ever. policymakers warn this is an unsustainable borrowing bing. connell mcshane has more. he has the latest. connell. reporter: the bad news has been the good news as the stock market begins the fourth quarter in impressive fashion. now yesterday's rally was really driven, at least in part, by a relatively weak manufacturing report. today it was a report showing fewer job openings, more layoffs. the idea is a slowing economy may be leads to a fed a little bit less aggressive. that's playing itself out certainly in the bond market where we can forget about 4% for the time-being at least on the benchmark 10-year treasury yield. it is down a two week low. now you look at some of the stock names today, big tech names, leading the market higher. likes of apple, alphabet, amazon, and then there's twitter which has been quite a story. that stock was up today in a big way, thanks to elon musk. musk has offered to close his acquisition of twitter on the

terms that he originally agreed to, the price of 54.20 a share, $44 billion. all this coming just ahead of an emergency hearing on the acquisition that was supposed to be taking place in delaware chancery court. liz? liz: connell, great to see you. thanks for your reporting. get to florida congresswoman kat cammack and "washington examiner" byron york. congressman good to have you on and byron york, good to see you. congressman, it is now home state of florida, hurricane ian the deadliest hurricane since 1935. what does florida need right now? >> it is a all hands on deck movement movement right now, liz. we're doing search-and-rescue operations. over 1000 people have been rescued. we're trying to rebuild an entire grid. not just power lines and polls, an entire grid we have to get back up and operational. basic essentials of water, food, shelter. the big lift after those basic

necessities are met are the housing mission. thousands of people lost everything. they have nowhere to go. that fema housing mission is critical as we start rebuilding and disaster recovery. liz: to the congresswoman point, byron, this is all happening on midterms. how serious is that? we have this, kpmg survey, more than nine out of 10 ceos forecast a deeper recession by next year. 2/3 saying not mild and short. byron, we started out the third quarter. the market is wobbly now. started great. the rose 14%, s&p by mid-august. 17% swan dive. a lot of indicators are saying this is a rough road ahead? >> absolutely. i mean had a good day today, but still in a bear market. i don't think anybody can listen to the chairman of the fed, jerome powell, when the fed raised interest rates another 3/4 points. he talked about the so-called soft landing and you didn't have

to read between the lines to hear him say there will not be a soft landing. there will be a recession. one word about florida, this is the time that a governor's ability to is tested. if he does well, he can, his, reap enormous political benefits by doing a good job. this is a critical period for ron desantis. he comes out of this well, helping people, showing real organizational skills, taking care of this problem, that is an enormous boost for his argument to be president of the united states. liz: congresswoman, to byron's point, hurricane katrina made george w. bush's, further ture, hurricane andrew, george hw. economy is slowing, that prices are rising, that electricity bills are going through the roof, and that 401(k)s are crashing because his policies are so good and the american aren't believing that. liz: what do you say, byron? democrats can't afford to lose a single sate in the senate. anywhere from five to seven states may be up for grabs. what do you think, byron? >> well, when you get reality checked by stove fenn colbert it is -- stephen colbert it is bad. everything report as republican takeover of the house. all of the factors point toward a republican takeover of the house. yes, the senate is impossible to predict but there are certainly is a scenario for republican takeover. there is a scenario for democrats to keep it and there is also a scenario that it stays 50-50 the way it is now with the

rising gas prices really slamming the midterms with just five weeks to go. and now we've got this new october surprise, an even bigger gas price hike, thanks to opec and russia cutting production. grady trimble has more from chicago. reporter: hi, liz, governor gavin newsom and other california democrats are blaming the high gas prices out west on big oil's greed but the reality is this is something experts have been warning about for several months now. they have said that fuel supply is so tight, any minor disruption could have major consequences. right now in california at least three refineries are unexpectedly down. add to that the usual high taxes and regulations, and this is a what you get. prices at the pump in california are up more than 60 cents in just the last week. higher fuel costs in the golden state, washington, oregon and others are helping drive up the national average for the second

week in a row. what could make matters worse, if oil climbs back above $100 per barrel like some analysts are predicting. >> crude oil prices are rising. gasoline an diesel prices are going up as refineries continue with their maintenance season. unfortunately we're not going to see much relief in gasoline prices on a national level over the next few weeks. reporter: meanwhile the head of saudi aramco says the world should be worried because the global oil supply is extremely tight right now but at the same time the opec plus countries are meeting tomorrow. they're expected to cut production by a million, maybe even two million barrels per day to try to prop up the price of oil. liz? liz: grady trimble, thank you so much. joining us now, energy pro nick loris of c3 solutions. you heard that, potentially two million barrels a day cut. how high will gas get by the midterms? >> yeah we could easily see

