minus 2 million, 8.35 million. regardless, courtroom victory for johnny depp fighting to clear his name for six years now in a statement after the verdict, he said false and very serious criminal allegations were levied at me in the media which triggered hateful content although no charges were ever brought against me. it already traveled around the world twice within a nanosecond and it has seismic impact on my life and my career. six years later the jury gave me my life back, i am truly humbled. amber saying things differently tonight as i mentioned, the court awarded her $2 million after johnny depp's lawyer claims her abuse allegations were a hoax and he said she called the police a second time after trashing it by herself. after the verdict she said quote the disappointment i feel today is beyond words, i am heartbroken the mountain of evidence still was not enough to stand up to the disproportionate

power, influence and sway of my ex-husband. i'm sad i lost the case but i am sadder still that i seem to have lost a right i thought as american to speak freely and openly. but it turns out not truthfully, it was a circus. inside the court there was a party, outside as well. dozens of people showing up chanting johnny depp name, johnny, johnny. it's pretty funny because he wasn't even there. he was an english performing with jeff beck because he is john c depp the second or something like that. was the verdict of supplies for legal experts and should the judge have instead ordered the two to remarry and work things out like a couple of crazy kids? joining me tonight in studio to discuss, it's criminal defense attorney former prosecutor, he's argued both sides. so when this case started, is this how you thought it would end up? >> kind of.

i can't say completely, i honestly was thinking they would award johnny depp $10 and amber heard $5 or vice versa looking at both of them and saying you both have destroyed each other. 10 million versus 2 million, maybe in the jury's mind, 10,000,002,000,000 to them is like $10.5 to the rest of us. we talk about and i've seen and heard people say johnny depp one. he may have one at this nothing to be celebrated. i think he can win, i think he should take this moment where he's now being accused of basically showing the need to movement and once again another example of power and notoriety in a white male, take out and say you know something? i said i only wanted the truth, the truth came out.

i am good. that's all i need. kennedy: but he didn't win everything, he was canceled, thrown off, franchises, he had years of work taken from him and the one thing that kept people interested in the case, he kept going even though he lost a big case in the uk and came out of that with his reputation in tatters, a damaged person, people thought he was out of his mind for going around to but then as he got on the stand and said i know what's right, i know what the truth is, i know what she's claiming, that never happened. i never did those things and there was a turn somewhere in the middle of the case, what was it where people all of a sudden believe him and really had great disdain for her? >> for me it was a couple of moments. one of the moment believe it or not was the interaction between johnny depp's lawyers and johnny depp on the one hand and amber

heard in her lawyers on the other, i will tell you it was my wife who brought this to me, it's not just being a lawyer that allows you insight, it's watching and she said to me every time johnny depp was with his lawyers, they embraced, they connected and the jury had to have picked up on that, they made him credible. there was a distance between amber heard and her lawyers and the jury may have picked up on that also because if your lawyers don't trust you, if you're lawyers don't believe in you, how do you expect a jury to believe in you? there was an earnest, and honesty that was really lost on amber heard but to what you said, johnny depp one and the way the tides turned during the trial, it can turn again.

you won the stanley cup, he won the world series. retire. it's better to get out a year to early than a year too late. if i'm in, i picked this moment and say i don't want your money, i don't need to stepan your throat anymore and i can be trusted, i told you it wasn't about the money and i think he can begin building trust and get that life, he talks about turning the page, turn that page now and walk away, you want. kennedy: i think film companies look at him and they say well, he's a marketable person, he struck a chord in people, something so authentic about him we had no idea. we thought we were smart -- >> do you really now need to chase him and amber heard for the $10.35 million? you really need to notice her? she's dead right now, she is.

when that happened people finally felt comfortable coming out saying i don't like amber heard at all and i don't believe a word that is coming out of her mouth. >> i think are two moments for me in this trial that were pivotal. i think the audiotape where she admits to punching and hitting johnny depp was a moment where he revealed herself to the jury and the jury recognize as the monster in the relationship and i think the other moment that was telling and i thought was a brilliant legal strategy was when johnny depp's female attorney cross-examined johnny heard, woman to woman, i thought that was brilliant and very effective in the trial. i think those are the two moments i felt they were pivotal moments where the jury realized she was the abuser in the relationship, not johnny depp.

