their legal arguments and elaborate why they need a special master to oversee the documents the fbi picked up in its raid of trump's florida home? what do you make of this? >> right. this tells me this is a judge who takes her responsibilities seriously. she got the filing today from the president's legal team, obviously engaged with it and asked questions. she is asking trump's lawyers to substantiate the a lot of claims they are making. look, i see what your arguments are, i need information and more evidence for me to rule on your motion. elizabeth: the other thing, we've got anonymous government leaks coming out. "the new york times" is reporting based on sources, anonymous sources, reuters too. it appears it looks like they're setting a new reason for the fbi raid. they had to do it because of the quote volume of classified documents. "new york times" says 300 records. reuters says it was 700. "new york times" says it was cia, nsa, fbi stuff.

they were not secure as club workers walked outside of the storage area at mar-a-lago. what do you think? >> that is a new story that started to emerge today, liz. this is my problem with this. on one hand the justice department has been adamant not leaking not allowing the public to see the affidavit that provided the basis for this search warrant on mar-a-lago but at the same time there appears to be this deliberate, calculated policy of leaking information to favored news outlets and trying to get their story out there through anonymous leaks, anonymous sourcing rather than simply unsealing the affidavit and letting the public make the decision for themselves. elizabeth: to your point the judge signaling he may not unseal much of the search affidavit later this week, possibly starting thursday. let's watch what is going on -- you know there has been talk of former fbi officials and their bias against trump. you're going to listen to peter strzok. you will then watch democrat ro khanna pushing back on the bias. >> don, it's a tired story.

the national border patrol council, brandon judd. it's great to have you back. 5 million border crossers, including got aways under president biden, that's one estimate equal to the size of new zealand or ireland crossing, is that true? >> it is true. when you look at what's currently happening, these cartels are being -- they're generating a huge profit off of our policies. if it wasn't for our policies, this wasn't be happening. if we had the proper policies in place, we'll control this and these numbers would go down exponentially but this administration continues to invite people by inviting them into the unit. that catch and release is the magnet and that'll continue coming if biden doesn't make a change and quickly. liz: what is going to be the change? you've got trump-backed carrie lake and promising to declare an invasion at the border if she wins and will invoke war powers

and legally declare an invasion. what's the change? >> i support that. if carrie lake were to do that. there's a lot of argument saying it would have to be an invading force. i would argue it is an invading force. it's being orchestrated by criminal cartels. this is the largest movement of people in the history of our country, and it's all driven by the cartels and on top of that, you have the drugs that are coming into the united states, the fentanyl, the cocaine and all of the other dangerous substances. that's also being driven by the cartels. i think that there is an argument to be made this is in fact an invasion. now, if carrie lake were to do that the state of arizona, it would make everything better in arizona but then you have texas, new mexico, and california that would continue to have the same problem we're currently dealing with. president biden, he could change this immediately. all he has to do is end catch and release. just hold people in custody pending their deportation or silent proceedings.

if we go -- liz: sorry, finish your thought because there's a follow-up question i got. go ahead. >> yeah, if he were to stop that and end catch and release immediately, this problem would go away and we'd be able to go after the cartels and their profits. liz: governor abbott said it would put his guys, his team and his law enforcement in legal jeopardy at the federal level if the state declares an invasion. >> yeah, there's a lot of people, you know, jonathan turley, a fox news contributor himself saying it would be illegal to declare an invasion because it's got to be an invading force. there's things that need worked out and i'd like to see a supreme court making a ruling on this. if the supreme court rules it's illegal, there's no invasion. we have to get it to the supreme court but you can't ana un-unles you make that declaration.

liz: npr did a poll and the majority of people say yes, it is an invasion. a second request to send in the national guard and dc mayor calling this a m humanitarian crisis and isn't calling in the national guard an admission that the border crisis exists? why do democrats deny it? >> it's an admission and that's why president biden isn't giving them the resources they say they need. if he were to do that, he'd have to clearly tell the person public he's been lying to them this entire time, there is a crisis on the border, which he refuses to own up to. so, no, he's not going to give anybody any resources. he's not going to hire anymore border patrol agents, or give us new pollicis or programs and that would be an admission of his failiers.
