this or any similar product. she is traumatized and kraft heinz is accused of neglect representation. fraud. false and misleading advertising , breach of warranty and unjust enrichment. oh, that will be $5 million, please. i've been away for a couple of weeks and the first thing i see when i step off the plane is another ridiculous episode of liability law history. i have no idea how this thing plays out, but wouldn't it be wonderful to see a judge throw it out, call it frivolous and make the plaintiffs pay any and all court costs? i hate to say it, as american citizen, with an english accent, america needs the english rule. that is loser pays. that's how you stop frivolous suits. don't hold your breath. we like to think we live under the rule of law but all too often, it is the rule of lawyers third hour of "varney" starts right now.

all right, steve forbes with me this monday morning. all right, steve, we've got this lady suing over mac & choice. there's another story of someone suing tgi friday, don't laugh at my italian accent here. when are we going to confront these frivolous lawsuits that hurt us all, that's my opinion. >> well maybe heinz should sue her for having a bad microwave. maybe that's the problem. stuart: good one. >> she's a bad cook, what can you say but when this all goes back to years where judges did not want to be judgmental. they can throw these suits out. they used to throw these suits out but the whole philosophy rose you have to give everyone their day in court and have appeals upon appeals nobody wants to be overruled. judges you don't need new law, you just need judges enforcing what's there now saying this is frivolous, throw it out take it to the judge if you don't like it.

lawyers learned long ago because of the court system we have with judges not making judgment they can make it so costly that you'll settle just to get rid of the suit. it's cheaper to settle than to fight it in court so in terms of republicans get rid of the 87,000 agents, let joe biden go before the american people and say we need venezuelan oil rather than american oil. i'd love to run on that issue. stuart: but you know, can the republicans do anything with a tiny majority in the house and they are still in the minority in the senate? >> well, nancy pelosi showed even though she had a fairly small majority in the house standards, she had that caucus whipped together. can kevin mccarthy do the same thing? we'll see. stuart: republicans are more difficult to whip together than democrats, i suspect. >> well i think the prospect of an election and how poorly they did to expectations in this election is a wakeup call. you better have good issues. you better show you can govern and get something done even if the president won't do it. you've got an issue for 2024.

>> okay, if i might, on the get , can we just take a moment to celebrate the way, first of all that technology has enabled that type of communication? elon musk was on his private jet , stuart, hooked up through his star link service to roughly 100,000 people on twitter that night, and then let's take a moment to also celebrate that can you name another leader that two hours, stuart, it was a q & a that went on for two hours. i was just another person in there who asked itch i if i could ask elon musk a question and the host granted me that permission. donald trump did it during covid but i couldn't think of a college football coach or a business or political leader that would take that accountability and transparency. now to your direct question. what i think we have right now, stuart, is motive, a body, someone standing over the body, and that person having complete and utter motivation to commit the crime. do we have the proverbial smoking gun? that be a direct communication from a government official, to

someone at twitter, or google youtube facebook, to say spike the hunter biden story. we don't have the proverbial smoking gun but what we do have is a constant relationship with the fbi and big tech on a weekly basis according to mark zuckerberg, where they would come in and say watch out for this. watch out for that. building a case so that someone at twitter when that story came out, the hunter biden laptop story, was ready to go and say spike it, and every tech company followed, stuart. i think we have about as good of circumstantial case as you can imagine in saying this was dnc, first of all, dnc and then government in terms of the intelligence and law enforcement apparatus, leading to a first amendment violation of free speech through big tech. stuart: yeah, understood. >> will: and by the way then election interference. stuart: yeah, exactly. good point. now former president trump, he's calling for the termination of parts of the constitution, in response to the hunter biden

twitter revelations. in a truth social post, he said this. a massive fraud of this type and magnitude allows for the termination of all rules , regulations, and articles , even those found in the constitution. will, i'm sorry i think that's going much too far. i don't think he should be saying things like this. what say you? >> will: i agree. that's a no. okay, first of all, again, let's just set the stage. what a strategic blunder. in my estimation from president trump, because today the focus should be on what we just discussed. those twitter files, which is an ongoing story, that was used to subvert the american principle of free speech. instead every other channel, stuart, is only talking about this. trump changed the conversation to this , by saying this at this time. secondarily, the only thing that sets us aside, and i get the frustration, if one side of the aisle has no respect, nor no abidance by the constitution, what do we do? you know, what do you do, but the answer cannot be set aside

