his father was vice president. thanks for joining us. i'm elizabeth macdonald, "the evening edit," it starts right now. ♪ ♪ elizabeth: okay, joining us right now, national border patrol council vice president art del cueto. we wanted to go right at this with you. we're going to show the fresh angle of the border patrol on horseback. again, no whipping. photographer says he saw no whipping. this is the other photographer who took the original footage. you see the whirling of the reins, you see the migrants are panicked. a border guy grabs a migrant by his shirt, they're running away. is this enough for the president to say there will be consequences, they will pay? >> not only is it not puff enough for him to say that, i think it's very irresponsible how the president of the united states to say something in that tone and in that passion when

all he had to do was contact leadership from within the agency, and they would show him, one, how the training is done, how everything is within policy and how nobody was harmed. this is something that the horse patrol is trained to do to prevent the horse from attacking anybody that's near them standing next to them and at the same time be able to move the horse out of the way to safely control the horse so the rider is safe and the individual that's on foot is safe. and all it would have taken was a phone call. and then you heard kamala harris say the same thing and attack the agents. it's infuriating, elizabeth. it's infuriating that you have people in leadership positions that don't know how to pick up a phone and ask for a training manual so they can see what's within policy. elizabeth: should police in cities across the country who use the same deployment of horses to stop riots, to stop mobs, in new york city, in other cities across the country, should they face consequences

too for using the same actions? >> you know, nobody was hurt. everything that you're hearing from a lot of these individuals is they're spewing hate. they're wanting to cause this type of divide and, honestly, the statements like this, they're very irresponsible and they're very idiotic, and it's hurting a lot of people, good, fine people. look, we represent these individuals that are out there i putting their lives on the line, and how are they supposed to get a fair investigation now when the president has already condemned them when nothing was done wrong? how do they get that now? very irresponsible. elizabeth: again, we've got the news coming in. you're seeing brand new footage at a different angle of what happened with the border patrol on horseback. we're going to show in just a minute what the photographer, the first original round of footage, he's saying this has been misconstrued, there was no whipping. we've got a black lives matter protest potentially this weekend at the bridge camp.

that's now been cleared out. the dhs secretary, mayorkas, initially he said it was okay, today he attacks his own workers for having used force. you know, art, we've got texas republican representative tony gonzalez, his district covers del rio. he had a fiery phone ca call with the dhs secretary saying stop bs-ing me about what's going on. watch representative gonzalez here. >> there is a national security event that is just brewing. i mean, you can see another 9/11-type event on the horizon with everything, the debacle in afghanistan coupled with a wide open border, southern border, it just creates an environment ripe for disaster for americans. in the big bend sector, the sector right over a very remote part of the southern border, very few agents, very limited resources. elizabeth: team, show the new

footage again. the new footage of the angle, then we're going to show the photographer, what he said about what happened. art, so they're reassigned to desk duty, the morale is low are, agents are quitting just when we need them, when afghanistan has collapsed into a terror state. there's al-qaeda and isis in there. there's threats of terrorists crossing the border. what do you say? >> how irresponsible is it for the leader of our country to make those kinds of statements, to divide even more right now when we need our nation's borders even more defended than before? i mean, i don't -- i'm at a loss for words for once because it's just ridiculous. i mean, you're seeing what's happening. when you know that everything that was done was done within policy, when you hear all these people attack these agents that are out there day in and day out, as you said, we have agents quitting over vaccine mandates and everything else, and right now is not the time to start adding more division in this country. right now is not the time to

even attack agents especially when they have done absolutely nothing wrong. elizabeth: okay. let's do this. does the white house or the homeland security secretary alert border towns, neighborhoods, local hospitals, school districts, health care in those areas that they were going to weaken the border so badly that we, the population of nebraska is crossing? you know, he testified on two successive days he didn't have the data. did anybody alert these border towns what was going on or what happens about to come? >> no, members of the national border council alerted the agency and said, hey, this is the problem, this is happening. they were alerted back june 17th of this year and told they needed to have some kind of processing centers outside to make sure that they were ready for the surge that was coming. make no mistake, everything that's been happening, it's been happening since president biden was running for office. he invited this lawlessness. he invited it with his open border rhetoric, and now he's not only put agents' lives and

