>> i was there out house floor. it was a terrible day, i want to be clear on that but we were debating and doing what we should do in a democracy unlike places where i served all over the world. we were debating the constitution. we had a number of efforts to get this resolved in the courts. i want to be clear everyone who participated in that riot should be prosecuted but prosecuted with due process afforded in the constitution. there is real concerns that that is not being done. liz to your point on you know, the division and divisiveness today, i think president biden missed a real opportunity to try to unify the country and talk about the resiliency of our republic and the resiliency of our system that lead to a peaceful transfer of power ultimately. for vice president harris to compare, i'm a veteran, for her to compare what happened that

day to 9/11 and to pearl harbor was insulting. i'm glad you pointed out that for jimmy carter, a former president, for hillary clinton, and so many others for four years to say trump was illegitimate, push the narrative that the russians basically got into the election has gotten us to where we are today. i didn't see anything today to try to get the country to a better place. elizabeth: to the congressman's point, david, what are your thoughts? >> well look i think president biden today delivered speech that democrats have long wanted him to deliver, right? there are just stark differences of opinion between republicans and democrats at least in washington when it comes how they look back on january 6th. obviously individual members are going to have different experiences. they're going to think of it differently. the congressman just gave his thoughts on how he experienced that day but when you talk to

democratic activists, democratic politicians, and grassroots liberals they wanted biden in particular to call out the former president's unfounded claims about the stolen election and talk about what he did leading up to january 6th. in their eyes it wasn't just the speech he gave at the ellipse on january 6th in washington, what happened at the capitol. the riot on the capitol on january 6th, but what he talked about for weeks and months and has continued to say since then that led people to believe, supporters of his at least, that the election was stolen and something needed to be done. so while the speech he gave you know, i knew immediately because i cover republicans so closely would make them unhappy, it certainly wasn't going to bring them into the fold into some sort of unifying look at how january 6th should be dealt with, it made democrats and democratic party that have been looking for a fight from this president on this issue very,

very happy. elizabeth: yeah. i hear what david is saying. congressman, you're light right to hold out our institutions held up, american institutions held up. the point is well-taken we've been delegitimatizing rival president since bill clinton. polarization according to pugh started in '70s. the democrats refused to accept trump that he was illegitimate president like george w. bush in 2001. >> that's right. elizabeth: byron york is pointing out, more people refused to accept the results of trump's 2016 election than 2020, according to polls out of "the washington post" and university of maryland. >> again what i hear back in my district is just the sense after two-tiered system here of two sets of rules. to your point a number of democrats, they called president

w bush selected, not elected. john lewis led the charge in 2004. they protested ohio's voting machines and said the voting machines were rigged and tossed the election his way not to mention everything they did to president trump in 2016. on top of that, where is the outcry for courthouses being under siege for most of 2020. white house where over 60 police officers were injured and the president had to be evacuated after a breach of white house grounds? yet we hear nothing about that and, all we hear to the media and from the left is about this day and again, those folks should be prosecuted but sets of two sets of rules. liz, i want to say too, i'm not hearing about this in general outside of the day back in my district. i'm hearing about crime, border, inflation, afghanistan, and kitchen table issues.

that is what people are upset about. they're upset how the country is being governed right now. elizabeth: i think to the congressman's point, that, david, that is what voters are really talking about according to the polls, david. but now you hear about you know, getting rid of the electoral college again, packing the supreme court, you know, vote reform where you don't have to have an i.d. to vote. you just to have signature, david. mail-in ballots where you can mail in your vote that will be accepted 10 days after the election. federalizing half of the federal government, take over the powers of elections away from the states. that is, seems like this is a setup for that kind of action in d.c. by the democrats. your final word? >> well, look, you know i think when we look back at both parties over time chipping away at the legitimacy of our elections i think it's a very good point. i think what made 2020 different is that outgoing president clinton and vice president gore

elizabeth:330,000 children, mayor lightfoot considering legal action against the teach's union. the city filed unfair labor practices complaint. grady trimble in chicago with more. >> we should find out whether classes will be canceled today. the district is hoping to up schools with in-person classes tomorrow to get people to show up. they say one in eight ct uteachers actually went into the classroom today, which is slight improvement from yesterday but still not enough. one teacher coming in, joe okul has not participated in a work

stoppage since 2005. he is not participating in this one despite he has cancer. a districtwide shutdown makes no sense. he has 82 students. he is not aware of a single case of covid among them this week. >> there are ways to fight city hall. there are ways to make those demands without putting the fight with kids in the middle of a fight. >> democrats, republicans and public health officials are in rare agreement that one of the safest places kids can be right now is in the classroom. despite the fact that school districts across the country have gotten billions of dollars of federal aid from the government to keep schools open, more than 4700 of them are either closed or fully remote right now. mayor lori lightfoot says the ct-u is holding kids hostage. elizabeth: grady trimble, thank you so much.