england plays france i think it's on friday in the world cup. big game. you got any comment to make on this? >> well, we have been fighting each other for a thousand years. stuart: this is true. >> with a brief interruption of world war i and two when we were on the same side and this is one of the most contested sports for decades. france, look, ever so good as a team but do you know what? englands for wards are excellent and i'm quietly optimistic. stuart: don't jinx it whatever you do. i've got one last one. kind of getting serious here. the british government might have to use, is considering using, the military, a public service workers, ambulance drivers that kind of thing, nurses, if they go on strike. that seemed to be an extreme move in my opinion. >> no, we did it back in the 1970s there was a fireman strike and the army came in and took over so there is precedent for this but we are looking at nearly all of our big public services going on strike between now and the new year. it's not coordinated into a

general strike, but it's the biggest wave of industrial unrest for 40 years. stuart: this looks likely right before christmas? >> i think it's going to happen , yeah, postal workers, even nurses, and we never had a national nurses strike in the uk in our history. this is the cost of living. it's double-digit inflation and i'm afraid, you know, government is going to have to face this down, because if you do give, if you give in to the pay rises all that does is fuel more inflation. stuart: it does remind me of the 1970s and the minor strike in the 80s against margaret thatcher which she won hands down. >> she won but at a hell of a cost. stuart: yes but prosperity came right after that. the end of strikes. >> we had three prime ministers this year, four chancellors this year, its been the most turbulent chaotic year in british politics for 200 years and do i see firm leadership, or somebody that tends to get pushed over? i think well the latter, i'm afraid.

the fact we saw a rally in oil prices, jet fuel accounts for more than 50% of airline costs but good news on the sector side you had a delta pilot offer raises of at least 34% over the terms of the deal. i wish we had those type of raises here. morgan stanley also upgrading united airlines to a buy, calling it overweight saying 2023 is a goldilocks here for the airline stock, we're at $67 in their view. stuart: okay. >> what's the score? stuart: it's one-all. have you been on a plane recently that was not jam packed full? because i haven't. >> no i have not and cross- continents too by the way and it's incredibly expensive. stuart: exactly. lots of people, lots of money. all right, china shares, they are still on a bull run. >> yup, so hong kong stocks just came off their best november in 19 years, entering a bull market last monday, up 20% from recent peaks and this is on that reopening theme and optimism continuing today. stuart: i'll bet that pop stocks are rallying.

am i right? >> well, yes, and those are the casino shares that are up as well and the reopening but take a look at this. so sales are soaring growing 10 times this year from 2015, $33 billion worth of marijuana being sold with more than half of u.s. states now legalizing cannabis. the industry expected to grow about 60% over the next few years and this morning you had wedbush calling all these four stocks a buy this morning. might as well when you have more legalization. stuart: the lame duck democrats in the house are considering marijuana legalization all over the place. >> well that would improve usage i'm sure. stuart: that's why the pot stock s are up so much. susan thank you very much indeed now this. a doctor is warning that the woke agenda is now gaining ground in medical colleges. he says diversity has been elevated above achievement and merit. chris ruffo with me this morning is this accurate? is wokeness really penetrating deeply into medical schools?

>> that's right. there was a recent report that critical race theory ideology has been embedded in more than half of all medical school curriculum. we even had a story out of the university of minnesota in which students were pledging not to the dictates of modern science, but to actual kind of indigenous pseudo-science. they said that indigenous ritual s are just as good as modern medicine. they had to actually chant this along with their dean during a ceremony. things are going off the rails everywhere. unfortunately, the hard sciences including medical schools, are no exception. stuart: well what are we going to do about this? we can't have this imposing itself in our medical college. we can't have this. what are we going to do? >> the problem is that we certainly shouldn't have it, but we can have it, and listen. there's always been this idea that at a certain point, the

woke idiologs will stop at the hard sciences and stop at the medical sciences, they will stop at the national defense. that hasn't happened, and in fact, you see it everywhere, from the fortune 100 companies to the great medical schools of the country to the united states military. this ideology does not stop. it wants to conquer all of the institutions in american life and it won't stop until people take the risk, take the leadership and have the courage to put their feet down and say enough is enough, we're going to start pushing back. stuart: you got to stand up at some point. i swear, bob iger, he's returned as disney's chief executive. some belief he's going to pull the company back from woke culture but chris, i think he started it. i don't see him pulling back much on wokeness. what say you? >> well, i think that bob iger at heart, he's an accountant, he's a numbers guy and even though he, i think, arguably is true, started a lot of these woke policies in his previous tenure. he has a very convenient scape goat. he can blame his predecessor bob

stuart: to the border. police find an astonishing 660 pounds of fentanyl stuffed inside coca nuts. they made the bus during a traffic stop in mexico right near the arizona border believed the drugs were headed here, two people under arrest. in texas, border agents just discovered 25 pounds of liquid fentanyl hidden inside a gas tank. mike tobin from eagle pass, texas. mike, why are border agents calling that the liquid fentanyl why is that historic? >> historic because it's the largest seizure of fetterman international ever on the u.s.

