"the evening edit" starts right now. ♪. elizabeth: welcome to the show. thank so much for joining us. we begin with the stocks down slightly after the dow rallied is a hundred points in two days. now wall street debating whether the fed will pivot away from relentless rate hikes. fed officials some of them saying no. the president and first lady in fort myers with florida governor ron desantis shush saying ian destruction. opec and russia in rebuke to president biden cut oil production 2 million barrels a day. russia is using energy cuts against europe over russia's

invasion of ukraine. oil is marching toward $100 a barrel. edward lawrence in washington with more. edward? reporter: liz, president joe biden disappointed by the decision by opec plus to cut production. the president saying that the last of the release from the strategic petroleum reserve will happen in november. he will then consider more releases in the future, even though the reserve is at the lowest level in 37 years. here's the reaction from white house press secretary on air force one. >> we're in touch with partners, producers, consumers. no secret that the president believe energy supply should meet energy demand. it is important for the global economy as it faces global challenges. reporter: no mention of increasing production in the u.s. industry insiders say, the solution is simple. >> i cannot predict the future so i'm not sure, but it is not looking good with opec looking to hold down production. used to be where a couple years ago the american producer could

meet all demand and we met the growth in the world economy and we kept prices low globally. now we're being hamstrung by this president and by policies specifically meant to transition away from oil and natural gas to what? nothing does everything that oil and natural gas do. reporter: aaa anticipating gas prices will rise as demand is rising and supply is being limited. liz? elizabeth: great reporting as always, edward lawrence. joining us congressman dan bishop from house homeland security and along with former economic advisor to president trump, he is steve moore. gentlemen, thanks so much for joining us. first to you, congressman, the white house cannot name a single thing to lower gas prices except draining strategic reserves americans paid for. now kgp admits we need more supply? >> amazing. the white house said opec exercising this economic

leverage has given them is a hostile act. you know the entire biden presidency has been a hostile act against the american people. it has been one terrible decision after another and now, you know, with the oil reserve drained, with americans supply, domestic supply and energy production having been diminished, now, we're against the wall and so we're seeing prices go back up again. it is just, it is utter incompetence, all the stupidity only explains so much. at some point you got to think this seems to be intentional misalignment of american priorities. elizabeth: steve, to what the congressman is saying, now we've got cnn reporting that the white house has been panicking behind the scenes. a furious last-ditch, wide scale effort to lobby saudi arabia, kuwait, u.a.e. to stop this. blame big oil and mom-and-pop gas stations? >> look the congressman is

exactly right, that this is a self-inflicted wound. when trump left office we were, the major oil and gas producer in the world, liz. we were number one. and we are now falling behind the russians. we're falling behind the saudi arabians as a direct consequence of the biden policies. by the way this is intentional. they do want to reduce american oil and gas production, the problem we're still using a lot of oil and gas, liz. instead of producing it in texas and oklahoma and north dakota and west virginia and pennsylvania we're getting it from saudi arabia and russia and iran. the policy makes no sense. elizabeth: and now we're going to be, we're dependent on the mideast and russia to steve's point. we're dependent on china for solar panels an electric car batteries. cnn proposed using strategic reserves taxpayers paid for as bargaining chip. reportedly the u.s. would buy back up to 200 million barrels

to refill what biden drained out of reserves. he lowered the reserves to boost his bad poll numbers. >> absolutely. he has taken the reserve to the lowest point since 1984. so now american people are not only exposed to the economic reversals. the fact that home heating oil prices are going up, gas prices goings back up when we least can afford it. but we're also exposed as a strategic matter to risks from our foes abroad. you know it is just astonishing how naive or amazingly dumb the planning and strategizing has been in the biden administration. elizabeth: to the congressman's point, steve, if they really cared about the poor and middle class seeing their gas and home heating prices go up this winter they would open the keystone pipeline and unleash u.s. energy. and by the way that is like, those are, thousands of u.s.

