fbi. what is next in special counsel john durham's three-year probe into the debunked trump-russia investigation? fox news dave spunt outside u.s. district court in alex, virginia with the latest. great to see you. reporter: liz, special counsel john durham and his team walked out of the courthouse with a loss, his second loss in court in just a few months. he began looking at the origins of the russia probe about 3 1/2 years ago. igor danchenko found not guilty on four counts of lying to the fbi after judge ant think trenger remove ad first count over a technicality late last week. danchenko was the man the government says was the primary subsource for the steele dossier aimed at taking down candidate donald trump. in a statement rate today special counsel john durham said we're deappointed in the outcome, respeck the jury's and thank them for their service. i want to thank the investigators, prosecution team for their dedicated evidents

seeking truth and justice in this case. durham alleged danchenko lied to an fbi agent four times when he claimed he received a call from unidentified russian male sergey who had connection to republican politics. parts of the call made it to the dossier. durham said he wanted dirt on trump. the two never spoke. cell phone logs show no calls came in on danchenko's account. however his defense attorney said point-blank you can't prove he didn't speak to this man that the call didn't come have an app like signal, what's's app or another encrypted service. for john durham where he goes from here, we expect him to release a narrative report the next few months laying out his entire story over the past three years. liz? elizabeth: that will be something to read. david spunt great journalism. joining us look who is here, senator marsha blackburn from senate judiciary. it is great to see you, senator. >> good to see you. elizabeth: what was your

reaction when you heard the verdict? >> i think from this we have learned that there are indeed two tiers of justice. we know that d.c. is a swamp. it is full of people that are going to try to protect the fbi and the institutions. we do know that hillary clinton was involved in this. this russia hoax, all of this came from her campaign. the fbi knew that this was false. they wanted to take down donald trump so badly that they were willing to pay christopher steele a million dollars if he could verify what he was getting and they put danchenko on the payroll and kept him there for a few years and i think it is going to be interesting to see what durham's next steps are. but what the american people are gaining from this is insight into exactly how corrupted this group -- elizabeth: hearing this from your voters? >> yes. i'm talking to tennesseans every single day. what they know, there are two

tiers of justice. clinton was involved in this. they paid for it. they tried to push it over. they had this narrative. they wouldn't let it go. they wanted to take down president trump. elizabeth: so the special counsel durham in his closing arguments says the elephant in the room is the incompetence, quote of the fbi, how it mishandled it, right? basically james comey by october of 2016 new it was unverified the steele dossier. told the doj that. went ahead, this is the story to get fisa wiretaps on trump campaign including carter page. they misled the american people, fisa court and voters out there. >> that's right. and spent taxpayers dollars doing this. every time you write a check to the irs. think about that the fbi was willing to spend millions of dollars what they knew was misleading information and they were willing to pay an individual a million dollars if they would say it was true. and if they could substantiate

that. they were willing to put someone else on the payroll, keep them there. all your tax dollars. elizabeth: using a clinton operative charles dolan, who had ties to putin's press secretary? >> exactly right. elizabeth: that is what the steele informant was using? >> that's right. you have to look back even at the clinton foundation and the ties that were there with bill clinton. i think it's important to run a long thread on this. i have no doubt that this is the beginning of looking at this issue, not the end. elizabeth: so you know, you know the trump, excuse me the mueller probe never found trump or his team hacked into democrat emails. why didn't the mueller probe uncover what john durham uncovered? >> that is a good question. i'm certain as we continue to do oversight, as we take the house and the senate and you see ron johnson and senator grassily pick up some of this, you're going to see more of this. elizabeth: senator let's move on

to this. gop house lawmakers are sending preservation notices to white house chief of staff ron klain, education secretary miguel cardona, also dhs secretary mayorkas. looks like they're ramping up probes into ag garland as well. school board parent as terrorists, afghanistan, the botched exit there, the border crisis and more. which probe is launched first, first if the house is taken over by the gop? >> these are different committees. all of this is going to go through different committees and you're going to see each of them move forward on things that are part of the commitment to america that the house has made but also in holding the biden administration accountable. people want to know what is happening at the irs with 87,000 new agents. they want to know why the border hasn't been secured with dhs. you look where women are in their voting patterns.