side of the border according to agents and with title 42 set to expire in 16 days the problem isn't just people coming ink across uncontrolled border but what we see is the problem is lethal drugs coming across as well. you talk about that seizure. u.s. border patrol says working with the county sheriff's deput ies say they made the largest seizure of fentanyl in u.s. history. it was in liquid form being transported in a secret compartment built in the gas tank of a truck and that vehicle came across in robstown texas. the chief of the rio grande valley says it was enough fentanyl to kill 5.6 million people to give you some perspective that's equal to the population of the city of houston. this comes on the heel of that stop you mentioned on the mexican side of the border in which 660 pounds of fentanyl were seized. the deadly synthetic opiates were concealed in coconuts. it was on a path to cross in the u.s. at lukeville, arizona. >> this goes to show you the

sophistication of the mexican drug cartels used to smuggle dangerous narcotics to smuggle it through the ports of entry. to date operation lone star the texas department of public safety seized over 600,000 pounds and 350 million lethal doses of fentanyl. >> in laredo u.s. customs border protection seized $8.3 million of methamphetamine coming into the u.s.. a mexican citizen and passenger were coming across with a trailer that appeared to be empty. an alert agent referred the trailer for a secondary inspection. a dog was used. this time 913 pounds of methamphetamine were discovered both driver and passenger were arrested. meantime the flow of migrants is constant. nearly every morning groups in the hundreds are coming here to regal pass, texas, we see small groups throughout the day and title 42 was a tool empowering agents on this side of the border to send about a third of them back as that's set to expire.

vatican issued a 46 page guide for ethical investing. this after 10 church officials with r charged with financial in pro pry." jonathan morris is our resident theologian. let's get to the ethicallism, how do i invest ethically according to the vatican. >> it's kind of a more late term is a multi-billion dollar business, right now. it's a big deal. people say, if i'm putting money into something, i want to make sure i'm not supporting something i don't believe in, number one. number two. how do you as an individual investor decide what is ethical or not? of course that's according to your own values. what the church has said is we're going to give guidelines for churches or for religious institutions, that they can hand over to their money manager s and say this is what i believe in. so first, you have to have something you believe into answer your question, and it's not just about making profit. so i think overall, it's a very

positive thing that the church is offering these guidelines for anybody who wants them, it's unfortunate that they are also dealing with some serious financial corruption within the vatican that they are trying to clean-up and doing a good job of it. stuart: i put the financial corruption on one side. is the vatican, the catholic church jumping on the climate bandwagon? i think the answer is yes. >> yeah, there's of course, it's not just, when you come to a guideline like this it's not just black and white. you can invest in this , you can't invest in this. you also have priorities and in this case the priority is of pope francis have been very much in line with climate change and respect for the environment et cetera, but there's also other guidelines in there. they say let's not get involved in investing and adult entertainment, for example, or in casinos, et cetera. right? stuart: casinos? >> it's not that the catholic church says it's illegal to gamble or you can't gamble, but obviously, if you're investing in a casino, there's also some

serious ethical issues of whether or not you're getting people addicted to gambling, and they are saying stay away from that. stuart: the only thing i would stay away from as an investor is tobacco. i would not invest in tobacco. >> how about investing in things that don't make you money you'd stay away from that. stuart: absolutely i would. >> all of this , impact invest ing, what the history of this impact investing and ethical investing has shown is that you can actually be good and be profitable. i believe in that deeply, but of course, you have to be very wise about it. stuart: the best-performing group of stocks in the 60 or 70 years after world war ii were the tobacco stocks so i missed out on some of that. >> you can also be profitable by being bad. stuart: yes, you can. it's not starely a good thing i'd say. now non-religious people are voting and they tend to vote democrat. look at this. the group, these non-religious people, they were 22% of all voters in the 2022 election.
