"the evening edit" starts right now. ♪. elizabeth: we begin with your money. stocks did end lower today after posting back-to-back gains and to this fight that could hit the midterms and affect policies hitting your kitchen table and your wallets. a weekend of protests. the fight over the supreme court overturning roe v. wade. police shot off tear gas as rioters attempted to storm the arizona capitol building in phoenix. protesters marched on city hall in philadelphia. they tried to shut down the freeway outside of l.a. there is a attempted murder charges against a protester there, trying to use a flame thrower to attack a cop. the fbi investigating that. protesters also broke through police lines in d.c. pregnancy centers attacked in

virginia and colorado. there were multiple arrests in greenville, south carolina and in portland, oregon. hillary vaughn has more in washington. reporter: good evening, liz, some democratic lawmakers are making the case because the high court overturned roe v. wade that makes them illegitimate so they want to expand the supreme court. white house press secretary karine jean-pierre was asked over the weekend if the president is open to adding seats but she told the press the president made his view clear on the issue. he does not agree with expanding the court but some other democrats are looking to kick justices off the court because they feel some of them lied under oath when testifying to the senate before being confirmed. >> this sends a blaring signal to all future nominees they can lie to duly-elected members of the united states senate. i believe lying under oath is an impeachable offense. reporter: as protesters take their protests to justice's

doorsteps the republicans are warning the doj to draw a line for people protesting outside supreme court justice's homes. >> if we don't draw a line someone will get killed. if we don't reset here pretty soon, somebody is going to get killed. reporter: liz, the president did on friday tell protesters to keep things peaceful but he also made a point to single out the supreme court justices that were nominated under president trump, saying they are to blame for this decision. liz? elizabeth: hillary vaughn, great reporting, thank you so much. joining us congressman tim burchett along with fox news contributor liz peek. great to have you both on. there were protests but not the civil war senator chuck schumer and democrats claimed congressman that was going to be coming and polls show don't like seeing u.s. institutions attacked. the democrats are attacking the institution of the supreme court

itself. don't attack the institution. it is about the individuals on the court, right? >> apparently. i walked out there on friday when it happened, liz, and democrats were two or three deep with security details, i walked up there basically by myself. it was a group of christians out there singing and celebrating, rejoicing really. a group were holding hands in a circle the one of the congress ladies, i guess, hurled some insults at them. i thought, what a change it is when, if it had been the other way they would have been tearing up the streets like they had for a whole summer and then the basically the liberal media would be denouncing denying the whole thing. i thought it was a great change. elizabeth: the fight heads to the state courts, liz. democrats say this will hurt the gop in the midterms. white house talking about paying for transportation of women seeking to cross state lines for abortion. the polls show voters say the

economy takes priority over abortion. what do you think? >> i think always it's the economy. it has always been that way, liz, and as inflation continues to really hurt peoples pocketbooks i think that is what we're going to be talking about going into november. look, i think this ruling by the supreme court has undoubtedly energized democratic voters. we've seen that in the polls but it has energized some republican voters and what we've seen over the last several months is a real strengthening of the republican brand for a lot of reasons, not just inflation. it is also the border. it is also crime. if we're talking about suburban voters it is particularly the crime issue that is weighing on their and also the economy is weighing on them. so i think this is a important development. i don't think it is going to be determinative. elizabeth: what liz is saying, congressman, the court majority

ruled basically abortion is not in the constitution. that it should be left up to the states. you have to start persuading state legislatures and courts if you want it there. the women's groups are saying it's a privacy issue. they're quoting lines, for example, from the show, the west wing, that conservatives want to make government small enough to fit inside offer one's bedrooms. democrats say it's a racial issue and issue for poor people. >> i think they're just grabbing at straws, liz. the lady there is correct, it's the economy. i just filled up my gas tank today in tennessee and it is ridiculous. people are disgusted about it. they're trying to take focus off of what is obvious. fentanyl, the border, afghanistan, all the disasters that have just evolved and circulated around this administration are very apparent. i think voters understand it. they are going to show that. elizabeth: liz, to what the congressman is saying too, you know the vice president kamala harris is leading the charge to rev up the democrat base but the

