northern california. a big 6.4 earthquake, no fatalities, some injuries. property damage is reported. we're tracking now more than 80 aftershocks so far, some at 4.6 and 5. also this, house ways and means meeting today to talk about releasing trump's tax returns to the public. this is a taxpayer confidentiality fight. the justice department calling for title 42 to stay in place for a brief period of time. we've got illegal immigrants face sleeping on the streets in freezing weather. we've got grady trimble in arizona with the story. grady. >> reporter: liz to set the scene for you, this is of course the border wall. on the other side of it is mexico. over here you see private property. it is owned by rancher john ladd, fourth generation in this area. he is kind enough to join us today. you've never seen people crossing the border in these large numbers in your whole life?

earlier you get a call your cows were loose. liz, the message not just from john, officials across the border this is a bad problem f title 42 is lifted it will only get worse. elizabeth: grady trimble thank you so much. bring in former acting dhs secretary chad wolf and texas attorney general ken paxton. the news is breaking, senator sinema is asking the president to visit the border, chad wolf. what is going on with the supreme court and what's happening there? is this a rebuke to the white house? what do you think, chad? >> i think it is interesting. obviously the administration has been put in a difficult place because they're having to now advocate for title 42 because i think they know what the rest of the american people know. title 42 goes away they have not only a crisis but catastrophe along that border. they talk about needing it to stay in place for a brief party. period of time, i'm not sure what that means this is no

surprise. they knew title 42 was ending. the real issue is there is no plan in place for title 42. we see images in el paso, elsewhere that is with title 42 in place. there is no plan to end title 42. what is the concern to me, there is no enforcement posture. there is nothing they will do differently they have not done over the last 23 months where we've seen this crisis continue to blow up month after month after month. elizabeth: yeah. >> i think they're in a difficult place. asking them to remain there for a brief period of time. i'm not sure what that gets them. elizabeth: ken, here is the thing, the supreme court is expected to turn it back, the fight over title 42 back to the lower courts like it did in june with remain in mexico. that is the expectation. you know, authorities and former lawmakers like texas representative will hurd say what the president is doing is not humanitarian. this is pan ammonium. they're pushing the elderly, women and children that qualify

for asylum to the back of the line as the size of nebraska, idaho and vermont combined have been caught trying to cross. now people are sleeping on the streets amid record winter arctic chill temperatures. what do you say, ken? >> no. i think will hurd is right. this is a catastrophe not just for americans but also for the actual people that deserve asylum. they're lost in the shuffle of the millions of people that are coming across and using the magic word asylum and we all know most of those people don't qualify. think back when chad wolf was there, 14 to 16% of people actually qualified for asylum. now everyone is qualifying for asylum. hopefully we will have victories on remain in mexico. that is back in play. title 42 hopefully will stay in place with some semblance of a border. we're on the verge of total collapse. elizabeth: u.s. cities, ken, what chad is saying u.s. cities, warn public services will be cut

because of the influx. i.c.e. training videos, i.c.e. officials on camera talking about you who the white house lost track of at least 150,000 illegal immigrants in the summer of 2021. let's watch this. >> operation horizon, the background on this you guys may be new to it, over the summer we had well over 150,000 folks come in. they were issued a piece of paper said go find somebody in i.c.e. and that was pretty much it. there was no processing. this isn't something that you guys asked for, and i can assure you that no one in the criminal alien program asked for it either. >> since march of 2021, cpb has been releasing non-citizens or prosecutorial discretion, humanitarian parole, directing them to report to the nearest i.c.e. office where they intend to reside. elizabeth: chad, they're not showing up. they're told to report back but

they're not, right? chad wolf? >> that's right. i don't think that is a surprise at all. at the end of the day look, they continue to put so many of these illegal aliens into the system, they have broken the system. so this idea that they're just going to issue a piece of paper, have them show up at the local i.c.e. office, guess what, they don't show up. they know that. they have the same statistics, that i do, attorney general paxton does, they know all of this. they design a system to operate this way, this is by design month after month after month. you talk about cities declaring states of emergency, asking for federal help. of course they are, they are being overrun. you have community in texas in south texas, brownsville, del rio, el paso, arizona and the like that have been dealing with this for 23 months. they have been overridden by almost by month one asking for the federal government to step in. it is what dhs does, is provide border security but they're not

doing that. so state and locals are having to step up to use resources they simply don't have. elizabeth: ken, the other thing, a new harvard hill poll, more than 2/3 voters asked, they have no idea how bad the border is. because the media is not reporting on it. polls show voters thinking only a quarter million, 250,000 are illegally crossing when it is 10 times that amount. to chad's point, u.s. cities are reeling from a crime wave, fentanyl and drug crisis. president biden collapsed border. got rid of remain in mexico. safe country agreements in central america, ending title 42. under his watch deportations dropped to the lowest level ins in i.c.e. history, ken. >> unlike much of media you're show is coughing this. what we're experiencing in texas, arizona, border states, affecting entire country.

