california, newark and places like florida and texas. when you look at the overall report card here when you look at the border and education where our kids are falling further behind the china's and estonia's of the world you cannot give this president a good report card when it comes to looking at 2022 in accurate number how many bills have been passed. james: i've got a speaker for his doña. i'm with joe and probably a lot of your constituents that the measure of success for you and your colleagues should not be the number of bills you passed in the number of burdens you put on the american people. i want to ask you specifically about the economic burden and how washington is added to it this year, i've been cleaning to this hope that the tactics were not as big as they might've been during the biden first two years in other words 2017 try tax reform is largely still intact in terms of a competitive tax

more than six weeks ago. fox news laura ingle is live in pennsylvania where the arrest took place. what can you tell us. >> good evening this is where the suspect bryan kohberger has been brought. he is here in pennsylvania. this happened after his arrest very early in the middle of the night this morning he is in a jail that holds approximately 400 prisoners both maximum and minimum security inmates here 28-year-old bryan kohberger will spend his first night at the monroe county correctional facility tonight. he was taken into custody at 3:00 a.m. southeast of scranton, pennsylvania at a private residence known as a fugitive from justice warrant. investigators in idaho revealing little about the details of how they zoned in on bryan kohberger but they said they had enough to make arrest. >> a criminal complaint was filed yesterday in latah county charging the defendant bryan

kohberger with four counts of first-degree murder in addition to felony burglary which involves entering the residence with the intent to commit the crime of murder. >> affidavit with some details of the charges is sealed until the suspect is physically back in idaho. he is expected to be extradited after hearing this tuesday. law enforcement can confirm they recovered a white alondra and monroe county. a white alondra was the subject after the spot of the scene of the crime in idaho in the early morning hours of november 13 the four university of idaho students were murder. and today investigators were 15 minutes away from the crime scene they were raiding the suspect's home in pullman washington where he was a graduate student pursuing a phd in criminal justice at washington state. as we take a look more at some

of the documents that have been released. we know he's 28 years old he recently had a birthday and when i was looking at the date of birth it was one week after these murders so we have a lot of questions still here tonight, did he come here to celebrate his birthday, was he still in washington state was he here for the holidays, those questions are not answered but we will wait for more back to you. james: thank you laura ingle that's welcome to the show retired nypd inspector paul morrow thank you for joining us, obviously the suspect deserves the presumption of innocence like anybody else but based on what you've seen what we've learned how solid does the case against him look? >> obviously the police here have held their c cards close to the chest it was a remarkably leakfree investigation especially task force that large but there is a subtlety here the prosecutor's office filed an

affidavit that had to go in front of a judge to get probable cause so the executed the warrant in pennsylvania it sounds bureaucratic but what this means the judge bless the arrest, this is not like a summary arrest that occurs with the uniform cop that argues that they are put together in their mind what they think is a solid case they had the probable cause level, the judge agreed with that and they feel sure that this guy is involved whether if he is the only person remains to be seen. james: you been out there, you were in idaho as you survey the landscape and you look at what we do know. obviously from the police on the evidence but given the circumstances what we've learned about him as a criminal justice student what does it say to you looking at that set of facts. >> a couple of things jump out looks like the white elantra may have been a break in the case, something they have been focused on and they recovered it. another thing here the reason that that might be important it didn't get a lot of attention but behind the house there was a small parking lot and it's very

advantageous spot or a guy like this because you can look down into the second-floor and you can see a lot of the second-floor from the parking lot gives you a good advantage point we have to remind herself no matter how heinous the crime is he still innocent until proven guilty but that said the elantra being in and around the parking lot could be something that the police looked at very hard. the other thing pullman is right there i know we were focused on the university of idaho but just the way it worked out, i was out there a few times the town had gotten crowded the town of moscow the way it worked out i ended up staying in pullman. one of the things that struck me there's another school that is significantly larger than the university of idaho and i asked around when i was out there there's a lot of cross-pollination between the two schools and it turns out he was a student at the other school what his connection to the university of ido and this

house is the primary question now. >> i know a lot of parents are horrified watching the story matches. if university in idaho students but nationwide i don't know if you have any advice their kids heading back for the second semester at this point i know were still trying to figure out what exactly happened. >> you have a very salient point we walked the area out there myself and lawrence jones who is way out from in this case and we noted there are no ring cameras anywhere in the area there were other homes there, nonstudent but mostly student housing and there are no external cameras on any of the homes. it's one of those things if it were my child going away this point, we've had a lot of crimes across the country related to this in and around campuses, something that's developing is the urban areas in the country have more violent crime. i would be thinking in terms of sticking together making sure