vice president criticized this as tone deaf. she tweeted quote, we're in this fight together but then she posted an image of herself 35,000 feet above-ground on air force two. >> watching tv, liz. that is really, you know, mixing it up with the masses. i don't think either joe biden or kamala has has much heft to get voters to the polls or rouse their pro-democrat instincts going into the election. that is where they are their approval ratings are so poor but i think there will be tremendous amount of pressure on the white house, jo ebb jobe particularly, to do something about protecting abortion rights, whether the fda claiming it has jurisdiction over transportation and distribution of abortion pills, whether setting up abortion clinics on federal lands. my guess they will respond with something but the hope should be, liz, i think, that over time where the majority of americans

sit which is in the middle on this issue, not the extreme of democrats saying abortion at nine months is perfectly okay which is absolutely heinous, or the other extreme saying no abortions ever, including rape and incest, most people aren't there. i would hope most state legislatures ultimately really sort of serve their constituent by coming up with laws that their people approve of. that's what all these protesters should be focused on. elizabeth: interesting. >> trying to convince legislatures. elizabeth: europe has more strict rules on abortion than the u.s. does. >> yeah. elizabeth: conservatives are talking about how we have lax rules on abortion like china and north korea where abortion on demand beyond the 15 weeks like they have in europe but there is also to what liz pointed out, at least 100 nations have over-the-counter birth control. not the u.s. there is fear justice clarence thomas is writing future cases could affect the due process precedent on things

like same-sex marriage and contraceptives. more than half of abortions are done by pill. this is going to be a interesting legislative push. it is going to the state courts, congressman. this fight is inside of the states. how do you see it playing out? >> i see it 100% playing out in states. the pro-abortion crowd is basically lying saying overturning roe v. wade ended abortion. all it did was kick it back to the states. tennessee had trigger laws. most conservative states are moving in that direction. it will end up in the states where it should have been in the first place. that is where the battle should be. elizabeth: persuade voters there. democrat stacey abrams, stacey abrams talking about companies disney boycotting georgia over its abortion laws. liz, didn't that backfire when they got major league baseball to pull the game out of georgia after abrams ignited backlash

♪. elizabeth: look who's back, joe gamaldi, the national vice president of the fraternal order of police. joe, we love you. you're a straight-shooter. joe, this is outrageous. it's washington, d.c., right in congress' backyard. they just hit new milestone in crime. 104 homicides already this year. this is the earliest this ever happened in almost 20 years. when last year was already a record for crime. they're pathetic, joe. they defunded cops. they let felons out. what is more after civil rights violation than letting somebody out who goes on and assaults or kills an innocent person? d.c. defunded cops. homicide rate is up 16%. take it on, joe. >> i tell i think this is what happens when you see a bunch of incompetent people left to run a sy. these folks were so quick to defund the police bandwagon, they never thought how this would impact their community. shocker, it has been complete and utter disaster.

murders are up 1%. carjackings are up 33%. robberies are up 34%. overall violent crime up 13%. you know what their response to this was? they deployed violence interruptors. i don't know know what the hell that is, to replayer police officers, in neighborhoods they put them out in crime actually went out. so now they have done such a good job of demonizing, denigrating the d.c. police force, they can't find nick to take the job. they're offering 20,000-dollar signing bonus which nobody wants. they can't find anybody to take the job. they're working the officers to the bone tune of million hours of overtime. leadership of d.c. town is completely incompetent. they put their agenda over the lives of people they swore to serve much. it is despicable. >> will they chuck schumer or nancy pelosi call them a violence interrupt tore when

