"the evening edit" starts right now. elizabeth: okay, the breaking news. special counsel john durham joins announced a prominent lawyer who represented both the dnc and hillary clinton's campaign indicted for lying to the fbi in the trump-russia probe. his alleged lie was supposed to be the democrats bomb shoal, proof that trump should go to jail over trump-russia collusion t was such a patently false, off the wall story, even the fbi dropped it right near the start of its trump-russia probe. even robert mueller did not touch it but the media, msnbc,

cnn, and more they ran with it as if it was fact. now move over grassy knoll, this is tinfoil hat conspiracy left-wing stuff that tarnished the trump presidency early on. here is the big backstory. durham reportedly probing how did hillary clinton's campaign get this inside of the fbi joining me tonight congressman ken buck from house judiciary, former u.s. attorney guy lewis, former white house counterterrorism official nathan sales, brandon arnold from the national taxpayer's union and congressman buddy carter and claudia tenney. former dhs official mike howell. we have the update tonight on general milley and what is going on there. also today the president again misleading on the rich don't pay their fair share. he said it today. he should know better. he has been around since the nixon administration. irs data repeatedly show the upper brackets fund 90% of federal income tax revenues but this administration is doubling

elizabeth: welcome to the show. you're watching the fox business network. we begin tonight with breaking news. special council john durham announced that grand jury indicted a prominent lawyer for the clinton campaign. perkins lawyer. he is expected to make his first court appearance tomorrow. this is about the debunked claim that trump computers were talking regularly with russia's bank. the oligarchs. msnbc, nbc, cnn home. s ran with it as if it was fact. the fbi found out early on in 2017 that the trump computer was pushing trump hotel marketing information, hotel marketing information. joining us now, congressman ken buck of house judiciary, former u.s. attorney guy lewis. first to you, congressman. great to have you both on. durham is still probing how the hillary campaign and the dnc got

this inside of the fbi but his investigation ends tomorrow. what do you think of all of this, what happened today? >> well the indictment had to happen today because the five year statute of limitations would have run tomorrow. so that was the timing of the indictment. i'm not sure his investigation is over because there is plenty more that we need to know about the steele dossier and other issues but this obviously, a statement that was made by mr. sussman to an employee of the fbi, if the statement can be proven to be fault, mr. sussman's got problems. elizabeth: we hear you, congressman. let's turn to this media, including msnbc ran with this story as fact. rachel maddow even attacked other media for not reporting on it, watch. >> the title of the piece is, was there a connection between a russian bank and the trillion campaign, 7,000 world exploration of the alfa bank server mystery, alfa bank's

computer communications with the trump campaign during the trump campaign. the ah-ha moment was some of the stuff about the "new york times" and what they chose not to publish during the election. you explained what this might have been. elizabeth, guy, this kind of connects the dots, might have been ah-ha, phony moments. basically undercut the trump presidency early on. we understand what the mueller probe found. there are multiple indictments but there was no trump-russia collusion. this alfa bank story was phony from the start. fbi knew it. mueller didn't touch it. >> liz i agree with the congressman this is not at all the end or even the middle of the story. what we're seeing from durham, is the beginning, putting his toe in the water with the indictment. the allegations and detail of the allegations liz are shocking to me in terms of the

coordination, careful coordination a week before in october before the election occurs, how the hillary rodham clinton campaign, the lawyer, the law firm, put out these phony baloney stories, all, all designed, criminally designed to tube trump's chances. >> what guy is sheaing, congressman, fusion gps, anti-opposition research firm, got money from michael sussman's firm and gotten the money from the dnc and hillary clinton campaign to do the anti-trump research that is fusion gps fighting in civil court to keep secret its communications about the fake alfa bank story. fusion gps emailing michael sussman about the story in october much 2016. why are the fbi heads rolling on this? they were meeting with democrat

officials talking about this when they knew the stuff was phony baloney? >> there should be more accountability in the fbi, obviously the three or four people the head of the fbi are gone, that is a good thing. they acted in a partisan way. it is really disgraceful for an institution that is beloved by the american people, respected by the american people. the leadership failed the american people in this situation. but i feel very strongly that this investigation has to go on and congress should pick up on this investigation and make sure that neither party is ever subject to a criminal investigation for political purposes during a presidential campaign. it is very dangerous for the institution that we love in this country. elizabeth: what the congressman just said, guy, is supported by government documents which we have been reporting on for about five years. the doj inspector general michael horowitz reported that the fbi thought this alfa bank story was so fake that the fbi

