dollars bail. this person, violent criminal, never should have been walking streets of wisconsin. he ran over six people, now a child is dead. injured many seriously with a christmas parade in wash shaw wisconsin. he has been charged with6 crimes since 1999. he has a criminal record for two decades. >> several children were sent to children's hospital besides the one just passed. this guy had a 2020 reckless endangerment charge, fellly criminal possession a long criminal record. two weeks ago he was let loose for $1000, basically running over the woman with the same car and having felony bail jumping charge. having a warrant in nevada. when you talk about pretrial detention, based on two things, risk of flight and danger to the community. this guy rings every possible

bell for each of those prongs. had no business being out on the street. any prosecutor and any judge that winked and nodded let him out should have a day of reckoning for what happened that day. elizabeth: he has not filed his plea yet. we'll monitor the swaying as it unfolds. back to you, thomas, turn to kyle rittenhouse. kyle rittenhouse faced two million dollars in bail, versus brooks one million dollars in bail the last go round. there is this, thomas. does rittenhouse have a defamation case against the media and then candidate biden for erroneous claims against him. >> defamation cases are difficult to prevail. i tell that to my clients all the time. you have to show it was a statement of fact. you have to show actual malice. it is very, very difficult to win on defamation cases in the united states. from my perspective i think really his most effective rebuttal to all the things said about him, many which were

false, the most effective rebuttal the jury's verdict. in my view the jury's verdict acquitting kyle rittenhouse speaks far more powerful than what any lawsuit could. elizabeth: rittenhouse and his attorney believe this is actionable what happened, false attacks on rittenhouse, what do you say? >> i think it is. i don't you have to have actual malice because he was not a public figure at the time this happened. there are different gradations you have to show by the way of the defamer based on your status in the society. i'm not sure it will be the most uphill defamation case. just like with nicholas sandmann, people that are demonizing someone that has not gone through the judicial system, calling out because they have a an agenda, basically their own narrative as opposed to evidence they deserved to be called down sometime. he should take a deep breath, get on with his life a little bit. unleash a couple lawyers to go

with defamation. a lot of folks will have to pony up. elizabeth: in this case seems like there was no presumption of innocence. no thought of due process, trial by jury, proof of guilt beyond a reasonable doubt. with rittenhouse like accusations are tantamount to convictions in the media and with democrats. thomas, they could not identify specific plays in the process. they just disagreed with the outcome. what do you say. >> there is a lot of truth to that. no secret what a lot of people saw kyle rittenhouse what unfolded that night through a particular lens. that it fit a preconceived storyline. fit a preconceived narrative they had. to your point, all the wonderful constitutional protections some folks are quick to champion the presumption of innocence, proof beyond a reasonable doubt, funny how so many of these great constitutional concepts and protections get thrown out the window when the defendant is someone they find unpalatable.

elizabeth: to thomas's point. nicholas sandmann won a 275 million-dollar settlement with cnn after it did false reporting on the the confrontation with a native-american during a d.c. school trip. watch kyle rittenhouse on this. watch what happened with tucker carlson last night. >> mr. president, if i could say one thing to you, i would urge you to go back and watch the trial and understand the facts before you make a statement. >> that is not a small thing to be called that? >> no. it is actual malice, defaming my character for saying something like that. he crossed state lines. false. he is a white supremacist. false. none of that is true. and the lies that they can just get away with spread something just sickening and it is a disgrace to this country. i have really good lawyers who are taking care of that right now. so, i'm hoping one day there will be some, there will be

accountability for their actions that they did. >> okay. so you're intent, you will not let at that at let that go? >> like i said i have really good lawyers handling that. elizabeth: really good lawyers handling back. back to you, i'm going back to jim, jim, you're looking at the statements, media false statements about rittenhouse. candidate biden called him a white supremacist. they really poisoned the well and the national conversation on this because when you go out to talk to people about it they don't understand the facts of this case, how badly america has been misled on this? >> i think special recognition here for joe biden in this process. i guess even recently the vice president, because when people that are at the highest reaches of government weigh in and prejudge. we've had several incidents of this in the last few presidencies, where they weigh in, announce they figured it all

out before somebody is even charged or gone to court that is damaging for the civil. it is feeding into the emotional, virtual mob as well as the actual mob on the streets of kenosha. it's a terrible idea no matter what they think. these people should be upholding the criminal justice institutions saying let's be reasonable, rational. let's let the process play out. but instead for cheap politics, you have people denouncing, 17, 18-year-old kids, hoping to get away with it without any recompense. godspeed to kyle, i think he needs to go ahead to file away on the civil suits. elizabeth: tom, the president campaigned on unifying the country, right? the media reported that too. it was great he would unify the country. now both of them are splitting the country with false accusations. what do you say? >> i think one of the best ways to unify the country to hold your fire until you know what the facts on the ground are. when you jump out this preemptively announcing conclusion before evidence comes in, before facts come in, i

