"the evening edit" starts right now. ♪. elizabeth: okay, welcome to the show. we're going to start with your money. stocks mostly lower and volatile trading today. the nasdaq eking out a gain. s&p fell further into a bear market. markets are trying to find a tradeable bottom as record inflation has the federal reserve on track for more aggressive rate hikes this week. rate hikes historically lead into recessions. jpmorgan, other wall streeters they have been warning just about that edward lawrence has more in washington. reporter: liz, president joe biden brushing over the inflation we're seeing saying he is laying the groundwork for foundation after new economy we

talking 0.75 basis-point hike, not a half-point. joining us congressman darrell issa from house judiciary, along with forbes media chair editor-in-chief steve forbes. you heard what the president is saying. there is major discontent with elected officials, steve. we're seeing number of attempted recalls more than doubling since 2019. when you heard the president talking about inflation, what was your reaction? >> still in a budge, still feeling if you shout loud enough, trying to paint a rosy picture enough people will fall for it. people won't fall for it. they go shopping, buy gasoline. see what's happening. they have a feeling, rightful feeling, this government and federal reserve are at loose ends. they don't know what to do. they're in unchartered waters it shows by what they're saying doing, and not doing. elizabeth: take it back to representative, congressman, darrell issa. you heard what steve was saying,

congressman. crime, inflation, it is really driving voters in primaries in five states today, maine, nevada, north dakota, south carolina, also texas. congressman, people don't feel safe. they don't like the mayhem. why did it take so long to deliver legislation to increase protection for supreme court justices at their homes? >> it was a about politics and nancy pelosi and aoc. i think maybe the elections in san francisco began to be a signal to even nancy pelosi that law and order, enforcement of the law, all are starting to matter to voters including democrat voters in droves. obviously swing voters are coming to the republican party but you know, look, steve said something that i agree with almost 100% which is unchartered waters but in some ways in the '70s under jimmy carter we've seen a lot of this. what's different now is, we've got a broken supply chain that can be fixed in addition to runaway inflation and the beginning of a real recession.

elizabeth: you know to the congressman's point, steve, president biden has been losing his base. quinnepiac sees a drop in approval among hispanics women, millenials overall. he is underwater in 48 states in a new poll. so underwater he sneads scuba gear to get out. we said time and again. president is trying a new tack, trying to yell his way into better poll numbers. watch this. president biden: 100 million people have preexisting conditions. the only reason insurance company has to cover it is because of that law! by the way, republicans like portray me as a big spender. we have spent a lot of money. this year, by the end of the fiscal year we will have cut the federal deficit by another $1.6 trillion, in one year! when they come to you talk about big spenders, let them know, i

pre-pandemic employment picture. the economy is visibly slowing down now. it was negative in the first quarter. may be barely positive in the second quarter. for most people they feel they're in recession already because their incomes are being outpaced by rising prices. so when he makes that kind of talk people are wondering what planet he is on? people will react. then you have the federal reserve, liz, think you conquer inflation slowing the economy down. they are heading us for a recession, they believe only by recession they can cure inflation. how about stablizing the value of the dollar. that they won't do. elizabeth: that is a great point steve just made. you know, congressman, this is what the president is now talking about, he is talking about, he is claiming he is bringing down the deficit. he is wrong. $2.8 trillion deficit is second largest in u.s. history. it is going down because massive temporary pandemic spending is expiring.

pandemic spending tripled deficit 3 trillion or more. the 1.5 trillion biden is citing it is projection. 360 billion lower. way lower than the cbo projected. deficit is still bigger if congress didn't do anything and stand on their hands. >> you're exactly right, the permanent deficit, the permanent deficit is here, it is here to stay unless we increase productivity and prosperity. when he talks about the strategic petroleum reserve you know that is spending your savings thinking in fact it is income. income is new oil coming out of the ground. it is not what was saved up under the last administration being sent out. it won't last. he knows it. it also by the way didn't bring down the price of oil because oil is based on future and future is not bright unless we get not just asking saudi arabia to produce but we get back to producing that surplus we can produce. by the way until we start

