hearings. congressman, reuters is reporting that the european union nations will not join in the embargo with the u.s. and uk against russian energy. why don't they take on u.s. energy to replace it? >> because the biden administration won't allow them to take u.s. energy because the biden administration is waging a full-scale war against u.s. energy production. they will go to venezuela. they will go to iran but they won't even talk to the people in texas and oklahoma and south dakota about producing more right here in the united states which we have the capacity to do but the biden administration is bent on not, not allowing u.s. energy production to ramp up, not allowing us to be energy independent and not allowing the u.s. oil and gas to be shipped to our allies so they can supplant the russians. elizabeth: got it. general, did you want to weigh in on this, general? >> absolutely. congressman gimenez is right. the radical left has taken over

biden. we could be a world leader in energy production. think about the infrastructure bill, liz. you cover the markets every day. not a dime went to our southwest border here in arizona or any help to get pipelines and production back up. we could produce immediately. we're turning to some of our worst enemies like iran to help us out while we're trying to have the russians broker a deal. it makes no sense to me. elizabeth: we hear you. congressman, moving on to the supreme court nomination hearings, the opening states were today. it will be multiple, more days of hearings on this. congressman, republicans are tagging justice, excuse me judge jackson soft on crime, focusing on her work as a public defender, including defending for guantanamo bay detainees, working on a sentencing commission and fight over her sentencing appearing to be lenient on those accused of child sex crimes. what was your reaction to today's hearings? >> i think, look, we need to look at what her philosophy is about the constitution and how

she will interpret the constitution. you know, i am a strict terper. i like the constitution to be interpreted, not a new law to be dictated by the supreme court. you know it is up to us to dictate and make the laws of the united states, the legislators. it is up to the supreme court just to give opinions on what the law means, not to create new law. so my thing would be, what is she? is she one of these it's a living breathing document, so i will make new law which is not what she is supposed to be doing? or is she one that will strictly interpret the constitution. i think she will be the former. she will be one of those that wants to create law, not interpret law which i don't believe that is her job. elizabeth: you know, to the congressman's point, general, senator mitch mcconnell is saying she spent less than a year on the appellate court. we don't, she is a trial lawyer but we don't have her appellate court record. she only weighed in, authored two opinions. that is the issue. we don't know how she would be, stand on the constitution, on

the constitutional aspect of it, right, general? >> yeah. you bet liz, but as you mentioned, i'm running for the u.s. senate here in the great state of arizona. i would call on my colleagues, my future colleagues as we unseat mark kelly to just ask one question, does she believe d.c. can enter the union as a state? the answer is no, as a strict constitutionalist. it requires an amendment to the constitution. she has got a weak record, defund police, abolish i.c.e., now completely open border policy. biden has given in to the radical left. that is what we're seeing in these nominations. elizabeth: she would be the first black female member of the supreme court, the first justice in decades with a public defender background and as a criminal defense attorney. there were fireworks today, to the congressman's point he mentioned earlier about the far left bypassing congress to go to the courts to get their policies enacted. that is what senator ted cruz was talking about today. watch this. >> our democratic colleagues

ones that pass the laws. it is up to them to make sure that those laws, you know, are prosecuted. lauren: yeah. >> that's at problem that i have with supreme court justices that try to create law. elizabeth: okay. >> instead of the ones that just interpret the law. what ted cruz said, yeah, they don't, you know when the democrats can't pass a law they will go to the judicial system to try to get them to pass a law for them. i think that is unconstitutional. that's really what i'm interested about her. elizabeth: we have a monmouth poll. 55% say she should be confirmed. general, she is endorsed by 91 states attorney generals, police unions, former prosecutors as well but there is a big fight over senator josh hawley's statements you can't find a single case of her time on the federal bench which she sentenced a child porn offender to guidelines. democrats say he is wrong. when you saw this, general, what is your reaction? >> my reaction is what i said

