"the evening edit" starts right now. ♪. liz: welcome to the show. check your money. stocks ending up. it was choppy action in trading today. stock market reversed early losses after surprises and steep contraction in new york area manufacturing activity indicating a slowdown. we've got new details on the potential fbi overreach. former president trump claims that the fbi took three of its passports in his search of his florida home and documents protected under attorney/client privilege. fox news's steve harrigan in palm beach, florida, with more. steve? reporter: liz a real battle shaping up over potentially unsealing the affidavit that was behind this raid.

president trump also firing back saying document the should be returned to mar-a-lago. he says they are protected by attorney/client privilege. he also called the fbi raid a sneak attack on democracy. the biden white house pushing back saying there were no politics involved but decision was made independently by the department of justice. also they say filter teams are in place to protect any documents that do have attorney/client privileges. at the extent a number of republicans officials current, former still pushing for more transparency. they fear an open-ended investigation. >> what i thought they were up to here was basically trying to do a fishing expedition to see if they could find information that's relevant to the capital riot that might help them make a case arising out of january 6, and looking at the warrant, i think that is exactly what it is. reporter: the next battle will be over the affidavit the battle to unseal it. the department of justice say such a move would jeopardize

their investigation. they would appeal any decision to unseal it. not likely to see what is inside that affidavit for weeks in the future, if ever. liz, back to you. liz: steve harrigan, thank you so much. joining us congressman dale issa from house judiciary with heritage foundation senior legal fellow hans von spakovsky. great to see you gentlemen. thanks for joining us. >> thanks for having us. >> thanks for covering this continued and growing scandal. liz: congressman, will trump green light releasing the affidavit back in the fbi search? we still do not know what necessitated justified the search with battalion of agents with machine guns. the allegation he violated the espionage act and also records destruction. >> well that is one of the important things, liz, if you're making this kind of accusation the public and certainly the defendant have a right to know what the source of that allegation is, whether it is a credible source or not. so there is no question at all that the president is on good legal standing to make this

accusation. the same quite frankly as he is on good standing to say that there has been a long-standing argument between the executive branch and others including congress about the president's authority to declassify on the fly and therefore say this material is not classified because the president had the power to say it was no longer classified. liz: to the congressman's point, hans, if trump says release the affidavit, doj could file an appeal against that what this boils down to, hans, congressman, we talked about this, the government has to prove intent. that former president trump knew he was doing something wrong. this is the same standard former fbi director james comey cited about their probe into hillary clinton mishandling of classified emails found on the private server. what do you say, hans? >> well, yeah they would have to prove intent. keep in mind with clinton, who had hundreds of classified

documents in her home there was no such fbi raid. we didn't have 30 agents with machine guns showing up at her home. that shows the kind of disrespect the fbi and the department of justice have for president trump but the key thing is getting that affidavit, because that affidavit will provide the facts on which the justice department is supposedly justifying engaging in this kind of a search rather than simply having continued to negotiate or at best issuing a subpoena. there is also no indication that the trump folks were resisting, providing documents that the administration requested. they had already returned multiple doubts. there was no reason to suddenly do this a year-and-a-half later. unless they can show it was justified. we won't know that without that affidavit. liz: let's watch james comey in 2016 on the emails, the

classified e mail found on hillary clinton's server, watch this? >> although there is evidence of potential violations of the statutes regarding the handling of classified information our judgment is that no reasonable prosecutor would bring such a case. prosecutors necessarily weigh a number of factors before deciding whether to bring charges. there are obvious considerations like the strength of the evidence especially regarding intent, responsessable decisions also consider the context of a person's actions and how similar situations have been handled in the past. in looking back at our investigations into the mishandling or removal of classified information we cannot find a case that would support bringing criminal charges on these facts. liz: so if they couldn't find a case to justify bringing criminal charges back in 2016 and likely since then, congressman, would any reasonable prosecutor by james comey's standard take on this

case? >> well perhaps they no longer have reasonable investigators or reasonable prosecutors but assuming that there has been no change in the law and there hasn't, and that the facts are actually more favorable to president trump since he was openly debating that these documents in his opinion were not classified, he would seem to be on even better ground than hillary clinton who took them outside of the law, kept them on a server and then never disclosed them and left office. huge difference on that. let's also remember that although i think the world of the presidential records act there is no criminal statute for the records themselves. so we're not even debating whether he took records he could or shouldn't have had. we're only debating whether or not these are quote, classified from a criminal standpoint. liz: whether they violate the espionage act and you know, records destruction. we don't know. so that is the issue, right.