kennedy: what happens now? we were talking about it with randy, just johnny debt pay her? does he resume his role as america's sweetheart? >> to me it's godzilla versus freddy krueger. i don't think anybody comes out as a sweetheart and certainly johnny depp says his career is severely damaged six years is a long time but when i look at this, what i see online is is almost a mock mentality of people of johnny depp. johnny depp has tremendous passion out there. kennedy: okay but let me ask you, is that a reaction to so many people feeling there canceling unjustly, they know people who have been canceled, not able to reinstate reputation, what is that. >> this is great kennedy because

i think it's not what you are describing, i didn't see the online. what i saw is that women and remember, you heard amber heard, it's a setback for all the women and blah blah blah but it was women online who were like johnny depp is okay, johnny depp didn't -- it was like they were fans. it's a moment where reality seems consumed by the image of pirates of the caribbean. kennedy: he brought up something important missing through the need to movement his men and women are equal and women are just as capable as men of lying and hurting their partners. this is the first time people have had an open conversation about that. he says this is a setback for other victims because she herself was the ultimate victim, i think it's a setback because

they worried they are going to be portrayed as borderline monster like amber heard. >> i think what was really missing was trials. oozing from justice system as a whole, 99% of cases get let out so people don't get to come before they put the evidence out there and we saw janik depp and amber heard, she didn't have the evidence. she said all the evidence and didn't give her way but the evidence was against you. you look like the abuser and it looks like he's a nice guy, it seems she was the worst person in the relationship so we need trial, evidence, due process no matter who's being accused or who the accuser is or which gender. we have to remember all people can be abusers and all can be victims and what we hope to take from this is a better picture of what mental health issues look like and narcissistic abuse looks like and a place in our society where people are held accountable for their actions no matter their gender.

the average american is working more earning less, every pricing the economy is an all time high and you get down to it, is costing the average family $4000 a year, that's real money and who is biden blaming? greedy ceos not paying their fair share. kennedy: tell me about this calculus that when inflation is above 4% and unemployment is below 4% you will have a recession in two years. >> we see a lot of it, that's just one. larry summers is by no means the only one predicting a severe recession, some of the biggest banks forecasting 35% to 50% chance of a recession and every indicator the market themselves, the markets are one of the worst starts in history so every indication is where heading toward recession because of inflation and the irony is biden keeps doubling down talking about basically writing off student loans, more spending to fuel more inflation so we end up with missed the allocation that

brought us to where we are now. kennedy: and they will continue to do that so what happens when people start losing their jobs? when you don't have as many job openings and more workers in jobs available? is the government going to spend an extra $3 trillion again at that time? it seems like they are setting that up, it can be the only thing for these? it's like giving poison to the patient's. >> more of the same, what they're planning. keep in mind the recession and inflation peaked in the 1970s, it started years earlier and so many failed attempts, some was price control and joe biden talked about it again so this could be solved, inflation is not caused by supply, bottlenecks respect of janet yelling, not caused by russia or any other excuses, is caused by

spending and the sending of interest rates below inflation. that's what that did and everyday americans are paying an all-time high for everything in the economy. my fear is that economics is what seemed but also what isn't seen. we haven't seen bankruptcies yet, it's grueling under the surface and it's just a matter of time. kennedy: what we are seeing is a direct result of stimulus spending during the pandemic that people were warning about so now they want about when people hit real economic hard times and they don't have options for employment opportunity we are going to see another wave and consumer confidence is a thing that boost the economy and it's really waning right now. jamie diamond was saying it's still sunny right now but the hurricane is coming.

[laughter] >> it's always my pleasure to be on your show. i love being on your show. i think the two of us have a bond. kennedy: i think you're right and it's deeper than the loss but barely. here's the thing, i feel for her, i don't think it's her fault she's incredibly talented, i think she's one who's been put in an awkward position by the governing bodies have to make tough decisions and they don't want to because they don't want bad press but it's really difficult for the families of swimmers who were born female and went through puberty as a female to say is an unfair advantage, they can't juice themselves, they can't take performance enhancing substances and they argue her prior physiology does enhance in a way they don't have access to. what do you think?