elizabeth: welcome to the show, fox news contributor tomi lahren. great to have you on. what is your take own this? senate republicans may launch probes into hunter biden after the midterm? >> well it's needed. i'm actually surprised it would take this long but i think when we're discussing this we know who has a dog in this fight. we know the democratic party has a dog in this fight. we know the biden family has a dog in this fight. what is most angering to me, should be to all americans regardless of political affiliation the media, their role for this, why they waited so long to admit likely they knew ahead of the 2020 election, but dismissed as russian information. imagine how our country would be different if they would have reported on the story accurately instead of labeling it as they did. it is not just the media but big tech. they need to be held accountable. they are controlling a lot of the narrative here. elizabeth: people in social media are not up to speed what is going on if they're all reading each other's twitter

feeds because the justice department is investigating hunter biden for alleged foreign lobbying, money laundering violations, tax violations related to its overseas business dealings in places like china, russia, kazakhstan. more than four dozen intelligence experts they're not apologizing for saying the "new york post" hunter biden story about hunter's laptop was russian disinformation. the thing with this, tomi, when they said that, and this is why the people are being misled out there, their big caveat footnote was this, we don't know if the emails are genuine or not. they just look suspicious to us. that is who the media was quoting these 51 experts. your reaction? >> well that is comparing contrast that to the four years of the trump administration when they tried time and time again it prove that president trump had issues with his business dealings. that he had actually ties and collusion with russia. talk about reporting on a phony

dossier and golden showers, they didn't care about the facts. they didn't care about the evidence. they wanted to torpedo, attack and slander our former president. we want to talk about collusion here, the real collusion is between the biden family, the democrats, the mainstream media and big tech who all worked to silence the story. there is a bigger story to this. there is a lot of outrage but i think we also need to look at the strategy right now and the motivation for outlets like "the new york times" finally coming clean. my guess is this. now that joe biden's popularity rating is tanking, now it its clear he is not the man to lead this country the democrats are attempting to distance themselves from joe biden. so now if they talk about hunter biden or they talk about the existence of the laptop or shady business dealings they don't care as much because i believe they're okay with throwing joe biden and his family under the bus. they want to see a new democrat take over in 2024. i think there is more motivation to this beyond what we're seeing right in front of our faces. >> the president's approval

rating took another nosedive to 36% in a new civics poll. watch former a.g. barr on this. watch this. >> as soon as this letter came out from so-called intelligence specialists the dni, john ratcliffe at the time, and the fbi which worked for me, both came out said this was not the result of disinformation. elizabeth: you know, white house press secretary jen saki is not taking down her tweet claiming this. she is shutting down reporters asking about questions about this. she is saying now, tomi that hunter does not work for the government. the problem her boss works for the government. it is about president joe biden's involvement in this too. >> yeah. the quote, unquote big guy as they say. there is a lot more to the story. there needs to be a senate investigation. it is one thing we're talking about hunter biden, talking about his private dealings, whether he had the qualifications to sit on energy boards or make all this money from china and ukraine and elsewhere. that is one part of the story

but if you have got the son of the president of the united states, the leader of free world, selling political influence, possibly access to his very high-powered family members, that is a matter of national security. the american people quite frankly should feel lied to by not only the biden family but again the mainstream media that is supposed to serve as the watchdogs. there is a reason why most americans can't trust the media because they're not transparent, they don't hold our leaders accountable if they like the political leanings of the leaders in office. elizabeth: the president's son, being in business with the government of communist china, with entities who have backing by state military intelligence as well, this is not a private matter. to your point, many states a matter of urgent public interest. jen psaki said last year hunter biden was in the process of divesting his 10% share of a chinese investment fund. apparently he hasn't done it yet. now we have author peter schweizer saying the biden family by his investigative reporting have done five deals

elizabeth: joining us now congresswoman mariannette miller-meeks on the house select subcommittee on the coronavirus. congresswoman, i would like you to hear the sound bites from dr. fauci. this is about the new omicron strain, ba.2 variant. it is more transmissible. doesn't appear to cause more serious illnesses. watch dr. fauci, looks like he is confusing and flip-flopping again, listen to this. >> we need to be flexibility and if in fact we do see a turnaround and a resurgence we have to be able to pivot and go back to any degree of mitigation that is commensurate with what the situation is. so we can't just say we're done, now we're going to move on.

