year. the state claims he murder to of those people, the defense claimed the teen was protecting his own wife and others. very soon, a jury of 12 will decide his fate but how did we get here and what happens next? joining me live from kenosha, wisconsin, garrett is live outside. >> great to be with you, the case is not in the hands of the jury who will decide if kyle rittenhouse of vigilante for rocco to her as prosecutors claim a victim simply defending himself from folks trying to do him harm as he claims. the judge made it very clear to the jury during instruction that claims of self-defense will be a deciding factor in their deliberation. >> who's acting in self-defense. reporter: prosecutors aimed to weaken his claims of self-defense by arguing he was the aggressor and provoked

joseph biologically pointing his gun toward him moments before he was launched at. >> under wisconsin law, you're not allowed to run around and.your gun at people. this is provocation. this is what starts the incident. the defendant rushes in and points the gun and one of the things to keep in mind is that when the defendant provokes the incident, he loses the right to for self-defense. you cannot claim self-defense against a danger you create. reporter: in their closing arguments, the defense fire back calling it a political case with prosecutors rushing to judgment and trying to create a narrative that ignores the fact of what actually took place the night of the shootings. >> kyle shot joseph to stop the threat of this person. i'm glad he shot him because joseph got the gun, i don't for

law enforcement needs help responding to any unrest. kennedy: so obviously we've seen a big show of force preemptively here with national guard and state and law enforcement but residents are worried there will be people coming in from out of town to engage in the protests kyle rittenhouse is in fact acquitted. what are you hearing? >> we saw it last time, folks came out from chicago to the area to take part in the protest but devolved into riots. it's always a concern but we also are hearing overhyped, local leaders come out after the fact and say this is caused by folks from outside of our community, there's no way folks from here would be doing this. we learned later on that it is mostly a lot of folks from the area in

the larger debate as a whole. i know jacob blake, his uncle, i was talking to him earlier this week and they are having planning to have folks later this weekend this weekend regardless of what happens in the verdict but he said he feels strong jury needs to come back the right decision in his words and if he doesn't, folks are going to be back out here. kennedy: stay well and it's going to be different this time, protective of the town where they live and also people who want their businesses, it's a critical time of the year when many of them are going to be profitable for the first time this year. garrett, thank you for your reporting. appreciate it. the trial is now in the hands of the jury. who scored the most points? to break it down from official

attorney, author of how to become a federal criminal, mike chase is back. you've been following this very closely and many trial waters have seen the prosecution's. their estimation has falling apart. what you think? >> there's a lot of evidence that did not come in while for the prosecution, witnesses go south and there were times where the defense did what a good defense dust, they turned the case into a defense case the witnesses felt like different witnesses during the prosecutor's case. things did come together at closing today, prosecutors to refine their case a bit based on a lot of problems in their case. kennedy: how much ground from the prosecution make during closing argument? in your experience, has the jury at this time made up their minds or is there a way for them to knit together pieces of the

trial there will be enough to overcome reasonable doubt next. >> anybody who has worked with juries, confirmation bias is an extremely powerful verse on juries, they form opinions early but in my experience, juries do go in and take it very seriously and look at all of the evidence. can you fix an entire case on closings? probably not. these were exceptionally long closing from the government state asked for two and a half hours, basement every second, maybe more and it extremely long battle. when you're dealing with beyond reasonable doubt, if you have to talk about one, maybe you have improved your case beyond reasonable doubt. kennedy: interesting. they do have to prove intentional and reckless homicide, one of the differences between those two charges and how likely are they, either one of them, to stick? >> the first one, intentional murder, and it can be a small

amount of time they have to establish that kyle rittenhouse intended to kill these people and that was his design, his purpose to kill them unlawfully without privilege as they say here but that means without justification, self-defense. recklessness is a little different and they spent a lot of time on that, basically trying to establish that because he used full metal jacket bullets capable of flying through the intended target and potentially harming innocent bystanders they say, but that was so dangerous he should be found guilty of a crime. recklessness could be viewed as a compromise verdict if the jury was so inclined but intentional murder is an extremely high burden to prove beyond reasonable doubt. kennedy: how effective was kyle rittenhouse when he was testifying on his own behalf, was a mark moved by the defense based on what you have seen, has it paid off? >> in self-defense, the entire case turns on what was kyle

rittenhouse thinking in that moment? grown footage after the fact was he thinking about in that moment? was he fearing for his life? the jury is going to want to hear it and even if they are not allowed to enter jury instructions, they are going to read into the fact that he didn't. a lot of defense wires will run but i think this came together very well. as a witness, he held up well on the stand and we will see if the jury was. kennedy: there are a lot of people who have only been tuning in in the later stages and really only took a peak while rittenhouse was testifying and people i've talked to were moved by his testimony but there are some, this is a divisive case and summer on the left who have decided kyle rittenhouse's guilt and say the judge has a bias in favor of the defense. what do you say?

