"the evening edit" starts right now. elizabeth: more on this news that homeland security is secretly bracing for a worst-case scenario of as many as 400,000 migrants. that is the size of tampa, florida, potentially coming to the border starting next month. that is a worst-case scenario. but panama, joining mexico, say it already warned the white house to stop this now. panama now says 60,000 could be coming. this as homeland security still may fire border patrol agents over vaccine mandates. you will hear tonight from the mayor of one border town.

"the evening edit" starts right now. ♪. elizabeth: welcome to the show. you're watching the fox business network. with us now florida congressman carlos jimenez, homeland security, former i.c.e. acting director tom homan. thank you for being back with us. report from nbc homeland security quietly preparing for 400,000 trying to cross the border as they insist the border is under control. that is the worst-case scenario. your reaction. >> we know that the foreign minister of panama said there are 60,000 haitians trying to cross the border.

that is four times more than the bridge under el paso. this will be out of control. will be out of control until the biden administration changes their policy. basically just has to revert back to the trump policies and most of this will stop. elizabeth: so the congressman's point, tom, you and i talked about this for years now it is about the trump policies. the numbers they're talking about would be double the generational highs we already saw in july when 210,000 migrants crossed. annualized something like four million. panama saying listen we have to get together to stop this. pan panama is saying 60,000. senator rubio says it is double that. what do you say? >> the secretary can give speeches all he wants don't come, you won't succeed, you won't be deported. shown he is lying.

to give less discretion to the administration that is the problem. there is a lot of discretion given to the administration where they can implement certain policies yes or no. that has been a mistake on congress' part. we should write explicit laws tells the administration exactly what they need to do. they need to abide by and enforce all the laws but how the laws are enforced, that should be congress' role, not the administration. way too much power given to the administration. elizabeth: react to what the congressman said, tom what do you think? >> for instance, today unprecedented crisis on border, worst number in two decades. what did the secondary do today? issued a new memorandum to i.c.e. arrest fewer illegal aliens in the country. you would think the secretary would act like the secretary of homeland security and create an enforcement action to deal with the border, have some sort of consequence or deterrents to

thousands coming across the border, many with covid. he is sitting in his office writing a policy to arrest, more, less, illegal aliens in the country. which is another enticement for people to come here because they know they can't be arrested or removed by i.c.e. it is ludicrous that the secretary is doing that rather than trying to secure the border. it is beyond the pale. he is secretary of homeland security. he needs to start acting like it. elizabeth: should anybody in the administration step down over this, congressman? because when we look at the government data and analysis, tom pointed this out too, less than 2%, 1.6% coming here under legitimate asylum claims-let me back up. only 2%, less than 2% have legitimate asylum claims, right? 98% of them don't. they're coming here to get a job. we need the system to work for those who have legitimate asylum claims, the true refugees, right? >> that's correct. we need to have more judges to

adjudicate these claims but also those that are waiting their time in court, should be back in mexico, not in the united states. once they get into the united states, 90% of those people, a, will either never show up for their hearing or if they have a hearing and they're told to go back, they're given some time in order to fix their affairs here, terminate their affairs here, they will never show up again. what happened because, used to be 10% chance you could actually make it into the united states under trump policies. now it's a 90% plus chance that you're going to be able to live and stay in the united states. so they're telling all their friends, all their neighbors, back to their country of origin. come, no matter what biden is telling you, no matter what mayorkas is telling you it is all a lie, you can get into the united states. elizabeth: harvard "harris poll" says voters say, tom, two in three voters say reinstate the trump policies including remain

"politico" said they never seen this. this is unheard of. they only won with a net 90,000 votes. why do they get to be the loudest voices in the room? why does nancy pelosi sit on heads of house democrat moderates for so long? >> liz, it is no secret in washington that senator manchin has been saying 1 1/2 trillion for a long time. i don't know why speaker pelosi, aoc are saying what? this is the first time we heard it? it has been very common over the halls of the capitol and i'm a republican of the so surely they could have opened up their ears to listen. he has been saying this for a very long time. what started out as a bipartisan infrastructure negotiation turned into a hostage negotiation because speaker

pelosi paired up the $4.3 trillion reconciliation bill with infrastructure and guess what? she is killing the hostage tonight because that infrastructure bill does not look like it is passing. elizabeth: there is no policy discussion at all, right about this? they will just ram it through. including tax hikes on the american people with just democrat votes. that is taxation without representation, cutting out half the country, ming republicans. talking more about aoc's tax the rich dress and chock block bill. we're in midst of recession. we have 11 million jobs open. republican senator susan collins, democrat joe manchin are saying you will break the kegs between work and a brighter future. that is the american dream. what do you say? >> liz, we need more americans working. everywhere i go traveling across missouri there are help-wanted signs. the last thing we need to do is create another federal government program to have people stay at home more

