darrell issa from house foreign affairs and look who is bet, "newsweek" deputy opinion editor. batya ungar-sargon. good to have you on the show. first to you, congressman, the gop has a path to narrow, narrow house majority. could control of the house be decided by 10 close races in california? what are you hearing? we're hearing orange county, ventura county, central valley? >> basically the races in which we're already ahead by 2 points or more that haven't been called represent our majority. so we're pretty comfortable that we'll have a majority of 220 to 222. that is three or four seats more than the senate has where they're probably going to have a one-seat majority plus or minus. the fact is that the senate doesn't operate very well with a one-seat majority. the house operates just fine with a five, four, three, two, one-seat majority. we're pretty comfortable we'll have the gavels but also that we have the responsibility now to

virtues and they demand the working class pay for it. elizabeth: what batya just said, congressman, get back to what the gop agenda is and gop fixes, right? why didn't the gop a year ago stipulate, hey, electricity is not green. you had california voters rejecting a plan to subsidize the electric car industry. $90 billion they rejected that. they didn't want that. michigan voters said no to a wind farm. why didn't the gop come out strong say electricity is not green. 80% of it is fossil fuels or nuclear? >> you're exactly right. we didn't do enough to tell the american people that the only way to have the first world that we have for now is to include fossil fuels, particularly natural gas. make the investment in nuclear and other zero emissions and that this idea that you can blow with wind energy or light the world with solar, it didn't work at sundown. it doesn't work when the wind drops off. you know everyone who wants to

mexico's government is using footage from the street of kensington, philadelphia in a new anti-drug ads. the ads show homeless people, drug users late out on the ground barry walking or slummed over. the ads never identified the city, known from kensington, the neighborhood operating as open-air drug market particularly for heroin. drug overdose deaths in 20012001 were the highest they have ever been in philadelphia -- 2021. 1278 people died, 77% from fentanyl which mostly comes from mexico through the southern border. the mayor has supported harm reduction techniques such as adding vending machines for narcan. he supported proposals for safe injection sites. liz. elizabeth: what a story. bryan llenas thanks so much for bringing that to our attention. welcome back to the show, joe gamaldi with the fraternal order of police.

joe, that is quite a story. what was your reaction when you heard isn't. >> imagine the arrogance and audacity of the mexican government to use a philadelphia neighborhood to try to prevent people from doing drugs when they are implicit in trafficking drugs across our border. due to their ineptitude for generations the cartels there thrived and flooded our neighborhoods with illegal narcotics. because they refuse to do their job to take any action, because our own government refuses to secure our border the leading cause of death in this country is fentanyl for people 18 to 49. it is not showing signs of slowing down. here is an idea of mexican government, clean up your own house before talking about ours? elizabeth: that is heartbreaking. joe, there is a lot of about crime as factor in midterms. 2018 midterms, his panic asian support jumped double digits. black voters shifted four points

to the gop. joe, we want to ask you about this. about eight out of the nine states that have no-cash bail, you know, no-cash bail if you commit a felony, let out, if you try to do kidnapping even homicide, the majority of these states, eight states did not let americans vote on policies without setting bail, repeat criminals arrested for things we mentioned, homicide, arson more. why, how come americans are not allowed to vote on that? >> you know i don't think they want americans voting on it because it's a bastion of accomplishment for the democrats they were able to pass bail reform in a lot of these places. they know it would go down like the hindenburg on the ballot because we've seen murders at levels we haven't seen since the 1990s across this country. you saw it play out in the midterms in new york where multiple house seats flip. the house itself is going to flip republican but now that the republicans are in charge, it is time for them not just talk a good game but show something here. violence against law enforcement through the roof to the tune of

281 police officers shot already this year. so why don't the republicans go ahead and protect and serve act which would make it a federal crime to knowingly assault a police officer? don't just talk a good game. americans are expecting action on crime of this country. elizabeth: 27 of the top 30 cities with highest murder rates are led by democrat mayors. nine out of 10 arrests, joe, to your point, accused criminals were released with no bail, no-cash bail. new yorkers didn't get to vote on that, just eight out of nine states. it doesn't seem right at all? >> no, it doesn't. particularly when we see some repeat offenders, liz, how is it possible that 10 people are responsible for 500 arrests in the new york city police department right now? that is completely ridiculous. we are not even looking at the fact if we were to incarcerate them, repeat offenders for the long period of time, we could actually reduce the amount of victims we have in our communities. this has been the strategy for democrats for quite a long period of time we care more

