[laughter] joe watkins in kentucky, he pretended to be dead in a pool of fake blood is a halloween prank on one of his workers.

they ran out screaming, called police leading to his arrest for the false report. how do you defend him? >> so my client is facedown laying in a pool of blood and she runs out screaming and called police and says he's dead and my client is charged with the false report? i don't think so. the only reason she make the false report is because she didn't do the decent thing and check to see if he had a pulse or if he's okay when you work in food service, you got to get used to seeing dead bodies on the floor. kennedy: that's absolutely right. i know is, how do you rule on this? >> not guilty and if necessary by jury nullification based on how they are dismissed halloween pranks. kennedy: very good. doug. >> not guilty. it's clear mr. watkins has no criminal intent and it was recklessness, it was the woman