workers that the white house is trying to ice out. we've got transportation secretary buttigieg again claiming oh, we're in a transition. we've got more than 55 million americans now struggling to pay their energy bills. 20 million homes behind on payments. heating bills are now rising nearly 20%, steve. >> well, look, you know, our study that we just did at the committee to unleash prosperity finds we would be produce being two to three more million more barrels a day, each day, if we just stuck with the trump program. and that would mean by the way if we had done that, we would produce five times more oil than we've drained from the strategic reserve. we wouldn't need to drop the reserves by one ounce. so it is all a result of this kind of crazy green energy dreams when we're only getting 6% of our energy today, liz, from green energy but we get 70% from fossil fuels. elizabeth: that hasn't changed in decades what steve moore just

said, congressman. >> right. elizabeth: again more americans are living paycheck to paycheck from unrelenting 40-year high inflation. we care about the poor and middle class. americans real wages adjusts for inflation down 9% the last two years. americans are basically torching through 10% of their cash cushion right now. $270 billion out of 2.4 trillion in savings. congressman, sit tight, let's watch this. watch. >> five weeks to go. so take a look here, big picture indicator, we saw the president's job approval rating usually the most reliable indicator how midterms will go. for democrats this is not good news. joe biden's average approval rating is 42.7%. put that in perspective here, with mod presidents at this exact same point in midterm, biden at sail level, that trump, that obama, that bill clinton were in what were brutal midterms for them. elizabeth: congressman, the democrats are trying to make the

♪. elizabeth: joining us now, former federal prosecutor cully stimson. he worked in d.c., on violent crime cases including homicide, assault and more. hey, cully, it is great to have you on. good to see you. >> thanks for having me. elizabeth: cully, we have the news coming in, st. louis, missouri man convicted of murdering retired police captain david dorn during the 2020 riots. he is sentenced to life in prison, life in prison without parole. your reaction, there seems to be justice here, right? >> he got what he deserved. a jury of his peers convicted him. the judge looked at the law, did the right thing, did what he deciphered. the problem is outlyer, most people commit crimes, murder,

rape, robbery, don't even get caught, and those get caught are rarely sentenced in liberal cities to sentence they deserved. i glad he got what he ski servedded. >> democrats in media use deceptively flawed study by the left-wing think tank, third wave. it is drifting by rising crime in democrat run cities inside of those states with democrat mayors. so here is the question, we'll show the data in just a second. let's show it now. can gop governors go after weak-on-crime d.a.s even mayors in their state. >> it depends on the state actually, liz. each state has its own mechanism deciding whether to allow the people other the legislature or the governor to try to remove a duly-elected representative. so you saw in florida the state constitution there gives the governor the authority to remove a duly-elected person if they're engaged in misfeasance or malfeasance. desantis did that for an draw

warren a rogue prosecutor. in california the voters had a say in recalling chesa boudin who was the liberal rogue prosecutor in san francisco. up here in baltimore the voters voted out of office marilyn mosby, up the street in philadelphia, the state legislature is impeaching or trying to impeach the soros bought and paid for rogue prosecutor larry krasner. each state has its own democracy and has its own way of doing that. elizabeth: got it. patchwork quilt. cully, mississippi has the highest murder rate but more than half the homicides took place in democrat run jackson. run by a democrat mayor. the murder rate in democrat led louisville, kentucky, more than three times the next closest city. when you look how third way did the data, didn't include illinois with chicago with shootings every weekend. for 13 states they relied on local newspaper and tv reports, u.s. news and "axios" for crime

data. they didn't provide their specific sources or their methodology. so this is what the democrats and media are now citing as they move into the midterms. >> that is because they're panicking, liz. you saw in the previous segment crime is the number two concern of voters minds for good reason. chicago last year had 836 murders, philadelphia 551 murders, new york city, 485 murders, the common thread there? soros bought and paid for rogue prosecutors and defund the police movement. the same as in l.a., the same as in san francisco, the same as in baltimore. when marilyn mosby took office in the d.a. in baltimore, homicides and rapes went up a third her first year. they're pro-criminal, around at this victim, i don't call it a study, it's a little paper. this is not a study. elizabeth: it was not peer reviewed at all. >> it tries to flip the script, trying to blame governors, in

elizabeth: we have even more government workers caught stealing taxpayer pandemic relief money this time it is irs workers. at a time democrats want $87 billion for tens of thousands of irs collectors to go after taxpayers. hillary vaughn on capitol hill with more. hillary.

