of dollars. let's get right to the action what happened on the floor of the house. we welcome to the show, congresswoman kat cammack from homeland security and "new york post," jon levine. tomorrow you will be nominating congressman mccarthy for speaker when the house meets at noon tomorrow for the fourth round of votes. where do you come down on what is going on? >> listen, i have been very clear in my position. we need to be unified because unity is our greatest weapon against the biden regime and his radical leftist agenda. the only thing that division does invite weakness. as you see tonight we left the house floor with it still under control of democratically appointed clerk. that to me is not reassurance american people need at a time where there is so much uncertainty. if they don't know who the speaker is, if they cannot count on people they elect to give

their voice to in washington what can they count on? this is very frustrating but i do remain optimistic. i think tomorrow we will come together as a party, as one movement, to elect kevin mccarthy the speaker because i think that if at the end of the day we don't, we are going to again empower democrats. that is exactly opposite -- elizabeth: jon, is freedom caucus, any member of the freedom caucus agreeing with what you're saying, congresswoman? will any of them vote for kevin mccarthy? what we see last 24 hours continual moving of the goalpost. there is more concession into the asks of some conservatives into the house. i will say myself, i'm really excited about the changes in this upcoming rules package, really empowering members, opening it up so people get their initiatives heard on the house floor. we have to be clear, if kevin mccarthy is not elected speaker that rules package goes away. people have to put egos aside, i will do what is best for the

country, what is best for my constituents and put the politics and personal agendas aside. elizabeth: to what the congresswoman is saying, jon, all day long, the media saying this is gop chaos and so forth but is this fight biden did not want the world to see all day long on television? the freedom caucus, say we have historic crime, recession, border collapse, happening under biden and democrat leadership. president biden undercutting u.s. energy. that is what voters say would see what was watching on television going on, jon. what do you think about that. >> my hunch is that the white house is probably looking at what is happening on the house floor today and they're feeling pretty smug. it was certainly not a good day for republicans lawmakers who won the majority. they appear very, very divided. i must contradict the congresswoman from what i'm hearing sources on the hill, freedom caucus types are very, very dug in. there is very little appetite

for them to compromise. they feel emboldened by the actions today. there is increasing doubt that kevin mccarthy will end up as speaker. there is talk of other candidates who could be put forward. elizabeth: congresswoman, what is your reaction to what jon said? >> there is group of 150 plus members that will only support kevin mccarthy. it is not just the 20 that we have voted for an alternative candidate. they have to get over that 150 that said they won't support anyone but kevin. i pull it back to this. this is not about kevin, this is not about the freedom caucus. this is about the american people. our job is to represent their will. they don't go to bed at night worried about speaker of the house. they to to bed worried about can they pay their rent. they worry about can they put food on the table. they worry about the border is secure. as we sit here we have 300 people die because after open yesterday epidemic, as a result of the border crisis.

until there is a speaker. the longer this is drawn out the longer we have to wait for things to get done. those house investigations will take time. letters have to go out, subpoenas have to get sent, all of that takes time. none of that happens while republicans continue to fight over who is leading their conference. elizabeth: watch this. congressman matt gaetz, there was a push, congresswoman to get jim jordan to the speaker. jordan is not beholdened to lobbyists and special interests that corrupted d.c. watch the fireworks with jim jordan. >> three fundamental things we have to get done in the 118th congress. first pass the bills that fix the problems. in two years time we have, we have a border that is no longer a border, we have a military that can't meet its recruitment goals, bad energy policy, bad education policy, record spending, record inflation, record debt and a government that has been weaponized against we the people. we can never ever let a bill

like the one that passed 12 days ago, $1.7 trillion spent, we can never ever let that kind of legislation pass again. the differences we may have, the differences between joyce and jordan or biggs and bacon, they pale in comparison to the differences between the us and left which now unfortunately controls the other party. elizabeth: congressman, how come jim jordan is not gop house speaker? >> it is pretty easy. he doesn't want to be. jim jordan spent the afternoon encouraging his colleagues to support kevin. jim jordan wants to be chairman of the judiciary committee where he can have a actual role in holding this administration accountable, investigating and really delivering the results that his constituents and quite frankly all americans want. i agree with jim jordan that the issues that we are facing within the republican conference today, they pale in comparison to what we're facing outside. we need to deliver the certainty to the american people. we have to be beyond the moment. we have to meet the moment.

♪. elizabeth: welcome back. okay, this story, is the biden justice department covering up and blocking the release of hundreds of pages of sensitive documents about payments and gifts to hunter biden and jim biden from china, russia and ukraine? doj lawyers allegedly acknowledged these records do exist. it is all coming out after foia lawsuit. fox news david spunt is in washington with more. david. >> reporter: this fight began with a public records request more than two years ago. a colorado lawyer based near denver says the justice department is deliberately

withholding information key to the hunter biden investigation. the doj is declining to comment to fox news. kevin evans filed a public records request with the doj after seeing then candidate joe biden in 2020 deny involvement in his son's hunter's business dealings overseas. evans wants documents related to communications involving hunter, china, russia and ukraine. he also asked for documents related to the president's brother, jim biden who reported to be involved in those business dealings as well. the attorney claims he heard in court a doj prosecutor admit the department has 400 documents relating to his inquiries. a few months later, do jkom completely denied that statement. now he is angry. listen. >> not for you to tell the court, hey these documents exist. then a month later say we'll not confirm or deny whether the documents exist. >> reporter: while jim biden is not under federal investigation as far as we know, hunter biden