dependent on the federal government. that is not what we need. this reconciliation bill before us is the largest tax increase in the united states. $2.1 trillion. you're talking about taxes on people making less than $400,000. we can't afford that. we don't need that. elizabeth: the other thing too, jason chaffetz is talking about this, viewers watch for this, state taxes, your state taxes are going to go up within the next five years. why? because the way the democrats are writing new entitlements, only pay for them the first few years. then the states pick up the tab, right? this whole thing this thing is free, spending is free, pelosi, the president, other democrats are bullying this through with false narrative that spending costs nothing, watch. >> we talk about price tags, it is zero price tag on the debt. we're paying, going to pay for egg we spend. >> it is not about a dollar amount.

the dollar amount as the president said is zero. this will be paid for. >> of the invests that were proposed including tax cuts, the pay-fors, making tax system nor fair. zero. >> president biden also said something very important today, this is a zero dollar bill because it will be completely paid for with taxes. elizabeth: tell that to the blue-collar worker and middle class worker going to see their taxes go up. they want higher carbon taxes, gas taxes, taxes on tobacco, income tax rates at the state level around federal level will go up. when you subsidize things, that goes up. obamacare went up. college tuition went up. subsidize child care. the cost of that will go up. when you throw money at things, you subsidize it, those doing services charge more. joe manchin is calling this fiscal insanity. we can't afford it when we can't pay for social security and medicare.

that is what he is saying. what do you say? >> liz, apparently joe biden and nancy pelosi can't add one plus one. the math simply does not add up. the bill that passed out of the budget committee after an out hour markup, is $4.3 trillion spending bill 4.3 and it increases taxes at 2.1 trillion. you know how much it puts on our debt? $2.4 trillion. it is nonsense to say it costs zero. almost like joe biden saying he will never implement vaccine mandates or that he will not leave any americans behind in afghanistan. they're all lies. that is exactly the case here. elizabeth: i mean obama passed an 800 billion-dollar, you know stimulus package. what joe manchin wants is twice that. this is where we're at. i can't believe the reporting that you see at other networks where they're not drilling into the details of what exactly is going on, totally misleading the american people. congressman jason smith.

all over this. you're seeing a dozen states, worker shortages at hospitals blaming the vaccine mandate. these hospitals are getting medicare and medicaid. they cover roughly 17 million workers, congresswoman, especially the rural hospitals in rural communities. it is going to hit the poor really hard. 80, 85% of hospital budgets rely on medicare around medicaid. so now those hospitals are saying, listen we need fema or government worker strike force to cover our health care worker, nursing home shortages if we have to fire people. what do you say to that? >> you're absolutely right. we continue to push back against these mandates because these hospitals are going to get hit hard. and also you see those local health care clinics they will be hit hard as well. also locally the teachers are saying that there will be a shortage in our schools. that will create a problem there as well. so we continue to push back against these mandates. we believe that we should encouraging vaccination.

elizabeth: okay. afghan refugees coming into the u.s. including at fort mccoy in wisconsin. mike tobin joins us from fort mccoy with a look inside. mike, great to see you. reporter: good to see you, too and here on the base, liz, there are some 12,600 afghan refugees waiting to begin their new life. this resettlement has been dubbed operational lies welcome. the largest concentration of

afghan refugees as part of this operation is here in wisconsin. they're staying in barracks built in 1942 for world war ii. they have been refurbished since then. soldiers usually stay in the barracks when they come here for training. that is where they are staying now. some 40,000 meals are deserved every day. these are hall lal meals approved by imam. clothing arriving through donations. 45,000 vaccinations administered everything from measles to covid-19. major general guthrie says the operation pays for that support the allies for 20 years in afghanistan. people like this man. >> i worked for the u.s. army, with the special force, canadian, with different unit. i worked as interpreter. a lot of people know about my job i did work for the americans. that is why i was in trouble. reporter: like most of the refugees he does not know when he can be resettled, where he will be resettled, what he will do for a living.

john durham's demise are greatly exaggerated. he is still chugging along. we have the indictment the other day of michael sussman. he is actively using the grand jury and pursuing evidence and more indictments are to come. elizabeth: we're getting story out of "new york times," clinton and her campaign hired cyber researchers now thought to be four computer scientists, maybe more, and they exploited and accessed internet data in the government's powerful executive branch. it may involve the pentagon's darpa agency, a computer research branch to make the case trump was colluding with russia with trump's businesses talking with alfa bank. fbi debunked it. mueller didn't touch it. potentially accessing darpa. we don't know. this is what durham would be pursuing. this would be classified government information in pursuit of an attack on trump,

