the reality is, it's because they see exactly what everybody else in the country is seen and they know it's not normal. they know the confusion is not normal, it's not normal for the president to be that lost. i'm a little sad we didn't get the man we were getting because at least somebody would be in charge. the fact is we have a rudderless white house and the results have been devastating for the country. when they say judge him on his performance and not his age, that's not a good look. the two of them are absolutely connected, the age is an issue, his confusion, lack of mental stamina is an issue and we are seeing the results. kennedy: there plenty of 79-year-old who are spry incompetent, wherewithal and drive and stamina and can stay up past 4:00 p.m. our president is not one of them so what is the solution here? >> i would disagree.

and then puts it behind her back again in her invisible handcuffs. one 16 congress members arrested for blocking traffic. aoc and fellow squad member omar, no word on whether daddy -- brother was there. [laughter] escorted out, none of the members were put in handcuffs. they only faced a small fine. if anything, why can't they stop being so dramatic? is that too much to ask? >> they can't. this is why it's hard to take them seriously when they talk about any of these issues, these are deeply unserious people at their core. these are not serious people maybe aoc's defense, wonder woman has the indivisible airplane, maybe the cops should deploy new technology, invisible handcuffs in her and omar, by

the points, the assertion kevin laid out, i think one of the real problems pro-choice crowd has is they never seem to want to take on the argument pro-lifers are presenting and you could say is a constitutional right even though it's in the constitution, okay. you can say it's a right want to control -- but look, he alluded to it, right? the pro-life argument is killing a baby inside the womb is morally interesting to shovel from killing a baby outside the womb and none of them seem to be prepared to actually take on that argument, they can find extreme circumstances which most people believe usually should be exemptions, they can claim it's a right but it seems like pro-choicers want to take it on and my suspicion is because there's not a great counterargument to it. kennedy: they just want to stop

and say it's about healthcare, it's about reproductive care. it's not and i may disagree with dave whether or not it should be a choice between a woman and her doctor but what i don't disagree about is an incredibly serious act, it's not something to mock, not something like a nonsense jerk head, foul language, kevin but you are talking about the death of the thing, whether or not you think that is part of a woman's body, that will no longer exist after the act and that has to be acknowledged if we are going to have a serious argument. last word, kevin. i will get you a lot in the next segment, chris. >> pro-life and pro-choice protests we've seen at the

early when for twitter, lawsuit against elon musk they forced the world's richest man to buy the company $44 billion. the judge ruled in twitter's favor for expedited trial, musk's team wanted to delay to round-the-clock the possibly avoid the purchase. they rejected the request and set a trial date for october going for the delay risking harm to the company. how bad is this for elon musk and how much damages already done? attorney northwestern professor, andrew stoltmann. you could argue twitter has

already taken enough income to damage the company's reputation and people don't believe they have only a 5% twitter bot rate. >> that's the 64000-dollar question and if it ends up that esther musk is right and there's a much higher percentage, 20, 30, 40% that are bus and twitter has a major problem, huge problem because advertisers have been paying inflated rates for really long time and they will demand their money back. kennedy: at least 30% estimates are to be believed, discovery would obviously be shorter. musk's team wanted about six or seven more months, can they still find what they need to to prove twitter was defrauding them? >> that's a great question, that's why we will see a counterclaim for fraud from mr. musk because i think the increase is he can get a delay or at minimum, instead of a five

day trial, two or three week trial so that's next to him and what we will see, is that enough time if the trial goes forward in october? i don't think so because there's a massive amount of information, multiple experts that need to be retained so i think october problematic for mr. musk. kennedy: it seems like it would be difficult, maybe not impossible to get and present what he needs to in order to make that critical case. what's going on behind the scenes? it's hard to tell his motivation, those aren't always evident but maybe he's just trying to drive the stock price, purchase price down so he can get it for a bit of a bargain. i want the deal to go through, i'd love to see elon musk by twitter and take it private. is there still hope of that happening and how? >> i think there is a chance, i think all of this might be a ruse mr. musk to try to get a price down and if that is what

he's doing, he's been really successful. i think there has to be a settlement between the parties, neither side has a big advantage of going forward with the trial. we all know mr. musk is a gambler and has a history of going to trial with various dependent plaintiffs depending on the situation but this is high-stakes gamble because even the world richest man if he's got to come up with $44 billion, it's a major hole in his big wallet. kennedy: but even if he lost one or 2 billion, he's still way ahead of us, isn't he? i think he takes a gamble and i think there's something else going on here and you are right, it is not be who have twitter to draw this out because it puts so much attention on the negative. we are not talking what a great and necessary platform it is, we are talking about a giant tech company lying to people about

who's actually using it and the power they have over there users to center content. that's what we will continue to talk about and as long as we are talking about that, the company is valued at less and less and less so even if they settle, doesn't make sense to settle unless it's on a lower stock price. what is the chance of that happening? >> i think there's a pretty good chance if i was a betting man, i would say oligarchs at least 50% the deal still go through only at a significantly lower price and i think that's what mr. musk wants a lot of this has been the ethics by him in a gambler so i think he's trying to hammer this down and i think he'll be successful. kennedy: i don't know if you saw his white torso but if he does go before a jury, he could claim vitamin c deficiency defense and he would win. andrew stoltmann, always good to talk to you. coming up, prince harry does it

have decriminalized property crimes and violent crimes and all of a sudden there like rudy giuliani prosecutors when somebody defends themselves or their property we at the libertarian party, we call for charges to be dropped immediately after this guy was charged and it's like the idea that there's no right more important, inherent in the right to defend yourself and your property. if you don't have that, you have no freedom and progressive prosecutors are like out to lunch on this issue. kennedy: especially in an era of such lawlessness. this could be one of the most important political coalitions, the one for criminal justice reform but the older progressives are doing it wrong, they are just wrong because they are terrorizing victims and then people who are violent to meet

francisco and l.a. that have all seen crime spikes, how do we get to where people respect each other and there's a disincentive to so easily hurt people and throw away people as though they are garbage? >> that's a critical question. i think one keeping is visibility, we need more police on the street, i'm a democrat who supports increasing funding for community policing, recruiting more police officers especially in these key cities expansive this kind of criminal activity, these waves and we got to crackdown on violent criminals. i'm all about police reform when it comes drug crimes, position crimes. we talk about this all the time that we need to reform that and let the folks out that are serving life sentences.