eventually americans will know. it is coming to their state too. we're all border states. these impacts from whether it is the drug crisis, fentanyl overdoses crime associated with it, this all is going to affect every state in the america. elizabeth: watch the white house press secretary, they cannot name anything the border czar vice president harris has done to fix the border. refuses to answer why the president is getting rid of title 42. watch this. >> the president has been doing work at the border since day one. as you know the president appreciates the partnership with the vice president, you're right that has been her charge to work in a diplomat ticker way to finding the root causes of migration. i don't have anything to lay out specifically on what that work looks like but again, we appreciate her partnership and i would probably refer you to her office on anything specific on the work that she is doing. so look, we remain under a court order to lift title 42.

elizabeth: in washington, congress doing even more inflationary spending, 1.7 trillion. that is the new omnibus spending package. at the same time the fed battles inflationary spending with more rate hikes on you. the u.s., is it turning upside down? we have a new study explains why more than three million people dropped out of the workforce since before the pandemic. because the government is ramping up paying people not to work. we have hillary vaughn with more at the white house. hillary. >> reporter: good evening, liz. we are two years out of the pandemic but there are still millions of people out of work,

even though there is a job for people that want one. there are three million fewer people working today compared to prepandemic february 2020. the case of the missing millions from the workforce has been a mystery to some but there are a few factors experts say that are causing it. early retirement is one. another, some experts say are the benefits. staying out of work sometimes pays more in some states. the committee to unleash prosperity did a study. they say it is generous unemployment benefits keeping people out of the workforce n some states it pays pretty well. with generous government benefits bringing in enough cash to equal a median household income at about 24 states. according to analysis from the committee to unleash prosperity, the group says existing unemployment benefits, the dramatic recent expansion of obamacare subsidies, a spouse would have to earn more than 80,000 a year from a 40 hour a week job to have the same after-tax income as certain

families with two unemployed spouses receiving government benefits. the top state with the most generous out of work benefits, washington you add everything up, it is the same making 30 bucks an hour. these benefits are not endless. they do expire after a period of time but for the time they do pay out, they pay pretty well. liz? elizabeth: hillary vaughn great reporting as always. welcome back to the show, house financial services congressman french hill. congressman, your reaction to that report. are we now in a danger zone? we have able-bodied citizens they can make more money by not working when there are 10 million job openings? what do you think of this report? >> liz, merry christmas, happy hanukkah to your viewers. absolutely, this tells the whole story of taking the pandemic, turning it into a spending spree, expansion of the welfare state by joe biden and democrats in the house and senate. let me mention one other things compared to your report.

you can get your mortgage paid or rent paid without showing harm from the pandemic as a result of the american rescue plan. basically no strings attached. that is what the democrats did to so many of those pandemic programs. they extended them, they expanded them to more people across the country. elizabeth: we've got a new study that forecast 100 million people will be on medicaid next year. here's the thing, it comes from the foundation for government accountability. they say this number includes 21 million who were not eligible because they earn too much money to qualify for welfare. so we're just letting it happen. >> we've seen this before over and over again. we've seen people staying in public housing that make half a million dollars in new york that are overstaying, no one is seeing how to get them out of public housing this is absolute problem with the government. i gave the golden fleece award after the pandemic because 18%, 18% of the unemployment

benefits, some $160 billion during the pandemic, were paid fraudulently to people and no one has gone to get the money back. elizabeth: that is the point. there is a lot of fraud in these pandemic programs, right? we have people buying luxury cars, trips to las vegas, vacations to the bahamas, mansions and houses with this pandemic money that was stolen. now this, there is even more fraud feared to be coming with biden's 400 billion-dollar student loan bailout. the supreme court said today, news coming, they will take up the two challenges to that in late february, two major challenges to it as unconstitutional. states are saying the president does not have the power of the purse to do this, congress does. your final word? >> i agree completely. when you look at the spending in this discretionary budget this week, 1.7 trillion, plus mandatory, we're spending 1.3 trillion more in 2023 when

breaking just now. that twitter let the pentagon use its platform for a vast propaganda network worldwide, hundreds of fake accounts and "deepfake" images, amplifying tweets and messages in the mid-east. we're tracking more than 200 fake accounts. what do you think of this? >> this is more activity from the intelligence community and the department of defense that i don't think we have any business conducting. the role of the department of defense is, to secure our borders, make sure america is safe and what we we have now with the department of defense, the cia, of course the fbi, we have a lot of personnel and a lot of tax dollars being invested in misinformation campaigns on social media. they did not have the authority to do this by congress. this isn't something that i think the government should be involved in and we expect to hear from all the leadership in

the fbi, the cia, and the defense department on exactly what their objectives are and how much tax dollars they have spent. elizabeth: so they're talking "deepfake" images that twitter allowed the pentagon to put up on its site. this was going on with other social media too, facebook and telegram. another tweet came out twitter was doing high fives, cheering each other on the scenes, "the washington post" did a story what was going on here but did not mention twitter's role in this u.s. military psyops influence operation around the world? >> we just don't have any business doing this, liz. if you look at the american military's record in nation-building, it is not very good. if you look at the tax dollars we spent in afghanistan and iraq, just to name a few, to rebuild nations, to create democracies, it has not turned

