network. we begin with the president's poll numbers continue to drop toward below 40%. npr marist has it at 55% disapprove. the president addressed the nation today. announces his administration will buy hundreds of millions of rapid tests americans can get for free at a government website. after the white house delayed the testing requirement for companies in biden's vaccine mandate, delayed it to february. hillary vaughn has more. hillary. reporter: liz, president biden says he is taking action to try to cut down on long lines around the country for people waiting to get covid tests by bringing the covid tests to your living room. >> starting next month, private insurance will also cover at home testing. so you can order a test online to get reimbursed. reporter: white house says they will distribute 3,500,000,000 free covid at home kits -- 500 million. this will not be set up until

january after the new year. this will not fix the long lines people will need to brave today to feel safe gathering with family this holiday. >> this is not enough. we have to do more. we have to do better. and we will. starting this week the federal government will set up emergency testing sites in areas that need additional testing capacity. reporter: here in arlington, virginia, the line is wrapped around the block since this morning. public library ran out of testing kits an hour after opening. they will not get a new shipment in until after the new year. wait times are not up here from all around the country from florida to new york where yesterday some people reported waiting seven hours in the cold just to get a covid test. liz? elizabeth: thanks for your journalism. thanks for your report. joining us texas congressman, former white house doctor ronny jackson, along with former fda official rick meta.

great to see you both rick and dr. jackson. reaction to the president today. watch this. >> fully vaccinate, you have good reason to be concerned. you're at a high-risk of getting sick. almost everyone who has died from covid-19 in the past many months has been unvaccinated, unvaccinated. get vaccinated now. i believe it is your patriotic duty. we should all be concerned about omicron but not panicked. this is critical moment. elizabeth: he went after a report, a reporter asked how come you didn't do enough to get more testing. he got really angry and said, common. dr. jackson, your reaction to that? >> well i think as long as we're relying on dr. fauci and president biden to reassure the public it is not going to work. he is the most inarticulate uninformed person in the white house. no one trusts dr. fauci anymore either. this testing thing will not work, liz. it's a farce. they will throw out 500 million tests.

recommended everybody get tested across the board, device a week. that's insane. that would be 2.3 billion tests per month in order to do that. that is crazy. how about a testing plan? how about testing targeted populations? we shouldn't be testing asymptomatic people. we should be testing people that are symptomatic. this is just, this is us why another effort for them to continue to spin things up. just creating unreasonable fear in the country right now with this omicron variant. it is part of the grand plan to be honest with you. they need the fear to be able to blame everything that happens negative or bad in the biden administration on the virus. elizabeth: rick, you know, dr. fauci even said we have to live with covid but we have a hard focus on testing and vaccinations and not treatments of the is that really the only way when vaccinated are getting sick? people want normalcy. people want to hear more about treatments. pfizer, merck, biontech are working on pills and treatment. >> that's right. you continue to hear from the biden administration and

president biden himself they have no plan to end this pandemic. what is testing going to do when you have people that are, either not getting vaccinated, not able to talk to their doctor about not getting vaccinated. the biden administration continues to rule by fear, not allowing for people to talk to their doctors, to create trust in the system. what they should be doing talking to their own administration at the fda, talking about how we fast track treatment options. you saw pfizer release top line results. 90% effectiveness. keep people that are either vaccinated or unvaccinated out of the hospitals and stop them from catching a severe infection. that is what we should really talk about. how we'll not overwhelm the health systems because we have treatment options coming down the path. elizabeth: now we have democrat politicians nationwide to rick meta's point, in new york and michigan, they're saying no to lockdowns, not going with that but the point is that the president's saying known anticipated omicron when the u.s. is flying blind on variants.

we only test 6% of covid samples, dr. jackson. the uk is doing multiples higher of that. we're seeing omicron, there is only a third of the hospitalizations in south africa versus the delta variant, right? we have flying blind. i mean we're seeing world health officials, only a dozen people worldwide have died of omicron. the numbers are not really coming in yet. the reporting is really not there. what do you say to all of that? >> i say that they should be more informed, they should know what is going on. they shouldn't be spinning this up the way they are. we do know enough, this may be much more infectious, but much less deadly. we need to talk about the number of hospitalizations, number of deaths, stop focusing on number of positive cases. if they send out, make everybody in the country get tests twice a week, tons and tons of people asymptomatic test positive that will drive the number through the roof. it will create more fear and panic in the country. that is not the path the administration needs to be taking. they need to be following the