about suspects than we do about victims. it is despicable. it has to stop. elizabeth: family of keira beddingfield, mother of three, was murdered by her husband. they will family is saying the governor is responsible for the crime but a lot of seats did flip inside of new york state. they did flip republican as the governor holds her seat. >> well you know i certainly praise there for having the courage an integrity want to step up to file a lawsuit. i hope they do. i hope every other american who has been impacting by these revolving door policies, i hope they follow as well. we may not win due to prosecutorial discretion and protection politicians have in the country, we need to send a clear message americans will not tolerate lawlessness anymore. we'll not allow families continue to be victims because we want to keep letting suspects out over and over again. elizabeth: joe, good to see you

legitimate oversight because we are a white house that respects norms and the rule of law but i think that you know, the american people didn't vote for congress being used to conduct political vendettas over the next two years. they voted for -- >> well obviously everybody has to comply with the law such as the law is is. so you know, we would hope that they would feel chastened by the voters of america who dealt them an historic repudiation. elizabeth: sol, is this hunter biden probe's, is this a political vendetta? should the gop feel chastened not to investigate hunter biden? >> no, not at all. there are obviously political aspects to it but it is an investigation that is long overdue and needs to be accomplished somewhere and as i often said before on the show, the key in these investigations is, what is the scope of your inquiry? whatever we know, whatever the department of justice is looking

at is very narrow in focus and republicans have something broader in mind. i think that is a good thing and listen, they're not going to be able, the democrats will not be able to stop this. they will look completely inconsistent under the law if they do that. elizabeth: what concerns you most about what the biden family and what hunter biden was doing overseas with their selling access into the obama white house? >> just the influence peddling and the possible involvement of the president himself when he was vice president and, trust me, if the, if the democrats decide to try to create trouble or boycott the hearings like some of the republicans did in with the january 6th committee the republicans will be more than happy to hold hearings without them. listen this will be very embarrassing to a lot of people in washington a full-fledged investigation. elizabeth: how does it affect u.s. national security? >> well, i think that, what we might find is the influence

peddling that went on affected u.s. national security so much of the work that hunter biden did had to do with chinese entities and powerful chinese individuals. so i think the jury is still out on how it affected u.s. national security but that is going to be one of the big aspects of it. listen, there are a lot of people in washington on both parties who stand to be embarrassed by any real investigation into influence peddling in d.c. elizabeth: you know, joe biden emphasizes his son was a drug addict. critics say that defense stands in glaring contradiction to the fact that hunter maintain ad worldwide multimillion-dollar what you say is influence peddling scheme. the question is, why foreign figures gave him international money and transfers and complex deals worth millions of dollars to kyiv be to bay screening? >> that is what we call in criminal law an inconsistent defense. on the one hand you're a drug

anyway. elizabeth: what do you think, mitch? now the administration is not accepting applications for student loan forgiveness. a federal judge says it is unconstitutional. the eighth circuit court of appeals just upheld that block today. one of the largest exercises of legislative power without congress in the history of the u.s. is this a bailout or a buyout? >> it is definitely a buyout and to invoke the heros act which was post-9/11 piece of legislation for buying votes from young voters, the worst and most egregious part of it, liz, the fact you could be making a six figure income and get your student loan forgiven. that just to me is egregious, appalling, i could go on. elizabeth: you know the democrat, house democrats got i think it looks like the second highest youth vote turnout in the last 30 years. but people forget what vice president kamala harris had to say about college kids.

watch this. >> here is what we did, we recognized the fact that 18 through 24, when i was at howard university and we were in college, we were 18 to 24, you know what we were called, college kids. but when you turn 189 you're in the system you are considered an adult. what is the other thing we know about this population and a specific phase of life, remember, age is more than a chronological fact. what else do we know about this population, 18 through 24. they are stupid. [laughter]. that is why we put them in dormitories. and they have a resident assistant. they make really bad decisions. elizabeth: okay, adam, she was talking about a youth program aimed at stopping recidivism through education but that was pretty, you know, it didn't age well, right? >> right. you know, about 26 million people have applied for loan

forgiveness apparently they thought they made a bad decision and needed a bailout from the government. in fact 40 million people or more will be eligible. that is a lot of votes, especially considering how close a lot of the races are. biden was even going to issue checks to people who have not been paying, for those who have been paying their loans since 2020. it is almost like driving the voter except it is worse because they will not even get the bailout. elizabeth: to what adam said, mitch, it seems so cynical because it doesn't attack the root cause. they're all about root causes, of what, how fat cat college academics or tuition gouging families, it did not go after what academics, excuse me universities and colleges are doing, ratcheting ever higher college tuition costs. that is why what biden did is being called cynical. what do you say, mitch. >> i liz i got done paying for eight years of college. my twins graduated last may and the thing, all i saw over the course of four years, forget about the covid lockdowns but i saw tuition go up.