other countries grappling with this challenge. reporter: awe few weeks ago companies were making too much money, therefore they were gouging. bottom line for the ranking member on the senate energy committee. this is a biden caused disaster. senator john barrasso in a statement to fox business, president biden severely limited or restrictioned access to natural gas resources on federal lands and waters. at urging of activists and environmental activists they are starving banking resources for companies looking to drill for natural gas. senator toomey says the administration needs to reverse the energy policies. >> we may transition to widespread use of non-carbon emitting sources of energy and transportation and power and such but we're not there right now and as current prices show us, we to continue to make sure there is a reliable supply of the energy that we need for daily life. reporter: the treasury secretary

is now saying elevated inflation in gas, food, other things will last through the first half of next year. back to you, liz. elizabeth: edward lawrence thank you so much. good to see you. look who is back with us now, price futures group senior analyst phil flynn. we're looking into the government paperwork on this, phil. i know you've been studying it too. the oil, by drips and drabs coming into the u.s. economy starting in december through april of next year. it is only 50 million barrels. how much, combined with that, are the other countries doing, how much will this really move the needle? >> not at all. to be honest with you, when you look at 50 million barrels, you look at that in terms of global supply it is about 12 hours of supply. so you know, if you cooked a couple nothing burgers today you probably wasted all of that oil already and if you look at the other countries it is hard to know exactly what they're committing. the only one that gave us a hard number was actually india.

they said they would release five million barrels. five million barrels really isn't that much. oil tried to release oil from the reserves before a few months ago that backfired. it actually drove prices actually higher than they were before and they had to reverse course because they were running out of supply. elizabeth: here is the thing, energy secretary granholm doesn't even know, she couldn't answer today how many barrels per day of oil that the americans consume. it is about 18 million. if you're talking five million out of india, 50 million out of the u.s., i mean there is 1.6 billion, 1.7 billion barrels per day used. this is nothing. so this feels like window-dressing. feels like another opportunistic biden move, just to look good for holiday travel? >> this is headline. look at this i'm trying to save the gasoline prices, evil oil prices, nice i will release

50 million barrels, i don't think most americans realize how small that is. when you impact a global energy market next year will consume 100 million barrels of oil a day, this will not do anything. this is to deflect blame because higher gas prices go, lower poll numbers. elizabeth: feels like the policy shop is empty at the white house. the washington post is reporting that biden is going on the offense to stop his plunging polling numbers. on tunis i cannily blaming everybody else. say sicking ftc to go after oil and fast companies. blaming meat process oars for high meat prices. blaming companies not moving off goods off shipping dock fast enough. taking fewer and fewer questions as he continues to avoid interactions with the press.

now a child has died. they are victims of the christmas parade massacre in waukesha, wisconsin. these, he is going to face six charges of intentional homicide. five million dollars cash bail. how do you stop the soft on crime policies? can victim families sue? what do you think? >> unfortunately prosecutors like judges enjoy what's known as absolute immunity and that is a very fancy way of saying you cannot sue a prosecutor. you cannot sue a judge. anytime the judge or the prosecutor is exercising a judicial function. so the short answer is, you cannot sue a prosecutor, for example, for making a mistake and letting someone out either on no bail or 2-dollar bail. that person ends up going out and now killing a 6th person. elizabeth: so can they sue the

city? this guy has been charged with at least 10 violent crimes since 1999. can they sue the city? >> interesting question. there is a difference between being able to sue a prosecutor or a judge which you cannot, and being able to sue a government official which you might be able to. what you have here with a government official is not absolute immunity but something called immunity. it is exactly what it sounds like. you cannot sue a government official who is exercising a discretionary function. in other words, the decision whether or not to do something, something that is not ministerial. you cannot sue unless, as a result of that action or inaction you violate someone's statutory or constitutional right. it's a fancy way of saying maybe. elizabeth: what is a bigger violation of your constitutional rights than being mode down by

an suv at a christmas parade? that is major violation of those families rights. can they sue? what would you do in that case? >> well, it is a very, very interesting question the way you pose it because the oddity is, from a constitutional standpoint, it is not necessarily the victim that is protected by the constitution, it is the defendant. and here in addition to having the fifth amendment rights not to incriminate one's self, the right to be indicted by a grand jury, sixth amendment right to counsel. elizabeth: the constitution protects life and liberty. this guy took that away from them. i think -- >> agreed. elizabeth: i think they have grounds to sue. you have lawsuits like this against other municipalities across the country. this could happen. >> you would have to establish again, you would have to establish either a very clear constitutional or statutory

