tentative agreement to finish the omnibus spending bill by midday or early afternoon, the senate has agreed to vote on 14 amendments, most dealing with border issues before going to final passage. the results are in on elon musk's twitter paul about the $1.7 trillion spending bill. we should mention this is not a scientific poll but it is an important poll. >> he asked should congress approve this omnibus, 70 one% said no. then he added railroading through this giant spending bill but almost no one has read is unlikely to be in the best interests of the people. that was a quote, here's another, senator schumer, leader mcconnell, the public has spoken. they are overwhelmingly against this giant spending bill. here elon musk is dipping into politics saying what a lot of people feel, they are ramming

of his life about president biden and apparently he told friends his vice president is a work in progress. she fit the bill, she was the right gender, the right race. it also says the frustration in the biden harris relationship runs deep and this is my favorite, apparently her husband is complaining of the assignments his wife is given, hard jobs like the border. that bothers me is a woman. it should bother her. apparently the president thinks hi and off of her and he was a former vice president to think she can handle the stuff that they are complaining it is too hard. i would say president biden might expect more of her because he was vice president. lauren: that is true. some people question whether he did that well. let's get back to the markets. mark, we should mention know one strategy fits all sides. everybody is different, everybody should have their own

strategy, that's an important place to start, you are always focusing on that, everybody deserves separate strategy but having said that as you look into what might happen in 2023 are there some things that everybody should abide by? >> i say that because it depends on the person's agent financial circumstances and so forth but the nasdaq is down 30 one% so far for the or, bonds have not been well, horrible year in both markets and especially for seniors and retirees i invented a strategy, providing double digit yields, more than 10% and they pay every month and i use exchange traded funds and people get money every month to live on a reinvest. especially for a retiree or

senior, that's a very good strategy because it means they have money every month. dave: what about those who just say i don't care about making double digit income in my retirement, that is why it is good enough when i look at these 4.5% rates on a 2-year or even a 3-month bond these days because of the coming recession but what about parking my money there? >> the cheapest thing in the bond world, no risk of agency bonds that are 1 to 5 years out and that is another decent place to put money, you are betting about 5% if you know what you are doing on those bonds versus getting 12, 13, 14%, there's also a case to be made, you should have some of both. dave: i want to sit down with you for about 3 hours to figure out what i'm going to do with the next phase of my life.

amc is announcing $110 million equity capital raise by selling preferred shares, those shares are rallying 70%. dave: there's one name that pops out. mark grant is one but another is kathy woods, she's talking about her strategy but other people don't like it so much. lauren: billionaires like dan loeb, kathy wood wrote a letter, commentary, and articulated what her strategy is which is finding companies that are able to catch the wave of innovation and she prefers them, think tesla, over mature companies who spend money rewarding shareholders with dividends and buybacks. this is what dan loeb says to that. anyone teaching a value investing class or one on investment psychology should use this memo kathy wrote as a treatise to study the mindset of -- that is slang for investors who hold onto stocks for too long but he put it in a tweet which is funny.

for things like $65 million for restoration of the pacific salmon population, $3 million for each friendly highways, 7. $5 million to understand, quote, the domestic radicalization phenomena. 3.6 million for michelle obama trail, 477,000 for equity training for teachers. >> we are going to justify having all this money in the discretionary side, all this equity, inclusion, esg that is in their. equity appears 14 times in this bill. the democrat priority seem to make it in. 98% of all democrat earmarks, over 3000 of them in this final package. why are we paying for these pet projects when we have real problems in our country. >> reporter: government funding runs out tomorrow night, the house has to approve the spending package after the senate votes on it to officially avoid a shutdown. dave: when i hear senator

i have to talk about the culpability of the media in all this because the media claims they care about civil liberties and so forth but everything in the twitter files is exactly the same stuff going on in watergate in which they went ballistic about, you have the fbi, the cia sending out misinformation to the media, the politicalization of these institutions is what watergate is about, why aren't they reacting the same now as they did then? >> very simple, the new york post came out with that story, anyone who was interested could look to the new york post and said let's see what you've got and they would have seen it and run it as well. the new york times took two years before they said everything is true. if they were serious about journalism, serious about getting to the truth every media outlet would look at this, study after study, and how they are refusing to cover twitter. you are the only ones covering

close eye but meanwhile you are looking at other specific movers, let's start with paychecks. lauren: apparel services company reported earnings, raise their guidance for the year so why the stock down 4.6%? and analyst says this. there was a decline in their results for their professional employer organization and their insurance services, that is a crippled driver of their long-term growth. he also doesn't know why but what else, it was a good report card? dave: insurance is having difficulty. targeting some problems. lauren: they recalled several blankets, two fatalities, a 4-year-old girl and a 6-year-old girl, they were under the blanket, it was too heavy for them and they died due to us fixing her. if you have one, return it. dave: western digital.