prices above $4 per gallon again. right now the national average is at $3.80. so it is not inconceivable that prices could eclipse $4 a gallon. that really means regular americans are going to struggle. every dollar that they pay more at the pump means fewer dollars are available for critical things like food and health care. liz: yeah, here is the thing. it is happening just months after president biden personally flew to saudi arabia to say pump more but they rejected that. does this all mean president biden should stop undercutting u.s. oil and gas and make the u.s. energy independent again? >> without a doubt. the solution is not asking foreign producers who are less environmentally friendly than american producers to produce more, it is to produce more here at home. we have an abundance of supply of oil, of natural gas, of resources and all of the above energy strategy should really focus on providing affordable,

power, that requires opening things up in america not only for production but transportation, infrastructure, oil pipelines as well as refineries. >> but his energy policy is draining u.s. petroleum stockpiles, attack mom-and-pop gas stations after he campaigned on getting rid of u.s. oil and gas. nick you know this, gas was $2.40 a gallon when he entered office. now it is more than double in states like california under biden. watch this. >> we are going to get rid of fossil fuels. i guarranty you, i guarranty you, we're going to end fossil fuel. liz: you know, listen, even former president obama nick, you know this, after midterm losses, obama stopped talking about climate change. obama switched to and all of the above energy policy. even shamelessly claimed credit for the fracking revolution that obama's own epa tried to stop?

hotel on sunday. alexis mcadams with the story. reporter: we're learning more about that husband and father who lost his life in the shooting. he was just there to visit his son at college. it was supposed to be a fun family weekend and it ended in tragedy. take a look, this is where the shooting unfolded on sunday morning. it happened in the lobby of this marriott in poughkeepsie, new york. investigators tell us, the gunman got into an argument with hotel employee about the coffee. he opened fire, spraying bullets around the world, killing a 53-year-old man from long island. court documents eyed him as paul kutz. investigators say he was shot twice, once in the chest. his murder sent shockwaves through the entire marist college community. police are pledging to pour all of the resources into this case. >> i also want to express sincere condolences to the family and friends of the victim. this unspeakable violence in the

teachers' union, the national school board association, the pta, ones we thought had our children's best interests at heart, they do not. parents are mad as heck. elizabeth: homeland security gave more than half a billion dollars to schools, universities and zoos for alleged terror threats. this is from from judicial watch. these institutions are likely to be, encounter a terror threat, so this is another boondoggle. for the viewerser -- view iser, let's get back to the school board. a parent, a police officer in michigan, sandra, she's suing the mccolm county school board and who of its members. free speech violations. they then contacted her employer and the doj, the justice department. why? she was complaining about the impact of covid school closures on her children. >> this has happened across the country. recently, a district in michigan had to pay out damages to a parent who they reached out and got fired from his employer.

currently, there's a family in florida going through the same situation, a firefighter, where people who are exercising their constitutional a right to petition their government for a redress of grievances about their children's education are being terrorized. this is a deliberate attempt to chill political participation. it is reprehensible, and i'm glad that district was sued. they deserve it. elizabeth: talk to us more about how parents are winning. we've got a school board in maine, they had to pay a parent that they banned from attending school functions $40,000. that guy got it. why? they violated his first amendment right. he has spoken out against sexualized library books for school children. >> i mean, again, these elected officials do not like the whole idea with of the consent of the governed. they want to rule on high from their ivory towers, with but they don't actually want feedback on their performance because their performances. i think we're starting to see a lot of parents who now know what their rights are. they were kept in the dark for a long time. they didn't know what the first

amendment meant in k-12 or title vi or title ix or my of these discrimination statutes. but over the last two years, the scales have fallen from the people's eyes, and now they know where the red lines are x. if they realize the school districts are crossing those lines on a regular basis. elizabeth: so what are you seeing on ground with school boards? are they backing down? is that what's going on? >> absolutely. every single day we see districts canceling contracts. we are seeing districts not renewing contracts of superintendents, of teachers. you know, they're pulling teachers off, they're canceling lesson plans, those, you know, really objectionable things are exposed. every day we're seeing parents actually make a difference. sadly, aside from fox, most outlets are not reporting on that, so we try and tell those stories because parents -- elizabeth: because they were treated by the doj as domestic terror threats, that was the issue. >> absolutely. and that's probably why we're seeing fema give out those grants designating schools as