>> i think if you take every ruling by the judge piece-by-piece, he would seek consistency listening to the arguments of the respective parties, take politics out and maybe these were defense rulings but all the lawyers had an audience with this judge, denied motions and rented motions, ultimately what ends up happening both sides got to prove a case they set out to prove and we will see if the case is convinced either way. kennedy: it will be interesting and we will see how it changes how defendants are charged in the future here. thank you so much. in kenosha, of course, why we are witnessing for trial last year, more than 30 businesses destroyed and another 80 damaged after police involved shooting of a black man. businesses are once again boarded up and one owner whose business was burned down last year says he's worried about a repeat.

role, there were people on social media were surprised everyone involved was white. they were convinced that was racially divided, i don't know what this has to do with race people are so ill-informed and it was great listening to your previous guest who is an attorney but the amount of wannabe lawyers on social media who are exacerbating households and etc. from we have to hope kenosha does not have the same problems did posture. we have to stop as a country regardless of any critical judicial outcome. we have to stop treating couples probably property and livelihoods and businesses, regardless of what happens from have to stop allowing this to take place. kennedy: i have to agree with daniel, chris. he got responsible business owners and they've done absolutely nothing wrong and they are protective of where they live. a lot of them are trying to make

the community a better place, why should they be targeted like this? >> they should and it's unacceptable. if the verdict goes the way you want or not, that's not how we settle our problems in the u.s. we go to court and we could protest and elect new leaders but we do not burn down cities because we don't like a judicial ruling. it's a job of the judicial system, those who do it should be condemned by everyone on both sides, we should all hold hands and condemn people who got to the street and commit violent acts because of a political or judicial decision, that should not happen in this country ever. that doesn't mean people can't protest or voice their concerns but burning down buildings and running people's livelihoods and hurting and killing people, that should not be happening so i'm with you on that.

for what's going on in this case, i been watching, i am an attorney, i do not believe he's going to get convicted of murder one. i do think he might be convicted of reckless murder charge or another lesser charge but i don't think they got him on murder one through this case. we will see. i always say but for his actions these people would be alive today and the answer is clearly yes. but he claimed self-defense? on the reckless charge so we will see what happens. kennedy: that's interesting because a lot of people saw his testimony as i was talking with chase a couple minutes ago and they saw something completely different. they see someone who was acting in self-defense and it's very clear for them, what you see here and why is it so different? >> ics carotene trying to protect the community they worked in and they knew and loved.

>> yeah and the problem is it incentivizes the market so strengthens the market and that is a problem. kennedy: yes, cartel loves that because hartel are still growing weed in california and having a great time with a robust market and you can tax yourself into a real problem when you go too far. it's interesting because you pointed out some of these democrats sponsored bill don't let everyone out. they do have quite a few exceptions to the relief aspect of this. >> absolutely. the senate version actually prevents people operating state compliance medical dispensaries prosecuted federally from obtaining relief because they have employees working for them. any canvas company today would qualify for that exception and not get relief. kennedy: isn't that interesting? that is cory booker's bill,

correct? >> correct. kennedy: he's been on the right side in many ways and he was one of the few people during the 2020 presidential contest pushing some of his other candidates and we thought we had seen an evolution on the part of the president, former president but the va during the biden administration not being helpful in terms of research and prescriptions for veterans who want to use medical canvas for things like ptsd chronic pain, are you surprised by that? >> not really. got federal records and until the records are expunged, they are not free to fully live so i don't who's going to embrace this at some time but the fact that there are so many republican cosigners to the bill, do you think it helps push it through the house? >> absolutely. it provides an opportunity for bipartisan compromise. this is a very good bill and a lot of people were surprised a republican would have these ideas about prohibition i am very happy and a historical opportunity because it's the first time in history both parties introduced legislation to end prohibition. kennedy: and you've got cosponsors from states where there is legal recreational marijuana so it's not a huge surprise. it has to be rescheduled and decriminalized if we are ever going to get past this what is
