"the evening edit" starts right now. elizabeth: okay, we're breaking reports out of "newsweek." this is what "newsweek" is reporting that the fbi was going after quote, secret stash of documents in trump's florida home having to do with hillary clinton's debunked russia collusion narrative and also election-related documents. quote, fearing trump might weaponize all this against his enemies or use it to exonerate himself. we'll stay on the story. also this, there is lots of talk about trump's top critic liz

"the evening edit" starts right now. ♪ elizabeth: welcome to the show. you're watching the fox business network. stocks ending lower today. the federal reserve minutes though show the fed may not raise interest rates as high as first believed. also retail sales were flat in july. gas fell. also inflation is still taking a toll. as expected liz cheney, one of trump's most outspoken critics lost her wyoming primary, the gop primary to harriet hageman who trump had backed. cheney comparing herself to lincoln, talking about the civil war, talking about running for president. we have this though, more news on the fbi search on trump's home in florida. ashley webster in mar-a-lago, at mar-a-lago with the latest. ashley? reporter: we'll find out

tomorrow whether we get to see the full affidavit in the case against donald trump t will lay out the government's case, and any potential violations of the espionage act that deals with the mishandling of top secret up dos there are three public outcomes. the one the affidavit is unsealed and fully open to public viewing. two, the affidavit is unsealed so heavily redacted it will be difficult to decipher. three, the judge agrees with the justice department keep the affidavit sealed. media companies thinks the document should be opened because of intense public interest. former prosecutor andy mccarthy says it is unlikely the affidavit will be unsealed for everybody to read. >> i think in the middle of an investigation a judge which will release a warrant which would identify not only what the grounds were for seeking a warrant but will probably tell at least, at least the trump people enough so they would know who the informants were. reporter: legal experts say it

does have to do with the fact wyoming voters are far more aligned with donald trump than they are with liz cheney or even the previous sort of more establishment republican party anymore but, but i think the fact that she is so single-mindedly obsessed with pursuing donald trump and, and with the january 6th hearings and her sort of, her, single-minded pursuit of him i think really does remind voters that she doesn't care about these issues that you just mentioned that are far more important to them such as inflation, the broader economy, illegal immigration, all of these things that voters actually care about. >> you know, even obama and clinton said lower taxes and much more, in line what voters are saying now. andrew, let's get to the story out of "newsweek." "newsweek," andrew, that fbi was

going after a secret stash of documents at trump's florida home on hillary deuniffed russian narrative, and election related charges fearing that trump might use to it weaponize the stuff against doj or use it to exonerate him. what do you think of this story? >> sounds like totally they're talking about political prosecution. that is what they're saying in this quote here, they're making decisions to seize from donald trump to prevent him from making political action or political steps in the upcoming election. we have to remember that he had wide discretion and authority as the president of the united states to declassify certain records and to declare which records which were or were not believed belonged in the national archives, at least arguably from his side of things. so i think a lot has yet to come about why the fbi thinks that he didn't have a right to these records and ultimately, since we're in a criminal forum at this point, they will have to prove it beyond a reasonable

doubt with the presumption of innocence going to donald trump. elizabeth: charlie, critics say donald trump should not keep classified documents just like hillary clinton. if you reveal these documents it would reveal the intelligence gathering methods of our intelligence community but "newsweek" is quoting these anonymous top intelligence officials, charlie, saying that quote, while some of the documents may have dealt with nuclear weapons that was not the main focus. the main focus may have been trump planning to use trump russia documents or documents about what he thought was a deep state for his run in 2024, charlie? >> yeah. a couple of things. one thing that i think is very important to remember is that a big, the big difference between the hillary clinton's bathroom server that caused so much controversy four years ago is that hillary clinton never had the authority to declassify anything. donald trump did have the authority to declassify any of these documents. as andrew pointed out, there is

a debate to be had or an argument to be made that he could have made, that he, that he, that those documents belonged with him. that was the major -- elizabeth: what about the trump russia, what documents would be about trump-russia collusion narrative that the hillary clinton campaign and the dnc paid for and financed and also election related charges to exonerate himself? that is what "newsweek" is reporting. news week is reporting, trump might have moved documents, that he would hold own to them, that is what "newsweek" is saying? >> of course "newsweek" is also one of the media outlets that have spread the wild conspiracy theories for the past five years about trump's connection to russia and i have argued all along that the president probably should have made great efforts back when he was president to declassify all of this stuff to make sure that whatever records there are show

that, that, that this was a conspiracy concocted by democrats in order to hurt trump politically. he should have thrown them out to the public and made them all public. i think that would have helped him a great deal but i don't put a whole lot of faith in reporting by "newsweek" or anybody else especially when it comes to the issue of russia which they have gotten wrong every single step of the way. elizabeth: what charlie is saying too, andrew, final word, these are anonymous intelligence sources. we don't know the provenance of this information, andrew, to charlie's point. so it is difficult, it's a lot of speculation also flying around about this story. "newsweek" reports that the fear was trump might move these up dos. abc, abc is reporting that the fbi is inner fearing with trump white house lawyers, pat zippo lien knee and patrick philbin. the other thing, they had