science and be reassuring the public that we will be able to react to the next variant that comes along that may be something of significance. this is not the one. elizabeth: dr. jackson's point, rick, now we're hearing three shots is fully vaccinated. moderna is talking about a omicron booster. where is our chance to get back to normal? what is the normal vaccination dose number? >> we have to change the focus off the conversation here. look the fda themselves has not even approved, given full approval to moderna or j&j. in fact they have only approved pfizer's vaccine for 16 and up. now you have mandates coming down the pike that the biden administration continues to push, unethical and unconstitutional. rather than focusing on actually getting the products, making sure they're safe and effective they continue to create fear. we may never get back to normal until we stop talking about to the good doctor's point infection rates, start talking about how whether or not the

variants are overwhelming the health care systems or have high hospitalization rates. we haven't seen that yet. elizabeth: ceo of northwell, to dr. jackson's point, northwell is not seeing a rise in hospitalizations. we want everybody to be careful and safe. we want people to be safe and vaccinated but there is a slipshod approach here. just a few weeks ago, jen psaki, white house press secretary was ridiculing the idea that we're going to send free tests to everybody out there. now the president is announcing just that today. >> yeah. they're never on the same page. they really got to stop crying wolf, liz. they will continue to do this. when something does come up, we really need the american people to listen to what they're saying no one will listen to what they are saying anymore. they could reassure a lot of people talking about antivirals, therapeutic, natural immunity, things people have been asking questions about for a long time now but they're just fixated on pushing the vaccines on people that don't want to get the vaccine and pushing these

mandates. people are done with it. elizabeth: the mayor of boston is banning the unvaccinated from restaurants, gyms and theaters, rick meta. they want normalcy. don't want panic. they want optimism around hope. critics say we didn't get that from the president's speech. final word to you, rik? >> here in new jersey 1/3 of our businesses are locked down, shuttered. our economy continues to get crushed. these unmandated, undown constitutional restrictions they keep putting on businesses it is not going to work. it is only creating more hesitancy. those that may get vaccinated are thinking twice about doing it because they're being forced to do it. elizabeth: we hear you. 27 states, multiple businesses, taken the fight against biden's vax mandate from the supreme court. we could hear from the supreme court, few days, maybe a week what will happen with the cases. dr. ronny jackson, rick met at that, great to have you on. come back soon.

♪. elizabeth: welcome back, the president's poll numbers continue to drop after months of misleading on afghanistan, inflation, the border, government spending, the reasons for crime. now the university of michigan's consumer confidence number is lower than it was in december 2009. that was when the u.s. was in the middle of a economic crisis. edward lawrence has more. reporter: liz, president joe biden very aware of his sinking poll numbers though the administration is staying course on all of its policies, even in the face of the defeat of the social infrastructure package not coming up for a vote in the senate this year. >> some people think maybe i'm not irish, i don't hold a grudge. look, i want to get things done. i still think there is a

possibility of getting build back better done. reporter: this is what the president faces. 55% of registered voters say 20012001 has been a bad year for their family. only 30 one% say it's a good year. that is a very personal poll which could reflect vote against democrats in some areas. if you gone out street, ask 10 people, seven of them will say 2021 is a bad year for the country. it gets at the heart of small business owners, feelings about president biden, saying he is out of touch. listen. >> i really he doesn't think better that 6% of america is sml business. we're the number one employer in the united states. it is not amazon, per capita for every person we employ. reporter: independent voters reflect dissat backs with the way things are going in the fox business polls. elizabeth: edward lawrence

thanks so much, good to see you. joining us now, former cbo director douglas holtz-eakin. also this, cnn poll, cnn poll shows biden has a worse approval rating on the economy even than jimmy carter. are we at a unique moment in time in history we're potentially suffering through the worst president in modern history? what do you say? >> well we know some things that are in the numbers that are just really hard to dispute. yes, wages are rising, but no, they're not rising faster than inflation and for the household that spends over half of its budget on food, energy and shelter, those prices are up at an 8 1/2% rate so far this year. so they are not getting ahead. they know it. so it's a bad year for them. we just heard the discussion about the president's rollout of his plan to combat the coronavirus, to do better against covid-19. that is the key economic policy. i mean that, having confidence in that would improve i think people's feeling about the outlook for the economy. they have seen this movie

before. last year around december we saw a spike in cases. we saw the economy slow down. elizabeth: yeah. >> they thought they would be ready for it this time. doesn't look like they are. so you know, that is the kind of lack of confidence in the planning and execution that leads to the results they see on the ground. it is not a vote of confidence in any means. elizabeth: now we have nearly two dozen house democrats showing their vote of confidences or lack thereof of nancy pelosi, they are leaving. 23 is leaving. this is hitting pelosi a grip on power. watch pelosi get heckleed. >> usa. usa. >> mark simone. elizabeth: that is tough tough. you're out in public, you get heckled. nancy pelosi is doing the president you know a surge in misleading rhetoric. said the surge of migrants would be seasonal. that the is taliban would never take over afghanistan.