something happens to them? massive amount of d.c. cops leaving. 500 in last three years. it is at the lowest level of cops in decades, 3400. vote remembers weighing crime and inflation in seven states tomorrow including illinois. joe, this outrage. fox news contributor giano caldwell, his little brother was shot and killed in chicago friday. he was only 18 years old. this is a killing fields of chicago. 25 people shot there this weekend including a five-month-old baby girl. it's a national disgrace and chicago just stopped cops from chasing perps? what are they doing? >> you know first up. >> let me say thoughts and prayers are certainly with gianno and his family after this tragic incident and it is stark reminder all these statistics we talked about people being murdered, these are people, sons, daughters, father, mothers, families impacted forever. you would think mayor lightfoot could take a break from cursing out supreme court justices, classy i know, to actually deal

with the violent crime that is gripping her city. in response to it, you know what they do? they tell police officers you're not allowed to chase anybody anymore. just when i think they can't get any dumber, they actually decide to neuter our ability to chase people, to coddle criminals even more and stop police -- you're telling criminals, run from the police and we won't chase you. i cannot think of anything dumber than that. that. they think it's a great idea. you know when they're lying, liz? when they tell people it is going to benefit minority communities, when you know damn well it will hurt them even more because they're disproportionately impacted. >> they said it was racist to keep felons in jail during the lockdowns but let them out and now they're killing and assaulting minorities. victims of crime now, they're standing up saying where are democrats on the civil rights violations? they let criminals out of prison again and again. you've seen it who went on to

making jokes about putin. really transformative, kind of elevating the debate they're. your reaction to the president and g7 talking a price cap on russia's oil to starve russia out of its revenues it is using to finance the war in ukraine? here is the thing, congressman. it is already backfiring. oil is going up anyway. it could create loss of supply. why didn't they do it before with iran or venezuela? >> first of all it is not going to work. if it was going to work they would have done it first. you can't put a cap on oil because the rest of the world will trade it on dollar value. president putin will sell oil to a country and think will cap him? you think that will work? they're making record profits with respect to oil because they're selling oil to other countries not participating in the sanctions this is political foolishness from people who frankly do not understand how economies work.

who do not know how to deal with somebody like vladmir putin. elizabeth: to your point, u.s. consumer sentiment, looking at the university of michigan report is out. it is lowest level since 1952. so that is what is happening here in the u.s. i mean we're crashing in consumer sentiment. it is worse than the great recession. watch the president on russia and ukraine. watch this. >> president biden: for all those republicans in congress criticizing me today for high gas prices in america, are you now saying we were wrong to support ukraine? are you saying we were wrong to stand up to putin? are you saying that we would rather have lower gas prices in america? elizabeth: you know polls, you know what -- polls polls say yeah, we would have lower gas. all democrats have done is drive up the price of oil and gas to u.s. consumers with their attack on energy. look at this stunning findings,

quote, we need more oil and refining capacity but the president just killed a major oil refinery expansion in may just five weeks ago. he is destroying u.s. energy infrastructure as biden and the g7 leaders, they're now saying we'll spend $600 billion including u.s. taxpayer money to take on china's belt and road push to dominate world infrastructure? >> well, two things. number one, we should have been in the game with respect to global infrastructure because china is on the move. let's put that one to the side. number two, what joe biden did here in the united states was reckless, fiscal economic policy and not to mention energy policy like you just stated. if you want to see oil prices come down, if you want to see inflation uncontrol, washington has to control its spending. that is number one. number two the federal reserve has to get back in the game, which they're starting to do, number three, most importantly you have to take shackles off natural gas and energy companies that will send a signal to the

market they're prepared to produce more oil and put more oil in the united states. elizabeth: that is the way you do it. that is supply side stuff. that is what other presidents would have done. you unlock the power of u.s. energy to bring inflation down to go after putin. when we talked about with larry kudlow on the show, when oil goes up to 100 that is when putin starts invading. he did it with belarus, moldova and now ukraine. russia is cutting off gas into the nord stream 2 pipeline. why not just get u.s. energy in on the stick to take on russia here? >> because if he unleashes u.s. energy he is going to have a problem in his political base with the people who want this green new deal. they are so wedded to this thing, they refuse to actually acknowledge the realities on the ground. they still think nuclear energy is taboo. they don't want natural gas, they don't want oil. elizabeth: got it. congressman donalds, come back soon. it is good to see you.

