right now. ♪. elizabeth: thanks for joining us. you're watching the fox business network. we begin with the senate. it is going to vote this week on a senate gop resolution to reject president biden's vaccine mandate for large businesses. aishah hasnie has more. ashiah. reporter: liz, good to you, it is bipartisan resolution because democrat senator joe manchin who cosponsored this bill to kill president biden's federal vaccine mandate on private businesses this is what he says, quote, i have long said we should incentivize, not penalize private employers whose responsibility it is to protect their employees from covid-19. so this vaccine mandate targets businesses with 100 or more employees. the rule goes into effect january 4th. that is coming fast. it affects about 84 million workers nationwide. now critics say there is just

bad economic policy amid a disappointing november jobs report and also rising inflation. bipartisan resolution manchin is it putting out might turn out to be more of a messaging move though. we don't know that speaker pelosi would actually bring it to a vote on the house floor. now moderates could force a vote if there is more than 50% support among house members, they could force it, even then, we expect the president would simply veto that bill. that is not stopping efforts to derail this controversial policy after failing to pass an amendment to defund osha's enforcement of this mandate. senator mike lee of utah is promising that he is not relenting on this. >> it is going to come back again. every time we get the opportunity. in the unfortunate event the president persists keeping this in effect and threatening the american people this way, yeah, it will come up again.

reporter: in the meantime others are counting on the courts to come through as multiple courts ordered stays on enforcing the policy for at least federal employees outside of the military. keep in mind osha is incredibly understaffed. we're talking about only 1800 inspectors to oversee millions of employees across the country, 130 million workers. it really doesn't make sense how they would be able to enforce this federal vaccine mandate unless you had people who were basically calling in and tipping people off that their coworkers weren't vaccinated. liz? elizabeth: right, snitch usa. ashiah, great reporting there. thanks for joining us tonight. look who is with us now, dr. larry buschon and dr. greg murphy from the house gop doctors caucus. first to you, congressman buschon, we'll ask dr. greg murphy the same thing, what is

your forecast on the senate vote? >> well i think it is going to pass. the congressional review act only take as simple majority. with senator manchin saying he is voting for it, it will pass. i'm a cosponsor of hj recent 65 on the house side, the companion. i agree with the prem his this needs to be repealed. unfortunately the president has veto power over this legislation. elizabeth: nothing in the constitution, dr. murphy, gives the white house the power to dragoon federal agencies into enacting a mandate, a central bureaucrat you know, d.c. mandate on private countries outside of the legislative, circumventing the legislative power of the congress, right? so that's what is at stake here. isn't that the issue? go ahead. >> liz, nothing as far as president biden has done, several times he stated in his

presidency we don't know whether is constitutional or not but i will go ahead and proceed with it. close to 200 million people in the country are vaccinated. 90% of the at risk individuals 65 or older are vaccinated. time to move on. we can't continue to penalize small businesses or businesses for that matter, especially give the anti-business economic policy that the biden administration has pulled through. i think these things get thrown out by the courts. it is heartening to hear moderate voices over in the senate are willing to take a stand to throw this thing out. elizabeth: we hear you. congressman buschon, outgoing lame duck mayor of new york, bill de blasio, mandating a private companies without a testing option. no forewarning, no debate, whether it is legal. the incoming mayor eric adams has to deal with this. it feels like a alexander haig and nixon moment. all of sudden he is pulling this. dr. fauci says the omicron

variant doesn't appear as dangerous as thought. the white house fast tracking potentially more potent vaccines. what is going on with that? >> i would agree it is an outrage discuss policy and unnecessary and possibly not legal. it will further damage new york city's economy but here's the thing, covid politics is good for democrats historically. there is a lot of virtue signaling going on whether republicans care about people. that is what this is all about. it is an outrageous policy as dr. murphy mentioned. it is time to move on, open the economy and quit the political bantering about the covid vaccines, about the covid virus, and politicians need to step away and allow the american people to get back to business. elizabeth: it is the blame game, dr. murphy, "politico" reporting even democrat internal polling numbers has the president going down in battle ground districts across the country where half

