lost trust in the government if we could tell the truth we don't expect people to be perfect but we do expect people to tell the truth, be consistent and

transparent a lot more people would go out and get the vaccine after consulting with her doctor if they had some space in the government. but when we lie to the american people in this administration tries to massage and manipulate and control perception that does not help people go out and get the vaccine it makes them more cautious about getting it because they cannot trust as a administration. elizabeth: this is the president stepping into the private sector and violates numerous constitution not just commerce clause, it's about the powers of the executive branch versus the separation of powers. the president is trying to use osha, emergency standard authority, osha has not used this emergency authority since 1983. courts have knocked us out they knew could not do this trying to use the standard to enact public-health powers.

this is in the lawsuit, we have that it's unfair that he's accused of exempting postal service workers, exempting illegal immigrants in the postal service workers and union allies. i want to move on to this midsize companies, the little guys, they are worried, the pro-vaccine, there saying were for vaccine, putting this mandate on top of them when the kids find workers after the jobless benefits debacle, how does that work, what should be your message to the midsize workers, the little guys. >> i feel sorry for those people in the biggest question i have what is the difference between 99 employees and 100 employees, does covid only affect businesses that have 100 employees and more and listen we are in a state right now where we have 11 million job openings that we cannot fill, putting

still exist or happen again. so we need to really take a deep dive into carrying out this september 11 attack, not just financing al-qaeda but aiding and abetting the hijackers. elizabeth: correct me if i'm wrong i've talked to so many 9/11 families, they say terrorist are going to terrorize but when 9/11 was also about september 12 it's about people like you stepping up and speaking out. he rose walk among us we always look to hollywood for heroes heroes are walking around among us today and on september 12 we were republicans or democrats we were americans coming together showing that there is still good in the world, what do you say that. >> absolutely america banded together, the flag was flown proudly just about every single house and establishment wherever

u.s. marine corps and army veteran john byrnes, it is an honor to have you on the show. tell us about the moment that you learned about 9/11 you rushed in to help out at ground zero can you tell us about that. >> thank you for having me on it's an honor to be on. the moment i found out i was sitting in the classroom on the upper eastside 4 miles north of ground zero and the younger on the back of the classroom poked her head up and said a plane just hit the world trade center and it took me a few moments to process and she shared more news about a second plated i realized the national guard soldier in new york city i was going out to get to work. i did not get to rush into ground 0 that morning. i rushed around campus and i rushed down on lexington avenue and it was a frustrating day, the only useful thing i was able

to do for the first couple of hours was to go to the bookstore on union station in union square and grab masks for the city for our planners. you remember what you do not 9:10 a.m. that morning very clearly. elizabeth: you continue to work on the rescue effort. kudos to you. we were just talking to terry strada about this terrorist are going to terrorize but 9/11 was about september 12 when we were americans, we went to ♪ ♪ to republicans and was showing the power of america's character, people like you, it's always been there when america stood up proving there is good the bad in the world. >> we were able to put many differences aside, wasn't even september 12, the evening of september 11, the first responders in the new york city police and the port authority police and the fire department of new york get so much credit and they deserve it all but the national guard turned out in the

next few weeks and months to work at ground zero and thousands of americans did everything that they could from restaurants from statehouses, there was individuals who are making sandwiches for soldiers and police officers, it was one of america's best responses to something that happened, it was incredible i work with veterans on the director of education, i work with veterans of all ages and i work with veterans in their 30s and 40s who were young when i happened it inspired them to join the military i work with veterans in their 20s an early 30s who were children when it happened it inspired them to serve. elizabeth: that is terrific it's interesting that you say that. 9/11 showed us that we don't have to look to hollywood and heroes, heroes are among us, galvanized by danger, powered by the simple purity of their hearts to act the 343 firefighters who died that day, 71 cops, dozens killed at the pentagon the 40 heroes of flight

93 todd beamer who said let's roll we see this in the 13 troops helping people to escape who died in the terror to his bombing in kabul airport, we see it now with the veterans working on the pineapple express and other veterans standing up to rescue americans and allies behind hairlines that give us hope. >> absolutely i think about my friend vince who was working in the manhattan da office when he saw what happened half a mile away out his window and he looked around and realized his army uniform was only gear he had any put it on and ran over to the site and started directing national guard efforts he called the headquarters and reported what was going on and got the ball moving. i lost five friends that day and i did not know until weeks later in the intervening 20 years i've lost seven more to combat operation and another four or five who took their own lives. the tragedy of september 11 is still with us in very many ways.

most recently the 13 marines and soldiers. elizabeth: a personal note i wasn't going to to do this might fill families good, my sister married a family a fireman two days before 9/11 she lost her brother-in-law a fireman and 9/11. my great grandfather ran the new york city fire department my mother never knew her father because he died from mustard gas complications and my great-grandfather lost another son who is an fdny firefighter pneumonia. there is a personal touch that resonates with our family, dozens of people in my hometown rock filled center long island died in the 9/11 attacks. we feel you on that and we feel the viewer out there that can connect to the story and its people like you that give us hope. your final word. >> america is made up of people who want to make a difference it can make a difference in working every day if we could just break down the barriers that we have in the way that we talk to each