supervisors on the trump-russia probe used it in assessment how bad christopher steele was with the anti-trump opposition research. hillary's campaign, dnc funded steele. here is the issue. so they used this information to get fisa wiretaps. the fisa court is meant for terrorists. this fisa wiretap is putterful. it is one hop, two hop. it can look at people listening to the devices. democrats used opposition research. the fbi used it to get fisa wiretaps. that is perjury. where do we see that charge? >> liz, you're 100% right. what happened here falsely and corruptly the dnc, the campaign for clinton, weaponized, weaponized the fbi. so you do have people in the fbi the heads should roll after

reading the indictment, asking questions, who in the clinton campaign, how high did it go, who was funding and paying for this, it was clear in the indictment tech people and other people were cooperating. they have the billing records of the law firm and the corrupt lawyer, and i'm telling you this thing is in its infancy right now in terms of who is going to be held to account. elizabeth: to what guy is saying, by the way, congressman, "the new york times" is reporting that michael sussman billed his work on the alfa bank story to the clinton campaign. congressman, you remember the reports came out that james brennan had briefed, debriefed president obama at the time that hillary clinton had come up with this anti-trump information in the steele dossier in order to distract from her email controversy. that happened early on. christopher steele testified in a british it court that is what was going on. he was paid to dig up the

anti-trump stuff. somehow it gets into the fbi. somehow gets into the fisa court. even fisa court judges were outraged over this. why didn't durham bring more in terms of charges along those lines? >> i think you will see more charges along those lines. i don't know durham is staffed the way previous special counsels have been staffed but obviously this case, he had to bring this case today because the statute of limitations ran tomorrow. and i anticipate that you will see mr. sussman and others talking about what they knew at the time. it is clear to me that the clinton campaign has criminal culpability for many of the things that we're talking about right now. if they're using a lawyer at perkins couey as a cutout to go to the fbi, return coming to the fbi, they're aiding and abetting courtrooms this special counsel

>> well, liz, i think president biden should have listened to his advisors. we're hearing now that the senior most civilian and military personnel in our government were all predicting for the president that if we pull out precipitously it will destablize afghanistan, result in violence, result in chaos. that is why they recommended we keep a small presence there unfortunately the president thought he knew better. imagine what afghanistan could have looked like if the president simply listened to the advice of his experts. if he had listened we wouldn't have had the arbitrary deadline. we wouldn't have left while we still had american citizens behind enemy lines. if the president listened maybe we would have kept bagram airbase which would be a more secure facility to run an evacuation. if the president had listened maybe we wouldn't have to depend on the taliban to provide security for the airport in our troops. as we know that ended in

catastrophe. elizabeth: yeah, 13 troops dead. nathan, let's talk about this, general milley will testify before the senate on september 28th under oath. what will you be looking for in this controversy, the woodward book, coauthored, told china before and after the november election, quote, if we're going to attack i'm going to call you ahead of time. it is not going to be a surprise. your reaction? >> those are some very serious allegations involving general milley and it is going to be very important for congress in exercising its oversight responsibilities to hear exactly what he said and what he was trying to accomplish. now let me be clear, there may well be circumstances where we want our chairman of the joint chiefs to back channel information to china. if they're getting bad intelligence about american intentions, if they're about to overreact, it might be advisable for us to try and lower the temperature but if you're going to do that you can't freelance and create your own foreign policy. you have to synchronize with your boss, the secretary of defense. you have got to bring the state

department in. you can't just go out and go rogue. elizabeth: he is an advisor. he is not in the chain of command for operational activity. he also spoke according to the book with house speaker nancy pelosi. she too is not in the chain of command. then he tried to reportedly increase his control over nuclear launch procedures. people are say, former secretary of state mike pompeo saying it is off the wall to think that the cabinet is running around at that time worried that the president trump was going to go rogue and launch an attack on china. this is bonkers stuff. it sounds like hysterics to a lot of critics in washington. you know, general milley's statement indicated he got approval for all of this talk with china from the pentagon but the former acting pentagon chief christopher miller saying no he didn't. he wouldn't have ever authorized that. he called him inis a borednant, disgraceful and he should resign. what do you think? >> i think one thing the

chairman of the joint chiefs shouldn't do under any circumstances promise to tell an adversary that the united states is about to attack them that is completely out of bounds. it puts american soldiers lives at risk. we heard some again, serious allegations and now we need to hear from general milley what he actually said and what he was trying to accomplish. elizabeth: woodward uses a lot of anonymous sources, blind sources, secondhand, third hand information. your point is well-taken that he needs to testify and step up and talk about what happened. i mean if he didn't like what he saw, critics are asking you know, why didn't he just go public and why didn't he just resign? >> that's a fair point and i think the notion that president trump was going to launch a surprise attack on his way out the door is farfetched to say the least. i think one of his principle achievements in office was not starting another war. he talks about the need to end wars rather than starting new ones. so the notion he was going to