her she would be stepping behind her, taking her both in place if she was intended to doing. that is not what the video shows. it just shows her heart. elizabeth: elbow checking kids, used to be said the most dangerous place in the world was between a stick mic and chuck schumer. now pelosi in photo-ops. i don't know, what do you think? >> can you imagine if trump did that to the child of a democratic congresswoman, the outrage that the mainstream media would have? there would be calls for his third impeachment. calls for criminal charges for battery and unwanted touching. you wouldn't hear the end of it. you woe see the video everywhere you look. they're not showing that on mainstream media. of course not. elizabeth: this shocker for the democrat party, the associated press analyzed voter data and reports more than a million voters, looks like 104 million voters across, excuse me, 1.04, let me back up. i made a mistake, i'm

clarifying. 1.04 million voters across 43 states switched to the gop. this is happening in the suburbs. what do you think of this? >> yeah, it is not surprising at all with every crisis that joe biden put in place, border crisis, crime crisis, record high inflation, record high gas prices. i recently talked to the state party chair, our counterparty chair here in sarasota county, 800 more republicans, 800 republicans to 300 democrats register just last month. that is more than the double the amount of democrats in sarasota county. that shows you a trend of people coming to florida, registering to vote, more than twice the. amount of people recommending sistering republican. shows exactly because of the democratic policies this white house put in place. elizabeth: well-educated swing voters turned against the republican party. now they're swinging back. congressman, talking suburban counties from denver, atlanta, georgia, pittsburgh, pennsylvania, cleveland, ohio, a

elizabeth: joining us now, former assistant attorney general tom dupree. great to have you back on, sir. what is your reaction to this story? new york post saying based on hunter biden's laptop email texts that hunter met with four oligarchs closely aligned with russian president vladmir putin while biden was vice president. what is your take on it? >> this is significant reporting. seems every day revelation is piled on top of revelation. this is particularly significant because it links under hunter biden links to russian oligarchs connected to vladmir putin. they presumably wanted access to then vice president joe biden. elizabeth: they are pretty powerful oligarchs. the "new york posts" claims one of them, rather, was wanted for

murder in russia, citing a meeting with the post, sighting a meeting with ismalov it took place at the headquarters of his holding company. that oligarch was accused in 2017 by russian authorities for paying two million dollars for the murder of two entrepreneur a year prior. >> these are not boy scouts. they play serious hard ball. this is fascinating intriguing, raises serious questions were they want to meet with hunter biden. what is sear about this, this is not coming from political opponent of hunter biden this is coming from his own documents, emails and records on his own laptop. elizabeth: reporting what they found in the laptop in february 2012, days after hunter returned from russia, hunter met with then vice president biden in the naval observatory. that is what the calendar shows. so this seems again about the

all along. we had russian billionaire widow of ousted mayor of moscow who is now deceased, she had wired 3 1/2 million dollars for a consultancy agreement for an investment firm founded by hunter biden that happened in 2014. that was, tom, looking at this that story was always felt like the tip of the iceberg. that there was more action going on in russia between hunter biden and the bidens than realized. >> i think there is a lot more than meets the eye here, liz. what is interesting about it, all these stories, these revelations, like i said earlier every single day some new revelation. this is not driven by prosecutors, rather the media who are reporting this. that is how we're learning what is going on here. at some point it would be nice if there was some sort of official investigation brought to bear on all of this. elizabeth: tom, what bothers you the most about this story? >> what bothers me the most i worry that there is some deferential treatment going on
