southern border is not incompetency. i would say they know exactly what they're doing and they are doing it anyway. you just played the quote from secretary yellen not being worried of losing control with regards to inflation. the average american feels like you're not in control of inflation right now and there has been so much that has come out of this white house and from this administration where the average american feels like the administration isn't shooting straight with them and spinning like this is some type of a never ending twenty four seven democratic has convention. elizabeth: he said on the scene at town hall last week he has no time to go down to the border. he spending more time out of d.c. than trump or obama did. 21 point drop with swing voters independents. the numberses went south in august after the botch withdrawal of afghanistan. we see reports there are 363 americans stranded in afghanistan, 363. >> yeah. that was one of the concerns

that we're facing is we're asking this questions of the administration. they were saying that they couldn't provide us numbers. i mean i was questioning secretary blinken because i'm a member of house foreign affairs committee and being on the financial services committee. while we were going through the afghanistan withdrawal, how many americans are still there, how many green cardholders are still there, how many siv applicant are we aware of? they kept saying all of us they can't provide numbers because they're changing every minute. tell us the number the last time you were given an update. the american people wanted candor. when they said 100, all of us scratched our head t was hard to believe then. i am happy you're getting more honesty out now but color us shock. a lot of americans felt like the 100 number initially wasn't candid. elizabeth: watch the president yelling about passing his agenda. watch this. >> so let's get this done.

important points and the average american is able to dough their own smell test and realizing, liz, what you're saying is right. it is truthful. what is coming from president of the united states, the secretary, press secretary, from the others it does not pass the smell test. elizabeth: they were honest. the president was honest. nancy pelosi is honest say i will lose, democrats will lose 14 seats in the house, house democrats are leaving. retiring or quitting to do other things that means their net margin of control is just three. they never had a man it today. they only won the senate with 13,500 votes. that is how dave perdue lost in georgia. the fact they're signaling a spending deal, putting this on the backs of small businesses who are getting hammered by inflation, supply chain issues, worker shortage and more, do they care about the american work energy your final word, congressman? >> i think they're throwing members and the bus. you have a whole lot of house democrats are in tough seats to win as it is.

elizabeth: gop calls grow for attorney general garland to resign alleging a abuse of power after the national school board association apologized and retract adler where they called basically parents domestic terrorists. ag garland admitted in testimony he relied only on that letter to aim federal firepower at parents. david spunt has more on this story. watch this. reporter: good evening a source close to attorney general merrick garland tells fox news that the attorney general and members of his team are pleased with the update the letter from the national school board association and believe it is more in line with the doj policy than the original letter from september 29th. i want to read part of this letter from october 22nd. the new letter from n sba, on behalf of n sba we regret and apologize to the letter. to be clear the safety of the school board members, public school officials and educators and students is our top priority and there remains important wok to be done on this issue however there was no justification for some of the language in the

letter. the original n sba letter dated september 29th, used the words quote domestic terrorism. that is where people got upset. five days later attorney general merrick garland put out a memo telling the fbi to work with u.s. attorneys to hold meetings regarding potential violence or actual violence at school board meetings. multiple sources familiar tell that deputy attorney general lisa monaco was involved with the memo although attorney general garland signed it. the attorney general will appear before the senate judiciary committee on wednesday. expect this topic to come up likely multiple times. back to you. elizabeth: david spunt, thank you so much for your journalism there. joining me from house transportation and infrastructure congresswoman michelle steele. congresswoman, great to have you on. did the white house abuse its powers here? >> i couldn't hear your question? elizabeth: i beg your pardon. did the white house abuse its

power to help a special interest group based on misinformation that the n sba admits was wrong? was this a partisan hit job on parents? was this a abuse of power? >> this is total abuse of power because the parents tried to exercise their first amendment. the national school boards association tried to call them domestic terrorists. that doesn't work like that. why attorney general goes out and asks the fbi to go after these parents, these parents are their constituents for the school board members and they have to listen because parents know their kids much better than anybody else out there. i think their job is to listen because these parents want to protect their children. soth is a totally abuse of power. why the fbi has to go after these parents? elizabeth: you know the emails show that the white house did work closely with the school board group for weeks ahead of time on this to help this

political ally of the president. again being called a partisan political use of federal law enforcement use of power meant for al qaeda that was aimed at terrorists. talking about the national threat assessment center, the homeland security department, you know the fbi and secret service and what parents are basically saying, listen, this isn't just about teaching students the history of racism. it is actually indoctrinating students to divide them based on the color of their skin. it was basically talking about students in that way too and toxic agenda, agendas with things like porn in school books and school libraries. but it seems like the white house didn't take the time to listen to the parents. what do you say? >> i think they should have listened to parents. as i said parents know their children the best, not school board members, not elected officials, not the government. they should not get involved but they have to listen. exactly parents want to talk

about what their children need and what kind of an education they have to teach at school. so you know what? the white house, why they get involved with it, why national schools, school boards association, they called these parents domestic terrorists. i mean doesn't make any sense at all. then fbi goes after these parents that who speak up for their children? i mean you know what? we really have to get up for, from their back because these parents know their children the best. and we really have to support them and you have to listen to the parents. elizabeth: but former president barack obama claims this is quote, phony culture war stuff when democrat parents are saying no, it's not. we have republicans saying the president and the attorney general should apologize. we have half the u.s. commission on civil rights saying why did you do this just based on one letter that had no evidence in it?