careers in danger, the american public is in danger because of these false narratives and because of the rhetoric that he invited lawlessness into our country. elizabeth: we're looking at 30 states,30 states have two -- let me back up. the immigration court system is swamped. 30 states, 2 territories have roughly 60 immigration courts to handle 2 million illegals coming in. 15 have just one court. immigrants doing it right waiting in line, paying their dues, they're getting crowd out the back door. the immigration courts, their case backlog quadrupled in nine years, and they've got three times as many pending cases as the average federal district court judge. you know, democrat federica wilson even said, yes, the signal has been out there that the border is open. quote, there are cottage industries that have grown around the border where we have smugglers passing information so

people can come across illegally. so even democrats are saying, yeah, this is what's going on too. your word on that. >> let's remember that the many illegals that are already living in the united states. s this is how crazy it is. so they talk about the actual vaccine, and that's why the ports of entry are closed. the ports are the ones that allow people to enter legally, help boost our economy. those are closed because of covid, yet they're allowing these hundreds of thousands of individuals and releasing them into the united states unvaccinated, they're not even asking them about any of their prior vaccines that they have. then you have enforcing vaccines on agents which are now causing a agents to quit this agency. elizabeth: art, first the homeland security secretary said this wasn't a problem, what border patrol dud. now he's saying this is a problem he's going to investigate. he said the border was under control about a month ago. he said then privately, it's not

the rich or the incorporated. the biden administration and democrats in congress insist that the little guy is not going to get squashed by higher taxes, but the tax foundation says they are doing the math wrong saying, quote: the biden administration is misleadingly claiming their tax proposals would have a small effect. the actual a statistics show more than half of pass-through business income could face tax increases. the president of the national federation of independent business says that impact will be devastating saying this: if the tax hikes and mandates go through, the damage will be severe and long lasting. the country may recover in time, but countless small businesses won't live to see it. banks are also giving the biden administration backlash for a new tax proposal in this package that would force banks to hand over information to the irs about how much money is going in and out of every bank account above $600.

that one deeper, but the way i understand it there's a, quote-unquote, loophole that he took advantage of with a tax structure using a corporation to avoid paying payroll taxes. but what's interesting is when joe biden uses the tax laws to his advantage, it seems to get brushed under the rug. they're still looking for president trump's tax returns, and he's not even sitting in office. so it's interesting the double standard in the media about the tax brackets of the presidents. elizabeth: you know, this report does not name president biden by name. it analyzes cases where the irs won a judgment against taxpayers that did the same thing. they sheltered $13 million in book and speaking fees and s corporations to avoid paying the 3.8% self-employment tax, then they took a salary out of that. so that was the move. and even democrats are trying to shut this move down in their new bills for spending. what do you say to that?

>> well, it's interesting also as an s corporation, not to get overly wonk key, is a clinical pass-through entity, andhill bily -- hillary was talking about the plans to try to limit some of the benefits they get for taxes, and the reality is small businesses use pass-through entities, and it's going to be a job killer if we start taking away some of the benefits that pass-through entities get that ultimately lead to employing a big chunk of our work force. elizabeth: so he avoided paying into medicare and obamacare, he's got multimillion dollar manages. the republicans are saying if you want more money for the irs to do audits, ask the irs to audit yourself. let's show how progressives are really going after moderates. we're hearing about people shouting at each other in the democrat party in the halls of congress. they're really mad at the moderates for saying we don't like this gigantic tax and spend bill with. we're hearing $5.5 billion

trillion. that's about equivalent to the economies of italy and france over the next ten years that they want to spend. they're tweeting and attacking the positionives really blasting -- progressives really blasting the moderates. what do you say to this fight? >> what's really interesting is that progressives pushing for this tax and spend policy where you can't possibly tax enough, there's just not enough ways to tax, to pay for the spending which means we're going to be printing must be. but they're really advocating for this wacky notion of modern monetary theory where you just keep printing money. that's what we're doing right now, and is what do we have? we have inflation. and if you look at the housing a data that just came out this week, it showed that there's a slowing of home sales for homes $250,000 or less. why? because inflation is starting to really hit the wallet of working class americans, so much so that it's endangering the american dream. and that's right now the ridiculous spending that we've had so far.