surveillance footage, inside, andrew, inside of mar-a-lago and they saw something outside the storage room that made them think, oh, that alarmed them, we got to get in there. we got to get the documents at least one witness indicated more classified material might remain at that residence. that is what abc is reporting. final word, what do you say, andrew? >> tomorrow we'll find out more any documents or the affidavit released specifically. i don't think that will happen that will spell out very specifically what the department of justice, the fbi what was so urgent getting the documents instead of a much more appropriate process trying to subpoena those records. more to come on this but there are big questions about the integrity of the reporting that is going on pause we don't have the affidavit. elizabeth: yeah, we don't have the affidavit. it could be redacted. we're staying on the story, staying on what "newsweek" is reporting it may be about trump russia. this is all over the map. i mean, the passports, trump russia, nuclear secrets.

♪. elizabeth: welcome back the media reporting on what upenn wharton, cbo, chief economist have been warning that the democrat new inflation reduction act will not cut inflation. hillary vaughn at the capitol with more. reporter: good evening, liz, abc, cbs, cnn raising the same question why is this called the inflation reduction act if some experts are warning it will actually not do much to reduce inflation but even some lawmakers that helped write this law are admitting people hoping for relief from high prices at

the grocery store are going to have to wait. senator joe manchin telling me yesterday they never claimed that this package would bring costs down for people right away is it misleading to call it the inflation reduction act for americans, it will not make the grocery bill cheaper, not make everyday goods for them cheaper? >> immediately not. we never said anything happen immediately like today, turn the switch on and off. reporter: even this is called the inflation reduction act the climate perks in the package are getting a lot of attention. president biden proudly saying most aggressive action ever taken to combat the climate crisis but white house insists that there are also things in the new law that will reduce inflation, tax credits for solar panels and electric vehicles and energy efficient appliances and measures the cap prescription drugs costs for some people at $2,000 a year. unless you're making the switch to clean energy you will not see these savings today. the health care savings in this package are not going to go into

effect until the new year. liz? elizabeth: hillary vaughn, thank you so much. joining us now former cbo director, american action forum president douglas holtz-eakin. great to have you on. what is the reaction to the story. good to see you. what is your reaction to it? >> this will not have any effect on inflation. the theory of the case it reduces deficits by $300 billion. this will take pressure off spendand reduce inflation. doesn't do anything five years. if we have inflation like this six years from now we have much bigger problems this is non contributor to the inflation fight. worst, liz, when they passed this chips plus $300 billion new spending, a pact act for veterans up to $600 billion, deficit finance spending. they continue to spend and spend elsewhere there is no contribution to fighting inflation. elizabeth: yeah. >> they're underestimating how important inflation is.

we heard this when they were celebrating the july cpi report. if you ignore the decline in gasoline prices which was good news, great, we have the same rate of inflation on everything else, 5.9% the month before, no real progress. it is getting worse on shelter and key parts of peoples budgets. we need to get serious about fighting inflation. congress isn't doing it. elizabeth: branding thing. "build back better" was a marketing branding thing. inflation reduction act was a branding thing. really climate and health spending bill. democrats are not dialing it back. avoiding whether it will cut inflation at all. watch this. >> think about the energy costs, utility bills because of the invests that we're making. that is going to, they will feel that right away. >> they're going to feel that right away. >> they will feel that right away. >> should voters measure the success of this bill how much you reduce inflation next couple years? >> this bill extends out over several years. tax provisions, for example, some of the tax revenue will

happen immediately. some of the benefits in terms of deficit reduction will material over time. >> what parts of bill will work on that quickly. >> next question. >> want to take a moment to say a few words about the so-called inflation reduction act. and i say so-called by the way because according to the cbo and other economic organizations who studied this bill it will in fact have a minimal impact on inflation. elizabeth: so why is bernie sanders the loan lone voice of reason, doug? he is agreeing with penn chart ton, cbo which you ran, jpmorgan chase chief economist. so bernie sanders is the canary in the coal mine here? there is five trillion in spending since 2020. your word on that? >> i mean he is, he is correct in his judgment. how he came to that conclusion is not too complicated this doesn't do anything for inflation. and not hard to see that.

