homes, it's at the supreme court in front of the white house, in front of congress. that's where this debate should take place, not in people's homes or in terms of threatening violence in any of the activity especially toward justices and their families. kennedy: we are talking about younger justices have young children at tactic meant to change behavior and outcomes. how do you find all this? >> i'm taking the controversial position against mock rule and its forms whether january 6, protesting the justices. i believe in the rule of law, civil discourse and protest, take them completely peaceful, not mostly peaceful at the public locations and so forth and it's exercising your first amendment rights but just because a legal decision might

be against you is no justification for breaking with all of that. it is ironic the people who most seem to mourn the loss of norms are those justifying, georgetown law professor today was justifying going up to the justice houses as long as you are short of throwing cocktails at them. kennedy: i guess i wouldn't have a problem with that if this were of free speech absolutist more we've heard that in recent weeks but is the exact same behavior targeting some of the law professor was politically and philosophically aligned with, they have an issue with it. that is the great imbalance in this country. what's wrong for my side doesn't make it okay for your side. we are so far adrift from the

wade as is, 36% say it should be overturned. will the issue galvanize democrats in the midterms? he with me now, clear politics cofounder executive editor, tom bevan, what are you seeing in terms of polling and will it turn into a single issue election even though there are about five critically important issues circling both parties right now? >> right now it is a single issue election and its inflation. in order of magnitude above any other issue on the ballot right now. prior to the opinion leaking, there was a poll that showed abortion was number nine out of 13 issues offered to voters in terms of burns. it was well down the list. we are going to wait and see how high the issue rises and how long it lasts. part of the problem for democrats as we are still six months from election, it will be tough to keep the machine crank

up to 11 for that long particularly if these apocalyptic pronouncements, visions we don't turn into the handmaidens tail and of course we are still paying five or $6 a gallon for gas in the number, it's hard to see the issue having this power. could it help motivate democratic partisans who otherwise might have stayed home or less motivated? yes. democrats think and they hope you will win back suburban moderate women they'd one during the trump years but have lost the last 16 months or so. the data is mixed, we do have good numbers that we have anecdotal data including a story from reuters this morning surveying 40 woman in the suburbs of phoenix and scottsdale and found the abortion issue, even for folks who voted for biden in 2020 was

not the main issue, still inflation and that remains their top concern. kennedy: it is interesting because many people assume when something drastic occurs with abortion or roe v. wade, it would galvanize voters but we do have collective ptsd from the pandemic. we come out of the pandemic and now we are facing record inflation, a very curious employment market and you also have this looming war in europe that we could be sucked into at any given moment so if there were ever a time where abortion wouldn't resonate them a way it might have ten or 20 years ago, it now so the gruesome thing to pin your political hopes on, i wouldn't put it past either party to maximize that, pretty rough landscape out there.

>> there's no question it will be part of the election and democrats will do what they can to leverage it to their benefit. the question is whether it will be have salient it will be and how much it will motivate. the two groups democrats need, their bays and to win over swing voters in every issue they've confronted whether immigration, student loan debt has pitted the two groups against each other. please us progressives but alienate swing voters. we will see if this is an issue they hope it will lift the script but right now the cake is almost baked in terms of public perception about the democrats and the economic situation unless and until the inflation number goes down and we give it another reading on wednesday, it's going to remain the political problem for democrats to overcome in november. kennedy: we will be relying on you for all that, things are changing, not looking up get for
