>> oh, congressman, let me share something with you, quite clearly. i work 18 hours a day. okay. so when i returned from yesterday's hearing, i actually focused on mission. reporter: lawmakers want to see the data as fox confirms many haitians migrants are being released into the u.s. mayorkas says the numbers are coming soon. meanwhile nothing reassuring for americans about the fallout from afghanistan. fbi director christopher wray warning that the situation there could inspire homegrown terrorism. >> we're concerned that isis-k can take advantage of a significantly weakened security environment to operate more freely. we'll already concerned that the events there could serve as a catalyst or inspiration for terrorists whether they be members of ftos, foreign terrorist organizations or homegrown violent extremists.

the homeland security secretary around white house saying we did not expect the rapidity, the speed which the border is collapsing in del rio. they said the same thing about afghanistan. they also said both of these issues were uncontrol. your reaction to that? >> they're in over their head. they should know the answer to these questions. we've been saying as sheriffs this problem would get this bad if they continued down this road with these poor policies. you know what? it is not surprising we're at the point we are now. they should have the answers. it is disappointing that they don't. that is clearly shows that they're way in over their heads. elizabeth: sheriff, you do have four house republicans introducing articles much much of impeachment against president president biden with andy biggs. mounted officials on horses using split reins. they did not whip anybody. they were swinging the reins around deter the migrant gets

immigrants in that area, only to be attacked by your own government and people should be thanking you for the work they have done. i want to thank the border patrol. they have done a outstanding job. shame on our government for not having their back. elizabeth: we have been covering the story five years and we heard the same thing from border officials for sometime. rodney scott alleges that the homeland security secretary and white house are misleading the public, intentionally eroding border security. he says declassify all the information on number of individuals caught in the terrorist screening base. do you agree with that. >> i agree with that. they will never do that. they should come before the american people how bad this job really is. they have been lying, lying, lying to the american people. they continue to do it today saying they're not releasing these haitians into our communities which they absolutely are. this is just been a disaster all along. we're sheriffs. we're tired of it. border patrol is tired of it.

do into this country. elizabeth: to your point about white house misdirection, we keep hearing it, right? mayorkas says the border horse incident was not a problem. now he tells msnbc he was horrified. they are saying the border is not open. migrant crossings are at 21-year high. saying no crisis. 15,000 people are sitting under the bridge in unsane terri conditions. by the way 25,000 more may be coming. the population of del rio is only 35,000. jen psaki saying they don't intend to say. associated press say they are releasing them into the u.s. by thousands. jen psaki blamed trump for inhumane conditions. your take on all of this. >> that is such poor leadership. look i'm a leader of an agency. when we mess up we have to own it, we have to take responsibility for it. i don't get a chance to blame the old guys. that is what they need to do to take responsibility. their pride won't let them. they frankly don't know -- i think they're in over their head or they are purposely creating such chaos in this country and i

money to the taxpayers, shrink the size and scope of government but they have left us on the sidelines. so it is up to them to pass this continuing resolution and raise this debt ceiling because they're the ones who control the levers of government and they don't want any part of our involvement. elizabeth: so they want to raise taxes. by the way they want five trillion all-in spending. it is intrinsically inextricably linked by progressives. they will not break out infrastructure from the social spend. it is five times the of italy and france. it makes zero economic sense to do what was done under the eisenhower administration, put us all in upper bracket tax rates of 60%. we've been here before. kennedy cut taxes. reagan cut taxes of the models congress and democrats use are, so out of date their models. even unreagan they said, you will not get beyond 3% growth.

well guess what? growth doubled when they cut taxes. so it is like we're back to the future again. we've already learned these lessons. why do we keep going round and round the bend? >> he is taking carter malaise to a whole new level. essentially saying make the corporate tax rate higher than china's. let's raise the capital gains rate, let's raise the death tax. the tobacco excise tax which will hit working families. his promises to keep tax increases to those earning more than 400,000 a year has gone by the wayside long time ago. so he is looking to tax everyone and everything that moves and that is just the beginning of the bernie sanders budget that they're trying to pass right now. elizabeth: it feels like we're the moderates. where are the centrists? the country is moderate around centrist for the most part. it feels like the circus, you know, ferris wheel fell off its axis and it is going careening

towards the ocean because of what the progressives and far left is doing, ripping the democrat party off its fiscal moorings. you see that time and again. what we're looking at right now, is basically, even when we have foreign leaders looking inside of the u.s. and saying what is going on with the united states? let's listen to the son of a leader of brazil talking to tucker carlson about this last night. watch this? >> i know that de blasio is a marxist. when you think you know what is better for the other people, then the other people opinions it shows a lot of who you are. they want to control everybody's life and to that point even the taliban can talk you know, say things about free speech to the -- we're scared what is going on in the u.s. elizabeth: he is scared? what do you say? >> you know americans should be scared because right now the liberals in washington run the

elizabeth: let's welcome to the show former deputy independent counsel fox news contributor sol wisenberg. sol, the durham indictments in the trump russia criminal probe he is looking into there, what went wrong, it shows the length hillary, her campaign and democrats went to in getting their allies in the fbi and the media to use their opposition research to go after trump because you know accusations are tantamount to convictions in today's media. what do you say? >> well there is no question