we've seen relaxation of restrictions all across the country now. any reason to reverse that? >> i don't think so, george, not right now. i don't see us going back into anymore really very restrict kinds of restrictions but you always have to have the flexibility. elizabeth: okay, first he is saying we might have to go back into restrictions, congresswoman. but then he is saying he doesn't see that we may need to do that. do you see how that is confusing? >> i think dr. fauci has been confusing for the past two years. you know, first, we, masks don't work. then we should all wear masks. so there has been, continue all confusion and a lack of transparency among nih, among the cdc, which is why people have questions. elizabeth: why not stick to one line, saying it is more infectious, it doesn't cause severe illness, we may not need to go into lockdowns again?

now he is raising a specter of lockdowns that destroyed the country. it ruined america. it was the most ill-conceived thing we've ever seen to hit this country in generations. how we let these local bureaucrats decide to shut down a dry cleaner or a shoe store, shoe repair shop that would have nothing to do with making the pandemic worse. >> that is a point i've tried to make continually in congress, that this should not be the precedent for how we try to mitigate other pandemics which will come in the future. he has been very confusing. the cdc has been confusing. you know, they, we need to have a risk benefit strategy. so what's the risk of disease? what's the risk of spread of disease or transmission and then based upon that we then determine what mitigation efforts we want to have. i don't think we'll have to go down to lockdowns. remember what happened with omicron first came up. we already knew from south africa, we knew from great

britain that is highly contagious it was transmissible, you didn't get ill or sick. places went into lockdown and passports and vax mandates they went overboard. if you look at all the information coming out of other countries we would have known it was very mild, most people didn't get ill and just like the delta variant, even if you were vaccinated and boosted you could still transmit. so the cdc still doesn't acknowledge infection acquired immunity or -- natural immunity. elizabeth: enough with the lockdowns. never do it again. it was the worst, dumbest, most insane decision to do that to this country, and too do it to businesses across the country. everybody is paying for it now. >> the costs were enormous. elizabeth: the w.h.o. even said 1918 flu pandemic, we do not lockdown. we didn't do it in a full-scale like that. you shut down concerts or church

police are investigateing a party venue, 10 people were shot. what is happening, sir? >> we still have people who engage in indiscriminate violence. they have probably had a feeling they can get away with it. when we had some issues where law enforcement trust has eroded, prosecutors decided not to bring charges against people. judges were holding people without bail, not holding people without bail. we saw a general lack of consequences, resulted in people thinking they can engage in violence. we need to make sure that the whole system is working together. law enforcement is the front line but once we get people identified and in custody, the system has to hold people accountable for actions where children, i believe one as young as 18 months old was shot in the incident down at the car show. that is just inacceptable. society shouldn't accept it. we should do something that it doesn't happen again. elizabeth: now this trend, half of the top 20, largest u.s. police jurisdictions they want

to increase police funding in their 2022 budgets. the defund police movement appears to be going away. minority groups warning, african-american and hispanic groups saying if you get rid of cops we will get hit with more crime. we have that. we also have this story. prosecutors in new york city are so overwhelmed, at least 100 prosecutors quit and attorneys, 90 professional staff out of offices in the bronx. they're overwhelmed. >> feel like i'm back watching the "hill street blues" series on tv, crime and violence running rampant through the streets of america, prosecutors and cops were overwhelmed. police were using tactics quite frankly were unprofessional. 20 years of policing went out the window with the four sisters in their response to ears and murder of george employed. unfortunately a lot of police work was thrown out. good gains were thrown away. we're starting to see them come back. we're recognizing that people
