operational meltdown. the news comes own the heels of a video apology by the airline chief commercial officer, the second apology from the company. >> you know by now all the flexibility and planning we put in place to deal with the storm just wasn't enough so we extended flexibility for self-service travel changes through january 2nd. >> reporter: as the airline looks to get back to the skies, the chorus of voices from this travel nightmare is getting louder. 38 attorneys general wrote to congressional leaders warning of lax oversight from regulators at the department of transportation led by secretary pete buttigieg. they said buttigieg's agency failed to respond to provide appropriate recourse to thousands of consumer complaints about airline customer service. and they added americans are just justify fly frustrated

>> sky solver is a system souths with uses to assign flights to pilots and flight attendants in times of disruption. it had a really hard time handling the big storm last week. that is part of what they said is, in fact the root of the problems they have had. james: it's not a total surprise. you were writing about how this has been an issue for a while, that this what used to be a small company has grown into a really huge company but somehow along the way they didn't seem to get the tech upgrade you might have expected? >> yeah. that has been something southwest has been addressing for the last several years. they said this was a system that was nearing the end of its useful life and they were making some changes to it. they had made changes in crew scheduling the last year but the overhaul doesn't seem to have come quickly enough. james: i guess for a lot of people watching this it's sort of mind-boggling. you think about big companies they spend a lot of money on lots of things.

maybe some of it not so important, public relations and what not but this seems so core to what they do, making sure pilots and planes are in the same city at the same time when they need to fly. i mean is there sort of a management lesson here? it just seems sort of mind-boggling that something so central to their business would have gone neglected so long? >> what southwest has said this system had been working well enough. it had been able to help them navigate previous disruptions, snowstorms, hurricanes, sort of more run of of the mill problems but that this particular symptom just had such a massive impact on its entire operation and was really unique for them. that said, their pilots and flight attendants have been critical of the airline's technology for a long time leading up to this, have faulted it for not investing enough. james: were regulators, institutional investors, raising

hypocritical isn't it kind of late for containment strategy of covid-19 because it has the name because it started in 2019? >> funny how they keep going back to the trump era policies that were working like at the border among other things. so, look, china specifically the chinese communist party has been lying to the world for three years about the origins of covid. we know this has been going on but the biden administration says we don't want these people here. we have 48 hour i believe test requirement which is required in china. we've fon from the zero covid policy which is very extreme. we saw a violent crackdown on people and protesters against the zero covid policy. i was actually in taiwan during zero covid in september. it was even harsh there because obviously the shadow of the chinese communist party in taiwan as well but what's happened now, a lot of these protesters now said, look we're

fighting back not just against the covid lockdowns but for our freedom, for democracy, things we sand for and i think a lot of people saw this happening in the united states with our lockdowns that didn't work. huge high infection rate, zero covid in china didn't work. they didn't develop any natural immunities, herd immunity we talked about dismissed and banned on social media sites like twitter because of the misinformation out there. so i don't know, i think it is interesting, the biden administration all of sudden now going to this hey, we've got to be careful who we let into this country but i do agree with you, is it too late? maybe now we should still be hooking who is coming into this country because we're not doing anything at the southern border. we have people coming across with covid, with whooping cough, with mumps, measles, eradicated diseases and we're doing nothing about it. that was what title 42 was originally intended for a public

health statute. here we are, hypocritical to the biden administration enforcing policies coming in to new york city but not any of the 160 countries people derived from coming across the southern border. we have no restrictions and border policies there. who knows what the diseases are coming across the border. james: fair point. i wanted to ask you on the southwest airlines issue, it seems very straightforward it was not enough investment in technology. they want to upgrade. that is going to be i'm sure a big management effort. do you have any reason to think that, that oversight from you and your colleagues or pete buttigieg, the transportation department will speed up the upgrade that southwest needs? i understand there is need and desire in washington to do oversight. obviously this will chew up a lot of executive time, hearings, meeting with policy makers.