lauren: the micron sector, those ratings are under review for potential death rate. dave: title 42 remaining in legal limbo, businesses along the border are preparing for the worst. grade from. at an auto repair shop. what are they telling you? >> reporter: they expect an influx of migrants in this area just like officials all along the border are warning about. to give you a sense of where we are, this highway is one of the main smuggling ports in this county. we are riding along with law enforcement and we've seen drug and human smuggling in the days we've been here. the owner at this repair shop, you've been here for a long time, you've seen it a lot in that time especially lately, you had people breaking the glass behind you, sometimes you find migrants, sleeping customers vehicles you are supposed to be repairing but your biggest concern is the safety of your family. >> that is correct.

despite still paying the contractors, they intentionally went to court to fight title 42, to end it, to end title 42 and end remain in mexico and they refused to go to the border to actually talk to the cvp agents who are desperately asking for assistance because they cannot overrun the drug cartels. the president still refuses to do it, you see apathy among the agents, 14 suicides this year alone plus others killed in the line of duty, hundreds of migrants have been killed in this process and 100,000 americans and so what is frustrating in the senate, what is holding up the omnibus bill which is hopeful and i hope it dies in the senate is actually a fight over title 42 because democrats don't want to include that in the on of us bill. they don't even want to keep things as they are, they want to make it worse instead of making it at least better. dave: there may be amendments, they are so much pushback by you and the public in general

they may be making amendments right now as we speak which we will see later in the afternoon but another thing about the spending bill, while it has these vanity projects for senators shelby and lady, it doesn't include funding for the world trade center healthcare program that helps 9/11 survivors and their families. senator schumer is pushing this, you asked to new york senator schumer to be interested in 9/11 spending. >> it is disheartening. there's a group of representatives, sponsors of this legislation have been pushing for it all year. it would fix the shortfall in the funding for the 9/11 healthcare program. you have diane 9/11 responders to this day and it is a slap in the face of our heroes that it is not included in this omnibus

bill that spends billions and billions and billions of dollars in all sorts of unnecessary spending and sending overseas. the bill alone, $1 billion to in carson h legal immigrants in the united states instead of deporting them and providing ngos with funding to facilitate this trafficking. that is in the bill but you don't have money for our 9/11 heroes, is a disgrace, this bill should be killed and instead not shut the government down, no one is asking for a shutdown to what we are asking for is to continue current funding levels until the new house can do its job and do it at a pace that is responsible on behalf of the taxpayers. dave: it's not a simple choice between shutting down the government or passing the bill, there's a third option and they are not taking the third option which is a disgrace. good to see you, thank you for being here, appreciate it, hundreds of chain stores in new york city have closed since 2019, how many and what is behind those closings?

lauren: 781 fewer chain stores now than before the pandemic of the decline of 9. 8% lead by metro, t-mobile, they closed one hundred 53 stores, duane reade is on there, they closed 90. even starbucks and dunkin' donuts closing up shop in the last 2 years, the reason is simple, people are working from home there's no office were not as much office occupancy and we are shopping online but it is going to probably get worse because you have crime, so many stores boarding everything up on the outside so they don't come in and smash the windows and then they are stealing stuff when they get inside so more and more big stores saying we are going to close. dave: andy curran lies shoplifting which is extraordinary. new york city is going to officially begin weed sales in time for the new year. where's the money going? lauren: for selling legal recreational pot, it will go to charity, not any charity but

specific nonprofits that lend support to communities that have been impacted by the war on drugs so the starts december 29th. new york state will sell legal recreational marijuana on that day, we made it by the deadline of the end of the year, this has been years in the making, it is racial justice system, to ensure that those most impacted by cannabis, location get the first retail licenses. it took so long to figure out how to make this work that would happen? you have an illegal market that is popped up estimated to be to billion dollar illegal market so they have to figure out what to do about that, how to make sure the legal shops have assigned it say they are legit and the product is stamped -- dave: it's a contradiction in terms because it is kind of like selling the scratch off lottery tickets and using that money for addiction to gambling. the same sort of thing that is going on. one thing completely upturns the purpose of the other.

's visit to the white house coming as congress is set to vote on a spending bill which includes 45 billion extra dollars in addition to the aid we spent so far in ukraine. aishah hasnie is at the capital. was the reaction? >> reporter: it is important to note that for a while, democrats and republicans, vast majority of lawmakers on the hill do support sending more aid to ukraine, although we are seeing a growing number of voices on the hill calling for mode oversight into the dollars we are sending and here's why. one year into this war the us is by far the biggest contributor to ukraine, directing more than $60 billion so far with another $40 billion expected to pass any day in this omnibus package. are public and senator josh hawley said lack of oversight

what are your material it --. and a need for transparency is ongoing, all that make sense. what doesn't make sense is to assume pulling support for ukraine will make america more secure. that is folly. >> reporter: bottom line, keep an eye on how the gop continues to respond as we expect more asks for more aid in the next year. dave: good stuff, thank you very much. another republican could soon challenge house minority leader kevin mccarthy's bid to become speaker but who is it? lauren: steve scully's but he's not saying that. a group of lawmakers have approached scalise to be speaker of the house, we like you, politico is reporting he is being quietly recruited should kevin mccarthy's bid fail. scalise has said on the record over and over he supports kevin mccarthy but if you look at mccarthy's past victory, very narrow. he need needs support from 218
