[laughter] they filed for a mistrial with and without prejudice. explain what those motions are and what prejudice means here. >> they have to to protect their record. i don't think they are actually saying they don't want the acquittal, they want to be on record objecting to certain events that have happened they view as prosecutorial withholding evidence and etc. so without prejudice, it's a mistrial but we are going to be back here and retry the case. with prejudice, they are asking the judge to say my client didn't get a fair trial and that should be the end of it but i think they're just trying to make a record which is good because i want to make clear they've objected the way it's gone. kennedy: when what the judge will on that?

is he waiting for the jury to come back? how does it influence how he rules there? >> judges love to avoid tough decisions the if they don't have to make them. kennedy: especially in a high profile case. >> absolutely. if i am the judge, i've got your motion, i understand but let's pray we can get to a place where i don't need to act on it. so far the jury has not given them clues where they are headed so you may have to make a role. kennedy: has the jury given a lot or just a few notes compared to other juries and other high-profile homicide cases? >> this is a quiet jury. three notes over three full days of deliberations without real indication of what's going on, that's not a lot of communication. sometimes you get notes that say what if we agree on two counts but having a tough time on the other three? i was a tomorrow keep your eyes

peeled for any notes that suggest they are at an impasse and haven't been able to reach a decision that will be the big moment. kennedy: what is an allen charge? for the judge do? again, how does this much media coverage and interest in the fact that the city could potentially burn again pending on the outcome, how does that influence the judge running the jury back into the liberate? >> let me tell you one thing, these courthouse, judges talk about a 100-year-old courthouse, these are not skiffs in the u.s. congress. they are not soundproof. in all likelihood, the jurors know full well what's going on outside. when they are in deliberation, is a good chance they are hearing the ruckus outside so i get concerned they will be attuned to trying to affect public opinion but an allen charge, that will come in place if the jury says we cannot reach

a decision, we think we are hung. the judge is now allowed to give a charge the lawyers will fight about what he says but he was a basically if you are in the minority, i want you to go back and rethink your position and see if you can get to a verdict. it's a dicey situation but it happens a lot of trials. kennedy: what happens if it is a hung jury? >> if they are hung, effectively there is no verdict and i think at that time the judge will consider the mistrial motion but if you get to a position where mistrial is denied and jerry hangs on certain counts, we do this all over again and who knows if it goes back to judge schroeder if we get to see the inside of a courtroom again, he's not sure if he wants the media watching what's going on so if the jury hangs on some counts, they can retry their but if they hang on all counts, who will be back here again. kennedy: let me quote holly,