what do you think happens here over the next month or two with southwest? >> well i hope this has a couple of components to it. number one, what, the mistakes made by management at southwest were terrible. this conditions were terrible. they need to relook at that we certainly need to investigate. we need to look at pete buttigieg, his department and their failure to provide oversight and provide the reasonable regulations they need but i think we need to look at a third thing. what are we doing to the airline industry in terms of energy policy, making it so difficult for them to compete in the world right now especially in the united states against other airlines who don't have the same types of restrictions? i don't mean stepping around safety or bypassing safety issues. i'm talking about issues where they can actually be more safe and not be so restrictive coming to epa regulations, when it comes to regulations dealing with energy that don't make sense in terms of science? i think we need to look at that aspect of it as well because it

will affect the entire industry and their ability to be effective, productive and safe. james: to that point i don't know whether they were pressured by washington or big institutions or whether they just wanted to but it is an irony here, southwest has spent a lot of time talking about and focusing on the technology of lowering carbon emissions, which is kind of bitterly ironic if you're a customer you realize their technology couldn't get you from a to b. >> right there is so much pressure on all companies, particularly look at the airline industries they're operating with fossil fuels which have been villainized by the far left, by these climate change activists, those becoming so woke caught up in the environmental craziness there is no common sense. you will be in the flying in lech trin plane right now n my district in near erie county we are so grateful we have fossil

aclu lawyer on title 42 and then get your reaction. let's listen. >> you can't misuse a public health -- it was not intended to regulate the border. i also think people are overstating what is happening at the border. if you closed the border for so long of course there will be a temporary influx of people but ultimately it will even out. the federal government has more than enough resources to deal with this. >> general, this seems to be put to good purpose but as a general rule, i don't like politicians using covid as an excuse to do whatever it is they want to do. don't we have other laws? weren't there plenty of laws on the books before covid came along so we don't need to claim a public health excuse to secure the border? >> yeah. you're right about that. there are plenty of laws on the books. all of them are being ignored, not enforced by the biden administration.

>> you would think. we have been saying this a very long time especially at the heritage foundation, we were reporting all these piecemeal data points of the government leaning on big tech companies shouldn't be allowed to continue to happen. yet we have the smoking gun. we have the confirmation now, and you have legacy media saying, oh this is a nothing burger when before they were clamoring for that actual evidence. they were saying they're private companies, they can do whatever they want, we have no evidence that the government was coercing or even pressuring them. now we have it and now they're curiously silent. this basically says all it needs to say about their motivations. they care about the first amendment when it protections private companies and they're saying now, there is a new strain of argument first amendment really protects big government. what about we the people, users? that is my question. james: wow, that is frightening. important to point out

james: crime running rampant in cities across the country. as we close the year small businesses are now paying the price, some forced to shut down. in san francisco this week a bakery was targeted for the sixth time. the owner saying on facebook, they took everything from our castro cafe last night. it happens over and over and nothing changes. here to tell us about it, joe gamaldi. joe, we look at cities like san francisco and you sometimes hear about big chains that are removing their stores. they can't secure them anymore. it costs too much. we don't hear as much often about the small businesses who are even less able to provide security to afford to secure their businesses but it's a

disaster for them. >> yeah, absolutely. i mean what has been allowed to happen to our urban communities and small businesses that operate there is nothing short of a catastrophe. the elected officials there that support these woke revolving door criminal justice policies which are complete nonsense completely abdicated responsibility to provide safety. that is why you're seeing a recent survey of small business owners said 47% will likely shutter their doors within the next year. it is even higher in the retail space because organized retail thefts are crushing them. retail theft will top $100 billion this year. the most disturbing part of all of this it is completely avoidable. politicians, d.a.s, here is an idea, grow a spine, do your job. we as police officers we're catching folks, putting them in jail. they let them right back out. what do you think they will do? they will do it again. james: san francisco they did replace the d.a. we've seen in a bunch of these woke west coast

cities where politicians have learned not to say defund the police anymore. are you seeing any encouraging policy turns where beyond the rhetoric, having seen this disaster, police are feeling like they can do their jobs again? >> i think you're seeing a lot more awareness from the public, putting a lot more pressure on politicians to change some of these policies. we've seen challenges in cook county in chicago against bail reform we hadn't seen before. we're seeing similar challenges in other communities. people are certainly stepping up, it is important to point out how pad it is in these communities. when these small businesses shutter is creates a vast wasteland, financial deserts, food deserts, people can't go to the corner stores. people that have means move out of the neighborhood, all that is left is underprivileged. what they have done to the you are urban communities is truly unforgivable. james: there is not much advice,

james: the gop is gearing up to take control of the house next week and members of the house judiciary committee are already launching an investigation into major climate groups to find out are they violating federal antitrust laws? hillary vaughn on capitol hill with the latest. hillary? >> reporter: good evening, james. republicans say they will investigate so-called woke investing gse standards. the idea investment groups will look into climate and social impacts of an investment before putting money into an entity. lawmakers think doing that could be a violation of antitrust law. six republicans writing a letter to climate investment groups questioning them over esg policies saying this, esg at its