>> step one is to get the operation back on track the best way to serve our customers is to get the network going again debbie a lot of lessons learned that come out of this. the futa passengers home and reunite travelers with missing bags is ongoing, the department of transportation requires passengers be compensated for lost luggage engine about at $23800 the department is promising they will be fine if the airline fails to reimburse travelers for meals hotels and ground transportation or fails to offer refunds for canceled flights transportation secretary pete buttigieg wrote the letter no amount of financial compensation can fully make up for passengers who miss moments with their families that they can never get back and continuing he says, that is why it's so critical for southwest to begin reimbursing passengers for the cost that can be measured in dollars and cents.

lawmakers including progressive ro khanna are calling out buttigieg for not doing more, tweeting six months ago bernie sanders and i called for pete buttigieg to implement fines and penalties for canceling flights, why were these recommendations not followed. this mess with southwest could've been avoided. executives have promised to improve the airlines operation but that likely will take years. in the short term the fourth-quarter results are expected to take a hit. executives wouldn't venture on how much but the last time southwest dealt with massive cancellations similar to this was october 2021, they canceled 1800 flights in one weekend that cost the airline about $75 million. this time we surpassed 15000 flights eight times that amount. james, back to.

been a general posture at the border they don't need a solution because everything is going as planned. i want to play clips from biden officials talking about the border and ask you to respond. >> we have a secure border. >> the border is secure. >> with taken unprecedented action over the past year end a half to secure our borders. >> the board remains closed it is not open we are turning away the majority of adults. >> we have a process in place to manage migrants of the border. >> the president and everybody who works for him has been saying we got this there is not a crisis, we will process and yet he's backstage screaming for a solution not that there have been plenty of people suggesting solutions, what do you make of this bizarre story.

>> is very concerning, if he believes there is a problem down there we can all see with their own eyes despite the clips with the leadership ignoring how bad it is down there if you have a president expressing frustration of what's happened or how to fix or sensibly down there make this go away and some version he's upset but nothing gets done that is a concern to all of us he's a commander-in-chief if he wants to fix the problem is not that hard to do, he inherited 40 year lows of activity on the southwest border when he took over the border was more secure than i had been in decades within one day a being with the president he ripped down all of the tools that were being used by the frontline to help secure the border in 2020 and he inherited 40 year lows and hours in the worst surge on the southwest border that we've ever seen they are on pace to do well what they did last year which is

record 2.3 million in the year before 1.7 it would never seen the activity across the board illegally in years and we're going to do more this year and if they really want to fix this all they have to do is go back to what they inherited but they refused to do it, fees not in charge, who is. >> this question keeps coming up but it is so strange were a lot of people have theories why does he think it's good politics to keep the chaos going. does this make you more optimistic with less optimistic is it a staff issue are they not telling him that there's many people in congress or elsewhere in the country saying here's the proposal here's a way to end the chaos, do you think is not getting informed by his staff is that with the story tells us? >> the idea is scary if he is not being told the truth as a president and then he doesn't have the faculties to find out on his own was going on at the border he put the vice president in charge of something, root causes or something like that.

>> the root causes i guess the ideas, you fix the rest of the world so nobody would feel the need to come to the united states or the desire that's a long-term project to say the least and possibly will never happen. how likely other countries will become more awesome than the united states, pretty unlikely. >> agreed. if they really thought there was a problem down there why isn't she engaging with countries like venezuela and cuba we just did a deal with exxon but then produce oil and venezuela did we get a repatriation agreement with it, that's what we should've done. right now the border record activity and two thirds of everybody at the border are being released into the united states that is a recipe for more of the same and that's we're going to go. james: thank you ron will have to leave it there.

recently. james: i think about three years ago we followed italy and other countries in implementing the economy destroying lockdowns and we talked about the negative consequences that flowed from that, closing schools, kids loss of learning isolating people, mental health issues and other issues that were ignored, i hope were not heading down that path again as you talk to people in the medical community is there a sense that there would be more pushback now on public health experts that we have to reimpose all of the covid rules? >> i don't think we should consider any of these mandates, the lockdowns, the shutdowns, the school closures with a severe detrimental impact on everyone not just the children