anton, talk to us about what happened, your story. >> i grew up in east dallas. i was in projects. my father sent to prison at nine months. sent to 36 years out of my life. elizabeth: for what? >> aggravated robbery charge. for him not being in my life, a lot of choices i made that led me down the wrong path. elizabeth: you grew up in poverty but not everybody joins a gang, right? >> right. elizabeth: but you chose to join a gang right? it was the bloods in dallas? >> in my neighborhood, most neighborhoods, the name of the game is survival. most kids don't want to join gangs but if you want to survive you have to join gangs. that was true for my neighborhood. i had to join a gang just to survive. elizabeth: what do you think, alice? you're getting gang members out? >> right. elizabeth: how do you change their minds? alice you found this story. what struck you about this story. >> the thing that struck me is

concerns about their freedom are very, very much still very significant in terms of how they will vote. elizabeth: all right. alice, it is remarkably misleading and breathtaking idiotic because the real clear average poll is multiple polls. it is not one poll is outlyer. multiple polls of an average. when you heard nancy pelosi trying to dismiss voters about crime, what was your thoughts? >> americans are not stupid. americans like myself included we are very concerned about the rise in crime and we know that we need data driven smart on crime solutions. i cannot, you cannot dismiss what we see and what we fear and what we see that is going on a daily basis. it is very depressing. >> yeah it is. who else is doing what you're doing, anton? seems like you're leading the charge here. >> it's a lot of organizations across the country but i speak specifically what we're doing in dallas with the police chief.

♪. elizabeth: okay. the white house moving to again sell off oil from the nation's petroleum stockpile to keep gas prices down ahead of the midterms that is the accusation. fox news aishah hasnie is on capitol hill with more. ashiah. reporter: good evening to you, elizabeth. we do know the president will be addressing gas prices tomorrow. as to the details of that announcement the white house playing very coy. the president reportedly will announce a release of oil reserves, ten to 5 million barrels. critics say it's a drop in the bucket when you consider how much oil is consumed globally every single day. second the president could detail how he plans to refresh the petroleum stockpiles. this is important. it is at the lowest point in nearly four decades and finally the question is, will the

president also announce a fuel export ban? domestic refineries are reportedly bracing for that news although the white house today would not confirm this. some democrats believe president biden could take action against saudi arabia for opec's decision to cut oil. we will hear the president's decision on gas prices. this all comes 21 days ahead of a big election as about 53% of voters according to a new "fox news poll" disapprove of the president's policies on energy. elizabeth? elizabeth: wow, really interesting reporting. ashiah, thank you so much for that. joining us now "washington examiner" columnist and author byron york. byron. so good to have you on. byron, what is the reaction, selling up to 15 million barrels out of strategic reserves. when you hear that, what is the reaction? >> mike pompeo called it the political petroleum reserve. i think it is just that.

doesn't make any difference in gas prices. some of the oil released from strategic petroleum reserve is sold overseas. what is the purpose in that? something really interesting is going on with biden and saudi arabia. you know we had reports last week, was it, that when it came clear opec plus would cut production that the biden administration asked saudi arabia, please, put it off, for just a month. we only need a month. please put it off. now they deny having any political motive but the fact is if it had been delayed for a month, that would have delayed any effects on the price of gas until after the midterm elections. when saudi arabia and opec plus went ahead said no, we'll do it right now, we cut production, the president and his party immediately began talking about punishing saudi arabia for doing this, punishing them from cutting production or punishing them for ignoring and refusing

first reaction to that report? >> it is ridiculous, liz. no one i talk to back home is talking about abortion. they're concerned about putting gas in their car, putting groceries in the refrigerator and making their rent payments. abortion is not even a top 10 issue right now. to say that is the driving issue of the day in new hampshire, it is not the driving issue anywhere in america. so i think we'll see a clean sweep of the house and really a fight for the senate. i think that don bolduc has an incredible opportunity to pick that seat up. elizabeth: the other thing going on that makes people crazy, a lot of government spending, a lot of money flying out the door, democrats are talking about a lot of money for irs to do more audits. more it's agents. the inspector general for the labor department discovered thieves again stole tens of millions of dollars in taxpayer pandemic jobless benefits including criminal gangs who spent the stolen money on drugs and guns. your reaction? >> i mean, just think about this -- elizabeth: does it get any worse? >> absolutely it does.