the voters don't like the job he is doing. he is underwater in the battleground states of pennsylvania, north carolina, arizona and nevada. you know, they're taking the blame game to a whole new level, dr. murphy. now the new line of attack is blame republicans for prolonging the pandemic. what do you say to that? >> it is comical to be honest with you, liz, outright comical. i don't think that the white house press secretary has a very good job because she has to put lipstick on a pig. this is just ridiculous. the fact this he would attack republicans for prolonging something they themselves have exacerbated is simply absurd. we need to get back to things. the whole thing about the omicron variant got thrown out crazy by the media and white house long before we knew anything about it. let's move ahead and stop the stupid policies this administration is moving forward. elizabeth: congressman buschon, they're blaming the pandemic for inflation, supply chain, bad jobs report, blaming the

pandemic for smash mob looting. the messaging has fallen down the bed down the stairs for the white house. any politician knows they need a clear adversary to keep winning and the president is not having one. now but they are going now getting vaccine. >> answered verses versions of this question before but we feel here covid still has an overlaying effect, impact on people and how they're seeing things day-to-day, for good reason. elizabeth: okay. congressman buschon, what do you say? >> well first of all in polling for democrats covid continues to be the number one issue amongst their constituency. that is why they're saying these things. reality is the reason we can't get out of this because of the oppressive policies this administration continues to impose like this mandate for health care workers, for example, which led a letter today with congressman buchanan today against. you know they're stymieing oil and gas exploration in the united states, getting us to where we're not energy independent, threatening tax increases on americans, and american businesses. they need to look in the mirror when they see why the economy

won't get back on track. elizabeth: quick final word, bret stephens makes the point, there was irritating obnoxious kind of attack that the covid-19 pandemic was taking off like wildfire in the red states. now "the new york times" is actually saying no, it is taking off in the blue states and new mexico and in vermont and minnesota. where florida, alabama, louisiana, the red states are seeing it dropping that was always a obnoxious line of attack to go after red states they're causing pandemic after, that is what we're seeing in terms of that storyline being flipped, dr. murphy. your final word? >> the virus itself is not very political. the fact that they have tried to make it political. the fact this is not going away. it doesn't care whether you're in a red state or a blue state. we need to stop running from this thing. we can't realize, we have to realize we have to start living instead of fearing of dying. it will be here.

multitrillion dollar reconciliation package they keep pushing. is it one and done? i would hope so before any additional regulations, anymore inflation, anymore control mechanisms to put on people. i think they will have a very difficult time passing anything before the end of the year and i keep hearing from the senate they're asking what the actual costs are related to this bill, something that the house democrats didn't really ever seem to get an answer to nor require it before they passed it. elizabeth: it was an achievement to get infrastructure done, right? even when republicans were controlling both chambers of congress they couldn't get one under the trump presidency. this may not happen because the midterms are coming up. congress will have to raise the debt ceiling by september 15th. the biden agenda may be done and over. your point about inflation is important. economists are saying this. the federal reserve, treasury secretary, all warning inflation will remain stuck above 2% over the next three years. listen to senator john kennedy

♪. elizabeth: let's welcome back to the show former white house national security advisor, he is retired lieutenant-general keith kellogg. general, it is good to see you. with re heading into a new cold war with russia and china? >> yeah, liz, i think we're already there. if we're not there we're fast approaching it. here is what -- i think we have cree crises on our hands

simultaneously. you have got the iranian nuclear deal trying to renegotiate that. that will not work. you have china and taiwan but the most current one facing us right now what is happening with russia in ukraine. if i was advising the president, i said you need to think about what is put putin trying to do long term? you have to understand to what he is doing to operate well and respond to him. putin looks at himself as the newest version of peter the great. when you look at him, what he is doing right now, looking at the russian constitution, he can serve as president until 2037. that is longer than any russian ruler, modern russian ruler. longer than stalin. longer than katherine the great and a little longer than peter the great who is his role model who was an expansionist czar going forward. he looks at himself historically and i would tell the president you need to think how he would react to this, trying to do