producing natural gas, you will see those german and other countries turning back on their coal usage and that in fact is bad for the environment in many, many ways including not just climate change but coal is a fairly dirty energy. we have a cleaner energy. we used to export it. we're not exporting more of it until he allows that and shutting down federal lands, not granting permits which he has done by executive order, that is what is causing the future market to keep going higher that means higher prices not for everybody just now but in the future. elizabeth: i tell you, future, biden will be 86 if he wins another term. he is up against a more dynamic, potentially could be ron desantis, rick scott or we're taking maybe tom cotton or mike pence you know? so he has been around since the nixon era. his policy shop has been empty. not much of a track record. we thought he was going to unify the country. boy he is really threw a

ramping up? david punt spunt is in washington with more. david. reporter: this is significant step protecting not only supreme court justices but also members of their families. last month senators introduced a bill that would give more protection to the justices and members of their families. not even a week ago a man threatened to kill justice brett kavanaugh. members of congress in both parties are frustrated it took so long to get to the house floor today. house majority leader steny hoyer told reporters the reason for the delay, democrats wanted to offer protection to family members of court employees, for example, not only family members of let's say, justice kavanaugh but family members of his clerks. ultimately that did not make it in the final bill. but some democrats still want it. >> republicans failed to protect families of supreme court

employees who are at risk. shame on you for doing that. reporter: white house says the president supports the bill to protect justices and members of their families. as soon as it gets to his desk he is expected to sign it. liz? elizabeth: thanks for coming on. we have congressman dan bishop. always a pleasure to have you on. there are new details about the wannabe kavanaugh assassin. nicholas roske he came by cab with a gun and ammo. he saw u.s. marshals, texted his sister, talked him out of it, called 911. his lone sister stopped him. >> that is not heartening, is it, liz? the issue, left is protesting outside of justices homes. they published addresses of justices homes. the tweet came out from the group named after ruth bader

ginsburg, i can't remember the name, posted church of justice barrett and the school her children go to school. you wonder how low they go. we could have done it friday easily by unanimous consent on the floor. democrats delayed the bill to provide additional protections to the justices families. i'm glad we got that done today. elizabeth: we have 27 democrats who voted against it. watch house minority leader kevin mccarthy watch this. >> for some reason we continue to come to the floor, you feel some pressure on that bill, but you change it, the country will know why, because if you change the bill, and move it back to the senate you're trying to kill it. you're trying to delay it. that is exactly what you're doing. i think you're jeopardizing peoples lives. i think you're jeopardizing the safety of the supreme court. i think you're playing more

games than anybody in this country can understand and we do not understand why. because there has been no cheap answer. why would you hold the bill for more than a month? why would you hold the bill after somebody's arrested that traveled across the country to kill a justice? why would you continue to hold the bill now? elizabeth: so why? >> you have got to wonder if there is any bottom to their conduct, liz. i certainly can't explain it. as you said, 27 voted against it today. if, notion was they wanted to extend the protection to the families of clerks, well, if that is the case, it seems like maybe they know the identity of the leaker, that america still don't know a month 1/2 later. whatever the reason, i think the leader had it right. leader mccarthy, what are they doing? this is, i have, america has never witnessed this kind of trampling on institutional norms and disregard for the safety of those who are most important in our system of justice.

elizabeth: you know senator elizabeth warren today criticized for using inflammatory rhetoric. the senator said quote, extremist supreme court is poised to overturn roe v. wade now is not the time to back down. is this all about intimidation? that is how the left operates? we got reports that the neighbors of justice kavanaugh are scared. protesters have shaken up their homes, disrupted their lives. they're scaring children. justice barrett and kavanaugh have children. they're protesters are abusive. they're shouting things like f-you, f-your children. this could get worse. protesters are chanting riots could happen if they don't get what they want. neighbors say overwhelmingly people from outside the area are organizing the protests. they fire bombed pregnancy centers in and attacking churches too. >> there is no decency on the left on this issue. they consider themselves not to be constrained by any sense of decency whatsoever.

the story that you made reference to talks about children being afraid in their homes, children of neighbors of the justices. they can't be put to bed at a normal hour because of ongoing clamor outside. is there going to be any decency? is there any left? elizabeth: january 6th was a horrible day. january 6th was awful. we have the january 6th hearings going on but we hear silence from nancy pelosi, chuck schumer, democrats about illegal protests at justices homes. they're playing with fire. ag garland still not enforcing the law. harrassment and intimidation of our justices at their homes is illegal. top democrat hakeem jeffries, is equating republicans calling for protecting justices bringing up the quote, january 6th insurrection. how can you tie the two? >> i always said and said on the floor today, liz, when we were getting ready to pass the bill, there is not a republican i can name who has failed to condemn the violence on capitol hill on