reporter: good evening, liz. this bombshell investigation from the doj shows the irs might have their hands full policing the people they already have on staff. one of these irs employees committed pandemic fraud in more than one way. a 38-year-old woman from car adobe ba, tennessee, submitted loan applications for pandemic relief for businesses that did not exist. she also claimed to be unemployed to collect extra cash. all while being actually employed by the irs. so not only getting taxpayer-funded paychecks but stealing taxpayer money at the same time. the u.s. attorney for the western district of tennessee saying these thieves stole the money, not out of need but out of greed. quote, these individuals acting out of pure greed abused their positions by taking government funds meant for citizens and businesses who desperately needed it what they spent the money on will blow your mind. the five irs employees used stolen tax paider money to by luxury goods like a mercedes-benz, gucci clothing,

gucci purses, jewelry, self-care like massages and vacations several taking a trip to vegas to prothe cash. last month the u.s. inspector general announced they would auditing the irs making sure their own staff would pay taxes after they found 1250 irs employees didn't pay their own taxes or were late to pay. some excuses the irs agents used for not paying taxes was that it was too complicated to figure out. liz? elizabeth: hillary vaughn, always terrific reporting from you too. joining us now, "washington times" opinion editor charlie hurt. charlie, your take on the story? >> oh, it is truly astonishing. to think about the fact that here we were, this covid relief was something in a national emergency, in a once in a 100 years pandemic we were told where people tightened their belts. people stayed home. people did all sorts of things in order to help people who were less fortunate than ourselves.

this was, one of the most dire emergencies outside of wartime that this country has ever been through. to think that you had the very government officials who were in charge of, of collecting our money and safekeeping our money and making sure our money didn't get wasted were stealing it themselves and running around and living like kings and queens off of our hard-earned money. it is absolutely astonishing. and the idea that you have the biden administration and democrats in congress coming back and saying you know what the problem here is? we need 87,000 more irs agents who are doing things like this, and even worse not catching things like this? it's appalling and the fact that something like this comes up, you know, in the throes of an election, i think, i think it probably means that someone will pay a price for it and i hope they do. elizabeth: charlie, to your

point, reports are they stole anywhere from 400,000 to half a million dollars. they spent it on luxury cars like a mercedes-benz, trips to las vegas, gucci fashion wear, jewelry. charlie, we talked about this last week it came just last week, homeland security inspector general reported dhs homeland security government workers are caught stealing $2.6 million from taxpayers. more than 2,000 fraudulent, bogus jobless pandemic claims, pandemic jobless benefits. we're talking fema, tsa, even workers at government law enforcement training centers were stealing. they are training people to keep us safe but they're stealing from taxpayers. >> exactly. you know, across this country, there are a little old secretarys who got over their skis, who stole less money than this, from companies, private companies that they worked for and they go to jail for it

because it's fraud. it's theft. here you have the the federal government, power to tax us, officials who are in charge of watching the henhouse, and they're the ones doing this stealing. it is, i would argue that it is you know, theft, fraud, of any sort is bad and i'm glad that it is against the law but the idea that you would do this, that there are people who would do this and they operate in a culture where they think it is okay to do this, to tax, innocent taxpayers who were just trying to make money to feed their families and have to give a cut of it to uncle sam and these people go do this with it and steal it, i can't think, it is hard to find a graver, more serious crime. it is really does, it causes a lot of us to think that you know, what role should the federal government have in an emergency like this? elizabeth: right. i mean, right after medicare was

♪. elizabeth: welcome back. the fbi released its annual data on u.s. crime. the data show the u.s. appears to be heading in the wrong direction. fox news david spunt at the justice department with more. david, good to see you. reporter: good to see you. unfortunately yes, you're right, liz the wrong direction, fbi puts out the numbers every year. as you mentioned numbers are not looking good. let me read some of them. from 2020 to 2021, murders increased from 22,000 to 22,009 hundred. 4.3%. murder rate significantly climbing between 2019 and 2020 where murders climbed 1.4%. fbi officials are quick to point out these are estimated numbers and even though they released them in this report today they don't give a complete picture of