inflation would be transer to. government spending cost zero. he would cure covid. latest cnn poll, 2/3 of voters have a doubt for his leadership. >> this is an issue for the white house. that is why we know it. why we saw him on a tuesday in december talking about a plan for dealing with covid-19 during the holidays. they have to show some confidence, some ability to understand and project solutions to these issues. the track record on the international front is afghanistan pullout. people know that. track record on southern border is just disarray in the worst migrant problem we've had under any president in the 21st century. and the economy which was supposed to be the strong point is not giving him credit like they had hoped. they have a problem. they have to find a winner somewhere and i think what you're seeing in the house delegation is, we don't really see it in build back better. that is not making any progress and so we're likely to not get reelected. let's pull the plug now. 20 odd democrats in the house

have done that. elizabeth: let's stay on that for a second because "the hill" magazine out of d.c. is reporting that democrats in the senate plan to take a hard ball approach against senator joe manchin. well senator joe manchin did make a $1.8 trillion counteroffer reportedly included universal pre-k, expansion of obamacare, hundreds of billions of dollars to fight climate change but it went south after white house statement singled out manchin for criticism. that was a mistake. manchin is warning we're getting financial crisis with inflation at a 39-year high. white house and far left democrats ignoring inflation hitting mom-and-pop shops, small businesses across the country. everybody feels bullied now by d.c.? i. >> think it's a big problem for the way they're handling this. they could still rescue some of their initiatives perhaps inside of that build back better bill but certainly the notion that majority leader schumer can put

calling out the clinton campaign and multiple former workers on the campaign with, quote, matters before the special counsel. let's welcome back to the show former federal prosecutor jim trusty. what's the fallout of this? durham's team is also indicating former clinton campaign members may be called to testify. >> yeah, it is interesting. the motion itself is pretty ministerial, pretty pedestrian. it is not a motion to disqualify for a conflict, one option prosecutors can have when they feel strongly. it's a motion to have an inquiry. they want to create appropriate record, a small firm representing two different clients in the same lane will abide by their ethical responsibilities. i know the two attorneys in this case. they are courtroom tigers, they're tough litigants but also very ethical. this is setting up for the court a very limit the inquiry to make sure the clients are okay with a walled off approach within the same law firm. elizabeth: we get that. >> but the big picture, sorry,

liz -- big picture is shows durham's probe is alive and kicking. they are focusing with a microscope on the hillary rodham clinton campaign. elizabeth: i want to get to this. let me break down what you just said. durham is asking the court to review potential conflict of interest. the same law firm is representing both the steele dossier igor danchenko and the hillary camp is also representing the hillary campaign and former workers. it is circular. the clinton campaign financed the anti-trump steele dossier. igor danchenko is a source for that. the law firm is representing both sides. igor danchenko, charged with five counts of lying to the fbi. but when you look at what durham is saying he is looking at the clinton campaign's knowledge about the truthfulness of the anti-trump steele dossier her campaign funded and how much clinton and her team controlled the steele dossier source igor danchenko. how much they knew about the

integrity of his methods. this points to culpability, putting false information inside of the fbi and doj? >> yeah. i mean we know this from the last indictment, from the danchenko indictment, it is clear, durham has kind of shifted his focus to the political lane, not the academic lane we saw in an earlier indictment. it talked about how danchenko was specifically fed false dossier information by someone in the hillary rodham clinton campaign. now we know there is this digging that is going on, potential for testimony or potential for conflicts based on the fact that everyone is going to be tempted to point at somebody else on the chain say, they're the ones that introduced the faulk hood into the process. that is kind of the hub of the potential conflict. but it is a bad day for anyone associated with hillary rodham clinton's campaign including possibly even hillary herself. elizabeth: here is the thing, we know the durham probe are

putting out what they're called, speaking indictments? is that what they're called? not five or 10 pages in the indictment, like 25 or 30 pages. it is like a road map -- >> right. elizabeth: what could come down the road. so when you, sort of like, feels like durham is laying the ground work for a potential charges against the clinton campaign. we don't know either way but that is what it feels like when he is laying out what he is thinking, what the evidence are and what he is looking at what do you think? >> i think that's right. the danchenko indictment was lengthy, i forgot how long now, 30, 40 statement for false statement charges. false statement charges can be written on a cocktail napkin. laying out the involvement of the the hillary rodham clinton campaign. how much attorney/client privilege kicks in to protect people and how much it doesn't. that is real thorny issue. depends how many people are within the communication.