to what the congressman just said, trump said his lawyer had a standing order to declassify documents when he left. >> right. liz: hans, the point is, issue the government has not earned the voters trust here. critics say anyone who is demanding we take the allegations at face value with zero evidence are being asked -- first this question, has trumps accusers admitted trump did not collude with russia as the mueller report found and they were mistaken about that? problem of lack of accountability there has trump's followers really upset. >> well, that's true and look, the key issue as the congressman said is the fact that president trump according to his office and his intelligence officials declassified all these materials. again that is important why we should see the affidavit because if the fbi and the justice department failed, failed to tell the court when they were applying for a warrant that the president claims all these documents were declassified,

well then they may have misled the court again, the same way they misled the fisa court when it came to the russia-trump collusion hoax. liz: to what hans said, we do not know what was thought and what was found, right, congressman? the steps the justice department took here are so bold and the rubicon has been crossed. what do you think? >> it absolutely has. remember one other thing, the president of the united states, the current president has the ability to raise things back to a classified level, meaning he could declare that these documents are sensitive and demand them back in the ordinary course, not because they were taken illegally but because there is no documents back because he feels they're too sensitive. the ability to declassify and the ability to class clue by every president has been declared unilateral. they have acted that way time and time again, president after president. there was a way to do it, right way to do it.

this certainly isn't it. and from a transparency standpoint this is certainly not transparent and for hans who spent so much time at the federal election commission the reality is this is an election integrity question. >> yeah. >> does the candidate who says he is going to run for re-election have the right to use this as a tool against someone who presumably will also run? i would say this also would be in doubt. liz: to what the congressman just said, hans, top senate republican chuck grassley vowed the senate will investigate if the gop takes back control. he demanding the release of the affidavit. watch what is going on with the coverage here. watch this. >> they can have very, very, very dire effects because the government has always been very tough on national security information, particularly the national archives. >> not just against republicans, right? >> not, no, not just against any party, anybody who, any

contractor, republican, democrat, officials of the democratic, sandy berger who was bill clinton's national security counsel advisor he tried to walk off with some documents and he got himself in a whole heap of trouble for it. liz: but he didn't -- one name is missing there, hans. hillary clinton. were they tough on hillary clinton? >> that's right. you know, they keep missing her. all the other officials they're talking about were not former president. you've got to keep in mind that a president has the ability to declassify any documents which other officials do not have. that is a key issue. also since chuck grassley was there, keep in mind, chuck grassley only recently revealed that fbi, fbi whistle-blowers told him about partisan decision-making in the fbi offices in washington. liz: to block the hunter biden probe as disinformation.

celebrating. many civilians though remain in hiding, uncertain about what comes next for their country. the past year has been anything but a celebration for the afghan people. the country's economy has collapsed plunging millions of people into poverty. women's rights have decreased, the security situation remains fragile. yet when you walk through the streets of kabul there is a sense of normalcy a routine. the taliban patrols like a police force. there are street vendors selling food, there is traffic. but behind the veneer sits fear, uncertainty for the afghan people, namely the american allies, those who were left behind when the withdrawal happened last august, many whom have reached out asking for help because they don't know what to do. they are stuck in a taliban-controlled country. their lives are at risk. liz: trey yingst, great reporting, thanks very much. joining us house foreign affairs

rather thanking member congressman michael mccaul. great to have you on. >> thank you, liz. liz: new gop house report based on pentagon documents. biden's afghan exit was worse than realized? can you explain that? >> we it was an unmitigated disaster of epic proportions unconditional surrender to the taliban but the more we investigate the worse it got. the white house and the state department failed to heed any of 9 warnings made by the intelligence community about the conditions on the ground that they were quickly deteriorating and that it was becoming more imminent. same with the top generals in the pentagon, warning them, and yet, white house seemed to have this rosy picture that everything was fine, that we're not going to have helicopters off the top of the embassy like vietnam which is exactly what happened. i think most important, liz, there was an offer made to secure kabul for purposes of

evacuation for the american forces that with nato and the white house declined that offer. that would have changed everything, because what happened, we put the taliban was put in charge of security at the airport which led to the chaos and ultimately, liz, the suicide bomber that got through and killed 13 servicemen and women, injuring 50 or so more, the no man left behind, no woman left behind, there are still american citizens stuck in afghanistan and we left 100,000 afghan partners we promised that we would protect them. the veterans get upset about this. liz: presidents since the '90s, knew a lot of planning was needed and planning was done 11th hour until the exit. biden was on senate foreign relations. they misleadingly claimed it was