this is half the u.s. commission of civil rights criticizing the white house on this in a letter to ag garland saying you didn't cite specific examples of harrassment and threats of intimidation and violence from parents. 20 states are distancing themselves from this. should the white house apologize? >> i actually wrote the letter with our colleagues that asked for -- elizabeth: so you don't think they should apologize? you don't think, they should apologize? >> they should apologize because national school boards association apologized and our attorney general reversed the fbi directive. you know what? they should apologize and should not get involved with this because all the school systems, the local knows the best. actually parents know the best. so you know you should not get involved so, yes they have to apologize what they did and how they worked on this. and this critical race theory, this is totally divisive.

shortages, thousands of workers, according to the national wholesalers organization, they're saying hundreds of thousands, maybe tens of thousands could leave right before christmas if the federal vaccine mandate comes in. that there is an option. do testing instead right now. do testing after the holidays. or mandates. what do you say? people say lives are at risk, what do you say? >> lives are at risk. there are other options to get people safely back to work. we've been doing it throughout the pandemic. health care workers in particular know how to keep themselves and their patients healthy. there is testing options. there is personal protective equipment. we know how to do this. bottom line we have way too many products americans need sitting on ships right now. they're stuck outside of our ports. there is a shortage of not only truck drivers and dock workers,

warehouse personnel, people driving not only from the port to the warehouse but the warehouse to the grocery store. there is nobody at the grocery store to stock the shelves. when you force literally hundreds of thousands of people out of the workforce it is going to exacerbate the problem. it will make our hospitals less able to help the needy and it is going to make our communities less safe because our first-responders will be put on the sidelines. >> "biden rule" says the federal contractors, even if they're working at the ports there is no option for them to say just test me instead of getting vaccinated. that is what truckers are warning about too. you can't vaccinate an army of truckers. we're already short 60,000 truckers. vaccinate in time for the holidays, this could be a real problem for the white house running up to the holidays, you know what i mean? listen to governor ron desantis. governor ron desantis is saying florida could rescue christmas. one hundred boats stranded off

♪. elizabeth: joining us now "daily caller" editor, vince collagnese is brac with us. vince, here's the story. special counsel john durham is about to turn over a pretty extensive fbi electronic file to indicted democrat lawyer michael sussman. he accused of lying to the fbi on trump russia. the fbi concluded there was no secret internet back channel between trump and russia's alfa bank. will durham find that the democrats knowingly planted a false story at the fbi? >> i think he will, i think he will and the reason for that is because john durham has a reputation for a very serious and detailed person. this is not a small deal that he decided to go after one of hillary clinton's lawyers, michael sussman, for lying to the fbi. you don't go after an attorney

like this at a very high-powered law firm unless you have your ducks in a row and i think john durham does have his ducks in a row. now he has to provide the evidence that it is true that the hillary clinton campaign with its attorneys manufactured a hit on donald trump to suggest that he was somehow connected via trump tower to alfa bank in an act of collusion. john durham saying there is no evidence of that and in fact the evidence is that you manufactured this and lied to the fbi. i think this is a big moment. we all await that evidence. elizabeth: alfa, this was supposed to the democrats of silver bullet of trump-russia collusion t was reported in the media as fact. alfa bank and russia was saying it was phony. that there was not a internet back channel. this was trump marketing hotel spam email. they had a computer scientist on it, from three companies working

on this. university tech he can period o, someone accessed executive branch data, the pentagon darpa to try to prove this. this seems like a conspiratorial push to get trump nailed over trump russia when evidence didn't exist but they tried to use power in the government to do it. what do you say? >> this is awful. what you have is hillary clinton back in 2016 and her campaign, they have access to the levers of power of the united states government and they used them against a private citizen, her political opponent, to manufacture evidence and to delegitimatize him not only during the campaign but during the four years of his presidency. this is a gross abuse that deserves to be fixed and the american public, it should not be a partisan matter. it should be completely outraged at the behavior of our institutions to be weaponized in this way. i hope john durham gets to the bottom of this. elizabeth: hillary clinton team
