intentionally violating federal law on our border. they're doing it every single day and they're doing nothing to stop it. in fact they're encouraging the behavior. they're transporting illegal immigrants all over the country in violation of the law congress put in place. they impeached trump over a phone call to the ukrainian president. these leaders, biden, mayorkas are violating federal law on the border. elizabeth: you say yes to that. >> absolutely, 100%. the judiciary will do an investigation on all this, lay it before the american people to see how bad and how intentionally our federal laws were violated by this administration. elizabeth: not upholding title 2 of the constitution. mayorkas testified homeland security spent, they also spent $72 million in shutdown costs to stop building trump's border wall to get, cancel contracts and more. that is a lot of money to stop building a border wall we appropriated for. >> we already appropriated for. the money was there. the supplies were there. we could have finished several months after biden took office.

control of the border. the only person who is saying no is mayorkas. he is not listening to the front line troops. like ignoring what the troops are saying in the foxhole. show you how political it became in the border,. elizabeth: "gallup poll," civics poll, poll from morning consult. the president is deep underwater. democrats, republicans are saying the president is wrong. congressman, cat bow, he is not president of one caucus but president of the border states. the governors are warning, the wages is desoperate, neighborhoods, communities hit with rising crime, robberies, destruction of property, home invasions. talk to us about this. apparently a shortage of detention centers, shortage of buses, air flights to move the illegal immigrants out. they have nowhere to go. they're stuck in the local border towns. they can't handle it. what are you hearing? >> yeah. think about that, right? you're exactly right. that is the current situation where they have anywhere from

five to 7,000 people a day crossing the border. and, when they, that is with title 42 being utilized. the title 42 allows you to deport people immediately when they come across the border. with that is fon, just number about people they will expect the fact when title 42 pulled, it will be a magnet to pull that many more people up to the border. they're expecting as many as 18,000 people a day. if you think it is chaotic at the border now, wait to see what happens when title 42 goes away. elizabeth: to congressman katko's point, final word congressman greg stuebe, biden's border collapse necessitated dea response. dea, the drug enforcement administration, warn drug and gun crimes are pouring across the border into 34, 34 u.s. cities. we've got criminal drug networks and gangs operating in those cities. that is according to the dea. so that is how serious the situation is. but it seems like the

getting close to trial because both sides are taking the gloves off. obviously the government, durham in this case, he wants to get as much evidence in as possible, the connection between steele, between trump, excuse me, between hillary, between the law firm and everything they did to tube president trump's campaign. the other side, they want to exclude everything. they don't want anything to come in there except for a meeting he had with the fbi where maybe he wasn't 100% truthful. elizabeth: guy, the other thing too is special counsel durham's court filings, let's show it, it's indicating his team issued trial subpoenas to the clinton campaign and the dnc. unclear if hillary will be call in to testify or even if they will charge her. excuse me, john durham's team says they have got hundreds of pages of documents of emails and text messages on this. what the fallout of the clinton

campaign and the dnc being subpoenaed to testify? >> liz, this could be explosive, because think about it, the government is holding all of this information, all of these emails, all of these exhibits, and they're going to start calling witnesses to come in. some of these people may very well be taking the fifth amendment, saying hey, if i testify honestly i'm going to incriminate myself. indeed there was some talk about that today in court where the defense was arguing that one of the witnesses, this guy, the executive number one, who is actually mentioned in the indictment, the defense was saying, look, judge, unless the government immunizes him, in other words, gives him immunity, he will take the fifth and not going to testify. i'm just telling you, this thing, there is no telling what could happen when durham -- elizabeth: when you plead the fifth, doesn't that say, we get the legal implications but it kind of tells the world something else is going on here,

right? durham appears to be ramping up a conspiracy charge against hillary and his team. his court filings, we've been reading through them, they keep talking about the hillary's team, quote, joint venture in the summer of 2016 with computer researchers to get information out of the white house, or internet traffic involving, not at the white house. internet traffic between trump and his campaign, using internet data to do trump russia. so this, when you see the words joint venture, that sounds like a conspiracy, guy? >> that is a buzzword, make no his take, liz, it is a buzzword for conspiracy. conspiracy where two or more people unlawfully, illegally, come together into a venture like this to commit a crime and that's exactly what durham and his prosecutors are claiming here. you better believe it. elizabeth: let's stay on that. he has got to prove beyond a

reasonable doubt criminal intents right? he has got to prove intent. so the hillary team creates trump russia. they try to push the doj, the fbi, the cia to investigate trump. at the same time they're doing that they go to the media, they actually say to the media, hey, the government is investigating this when they weren't. this is hit-and-run on trump without the fingerprints, right? hillary's hired guns, fusion gps , tell call a reporter tell them about carter page. how can they prove criminal intent to show a conspiracy charge? >> they wind up with circuitous, curious facts and you start tying it together. what is really so amazing, liz, actually one of the largest firms in washington to tie it all together and try to cloak it in attorney/client privilege so it never sees the light of day. sounds like a conspiracy to me.

okay, another shooting. three people shot dead at a hotel in biloxi, mississippi. crime is getting so bad there was even a brazen armed robbery yesterday right outside of fbi headquarters in d.c. the suspect got away. what do you say to all this? >> it is absolutely horrific and traffic. it is open season for criminals especially in our big cities. crime is way up. look at new york city, just over easter weekend there were 29 shootings there. random acts of violence are way up. just before we went on air, i read a story about a 70-year-old grandmother walking home from the pharmacy in brooklyn, got stabbed in the back for no reason by a total stranger. these kinds of headlines have become so common, they don't raise eyebrows. they become normal. a lot of time people committing acts of crime are criminals repeat offenders, should not be on the street. they were let out on inappropriately low bond. elizabeth: now like crime does pay, right?

happening, since the blm riots police have been vilified for doing their jobs. these soft on crime policies have made vulnerable 307lations especially in cities even more vulnerable. this is happening because left-wing voters don't always that understand the long term consequences of these radical policies. a lot of these people live in door protected buildings, safe neighborhoods, they keep electing nuts who pedal soft on crime stuff until the crime gets so bad voters leave and move on to texas and florida where they vote for the same nonsense. the most vulnerable who can't afford to move are the most victimized. elizabeth: stay on that, deroy murdoch had a stat, 9900, 9900 murders of blacks killing black people. minorities are getting slammed by crime. we don't want that anymore. we don't want this for our country anymore.
