stuart: i feel good, it is friday morning, 10:00 eastern and susan is sitting next to me. susan: james brown. stuart: a little before your time. there is fox square at look at that, the dow is up 353 points. it opened lower, stayed low for a few minutes and then bounced up. that is a significant rally. 347 up. look at the 10 year treasury yield, now at 4.25% unaware it was half an hour ago. it is up. you would have thought that would bring big tech and nasdaq down. i'm showing the big tech, apple is up, amazon is up, microsoft is up, google and meta-are both down. how about bitcoin, that thing has not moved very much.

susan: it hasn't moved up but it hasn't moved down. stuart: it has been around 19,000 for several weeks it seems to me. now this. the president visits pennsylvania, his handlers tried basement strategy, didn't work, they couldn't keep him away from reporters. he lost his temper when asked about his limited campaign appearances, went out on a limb on abortion and snapped at a reporter about that too but he is really trapped. he can't completely disappear from the campaign trail and his handlers can't shield him completely from the reporters or from himself. biden runs away from the media even though they largely support him. remember donald trump, walking the redline almost every day answering any and all hostile questions, he may have angrily put them in their place but he never ran away. he went straight at them. biden is dragging down his own party, he can't answer

questions about inflation without making factual mistakes, can't answer questions about the border without ridiculous spin that it is secure. should have been embarrassed when john fetterman tonight ever wanting to defund the police and empty the prisons, two years ago president biden was plugging the same anti-police line. has attempt to turn attention to abortion appears to have failed. one thing after another. it comes to this. democrats are floundering, they need a president who makes their case for reelection and that is not the leader they've got. he can't handle the media, his policies are failing, his policies can't protect them, that is a political mess. 18 days to the elections. the second hour of varney just getting started. ♪ stuart: shannon bream joins me now, there's chaos and the campaign.

what say you? >> you know what history says about a president and his first term, the midterms will not be kind to his party, that is something against him and every issue voters tell us is top of mind for them is not going well for this white house. the economy, inflation, struggles filling up the gas tank and putting food on the table, those are all things that are real-world experiences, doesn't matter how many commercials or speeches people give, that is where the rubber meets the road and historically people punish the party in power when they are not doing well financially so all of this is working against the white house. it is understandably will be frustrated, some pulling has his approval ratings down in the 30s. it has to be tension city out of the campaign trail. he has unlimited amounts of getting out there, only wants to go where he makes a difference. interesting to see candidates calling on resident obama to help them in the campaign trail

in tight races rather than president biden. stuart: president biden supports federal funding to help women get access to abortions but he also believes there should be some restrictions, watch this please. >> anything on abortion at all? >> president biden: roe versus wade, rita, get educated. stuart: he lost his temper again and that thing about abortion seems to come out of nowhere. he didn't have an answer ready. that is chaotic. >> i've read it so the president knows i've done my assignment and i'm educated on what is in a row versus wade. it's difficult for him because this is a question democrats have to answer on the campaign trail. you would think he would be prepared for that. they are clearly able to say what they are against but what they are forced the tricky thing. are you for abortions all the way to 9 months, some of them are and when pressed on that very rarely it is uncomfortable place for them to be but this president has to know that is

the one topic democrats feel has been working for them over the summer though it ticked down heading into the fall so you would think he would be prepared to have an answer and to know that abortion is going to come up and what his position news. the democrats are all over the place on that, they want to point at republicans and say they want to restrict every thing, take away your rights and send you to jail over abortion but when asked what their position is many have struggled as it seems the president did. stuart: it is a mess. i've never seen anything like this, 18 days to the midterms and democrats are all over the place. all the republicans have to do is stay quiet. congratulations on your promotion, we will be watching you on fox news sunday this weekend. thanks a lot. the pentagon updated their reproductive healthcare policy. good morning, what are they doing? ashley: the defense department will pick up the travel costs for service members and their

dependents who might be forced to cross state lines for reproductive healthcare needs. defense secretary lloyd austin says the supreme court ruling created a hardship or emergency circumstance for many servicemembers. cording to the pentagon the department of defense is looking to reduce the burden and cost to servicemembers who are stationed in states where such reproductive procedures are no longer legal. the national right to life committee is accusing the biden administration of using taxpayer funds for what it calls abortion tourism and playing to the single issue democrat party. stuart: president biden's plan for student loan handout past a major legal hurdle. tell me more. ashley: federal judge in misery tonight a request by a group of republican state leaders to block the administration's student loan forgiveness program. the ruling said the gop