that the president is not doing what's necessary to invoke a level of calm on how to reduce or rethese crime numbers -- recede these crime numbers. by doing nothing, you're exacerbating the problem, and that's -- elizabeth: they didn't mention the dnc, they didn't cover it, their convention last year, nothing in the inaugural address or address to the joint session of congress. let's show the murder rates in cities across the country as we talk about defund the police. austin, texas, is one example. they cut $150 million, the austin city council, out of the police budget. that's about a third of the budget, a third. now there's not enough staffers to answer 911 phone calls. so so if you're in a car crash with no injury or a burglary where the robber has already left, you've got to call 311. your reaction to that.

>> this is a classic sentiment of the liberal left. the mayor of austin, texas, is a democrat, and he -- like a lot of the other democratic mayors -- believes in this notion of i don't want to say defunding police, but receding police. and as a result, the public is suffering. we don't have enough police resources. police resources are being stretched thin, and the liberal democrats don't understand the carnage that subsequently is backlashing into these communities. elizabeth: you know, there's a pushback in the concept, you know, we've talked to democrats who say this isn't true, it's not democrat-run cities, it's not democrats' fault, it's the cities themselves at fault. what do you say to that argument? >> i say the numbers don't lie. when you look at the quantitative statistics, when you look at the democratically controlled cities in the united states, you clearly see a meteoric rise in crime. it's very different when you

♪ elizabeth: okay, let's bring in florida's greg steube from house judiciary. congressman, first let's deal with this bombshell from the durham indictment. i'm going to go through it slowly. the indictment says that hillary's campaign hired big data internet researchers, including emory university. these were people working inside the beltway. the indictment says they, quote, worked to locate any connection between donald trump and russia's alpha bank, and in doing so, accessed data of an executive branch office of the u.s. government. they were working as subcontractors initially to help

protect against cyber attacks on the government, but they accessed the executive branch. this feels like a cyber nixon break-in. let me tell you what agencies; defense, energy, homeland security, justice department, state department and the treasury department. your reaction to this story? >> well, first of all, it's not surprising at all that this is going on. i mean, we have our own congressional members trying to get the cell phone information of republican congressmen and women because of january 6th and using that as a reason to get to our cell phone information. so none of this surprises me. but what is really frustrating to me and every american at least in my district, and i would think most americans, is this is a fact that the hillary clinton campaign used a russian dossier, the steele dossier, to then promote the fbi to investigate using 100% campaign information to get a warrant from the fisa court.

all based on lies, all based on campaign disinformation to get a warrant from the fisa court to spy on members of the trump campaign. and all of the people that were involved in that a, nothing has happened to them. we all know that that was false, we know that it was a campaign dossier, we know that they used that dossier knowing that it was false to get a warrant from the fisa court to pie on people like carter -- spy on people like carter page and others in the trump campaign to try to get evidence of a lie that they could keep this monologue going that there was this colleagues between trump and russia. and after two and a half years, nothing has come of this other than two small indictments for lying to congress. elizabeth: we're not sure how the january 6th capitol riots play in here, but i hear what you're saying. i want to explain this. this was hillary's big push to get the fbi to investigate trump, claiming that trump's businesses were, their computers were talking to russia's alpha

bank. the fbi debunked it. it was hotel spam marketing. in other words, a third party computer server was sending out marketing spam e-mails about trump hotels and properties to alpha bank. robert mueller didn't touch it. we've got to move on to jake sullivan. the indictment against michael sussman, he pleaded not guilty to lying to the fbi. biden's now national security adviser, jake sullivan, he was in this web of democrat insiders as hillary clinton's foreign policy adviser. he knew about the russia alpha bank story. he testify thed in 2017 he didn't know about it. if he didn't know anything about it, why was he running around to cnn, a abc, cbs, nbc and fox news with this trump-alpha bank story? >> well, because he knew that if he promulgated this false story, that cnn, msnbc and these other