that's true and really what happened with the alfa bank story parallels almost precisely what happened with the steele dossier. in fact one of the, one of the hilarious things that has now come out is that one of the, one of the steele memos, the one about the alfa bank, was actually fed to him by michael sussman who was just indicted. everybody thought it came from christopher steele but in fact it was fed to him by michael sussman. so you know, if you can think it, it turns out to be true in this situation. it was very important for the clinton campaign not to be seen as the source of these rumors about donald trump and russian collusion. and so they would feed this information through various cutouts. people like fusion gps, people like michael sussman, then when the investigation was launched they would go to the media to say, hey, this is serious. the fbi is looking at it and too

many members of the mainstream media were too comply ant spreading the story. really disgusting. elizabeth: democratic lawyer michael sussman pled not guilty lying to fbi. he got to sit down with general counsel james baker to begin with. he is friends with james baker reportedly. he told congressional investigators that he didn't know who sussman was representing, working with the dnc or clinton. how do you not know? he is your friend? jim jordan found that unbelievable. >> no, it's a little bit different than that of the notes that were taken by priestap indicated baker clearly now that sussman represented both the dnc and the clinton campaign and i believe that's why i asked him, all of sudden he has got sussman in his office and he says basically, essentially, look i know you, your firm represents the clinton campaign and -- elizabeth: wait, hang on. >> so what are you hear for, right? so what are you hear for today?

elizabeth: baker testified he couldn't remember. baker testified he couldn't remember if he knew sussman's connections to the dnc and hillary clinton campaign. he testified to that. but the doj attorney general warning fbi, stay away from steele. it may be political research. slate and "the new york times" ran the story and slate ran their opposition, story by fusion gps which was the opposition research firm and fusion gps is telling slate, hurry up, get it published. you know what i mean? david korn and "mother jones," that far left operation. that media outlet in the fall of 2016, gets portions of the steele dossier to james baker. baker leaks around back to "mother jones" and yahoo! news. baker has been accused of leaking too. you know what i mean? it feels so circular, sol, what happened. >> it is circular, like i said.

the clinton campaign, it was important to them to be able to say, wait a minute, the fbi is looking at this and you make an important point about james baker. is the fbi looking for plausible deniability here? you know, is it important for baker to be able to say, which is what the notes indicate, the contemporaneous notes to be able to say i asked whether or not, whether or not they represented anybody, whether sussman represented anybody with respect to this alfa bank report? and he said no. so was baker being a careful public servant or was he looking for plausible deniability? but there is another question, there are so many questions here be liz, what, why does a guy like sussman, what makes him able to just walz into the office of the general counsel of the fbi say i have information for you? that is highly irregular. an agent should have been

brought in immediately when he did that. there is so much that smells about this. you could go off into so many directions. one key here is, is this the end, end of the line for durham and he wants to get all this out in a speaking indictment or are there other indictments yet to come? will the report see the light of day? there is a lot we still don't know. another huge, huge issue is, was another crime committed here? was this information that the tech executive in the various researchers gathered for sussman, did that violate a criminal law? all of that is yet to be determined. elizabeth: you know, we're so grateful that you came on, sol. you know, bruce ohr, justice department friendship with christopher steele, it goes on and on. sol, you're terrific, great to have you on. come back soon. >> great to be back. elizabeth: we want to make a clarification. we showed erroneous photo before of james baker.

lopsided on the battle. if you want to be equitable about things you put the same troops along the whole battle, then you lose the war because they came in on one side. equity here is the mantra of the biden administration, really cost peoples lives. what is called for reallocation of supplies. where the most needed is evident. for the biden administration not to do that is just showing again and again and again how political this administration is and they're truly not caring about lives. i do believe that, disproportionately as roger said, are affecting red states. you know what a, if you really do care about the american people reallocate the supplies to save lives. elizabeth: there is this, doctor, congressman. osha has yet to release the draft of rules to force private businesses to mandate vaccines. this is nearly two weeks after

elizabeth: joining us now, former top dhs official lora rees is back with us. the associated press is reporting that the biden administration is secretly sending thousands of illegal aliens into the u.s. concerns are growing that border patrol officials have had it, they're quitting, and we're hearing potentially tens of thousands more migrants could be headed to the border. that's according to homeland security officials and reports. what do you say about it? >> yeah. well, these haitians that are coming here, they clearly intend to stay for a long time despite jen psaki's bizarre claim that they weren't intending to stay long. there's been reports that border patrol agents and i.c.e. agents have been injured, haitian migrants have overtaken buses and tried to escape. there's been reports that agents

have been bitten by migrants. and so, in fact, these, many of these migrants had already been resettled in chile and other south american countries, but they saw that the u.s. border was open, they sought to take advantage of it, they plan on applying if for asylum, claiming that they just came from haiti, and they are not eligible because they were already resettled, and we have to guard against asylum fraud. elizabeth: lora, you and i have been covering this story since 2016. as we see it involve, you see the media not reporting on it for years, you see the white house and the press secretary downplaying the crisis at the border as a challenge, you hear that from the homeland security secretary, then you have rodney scott. he's a 29-year veteran of, you know, border authority and national security.

he's been in that, you know, network for some time. he was biden's former top border chief. he's warning that transnational criminal car the tells are purposely -- cartels are purposefully blowing up the size of the migrant camp to distract border patrol away so they can do human smuggling, drug trafficking and potentially cross terrorists across the u.s. border. your reaction to that. >> yeah, it's terrible. so the border patrol has had to shift resources to address what's going on in del rio. there's over 220 miles of the border that are unmanned because of this. that border is wide open thanks to the policies of the biden administration and now traffickers taking advantage of it. and we have to remember with the fall of afghanistan, al-qaeda, isis, the taliban are revitalized, they have to have their eye on that open border to