officials representing sick states didn't have standing to challenge the loan forgiveness because they couldn't show they were harmed by the biden program. george w. bush appointee said he didn't rule on whether the loan forgiveness program was lawful because he determined the states lacked standing was so the court lacked jurisdiction to hear the case. the program effective the cost as much as half $1 trillion and benefit the majority of 43 million people in the us who hold a total of $1.6 trillion in student loan debt. republicans call the plan unaffordable and unfair wealth transfer that will drive tuition higher. stuart: let's bring in jonathan hoenig to look at the markets. i might point out the dow is up 400 points and the nasdaq is up 107, 103. before we get into oil prices and energy stocks and that kind of thinking you explain why the dow suddenly up 400 points?

>> we are overdue a balance. as bad as the economic news is bad, it is, it is true it is the bad not just stocks and bonds at interest rates, the news is out, well-known, we've seen record level of short positioning, investors are smart, they see the recession on the horizon despite the fact washington, they are cutting back, so we are due for a bounce given all the pessimism. the question is does the bounce hold, is it a bounce horrible market, how could every day investors participate if they make some money on a very ugly year for missed assets across the board. stuart: is in a bounce or is it a new bull market? >> it could be a nubile market and that is energy. inflation is not going away. the biden administration is exacerbating it or making it worse and look at the market now, looking under the hood, stocks looking like they are in

bloom markets, those names are energy-related names picking up against 6-month high or all-time high and not all these names have room to run, thinking energy prices are high now but on inflation-adjusted basis they are well below where they were in 2,008 and we are talking gas prices that would be 40% higher even from where they are here if oil prices get that high so we are in it for the long-term when it comes to inflation and energies a place on putting new money to work. stuart: i can't imagine capitalistpig.com invest much in exxon, the big-name oil companies. i think you come down market a bit. what are you -- >> we are always looking for opportunities and if you want to be a contrarian, you look a little bit off the radar screen so one area to consider, do your own due diligence, talk with financial advisor, ps ce, an index of small-cap energy stocks. a rising tide lifts all boats,

apologize, we have a border patrol boat coming by, 21 days into october and we do not have any september border numbers from the federal government and those numbers are expected to be huge. in the meantime activity here is nonstop. look at this video we shot early this morning before the sun came up from our new drone that has thermal imaging capability, a group of several hundred migrants who crossed over at the same time. almost all of them single adult men, we are seeing fewer venezuelan migrants crossing as a result of the new dhs policy expelling venezuelans but we are getting huge groups from other countries including cuba, nicaragua and colombia. over 3,000 gotaways in the last week alone and look at this video, and american mom caught smuggling several illegal immigrants in her vehicle while she had her 10-month-old infant and her other child in the vehicle with them. texas dps troopers found in a compartment with a stroller on

top, a guy in that secret compartment, the mom told texas dps she was trying to smuggle illegal immigrants to the san antonio area. she was arrested and charged with human smuggling, major fentanyl bust out of arizona, cbp officers at the port of entry seizing 242,000 fentanyl pills found in a spare tire for smuggler's vehicle, also found 17,000 fentanyl pills strapped to the body of a pedestrian, trying to walk through and lastly a bizarre bust here, same port of entry, cbp officers finding 2100 fentanyl pills stuffed in time ali's in an ice chest. inside each was a bag with blue fentanyl pills. 2,000 of those out here. back your life in democrat led city of el paso, texas, they are no longer going to bus any migrants to new york city or chicago. they are saying as a result of the dhs policy on venezuelans

indias should be stepping up. i don't know what is going to happen if we get overwhelmed again. stuart: at the moment i take it they are in camps in various times in el paso or are they just wandering around the streets? >> all of the police are going into local ngos. i know we also to have hotel freezes so we are putting them, preventing a lot of these migrants being out on the street but if not bussing them out i'm not sure what we are going to do with them at that point. i would hope the federal government will come in and resolve this and better handle it. stuart: what does that mean? i don't think the federal government is going to build a wall around el paso, that's not going to happen, what could the federal government do to help you out?