allegedly covering up 400 pages of documents about gifts and payments the biden family got from china, russia, ukraine. this lawyer evans said he filed the foia request in 2020 right when biden won after reading about the biden's overseas dealings. they strung him along for two years before he eventually sued. what are you hearing about this? >> we think it is very credible. we heard from multiple different sources first of all the records exist. more importantly the biden family did receive numerous exists from our adversaries from around the world that raises ethics questions. that raises questions whether or not those gifts were reported on their taxes. remember, liz, part of what they got former president trump on not disclosing one little item of his taxes where he provided housing for his employee. that is 100-dollar fine with the irs. potentially what the biden family has done would be even worse. now look the biden family has been involved in the influence

peddling scheme over a decade and jim biden gets let out of the conversation quite often. he is just a big part of the biden family influence peddling as hunter biden is. elizabeth: how does jim biden construction company get contracts to build housing in iraq? this is allegations of corruption. this veers dangerously close to bribery. we have not heard that word, it is speculation right now that word used in terms of what the biden family was doing, congressman. >> right. and with respect to the jim biden he is in a federal bankruptcy lawsuit now with a former health care start-up company in nashville, tennessee, that claims they were approached by jim biden and they contracted with jim biden to help them receive funding for their business from the united arab emirates. a lot of what jim biden has been involved in pertains to the middle east. we have a lot of questions for jim biden. he is going to be hopefully answering some questions for us

as we continue our investigation of joe biden. elizabeth: congressman, also this story. that the white house has 60 days to possibly block the national archives from releasing potentially 300 emails from the obama white house, plus internal documents with information about hunter biden's work at the controversial ukrainian gas company berries ma. burisma. this is a separate foia lawsuit. what is your take on this. >> this is one that tom fitton has led. we're waiting results -- i'm sorry, stephen miller he had are, i apologize. there are a lot of requests out there that foia requests of different groups are trying to get. this is the stephen miller request and we're hopeful that is one that we get an answer from very soon. remember joe biden applauded the national archives when they turned over the documents relating to the presidential library and the january 6 and all that other stuff on

president trump. now there has been a credible request by the stephen miller group to get these documents pertaining to burisma and joe biden's involvement with that said did shady scheme in ukraine. will joe biden be consistent and release that data as well. this is something we're anxiously awaiting. we're very fortunate to see there are conservative outside groups doing simple foia groups to get information. we're hopeful this leads to more information for us to be able to conduct our investigation. elizabeth: congressman, you and i have been talking for the last two or three years about how the u.s. intelligence community can work with the media and basically turn the media's narrative around. that is what frank church was worried about in the '70s with the church committee. now this new judiciary panel with working name select subcommittee on weaponization of the federal government, that a new church committee. can you talk to us how that

from neighboring countries for terrorist acts. 323 cops shot in the line of duty last year, 60 of them shot dead. we don't have msnbc reporting on any of that, the "new york times" not bringing the story together, the media not bringing the story together, joe. can you do it for us? >> when you project weakness as a country these are the things that happen. we're certainly happy that these officers are expected to make a full recovery after nearly being hacked to death by a machete but now this case is in the hands of alvin bragg who has a terrible track record in manhattan of prosecuting criminals. i certainly hope federal charges are going to follow because we must project strength. we need to send a clear message to anyone else planning an attack like this, it will be met with swift and harsh penalties. otherwise it will continue to happen again. to your point 331 police officers shot last year. nearly 90 ambush attacks. we're attacked every day for the uniform we wear. that is not hi per bow lee.

illinois legislature calling this the safe-t act. maybe the criminals will be safe under the act. eliminating cash bail has been a disaster everywhere it has been tried even chicago. university of utah study, 50% of the people released offended on a violent crime when they were let out. these politicians are pushing up these policies when murder is up 48% in illinois over the last 10 years. how stupid do you have to be to go even softer on crime, in the midst of hittor rick crime wave this is complete joke. david: what they're saying in the illinois case, it is unconstitutional overreach. that the state legislature can't step into matters of the judicial system. it is up to the judicial system and state prosecutors. they're the ones suing hey, don't do this.

there is constitutional separation of powers case. joe, why, how come the voters don't get to weigh in on this at all? >> i think there is a reason why they don't have voters weighing in on bail reform and why they don't have them weighing in on sweetheart deals for criminals. this is why it is all done in the dark. why you never know how many deals the d.a. is cutting. it is why you don't hear about these charges being dismissed. if the public had any idea of just how bad it is they would vote this down enormous numbers. so of course they do it behind closed doors. they do it with lengthy legislative bills that are thousands of pages long to hide it from the american people but the american people are waking up. they're not stupid. they know that bail reform has been a disaster. they know crime is out of control. they know this country is going in the wrong direction right now. i hope our elected officials see it the same way. get off that are ass and do something about it. elizabeth: it is coming up in the speaker fight. joe gamaldi, thank you for