right that has been violated and anytime you are suing you run into the issue of things like notice, did you know, did you have reason to know before you acted or didn't act but to my earlier point, it is actually the defendant here has the eighth amendment right not to have excessive bail set. go figure that one. elizabeth: this will infuriate viewers and people out there. we have a child now dead. we have 17 children still in the hospital, many with serious injuries. six people now dead. how do you stop this? this has got to stop. >> i'm saying this now as a criminal defense attorney where the better my client does with bail or no bail, the better i look but now i'm speaking as a human being. as a human being bail reform, this into knee-jerk reaction to not having jails overcrowded with people waiting for trial who can't raise 50 or 100 or $500 bail, the knee-jerk

reaction was growing water on agrees fire, you don't it. when you take away discretion from a judge to set bail. when you take away discretion from a prosecutor to take away bail, now this is what happens. elizabeth: democrat rashida tlaib supporting new legislation to free everyone from prison. wants to let everyone out of federal prison. massively leaks of private taxpayer information. in this case, to "propublica." already it's a occurring again this year. the irs was caught targeting in a non-profit based on their biblical teachings. as you know we've seen thousands of private taxpayer returns over 15 years leaked, this time again to "propublica." there are two worries for americans. one, will their personal and business bank accounts be surveiled by the irs? secondly, will the irs be tar the ifing again americans based on their beliefs? i believe that is the case. in both cases americans risk this. elizabeth: you know what happened, congressman? you know, the obama era targeting of conservatives, right? it was way worse than anybody ever realized. so sometime in 2013 it was reported to be under, under 300 groups, conservative non-profits, picked out for extra you know, scrutiny to get

tax-exempt status. 296. there were 466 groups. the conservative northern profits were scrutinized three times more than liberal groups. worse than realized. you guys on ways and means, you have work cut out for you. >> you may recall that scandal caused two irs commissioners to resign and lois lerner to resign as well. now we've seen tens of thousands of potential tax returns leaked to the media as well. so the worry here is unleashing 80,000 new irs agents. they will be focused not on the wealthy and not on big corporations, on farms, ranches, small businesses, for the most part. and then the irs surveillance targets frankly everybody. so americans ought to be very concerned because the senate and the president are still pushing for the irs bank surveillance to be put back in this big

4 trillion-dollar spending bill. elizabeth: so lawyers investigating what the obama era did, the irs did under obama, you know they went after liberal groups in its operations to try to soften perceptions in the media of political bias. we saw that, you know, i covered this story when i was at "the wall street journal." kennedy, john f. kennedy's irs commissioner cap lynn, he told me that kennedy's irs targeted daughters of scion, daughter the of the american revolution when they targeted tens of thousands of conservative non-profits. why do they do that? kaplan said to avoid appearing bias, partisan in the press. you have your work cut out for you. they could make move like that, to cover up what they're doing behind the scenes. what are you saying sir? >> we have to stay on our toes. that is one of the top priorities from the ways and means committee. there is no question. look, the obama biden

>> liz, they can enforce the laws on the books. look what we're seeing is natural and expected consequences what is effectively the decriminalization of theft. there is no respect for private property. look, this is organized crime. that is the only way to look at it. may not be the traditional organized crime in the sense of the mafia but these are planned, this is coordinated, this is tearing apart the very fabric of society. it started last year in 2020 when our leaders, effectively said look, it is okay to go ahead and commit looting. okay? we're not going to enforce the laws on the books. guess what happens when you fail to enforce the laws. you take away the disincentives to commit crime. when you take away the disincentives of committing crime, crime goes up. it is natural. it is to be expected. it is lunacy, not to enforce these laws. elizabeth: let's stick with this. lapd is now warning as you give,

you know, give, say shoplifting we'll not prosecute it, we'll bust down shoplifting charges to just misdemeanors if it is under $950 in theft, they're saying this is a gateway to more crimes including at-home robberies and street holdups. lapd is really warning and worried about that. what do you say? >> yeah of course, it's a gateway. these are not just thefts. this is actually a burglary. when you go into a business, you have the intention of taking they're property from them, that is the definition of burglary. we're not talking about petty theft here. look, the legislature is the proper entity to decriminalize anything. when prosecutors do it by fiat, basically that says look you can do whatever you want. elizabeth: why do they get to be the loudest voices in the room, not victims, not taxpayers? how dare they fall down on what their job is supposed to do! they have a duty to protect.

now we see shoplifting charges, conviction rates dropping under the d.a. office in san francisco and los angeles. charging rates dropping out of san francisco, duis, hit-and-runs, petty theft, weapons, assault. who do they represent? do they represent anybody, or just those that will get them back into office? >> to borrow a phrase, elections have consequences, don't they prosecutors are asleep at the switch. it is dereliction of duty, a violation i think of the oath they take to protect and serve their constituents. when you allow people to, basically ignore private property laws and you have no respect for the concept of private property, like we've talked about before, society disintegrates. our system of laws is based upon priority property. elizabeth: when you talked about -- you're right it is based on priority property. we talked about this during the