out very well for the american taxpayer. it has not turned out well for the american soldier. now what we see, the pentagon and the cia meddling in misinformation campaigns in other countries, just the sort of thing we have accused russia and china doing in the united states. so you know, this is something that we have no business participating in. this is something that nobody in congress had any idea what is going on. this is another example of the federal bureaucracies under joe biden completely out of control. elizabeth: the thing is to your point, remember senator frank church in 1975 warn about u.s. intelligence hooking up with technology to manipulate the media, manipulate americans, manipulate their points of view. so where does the house go on this because the fbi just blew up this standard? they have to have indication of a crime to start an investigation but now the fbi is caught, quote, pre-assessing

♪. elizabeth: okay, this story, president biden moving to sign the national defense authorization act into law this week. it has a repeal of the military's vaccine mandate. republicans led by senator marsha blackburn fought to get rid of that mandate. fox news mike emanuel in d.c. with more. mike? >> reporter: good evening. with president biden due to sign a massive defense bill that ends the vaccine mandate for the military, now some leading republicans are demanding to go a step further to reinstate those who were kicked out. >> there a lot of people, thousands of people that have been kicked out. they need the opportunity to come back in and they need to get back pay. so many families were harmed over this. >> reporter: more than 8,000 servicemembers have been kicked out for refusing to get having nated for covid-19. 834 from the air force, 1851 from the army, 3717 from the

marine corps. 2041 from the navy. at the white house the press secretary says the vaccine mandate should have continued. >> clearly the president was opposed to rolling back the vaccine mandate but we saw that republicans in congress decided they would rather, rather fight against the health and well being of the troops than protecting them. reporter: since the vaccine mandate was imposed military officials estimate 98, 99% of active duty personnel have received their shots. earlier this month defense secretary lloyd austin defended the vaccine mandate saying quote a million people died in the united states of america. we lost hundreds in dod. so this mandate has kept people healthy. austin added, i support continuation of vaccinating the troops. republican senators point to recruitment and retention struggles in the military calling for change. liz? elizabeth: great reporting, mike emanuel, thank you so much.

bark with us now "new york post" columnist jon levine. so good to see you again. you and i talked a lot about censorship. democrats joined the gop today, they launched a new 9/11 style commission to probe the origins of the pandemic. look at that, twitter files about censorship, the lawsuit out of louisiana and miss missouri, jon, what was going on with big tech and the government shutting down debate during the pandemic? stopping push to avoid lockdowns? it is all coming out now, jon. >> it is a critically, critically important question. during the origins of the pandemic, this came from a chinese open-air food market, someone sort of ate the wrong thing with a bat. it was unclear. they tried to present the idea it naturally occurred. people like former president trump and others said maybe came from the bat corona virus lab literally in wuhan you were shut

down. that was not allowed to be discussed. if you tweeted about it you would get banned or censored. it is critically important to understand the origins of coronavirus, because if it came from that lab, how it escaped and what potential involvement the united states had in funding that lab, collaborating with that lab and who is to blame on our end. elizabeth: jon, to your point, this virus has never been discovered in nature. this has not been found in nature yet. dr. fauci and francis collins put on a full court blitz saying it was not man-made, that it came from nature. dr. fauci testified in the louisiana, missouri lawsuit, he was afraid blaming the chinese for the outbreak would increase tensions with the beijing. he is was not a diplomat. >> he was playing politics.

facts are stubborn things. if it hurts the chinese people, you have to tell what is and what isn't. have to trust public authorities otherwise no one will believe anything. we have to get to the bottom where covid came from. it is increasingly obvious it did not come in nature it did not come from an open-air food market. it is increasingly probable it came from the wuhan lab. we need to know more. elizabeth: systemic discrediting of doctors who said no to shutdowns. government documents, you said, dr. francis collins, former nih director, sent an email to dr. fauci, about a quick and devastating take down of doctors from stanford, harvard and oxford who were saying fauci's lockdowns were wrong, you should do instead, focus protection plans to target the vulnerable like senior citizens but these doctors were smeared on the internet, smeared on social media as quote, fringe

epidemiologists peddling nonsense. you see trickle down from emails that ended up in censorship in social media. >> it is incredible to see things like those emails. if you look what you couldn't talk about on social media last year, you couldn't talk about the origins of coronavirus. you can't talk about vaccines. you can't talk about school closures. all these things make you a conspiracy theorist or get you banned outright. now we see that these policy decisions from social media tracked with you know, what government officials were talking about at that time, of conversations they need to shut down. so it is very, very disturbing what collaborations we still don't know about. elizabeth: other thing, jon, news coming in, dr. fauci testified in that lawsuit about emails suggesting his own officials tried to contact google to set up a conversation about misinformation about the pandemic. your final word? >> look, the twitter files is only the beginning. we don't have a google files. we don't have a face spies book