businesses. reporter: here is snapshot what the irs would look like under president biden's plan compared to today. its budget would balloon by $80 billion over 10 years. its workers would double, hiring 80,000 new irs agents to take on what they say are high-powered corporate lawyers whose clients are tax cheats. the white house says they will make sure anyone who makes 400,000 does not become targets for audits. as you know a lot of small businesses are over the 400,000-dollar threshold. they don't have a team of lawyers on staff to try to fight an audit from the irs. elizabeth: that is great journalism, hillary. great to have you on. good stuff. let's welcome to the show brandon arnold from the national taxpayers union. you heard hillary's reporting. what is your reaction? >> this is pretty terrifying if i'm being honest. the irs budget, $80 billion, 87,000 new irs agents. new snooping powers start at 600

bucks in your bank account. the irs will require banks to provide that information what you're doing with your money to the irs. and on top of that, another provision snuck below the radar, that is retroactive tax penalties. they can look back all the way to 2001, 20 years ago and assess penalties on mistakes that you have made, may have made things that might have -- elizabeth: wait a second. wait a second. now this vie rates the statute of limitations laws t was three years and, 10 years and three. now they're trying to change that to go back 20 years? do you know how insane that is? people will not have the records. people have already thrown out their tax returns because of the prior statute of limitations. have they lost their minds? >> sure looks that way. looking back 20 years you're exactly right. most people keep tax records for three years. in unusual circumstance they keep them from seven years.

talking about incidents that happen 10, 12, 20 years ago. people won't be able to fight back, powerful corporations, every day americans, we'll not fight back against the supersized irs. elizabeth: people always talk about make the rich pay their fair share. irs data shows they already pay 90% of federal income tax revenues. we're talking about the top 20% bracket. top 1%, they pay 40%. the bottom 50% pay just 3% into the system. shouldn't voters up in arms what democrats are doing? trying to sell this as good for america. they are loaded with waste and pork. haven't read the bill. trying to ram this through. they're set to lose the house next year. they can't win with biden's poll numbers crashing like they are now. new low 39% in one poll. quinnepiac says 42. half the country disapproves. covering the irs two decades, testified before congress, i testified before congress twice, when the irs get as dog whistle

from the white house they do it. because they get their budget approved by ways and means and senate finance. you just give a nod and a whistle. the irs will step up to try to deliver. this is scary stuff. >> absolutely. we all remember the political attacks that they launched at non-profit groups a few years ago. you know, we remember the information, private information about billionaire turning over that tax information to, to a news out let. stuff below the radar happens all the time. there was an irs agent pled guilty, pleaded guilty to wire fraud and i.d. theft. just pled guilty in june of this year. these incidents do happen. and the more information that they have, the more private data they have on every day taxpayers, on small businesses, whoever, the more likely information will be made into the public domain to use against us as a weapon. that is unfair and really scary. elizabeth: we hear you, brandon.

the joint committee on taxation, reporting that the house ways and means version of the tax increases, it will go after those making just 30, as little as 30,000 to 40,000 a year in about six years time. listen, nancy pelosi only has a slim net three vote majority. at least about half a dozen democrats are retiring. historically the party in power loses two dozen seats in the midterms. they're trying to ram this through now in order to pay in power. shouldn't people be up in arms about it? >> absolutely. the information that came out earlier this week is staggeringly important. $30,000 and up, incomes solidly in the middle class. you will see a tax increase in 2027 because of this legislation, the poor way it is crafted. the promise of only raising taxes on 400,000 people, peel that make $400,000 or more is complete nonsense. it is baloney. people will pay higher taxes starting in 202, even if they're barely scraping buy, living

"the lancet" says you shouldn't have to have it. moderna, by the way will be selling more shots if they have to have a booster, they say you have to have it as well as israeli study. a lot of israeli studies have been pretty accurate. i would put a lot of emphasis on that. however the key here regardless they should not be mandated and the biden administration has proven what the epitome of government overreach by mandating the vaccines. whether you have a vaccine should be a decision made by you and your doctor, you and your pharmacist and family member, not you and the government. elizabeth: stick with that for a second. i want to go back to the moderna and israel study. moderna say there are breakthrough cases on older

at least biden is not reversing this policy of president trump which he tried to do with everything else. it is one small, good sign, coming out of the biden administration we'll try to work with our partners to create some strength, to counter china and china's reacting. i do worry that joe biden doesn't have the staying power to really stand up to them in the long run. but that remains to be seen. elizabeth: what are the dangers here? >> you know, i'm concerned that china is going to continue to be aggressive and that we are not going to stand up. we obviously have proven in the debacle in afghanistan we don't stand by our allies. i know taiwan is definitely concerned. this is a big move for australia. they're in a part of the world where they need our support and they need to us really defend them and i think that it is going to be really concerning that for australia that we live up to this agreement and we also can trust australia and trust great britain to make sure that the sharing that we're doing with them, the creation of new