elizabeth: look who is back, congresswoman claudia tenney from house foreign affairs. good to have you on. when you saw the former nih director dr. francis collins joining dr. fauci, downplaying, dismissing the possibility that the coronavirus leaked from a lab in china, called it a huge distraction. what was your reaction? saying this months after collins said yeah, it should be looked into. >> it could be the discovery of emails from last year where they were trying to downplay the great barrington resolution, that was the three, the stanford, oxford, harvard doctors came out said, let's look at this pandemic from a common sense viewpoint. let's do less lockdowns and focus on the most vulnerable, try to get back to a more normal life. it looked like he was trying to suppress that. maybe he has a hand in this same funding that went to the wuhan

lab. this has already been proven. i'm wondering if he feels guilty. then of course he went out singing you know a rendition of "somewhere over the rainbow" where sometimes past the pandemic, a name like that which was kind of creepy i might add. i feel like there might be some culpability and guilt coming out of dr. collins. i would like to see more investigation if he actually has got some involvement with dr. fauci. i think they both, i would love to see dr. fauci fired. i called for that for a long time. dr. collins at least is leaving. elizabeth: "washington post" did a deep dive into government databases earlier, just a few months ago. they found the nih did approve and sign off under director collins $50 million for 18 separate gain of function supervirus research projects inside of china. to create these superviruses for vaccines and drugs. overall the nih funded 65 projects at the wuhan lab and 26

♪. elizabeth: let's welcome to the show from house armed services. he is the senior member there. he is congressman austin scott. good to see you, congressman. okay, "the financial times" is now calling out president biden for not making rising u.s. crime a national priority. your reaction to that? >> it's way past time and look, this stretches all spectrums of politics. it is from the local prosecutors to the mayors but certainly the president of the united states has a responsibility to address this issue in this country and if you look at him, what his party has done at the border, what they have done with the lack of drug enforcement and we've seen more deaths from drugs this past year than in any of the previous years, they have simply ignored this issue. it has been to the peril of every american including democrats in the country. elizabeth: you know, congressman, to your point, a recent increase in justice department money for local

police, yeah, that will help but that is papering over, it is papering over the democrats underlying weak policies. that is what law enforcement keeps saying. "the ft" is calling out this fact, that the double-digit increases in violent crime and property crime and other crimes, all of the gains made since the 1990s on crime, now thrown in reverse. the fall in crime since the 1990s was one of the most profound social trends since the second world war. now it is thrown out the window. >> that is absolutely right. look at what it is doing to the lives of the people in those communities. look at what it is doing to the economy in those communities where this crime is running so rampant. you lose the tax base that supports not law enforcement community and public education system and other things liberals demand money be spent on destroying their own tax base by ignoring the criminal problem in this country. president biden has a responsibility to address this.

certainly congressional leaders have a responsibility to address this, to work across the aisle to address this and they're just, they're just so scared to offend anybody, that they can't do the job for the american citizens. elizabeth: you make a good point about destroying the local tax base. when crime goes up, you start hitting the stores and the businesses they may pull out and then you don't get the tax revenue. then everybody's property taxes go up. the interesting point "the ft" made was the u.s., the 30% rise in, 30% more homicides in 2020 versus 2019. they're saying for a sense of the historic sharpness of this record. the previous record was 2,000 and 2001. that record was caused by more than 3,000 deaths in the attacks of september 11. that is how bad it is right now. >> that's right. and i think one of the things that they do hit on in the article that is not talked about enough, so many of our senior

law enforcement officers are retiring. they are retiring, when they make a good arrest, they go to a liberal prosecutor that refuses to address the issue. so many of these crimes are committed by the sail person over and over and again. the catch-and-release system the democrats put in place is simply not working for americans. it is not working for democrats, or republicans or independents. president biden has a responsibility to address it, congressional leaders have the responsibility to address it but they're controlled by this far left mindset of a select few in their party that are driving their primaries. so i'm hopeful that more and more statistics will come out, facts, that force the president and democrats on the congressional side to make the adjustments that need to be made. i problem is you, republicans are ready, willing able to work with them on these issues. elizabeth: okay. >> we have got to have some help. elizabeth: democrats, white house, president, they swore an oath to protect.