political operation in service of a political operation. what do you say to this? >> well there is a lot to unpack there. let me just say full disclosure, i represent a witness, key word witness, not a subject or target from this same setting. so i do have a little bit of knowledge of that but i won't talk about the his confidences but not everybody in the academic setting was copastetic sharing information with michael sussman to basically help the democratic machine. this was an accusation in search of a intellectual fig leaf, they didn't get it if the indictment got it right. the attorneys are saying differently. these are researchers that uncovered the ties to russia but the indictment has damning language about the researchers saying we don't have it, we don't like trump but we don't have evidence of a russia collusion. elizabeth: "the new york times" reports that researchers including potentially from georgia tech university have been working with darpa, the

pentagon's powerful research branch to protect the government from foreign cyberattacks. there could be an indication these researchers exploited classified government data meant to protect national security and protect the government in order to use for their own political operation to attack trump. so once we understand what they're looking at, does this become a question of criminal culpability for dissemination and miss use of government classified data? what do you say? >> it is possible. they are certainly in a breach with their contractual obligations with darpa and the pentagon to not misuse data for political purposes. they're supposed to be a public university pursuing a grant with our pentagon to protect the country. it is not about a political opportunism. but i think the hillary clinton campaign found some like-minded people that were willing to bend the rules and go on a little frolic and detour possibly to give information that might help michael sussman's pitch to the fbi. elizabeth: jim trusty, thanks for joining us.

mayor of uvalde, texas the, mayor john mclaughlin. mr. mayor, nbc is reporting that homeland security has been working on a worse case scenario of up to 400,000 movants -- migrants starting next month. panama has been warning that 60,000 could be coming. what does this mean for your town and the region? >> well, the region -- if you go back this last week with the haitians in del rio, del rio was overwhelmed. the grocery stores were out of food, you couldn't get stuff, people were coming to uvalde to buy food because they couldn't get it in del rio. i mean, we're not equipped to handle this. and the federal government is, you know, they're a failure in their job. the border patrol are are working night and day trying to do this, but this administration out of washington is creating total havoc for the border region and the surrounding counties. it's -- we can't handle it.

elizabeth: what happens with hospitals, hospital beds, jails? we're hearing the city's fire departments in the region are being used to shuttle migrants to bus stops and charities and can and government agencies. we're a humanitarian country, of course, we're an open arms country, but it's sort of like the people in washington are, you know, telling everybody else what to do when the ones doing the real humanitarian work are the people in your towns, right, mr. mayor? >> yes, ma'am. we're fortunate they're not dropping them off in uvalde. but our hospital -- our problem is the bailouts, the trains that they come off of, if an immigrant is sick or hurt, then he goes to the hospital. and if our emergency room is full of citizens waiting to be seen by a doctor, he gets puppet to the front of the line -- put to the front of the line. and that's happened on more than one occasion. a month ago every ambulance we had in town was out at the train

where they were pulling them off the train because they were all sick and overheated. every ambulance we had was tied up at that situation. elizabeth: what about crime? >> crime is up. crime is up. people, i mean, our crime is up considerable. some is local, but about70% is probably the foot traffic that we're seeing come through here. it's a shame in a town like uvalde where parents are afraid to let their kids play out in the yard by themselves or unsupervised, or if they are out there, one parent's got a firearm because you don't know what's coming. and it shouldn't be that way. washington don't worry about that. elizabeth: what types of crime are coming? are headed your finish. >> we're having -- our ranchers' fences are being cut, houses are being broken into, ranch cars are being trashed. in town people are breaking in cars, stealing whatever they can steal. if they can steal the car, they'll steal the car.

they're breaking in houses and stealing food, money, jewelry, anything they can pawn that goes -- and all this is from foot traffic that's being carried on by the cartels, by their coyotes. you know, the news doesn't pick up the other night in laredo, texas, a chi quote had four individuals in the car with him. he failed to stop when highway patrol tried to stop him. he got to speeds of 128 miles an hour. he killed himself and four individuals. you don't see that on the news. elizabeth: the justice department's also a reporting a lot of fentanyl pills coming into the united states. the laredo, texas the, mayor, democrat, he's saying, mr. prime mr. president, you're spending more on things like climate change than helping us at the border. has anybody from washington called you, anybody from the white house called you in. >> no, no.

from this administration? no, nobody's call me. not at all. we get deaf ears. elizabeth: so you get deaf ears. meantime, border patrol's workload has quadrupled in many instances. talk to us more about the criminality of the drug and human trafficking cartelses hitting your region. >> sure, what happens is, again, everybody that's crossing that worder, they're paying -- that border, they're a paying the cartel to come across that border. they're not walking across without paying a toll to that. carley: tell. if they get caught without a wristband -- a coyote brings them through these ranches where they cut the fences, trash the ranch houses and then a car picks them up. most of the time these cars are stolen from houston or san antonio or austin, and they come through, they hit on the the highway patrol or the police department, they try to pull them over, they run.