>> i agree from that view, she did grow up and went through mail puberty. look at her on the blocks when she's standing next to the other girls, she happens to be very tall but she's a very big advantage in swimming, they have bigger hands, longer reach, bigger feet and propelled themselves through the water. that is an advantage and she went through that because she went through mail puberty. i have from the beginning urged ncaa to look seriously at their rules because obviously this is not working. lia thomas is going out there and taking metals away from biological women. i have said from the beginning i am for women's sports, i am for women in sports and i have worked over the years to do that. unfortunately in this case it just hasn't worked.

ncaa has to really tighten up their rules. kennedy: how do they do that? who do they take guidance from if people are scared to admit some of the biological differences and it doesn't have to be from a place of moral judgment at all whatsoever. you can be welcoming, you can be encouraging, you can be uplifting but at the same time if you have strict standards in terms of doping, you also have to have criteria for how people compete and lia thomas should be able to compete somehow but maybe not in the division i women's category. >> the problem i've had is obviously the ncaa and division i and what they've done. they've opened this box up and everything has come out. she said in an interview, and i

agree with her that when she went through her transition, so much weight came off her shoulders. she felt happy for the first time and she could compete and be happy. she was never happy as a male swimmer. i am all for that but her happiness is the extent of the happiness of the other competitors. you have to look at it, i don't think the women who got just out of place for the ncaa finals are happy that she was in the competition or they would have been it. we live in this world, we go back to that where here she is the university of pennsylvania, ivy league school as woke as you can possibly get, especially one of the first start issues started coming out. the other swimmers were saying this is great, we have a trans athlete and slowly over the

season people started coming up against her. people were having to say something and not identifying themselves. that's a shame, that is the world world going amuck. kennedy: abc but bring up great points, people are anonymously coming out attacking her. they are maligning lia thomas and when they should be taking on the people who make up the rules who want to look the other way and skirt responsibility who create so much discord and i think that's the unhealthy environment they've created, we will see what happens. i have to talk to steve hilton but come see us in person very soon. >> that's it? that's it? died from drug overdoses last year. how many did he prosecute the main cause, how many? zero, not a single one. how can you say it's nonviolent? the reason for the nonprosecution he gave his they are worthy of the prosecute the dealers from honduras, they will be at risk of deportation. this is how crazy it is, so crazy even far left san francisco looks like next tuesday to be kicked out. kennedy: they are that up with it because if people aren't going to san francisco as tourists, that means all those great wonderful shops and restaurants owned by individuals, those of the first ones to go under book stores and boutiques and everything, what gives san francisco its characters? that's truly what is being hurt because the reputation of the city has not been bolstered by

people doing criminal justice reform the wrong way. yes, there's an argument of this against over incarceration in this country, no doubt about it but when you let people out who are going to hurt and kill other people, you are doing your city a great disservice. last word. >> exactly and is not just -- people are leaving. the population is plummeting, nearly 10% drop. that is huge, people leaving, they don't want to be in the city, number one reason people are leaving san francisco is crime. it happened so quickly, that's why it is a direct piece of evidence about whether policy of progressive's criminal justice reform works. it only works in one direction, higher crime, people hated . kennedy: high crime, high taxes. impossible to live there because you pay so much in taxes and for

settles and they will get laid off. so what does the biden administration say? they are blaming putin, blaming covid, canceling student loan debt and spending billions upon billions of dollars and sending them to ukraine. i think this inflation issue is the issue above all other issues and i think there is a reckoning, and november, the likes of which i don't think many americans can fully comprehend right now. kennedy: one, you have kids and grandkids, what you tell them about their money? you think we are looking at an entire generation that would rather have nice things and pay bills? >> that is not a bad thought because part of the story people live in high income cities. if you live in new york, washington d.c., and physical, l.a., the cost of living is outrageous and why you have

people who make big money and say i am scraping by, i've got to send my kids to a fancy school, be a member of a club or whatever and then they are hard-hit but the basic fact is not just this administration but even before, it was the case like 60% of americans said they were hit with a bill for $500 monthly couldn't handle it which is shocking but that is the reality. in you can try to make it political and it might get worse but that is the reality for so many americans right now. kennedy: the reality also is that taxes are too high. when you earn that much money, you have been demonized and the government, local, federal, they have no problem coming in confiscating your hard work. >> i love that because it is accurate. i'm not trying to excuse all of this, i think we have financial

literacy problem in this country, we don't teach kids how to invest were even before inflation, a lot of where people spend more as they start making more and all of that is problematic but when you want to get down to the gist of it, it is the government robbing us left and right and as you make more money you lose higher and higher percentages of that. i've seen it myself so people who want to demonize people when you have kids and pay for schools, schools are crap and people want to pay for private schools or home schooling and adds up quickly so we need to look at the factors in figure out what we can do to get government out and then figure out how they can pay their bills. kennedy: you have an entire generation being propagandized by aoc, you don't have to work for anything, if you're able and willing to work, the government will just give you whatever you want. party panel, thank you so much. wonderful, beautiful and amazing well done tonight and topical storm is next. ♪♪