really appreciate it. joining us from house oversight, house education committee, congressman james comer. great to have you back on, congressman. there is an uproar, chicago educators, mocking their strike on facebook saying they will take sick pay, days out for sick pay, even while on strike. that they could do this until june. should they quit and give other jobs. the mayor said if they don't show up for work they shouldn't get paid. where do you come down on this? >> i agree with the mayor first time ever. their job is to teach our children, unfortunately, what we're seeing is, the teachers unions have taken control of the public school systems in the largest cities in america. guess what, those are the school systems failing, those are the school systems we see the test scores decline the most. it is direct correlation to having virtual learning. students need to be in the classroom. if teachers, teachers unions are going to still work with democrat party to create an

environment where they can opt out of going to school in lieu of virtual learning, then we're going to have to do something about it because the school system is the safest place for kids during covid. that has been proven. the science shows that public schoolchildren have suffered very little from covid with respect to hospitalizations, which is how you should be measuring this. we all know with children in public school system that virtual learning has held our children back from virtual learning. elizabeth: we hear you loud and clear, congressman. mulvaney with us tonight. i will ask a chicago teacher. ask for your reaction to this. dock their pay for every day they're off? >> yes, if you don't work, you shouldn't get paid. that is a basic concept in this country. folks who pushed back on the biden administration to push back on the first place are unions, generally associated with the left. >> in the previous strikes i

already made a decision, because i joined the chicago public schools, as a teacher, first and foremost as a teacher. and, my role, i believe my role should be inside of the classroom with my students. should not be in picket line. i am first and foremost to be a teacher. secondly i believe that there are ways to fight city hall. you don't dangle the plight of the kids in the middle of the fight just to secure demands. but i have something against people using the union as a tool for political gain. and that is my stand. elizabeth: yeah. it is also about money. what did chicago and its schools do with nearly two billion dollars in taxpayer money it got with covid relief to keep schools open? that is out of 150 to 200 billion given to schools. what did they do with the money? >> that is a great question.

i don't think anyone in congress can answer that. the problem with the teachers union. what can you do to improve public education and dollars around more money, and more money. i know a lot of great public school teachers. they want to be in the classroom. they want their children to learn. most teachers do. what happens, these teachers unions have been taken over by the most radical, liberal, socialist teachers that just want to do everything to benefit themselves. they don't put the children first. that is very disappointing. because most public school teachers do. but these teachers unions are just going to have to look in the mirror, to say we're failing our children. we're failing public education and you know if you're not going to work you shouldn't get paid, there are 10 million jobs available in america right now. any teacher that doesn't want to be in the classroom shouldn't have any trouble finding a job in the private sector right now. elizabeth: congressman james comer, great to have you back on. good to see you. come back soon.

show. house budget ranking member. he is congressman jason smith. first, let's deal with this. great to have you back on, congressman. how did convicted boston marathon bomber dzhokhar tsarnaev get 1400-dollar relief check last summer? he killed 3 people and injured hundreds? >> carelessness, liz, i warned democrats right after the biden bailout bill was passed in the spring, the week after i filed a piece of legislation, we had a vote on the floor to prevent prisoners from getting stimulus checks. every democrat in the house of representatives voted against it. we saw it was going to happen. the democrats new it. they all voted to allow these prisoners to receive those checks. elizabeth: so dick durbin the senator was saying we need to keep that money going to prisoner's families but looks like the prisoners are getting it. the he has been ordered by prosecutors to return money as

restitution to victims. he barely paid more than 100 million he owes. a weird thing we're giving relief checks, taxpayer money to convicted felons? >> liz, not only waste in regards to relief checks to felons, but there were stimulus checks since japanese citizens who live in japan. there was, there was two million dollars sent to the university of syracuse to plant trees. there was millions of dollars to build luxury apartments in connecticut. four million dollars for a parking garage in south carolina. 16 million-dollars palm beach had to make a golf course. the waste within a bill that joe biden, nancy pelosi, chuck schumer says was covid relief was ridiculous. i sent a letter, yesterday, liz. a letter yesterday to joe biden, calling out the two billion dollars that joe biden used to convert and take away from

not still waiting for spanish flu test. the lines are so long for covid by the time you get to the front you don't have it anymore. cdc says it is cool. you can go home. you waited long enough. >> the country is in chaos. we need clear guidance from the cdc why they issued new guidance updating the recent five-day isolation rule, with the simple addendum, people who have recovered from the virus, isolated at least five days can take a rapid test if they want, but they don't have to, those who test positive five days from the initial test should isolate for another five days also. people who test negative or don't get tested can go back to work as long as they wear a mask elizabeth: that's funny stuff, right, congressman. here is the thing, i want to report this to you, school districts in atlanta, detroit, chicago, san francisco, newark, new jersey, they're citing testing shortages as a reason to

"wall street journal" editorial page is saying that you know, trump incited the rioters to march on the capitol, failed to

act as we watch on television of the white house. your thoughts on today? >> well, today, you know, a year later, the capitol is no more secure today than it was a year ago. speaker pelosi has refused to give us and the american people all of the footage from the capitol that day. still held in secret. nobody had access to it. she refused to give communications with capitol police an law enforcement leaders that day, days leading up to january 6th, january 6th what was going on. our question, republicans questioned her, why are you failing to release all this information to not only republicans and investigative committee but to the american people. obviously something is being hidden here. i think anybody that broke federal law should be held liable and criminally liable for the laws they broke. they should be treated the same way as other actors, progressive actors seen attack the federal courthouse over the summer.

"the daily mail" got these shots. what do you think of this story? >> absolutely elizabeth. happy new year. first thing i thought i was jimmy carter. during the energy crisis jimmy carter urged americans to stay home, wear sweaters to save energy. i thought that was crazy. to his credit jimmy carter wore a sweater in the white house.