the situation because of the reporting system in place. it's a new reporting system. not to get too bogged down in technical details. the fbi is in transition after system that will collect more detailed data about violent crime. the problem we don't have data from nypd, lapd, phoenix pd, some of those other big cities. hopefully we will get that next year. the departments are not required to submit. they plan to next year. the authorities are hoping next year in 2023 we will have a much better picture what happens in 2022 clearly numbers not moving if it the right direction. elizabeth: clearly an important story, david spunt. nation for that. >> you're welcome. elizabeth: welcome joe gamaldi, national vice president of the fraternal order of police. we'll move on, great to have you on. the parents of 9/11 first responder, an emt veteran, lieutenant allison russo, they

reportedly confront new york mayor adams at her wake. she was stabbed 19 times in a random unprovoked attack. they're saying mayor get control of the city's spiraling crime crisis. can he do it? >> well you know bravo to lieutenant russo's parent for confronting mayor adams, basically saying what we've all been saying, which we have to get this city under control. we have to get all of our urban communities uncontrol. how many people, how many victims do we have to have? how many people need to die? how many police officers need to be shot, 252, before politicians wake up and start giving us policies we're demanding. we know what needs to be done, liz. we talked about it before. zero tolerance for violent crime. seek the maximum when you arrest them. support our police departments. you know actually fund them the way they should be funded. if we do these types of things we can get our crime under control but it is going to be a telltale sign in the coming months, including after the midterms which politicians have the spine to do it. elizabeth: the talk from the top

democrat officials about defund the police was to go after police brutality, right? but then they just wanted to rip out and abolish police departments nationwide. the talk about no-cash bail is you don't want to keep the poor in bail but then they are releasing repeat offenders, violent felons back on the street. that is the issue. we talked about it, top democrat officials, including leading democrat women are still silent when it comes to crimes against women. where is the "me too" movement? joe, we want you to listen to this. you will hear the defund police democrat women. you will listen to women crime victims. they all say the justice system is broken and democrats, their policies are making it worse, watch. >> it is outdated, it is wrong-headed thinking to think that the only way you're going to get communities to be safe is put more police officers on the street. what we have to do, and what we will do is reimagine public

>> where is the justice at? i can't see my daughter again. i got to live with this every single day. it hurts. elizabeth: where is nancy pelosi? where is vice president harris? where is aoc, ayanna pressley, ilhan omar? where are they calling for justice for the women victims? >> you know it is sad and infuriating to listen to all of that. of course they're nowhere to be found. there is not a peep out of them, liz. while crime is spiking when their rhetoric had a role in this by them attacking law enforcement, vilifying us it gave criminals the green light. now it is disproportionately impacting minority communities, 12 times the homicide rate for black americans compared to everyone else. we're seeing increased violence against women in our communities. it all stems from them pushing this. you know liz, where are the social justice warriors? where are actors, actresses musicians, athletes, where are

send a message but what strikes me about this broader story how tony bobulinski, he gave this explosive interview with tucker right before the last election, gave another one close to the midterm election. has anyone else sought answers from this man? he has not been discredited. none of the details, to my knowledge that he shared with the american people on a handful of outlets including ours, i don't think any of that has been disproven or debunked. he is making very serious allegations about the biden family including now the sitting president. it seems like almost everyone else in the news media has not even dug half an inch deeper to you know find more information out about this. there is no appetite for it. elizabeth: they're not chasing the story, joe. what do you think, that jim biden phone call came 11 days before the 2020 election. were they trying to threaten bop linsky not to talk? >> why would you call at that

particular time? guy makes the right point. how many outlets are pursuing init veer with you tony bobulinski? where is "60 minutes," where is "meet the press." to guy's point none of the contents own the laptop have been disputed by the bidens, right? a laptop "new york post" reports weeks before an election, facebook, twitter say it is russian disinformation. they censor accounts, they lock people out of their accounts. obviously to protect candidate biden over at that time to put him over the finish line in these situations. even bobulinski said, hey, facebook and twitter, if they reached out to me i would be happy to verify that the contents on that laptop are real. of course they didn't. also in that tucker interview, which is a must-watch, bobulinski says ever since that fbi interview october 23, 2020, no one has been in contact with his legal team since to follow up on this. so it is like the third rail of journalism. it is the third rail of