under control. british parliament held biden in contempt. tony blair called his actions imbecile lick. watch the claim that al qaeda was gone. president biden: look, let's put this thing in perspective. what interests do we have in afghanistan at this point with al qaeda gone? we went to afghanistan for the express purpose of getting rid of al qaeda in afghanistan as well as, as well as getting usama bin laden and we did. >> well, if al qaeda was gone why did we need a drone strike to take out al qaeda leader al-zawahiri? >> in fact they attacked me. they came out attacking me saying there were only a handful of al qaeda left. there are hundreds, far more than before 9/11, for the president to say al qaeda is gone is just incredulous. >> sit for a second. team, show the misleading statements from the white house

on the afghanistan exit. it was completely botched also in the misleading representations and the lying. so you know, the other thing too, congressman, we're seeing from your report, is this true, that the president and his team knowingly misled america about the exit and after the fact even the offices for first lady joe biden, kamala harris's office and nsa jake sullivan their offices stepped in to get help, to help evacuate? >> yeah. we were trying to get people out myself. we went out to these outside veterans groups to get people out of afghanistan because our state department was so incompetent and the white house misled the american people and were making terrible decisions. we only had 36 consular officers at h to process hundreds of thousands for people to get out. liz: talking a the airport, right? only 36 officers working at the airport. that's why we had a massive

logjam. that led to potentially 13 troops getting killed, right? >> oh, 100% and the troops we did have were penned in at the airport, sitting ducks getting shot at. we turned perimeter security over to the taliban. you can debate whether we should withdraw but the way this was done was so reckless with complete list disregard for the conditions on the ground. i really fault the administration they outright lied to the american people what was happening. you had 3,000 afghan commandos, special forces fled into iran because they couldn't get out and they are specially trained. we have no idea where they are today. liz: we surrendered so much in the way of military assets, right, including bagram airbase. final word? >> final word bagram airbase will be taken over by china as well as rare either minerals. 99% of our intelligence is gone. most importantly turning point

liz: this is the create independence act, right? they're making more independents out of democrats. it is flat-out lying. it is "dem-splaining." what do you say, liz? >> i think it's wonderful that democrats decided they need to tutor us on all the very highly technical terms like inflation, oh, by the way recession. recession used to be pretty clear-cut. two quarters of down growth or negative growth consecutively. now that is not any longer applicable apparently. ditto with inflation. just a technical term. i tell you what, liz, when i go to the grocery store, i buy a whole basket full of groceries, seems like 25% more than it was a few months ago i don't think that is technical term. i think that is called impoverishment. the truth is we're getting hit with price increases all over the place, yes, technically prices moved sideways with some things going up and some down in

the month of july but the truth is we're nowhere near 2% inflation that the fed is trying to -- liz: when will the truth-bending by democrats stop? now they will go out to 23 states saying we're at zero inflation when that's a lie? >> yeah, but liz, people aren't that stupid and americans no better. in fact i think the funniest thing happened recently, the inflation reduction act, 12% of americans actually think it is going to reduce inflation. not only, rest of those people are not indifferent to this. 40% think it will increase inflation. think about, here's a real "dem-splaining," remember when "build back better" would bring prices down by spending another five trillion dollars and increasing our deficit? now the democrats are out there saying whoa, this bill, because it is going to minorly increase our deficit will actually bring inflation down. you can't have it both ways. liz: right. >> you can't have it so the

deficit coming down is good for inflation, oh, spending another five trillion doesn't matter. they don't make sense. i think people are on to that. liz: they spend so much time in d.c. they have lost their minds. i mean now they are "dem-splaining," this is the same crowd that can't balance the budget. they do nothing but mislead. now they convinced large people, out there, trying to, we can lower inflation with more spending. that is "dem-splaining." then you have carolyn maloney "dem-splaining" why she reiterated twice, told "the new york times," biden should not run again. oh, that is off the record. then she in a debate with jerry nadler. i don't think he will run again. then she is dem explaining that. i didn't say that? >> nobody wants biden to run again, certainly his own party, he is embarassment. he is incapable. by the way his policies are terrible. i think most americans have come to that conclusion and you know what? if they run him again, so be it.