maybe get a deal there. they have released oil from the strategic petroleum reserve. they are doing everything about it. elizabeth: the white house is downplaying the president's trip to saudi arabia claiming it is not about oil and gas. watch this. >> i'm saying there is nothing to preview for you at this time but i will say this, you know, to view engagement with saudi arabia on energy security as asking for oil is simply wrong and a misunderstanding of both the complexity of that issue and our multifaceted discussions with the saudis. elizabeth: so why are we wasting taxpayer dollars on the trip, right? so why is he going? so again, why is he going then if it is not about oil and gas? >> well, it is probably the only other reason is to reverse one of the biggest strategic geopolitical blunders in recent presidential history, right? you know the way he came in and bludgeoned saudi arabia policy, failed to take into account the intricacies of the middle east,

right? and that even though we don't like saudi arabia and they're not our favorite people we still had a lot of strategic interests with them and it is going to be interesting to see the difference of his arrival in saudi arabia unlike president trump who is basically welcomed, you know, you know, hero's welcome, right? because of his policies of being tough on iran, saudis loved him. because of that, you know, we saw some of the most significant progress in the middle east towards arab countries recognizing israel. that was all under president trump. elizabeth: here is the thing. the u.s. went from 12.9 million-barrels a day in u.s. production to 2019. it plunged to 9.7 million in 2021. it is 11.9 million. we have 270 million barrels to

229 million. keystone pipeline, killed 11,000 jobs, cancel oil leasing in the gulf, pushed banks to defund u.s. oil and gas. we have so much going on with what the white house is doing to undercut u.s. energy. now we've got five states in the west, new mexico, colorado, utah among them saying it will be impossible to build out the half million electric charging car stations that white house wants. biden wants that infrastructure but not existing u.s. oil and gas infrastructure? >> yeah, absolutely. listen, president biden's dream to electrify america, we don't have the power grid for it, right? we don't have the technology to power the power grid right now. we're having blackouts not only places where they have droughts, places in the midwest, indiana, other parts of the country. this is why his energy policy is totally out of touch with america and out of touch with reality and that reality -- elizabeth: talk to you about

this. this is serious stuff. >> yeah. elizabeth: u.s. oil and gas infrastructure, the pipelines and refineries, phil, they're getting hit hard by activist protests lawsuits, regulations. phil, you've been all over this, now the dakota access pipeline faces threats. not just keystone this is indispensable. over half a million barrels of oil each day from north dakota to midwest markets. far left groups continue to assault it with lawsuits. if they get their way oil could stop flowing. they're trying to shut down u.s. refineries too. there are only 129 refineries this year versus more than 140 four years ago. >> they're putting peoples lives at risks. we're seeing reduced production from north dakota because investors don't want to invest, they are afraid if they invest money to produce more oil they won't have a pipeline to ship it. they're not doing it. president biden is calling out the energy industry, why aren't you drilling? because of reasons like that because they don't know if

elizabeth: okay, the president's broken border, it's fueling the rise of dangerous drugs and crime in our nation. we're talking indiana, kentucky, ohio, montana now seeing record overdose deaths driven by fentanyl and meth. bill melugin is at the border with more. if you have kids nearby or children, watch out. some of what bill is about to report is pretty graphic. >> reporter: the numbers here are just nonstop. a dhs source telling us over the last 24 hours alone in the rio grande valley sector upwards of 1,400 illegal crossings, and we've gotten to witness that ourselves. take a look at video about 40 minutes away from where we are right now. this was a single, massive group of around 250 illegal immigrants and who crossed into texas. and mixed in with that group

were 138 unaccompanied children. listen to this. just since october there have been more than 85,000 of these unaccompanied children found here at border. just to give you an idea of that perspective, that is enough to fill up the dallas cowboys' stadium and still have some left over when it comes to these unaccompanieded kids. this second piece of video, more of that large group we saw last night. a dhs source telling us in the last two weekes alone here in the rgv, more than 20,000 illegal crossings including numerous sex offenders and ms-13 gang members, since october more than 3500 -- 355,000 illegal crossings here in the rgv. and listen to this, this is bizarre, they arrested a sex offender from el salvador who was sentenced to 20 years for forceful penetration of an inanimate object. no further details on that one. back yo who -- back to you. elizabeth: what a story.