doesn't do what he wants to do in terms of blowing up the size of the federal budget. this is bad enough. he wanted five times more. he is disappointed in the outcome. i'm disappointed in the outcome too but for very different reasons. this country has a government whose budget is out of control, literally unsustainable over the long run. this is another strong step in the wrong direction. it has to be a course correction soon or we're not going to do things that people really do care about, inflation under control. elizabeth: you know what the course correction is? they're putting it on the backs of the american taxpayer. cores correction for them. more irs audits. manufacturer taxes for them. companies that could hit small businesses. watch mohammed el-erian on abc, you know what? we'll feel the pain of inflation for a while. this branding thing has got to stop in d.c. because voters saying enough already. watch this. >> still see those food prices at grocery store continue to be sky-high, much higher than they

have been before. what will the relief be? what will that look like? when can we expect to see that on the grocery side aisle? >> supply side is getting better. commodity prices have come down. supply chains are improving. food inflation will get better but will not be immediate. it will take quite a few months for us to feel less pain when we have at the supermarket. elizabeth: you see what is going on? we have the d.c. media henhouse beltway echo chamber, right? inflation reduction act is great, everything is great. looking at, oh, we have major important experts like yourself, cbo, u penn, wharton, jpmorgan chase saying it will not really happen. democrats saying it will not happen anytime soon. no inflation cuts. your final word? >> most important thing is americans know it is not happening. when they look at food, energy, shelter they see prices 11% higher than last year. you can't fool them on that. they know this bill will not do anything. this is another bilge government

♪. elizabeth: welcome back. democrats are about to zoom out the door hundreds of billions of dollars of your money in new climate spending. there is growing fears of little oversight on that. this is the same thing what happened what "the new york times" is calling one of the largest frauds in american history, pandemic fraud. gerri willis has more on the story. gerri. reporter: liz, crime pays at least in the case of covid relief funds. we prosecuted a billion dollars of fraudulent claims but many of them will never be recouped of the look at these numbers, lost to fraud could be over $163 billion. but that is what happens when the government makes huge amount of taxpayer money available to the public with virtually zero

congressman. now we'll need government investigators from the fbi, secret service, the post office, irs to go after climate spending fraud? >> you bet. well that is disappointing to hear that report but not surprising. if you were really a democrat, you wanted to get to the bottom of potential fraud you would think chuck schumer and nancy pelosi wouldp a point democrats to serve with pat toomey and me on the cares act oversight commission but it has now been nearly two years since we had a democrat on that commission that is supposed to oversee the fed and the treasury spending and i don't know that i can recall a single oversight committee hearing in house financial services called by maxine waters to consider, to have the special ig from treasury testify about problems with pandemic spending. look, joe biden just made it worse. you don't even have to show harm from the pandemic to get mortgage assistance or rental assistance from the biden

administration. elizabeth: sort of like the saying go the conclusion is where the mind comes to rest. the idea you throw money out of the door, fixes the problem, mistakes in legislative activity and spending for achievement, problem solved. it's not. why does climate czar john kerry get to work in secret on climate spending? since when can a president appoint a person to implement national policy with no congressional oversight especially with trillions in spending? >> well his coconspirators are in charge of congress. schumer and pelosi set the agenda for oversight. they will not spend one second in oversight over the biden administration. they think any amount of unaccountable spending apparently is absolutely the way to go because we've seen that in the five trillion dollars of spending that they have authorized since joe biden has been in office. elizabeth: after all of that fraud, the president signs a bill to hire 87,000 new irs agents, doubling the size of the irs. we don't know if the irs will go

after that fraud or the little guy. watch this. >> i'm going to follow them to make sure the irs doesn't harass anybody. i would encourage all of my, all of my political friends to make sure their staffs are in contact with the irs. i want to make sure the epa doesn't overreach and is balanced how they do it. there is always a way to go out. elizabeth: we're supposed to trust a promise, trust a wing and a prayer. is the little guy small business owner going to call up manchin in the middle of a harassing audit, hey, where is your promise. >> exactly. when you look at joint tax estimates, they say this $45 billion of the 80 billion been awarded the irs is strictly for enforcement, that enforcement is going to fall on small businesses and low to moderate income taxpayers who are going to be paying those additional revenues. elizabeth: the only way you do it, you have to vote them out. where are the 87,000 teachers, congressman? where are the 87,000 doctors?

♪. elizabeth: elon musk was the sar star guest at gop conference in wyoming hosted by kevin mccarthy this on the same day that congresswoman liz cheney lost her primary. kelly o'grady has the story. reporter: good to see you, liz. location and timing of the fund-raiser didn't seem coincidence. he was guest star last night with gop supporters. it comes on the heels of billionaire recently embracing the republican party, becoming increasingly more vocal on twitter about his political beliefs. on twitter earlier this year musk said he voted republican for first time. he took to twitter saying he considers himself a moderate,

"the wall street journal" editorial board. great to see you. >> so good to be back. elizabeth: from where you sit what do you say to voters saying no to liz chain think? you have polls out of gallup, monmouth, emerson, pew, saying you know what, what is top of mind economy and kitchen table issues, gas and inflation. what do you think of the split? d.c. is so out of touch it seems. >> you just put your finger on it. i think truly myself if liz cheney voted for impeachment against donald trump a vote of conscience, left it at that, she let her will known, but that would be one thing but she decided to double down, turn everything she was doing in washington around january 6th. if you're a wyoming resident. you have only one representative in congress, you would like them to be focused on things mattering most to you in the world. for instance, inflation, economy, drilling jobs, mining jobs, which matter so much. instead they saw their one representative totally focused