heart radical partisan activism masquerading as responsible corporate corporate governance. these corrosive practices may violate antitrust laws and we must be relentless investigating them. the idea was to protect investors in volatility and risk investments into the energy market but in 2022 the 10 largest gse funds posted double-digit losses, blackrock's 20 billion-dollar fund and vanguard five billion dollar fund. all underperforming lagging behind the s&p 500. republicans in the senate say esg investment hindered investment in oil and gas which causes higher prices for everyone else. >> the whole esg restrictions financing, dries up cost of financing, combine that with moratorium on producing energy on federal lands onshore and off, lack of permitting, the administration is holding up

permitting, litigation, in the only reducing supply but drive up the cost of energy. >> reporter: esg crackdown is unlikely to pass congress with democrats still controlling the senate, but does not stop the states acting with their dollars. seven states are pulling funds from blackrock over concerns they value esg over investors. james? james: thank you, hillary vaughn. joining us with reaction is congressman darrell issa from the house judiciary committee. congressman, thanks for joining us. before we get to this esg stuff, i do have to ask you the president apparently not a surprise but signed that disasterous omnibus. any thoughts as we embark on this new taxpayer spending disaster? >> well i think he should be proud of the fact that there are many billions of good, well-spent dollars out of 1.7 trillion. if you look at the downside, the downside is there are hundreds of billions of dollars of

unnecessary spending there that is in fact going to have us be in a recession and still have inflation when that shouldn't be the case. government is in fact the reason we have inflation. recession is what is being used to cure a disease caused by excess spending. you know president biden is celebrating hundreds of billions of dollars of excess that wasn't necessary and shouldn't have been in this bill. james: okay, sad news. now more sad news. sorry to be a downer on this, this esg stuff, i'm so glad hillary stuff pointed out esg funds were big losers this year, this year, not a good investment strategy. now if people want to take their money and express their values in their invests that is up to them but it looks like we have a problem with governments, state governments in many cases, we might talk about your state, and

wall street institutions pushing for political changes whether it is on climate or other issues, that the average investor may not realize that they're even funding this stuff and they don't want to? >> well you know, my state employees who rely on the revenue from the state pension which is one of the largest in the world, they assume that those fiduciaries are trying to get the greatest return for them. they're not assuming they're trying to move a political agenda. in many cases as you said earlier, as the lead-up said, we are driving up the cost of fuel and particularly the cost of fuel when it comes to the small and medium business, the people, the wildcatters who go out and get that oil, find the natural gas. big companies can usually figure out a way to get their revenue. exxon will probably take it out of cash flow but that is not true of many of the startups who will find, better more efficient

ways to get fossil fuel, quite frankly in more environmentally sensitive. those companies are finding it impossible to get any kind of financing which drives up the price of fuel and it's unfair to the pensioneer who expect his or her pension to get the most revenue it can, which means invest safely but invest wisely. >> talk about the pensioners in your state. calpers, big employee pension fund was very early on this trendy esg, environmental social governance stuff. they have not done well, partly as a result. is that going to change, or do state employees out there generally, do you think they will to rate worse returns to express their views? >> they have not had a problem yet for a simple reason. we have had a surplus coming out of covid. that allowed them to mask the

failure of calpers and calsters to raise kind of revenue they're forecasting. fairly soon they will be looking at needing a tax increase, needing to go to the taxpayers for revenue that they should have made out of a return on investment. they didn't make it. they didn't make knit a good economy. can you imagine in a bad economy what is likely to happen? james: like california needs higher taxes, like people need another reason to leave to go to texas, florida, wherever. i don't know how many of your constituents are fleeing at this moment, congressman -- >> james we have lost more people from california in the last three years than exist in alaska. pretty soon than what exists in montana. we're losing a whole state every year. james: montana looks pretty good if you're in california. >> many of them went to montana. james: thank you, congressman, appreciate it. >> thank you. james: up next further questions

before he was going to appear. do you feel like a great opportunity was lost, that you didn't get him on the record in a public hearing? >> i do. we had a good tell from john wray outlining a road map for us to look at but sam bankman-fried agreed to testify and didn't show up. the southern district of new york prismed that with their indictment -- preempted that with their entit dime, i would have thought they would want him to testify before congress under ocean to getter qualify their own line of changes, we hope we can have sam bankman-fried testify. and others in the case to get to the bottom of what happened at ftx, how it should inform us in oversight of the sec, and emerging issues okay round digital currency.