something, remodel europe the way he wants to look at it. long term he wants to break nato. he is doing a pretty good job of it. talk about that. elizabeth: there is talk of fresh sanctions on vladmir putin's inner circle and on russia's energy producers. also potentially cutting off access to the swift international global communications system for, for you know, for the, for banking. the white house can't just knock out russia from swift. it is based in brussels. the u.s. has no jurisdiction over that. by the way it is mostly a communications system for indicating wire transfers coming through and the like. they need to go through with the eu to go along with that. eu is likely worried russia so retaliate and cut off the oil and gas supply right? >> that is exactly right. 60% of europe depends on russian energy. if the nord stream pipeline gets approved, 80% of the lng, liquid

natural gas germany uses comes from russia bypassing ukraine. he has them over a real economic barrel. he knows that. he is applying all the pressure he can. we're sitting in washington will apply pressure on us. long term if he can break the eu, he can do it economically. that is in his long term gameplan. we're playing checkers, and he is playing chess and he knows it. he has been through four u.s. presidents. elizabeth: finish your thought. >> he has been through four u.s. presidents already. he knows biden is not a strong leader, what happened with four years with obama and biden. when we lost ukraine, when they took crimea from ukraine. knows he is not a strong player in the international community. he does it as well as he can. he is a strong enemy and crude and ruthless leader. >> nothing stopped the russia

taking crimea in 2014 including the president's diplomatic efforts. we're waging a war on oil and gas somehow asking russia to produce. somehow oil from russia is better for climate change than u.s. oil. i want to get your reaction on this. china is threatening retaliation after the white house announced a diplomatic boycott of the beijing winter olympics. it is also china is reportedly launching a potential military base off the coast of africa. your word on this? >> look. i think it is about time that president biden stands up and says hey enough of this. we're not going to tolerate it. i was fortunate enough to serve four years under president trump and vice president pence. they wouldn't put up with this kind of stuff, not at all. they would believe in work in asymmetric way to push back on this, do something that would make life difficult for chinese, russians, and the iranians. building the base on the western

part of africa. they have a base in djibouti part of debt dep employment sy. when the chinese go out to help you they are making a move to support themselves in the future and hurt you. look what they did recently in uganda. uganda couldn't pay the debt that the chinese incurred upon them. so what did the chinese do? they took control of the only international airport, entebbe international airport in uganda. they will do the same thing potentially in the panama canal because they own both big warehousing and ship facilities, both western and pacific and atlantic end. this is just the way they operate. and they're playing another play to become not a regional power. what they're trying to play is becoming a global power. elizabeth: stay on that quickly. >> they're doing pretty well at it. elizabeth: debt diplomacy for land grabs. we'll see chinese warships rearming opposite the east coast of the u.s.? oaf the west coast of africa

elizabeth: welcome to the show "the hill" media columnist, fox news contributor joe concha back with us. this cnn chris cuomo controversy, it is now getting worse. we have reports that newly fired chris cuomo is threatening to sue cnn over, this is the report, over his contract, 6 million a year or whatever. he is denying he ever lied to the network's president jeff zucker about working to help his brother, former governor andrew cuomo smear andrew cuomo's sexual assault accusers. chris cuomo saying that the cnn chief knew about it. these are the reports coming in.

are these reports true? is this report accurate? >> it is very interesting, elizabeth. i can't confirm them this is chris cuomo's word versus cnn president jeff zucker's words. what cuomo is saying, that i let zucker know everything i was doing the entire time, he was okay with it. when things got too hot in the kitchen only then did he fire me. it will be interesting to see what happens if this ends up going to a court because then i would imagine there is correspondence, text messages emails, between cuomo, between cnn brass. maybe that was the case in this situation because it is reallying it that all of these months, we've already known chris cuomo was advising his brother how to smear credible accusers of sexual harrassment against governor cuomo, right and cnn did nothing. only this week when the damning text messages came out for all the world to see did they actually do anything. by the way, a younger staffer