>> i think definitely what we have is unsustainable, the bussing is unsustainable. we were having to pay forget federal government's responsibility so i hope they will come in and do it themselves. i personally think what we were doing was way above our pay grade and the legislation, all of that is of the federal government level and for us we are doing them a favor and moving forward i hope they will definitely do something about it. that's not just my community but every community that is having a similar issue. stuart: 14,000 migrants were bust out of el paso. more than any other city that did any bussing operation. i don't see how you handle 14,000 people, more than that in a see as small as el paso. i think you've been left in the

ashley: doing it themselves, securing dozens of land parcels in south texas to build a state-funded border wall. the texas facilities commission says it has secured 32 land tracts that is in negotiation with landowners to procure another one hundred 42 barter london but rash border land parcels and greg abbott's operation lone star border security initiative. the tfc has approved $307 million to build 14 new miles of border wall along the south texas mexico border and adds to the 1.7 miles of state-funded border wall already completed this year. the area includes val verde county, part of the us border patrol's del rio sector which since july has been the busiest sector for migrant encounters along the entire 900 mile long southwest border, texas is doing it itself. stuart: thanks, back to you later. businesses are under siege in

stuart: markets are still in rally mode though we lost a little scene, the dow is up 200, half an hour ago was up 400, susan is looking at the movers. susan: of 3 year low for snap shares, quote early sales growth in company history, you are down 30%. %. isn't that incredible. they are forecasting 0 sales growth for this quarter and you have to remember the stock went public at $17 a share. imagine if you bought into that ipo in 2,017. what i found surprising as they are still adding users, more than what twitter has at 358 million daily that use snap, not a good sign for social media stocks. especially with the results next week. susan: could disappear next year. stuart: oil companies like

in the last hour. is he making any change to his woke policies? >> good morning, he is and remains defiant, he had a press conference in harrisburg, philadelphia progressive da larry krasner insists his more lenient policies are not to blame for the city's record crime surge, he says the republican led effort to impeach him in the statehouse is illegal and politically motivated. >> this is an effort to impeach someone for political purposes who has done nothing corrupt and nothing illegally can because they want to erase philadelphia's votes, straight up, that is what it is. they want to impeach our ideas. stuart: >> krasner says he will only testify to the bipartisan impeachment committee as long as the hearing is held publicly. that you may wants it behind closed doors. democrats and republicans have voted to hold him in contempt for not cooperating. since krasner took office in 2017 murders in philadelphia

are up 78% hit an all-time record in 2,020 one. republicans accused him of dereliction of duty as for laptop car. we are now learning that a man exonerated for 2012 murder in philadelphia last year thanks to krasner is being sought in connection to a recent deadly shooting, police are searching for 32-year-old jamir harris who allegedly drove two gunman who shot and killed 50-year-old man last month which in 2012 harris was convicted of shooting a 45-year-old man but was let go after krasner's office found his constitutional rights were violated. court transcripts show the judge in that case felt the da's office mishandle that case and now harris is a fugitive. this all matters because this is a senate race in which dr. oz made this race a referendum on democrat handling of crime. stuart: got it. thanks very much indeed. my next guest is all too

familiar with crime in philadelphia. dave grogan owns a restaurant in philly. it was just vandalized for the third time in the last two years. who is to blame for the situation in philadelphia? defund the police? fetterman? who do you put the blame on? >> i put the blame on the fact that we have eroded the respect for the police department, the police know that if they prosecute or arrest anybody nothing will happen, there's very little reward in upholding the law, crimes like vandalism are rampant because they are not even prosecuting the larger crimes. no sense of lawlessness in the city, the video the atvs driving around, they are up now, police and gas stations, imagine citizen drivers so there's a sense of lawlessness and the lifestyle crimes that

affect daily lives, no repercussions for that and that is the mentality. stuart: have you moved to florida? you run a restaurant in florida? i don't know, are you in florida working in the restaurant business? >> i own restaurant to the suburbs of philadelphia, new jersey and when covid happened we had one restaurant in florida but when it happened in philadelphia, in pennsylvania, locked down, time for the best in florida. we focused a lot of growth in florida. i would say for every one restaurant we considered up north, we open in florida. it is a funny thing. mayor kenny and philadelphia focused intently on masks and mandates and we will inspect you and put regulations in place but meanwhile if you get punched in the face around the corner from a restaurant nobody will get in trouble but if you didn't have a mask and a
