♪ stuart: let me clear my throat. that is our producers trying to get a connection to the state of the union message, the president will be clearing his throat. that is a stretch and you know it. 10:00 eastern. check out your money. the dow is down a hundred, nasdaq down 20, not much movement. the 10 year treasury, not good news for the market, 3. 64%, 10 year treasury yield is going up. a week ago we were below 340. as for big tech, we got a clear winner, microsoft is up $4, a news event later today about gpt, google is up, apple is up, amazon is down 3%. 3%. that's the markets, now this.

there are a few things you will not be hearing much about in today's state of the un message, the balloon will get a mention, just enough to claim victory and everyone stands up and cheers, won't spend much time on it because presidents don't spent much time highlighting embarrassing failures, same with the board, can't imagine how to convince the country everything is under control. vice president harris will not only be there but whatever she's been up to in the last two years won't get much airtime. the new york times says kamala harris is trying to define her vice presidency, even her allies are tired of her, that's a hatchet job. education, nothing good there, school closures, chronically declining academic standards, randi weingarten, big friends with the president and first lady, he will have a hard time trying to be the education president tonight. remember the gallup poll from

president is out of the question. i want to talk about vice president harris. looks like the democrats are losing hope in her. the new york times, dozens of democrats say the vice president, quote, has not risen to the challenge of proving herself as a future leader of a party much less the country. hillary clinton doesn't think she has political instincts. do you think biden will keep her on the ticket when he is running into thousand 24? >> i don't think he is able to dump her off the ticket. what did she accomplish as attorney general of california? what did she accomplish as united states senator? you can't name anything, the reason she dropped out of the presidential race before they took the first voters in her own state of california, she was polling in eighth place in her own home state, the democratic side of the island president biden picked her, he said, based on her gender and

the fact that she was not a white person. so, you know, i don't know what she has actually accomplished. i struggle to come up with one thing. stuart: wouldn't that sink the biden harris ticket? if that is what they run on, harris and the vp spoke, that syncs the ticket, doesn't it? >> i don't know many people vote for a vice president. i don't think she is an asset. stuart: with an 80-year-old president you take a close look at the vice president. >> you want to make sure you have somebody of confidence usually the driver is the president themselves. i think people look at president biden and see cognitive decline, lack of vision. what comes out of the state of the union is ask your self does he have a plan to deal with inflation, a plan to get the economy moving? you will hear about tax increases, you hear about more government spending and things

expected to raise taxes and talk about quadrupling of the stock buyback tax, will that have any impact on the market at all? >> it won't because these companies have dealt with regimes like this, tax increases in the past, they figure out how to take business offshore, how to get around it and how to do their job which is maximizing returns for their shareholders. he's clearly not a pro-business president and that's not going to change. stuart: the economist at goldman sachs have cut the probability of a recession to just 25% in the next 12 months, strong jobs, improving business sentiments, signal the risk of falling, what do you say? 25% chance of recession next 12 months? >> it is tough. how do we define a recession? that's a moving target. the point is whether you define

it as a recession or not, a lot of people in this country are going to be impacted by layoffs we are seeing and higher interest rates. how much impact, i don't know, 25%, 35%, the point is i think the fed needs at some point to stop raising rates, let the free markets get back to work, and when they do, we have a strong undercurrent or underlying economy in this country. stuart: and stay in the stock market until we get there. we have more on the billionaires tax. what is biden going to do? lauren: the rich need to pay their fair share. how? as you mentioned, quadruple the tax, stock buyback, one%, number 2, slap a minimum tax on billionaires. we don't have detail here except the richest of the rich, the white house says pay an average 8% and that is not enough. it is expected this tax is a wealth tax meaning unrealized

capital gains would be taxed. bottom line, this goes nowhere. this is all symbolism because who controls the house of representatives? stuart: just to be nasty to be rich. speaker mccarthy and majority whip steve scully's go to war with the us chamber of commerce, first i've heard of this. lauren: it started a few months ago but now that speaker mccarthy is actually speaker he is committing to what he said he would do. they think the chamber is too woke and they are not going to meet with chamber officials. how are they too woke? it is the largest organization that represents businesses in american they are not meeting with them. that the chamber endorse too many democrats in 2020, embrace esg and support immigration overhaul that harms us workers and us businesses so the bottom line is they're going to war with the largest business

organization in the country because they say the chamber does not represent american pro-business values. stuart: that is a switch. you don't think of republicans is going to war with the chamber of commerce. >> in the sense you have it all one way, on the left side, for these guys to stand up and say we represent a group here also, we need things more down the middle. we need more of that, can't go -- lauren: they have to speak. >> the chamber of commerce will ultimately have to cave because they've gone too left for too long. at some point they realize their is a lot more in the senate for them. stuart: i've got to get to movers, start with british petroleum, they made an astronomical profit, didn't they? lauren: $28 billion last year. they are going to reinvest that capital into the transition, the white house loves that while also producing more oil.

they increase their dividends by 10% and there buyback stocks. stuart: oaks street health, primary care operator get involved with cvs. we to they are up 31%, the wall street journal is reporting cvs to buy oaks street for 10. $5 billion because cvs wants to expand into primary care. stuart: got it, next case, an education company that are so far down it is 20%, what's the problem. lauren: the problem is chad gpt, artificial intelligence, is hurting their subscriber growth. they also have a downgrade from keybank. stuart: gpt, gets you every time. gets you every time. disney's dominion over its magic kingdom coming to a end. governor santos has seized control of disney's self-governing district and wants the mouse house to pay up big time.

stuart: everybody is waiting for jay powell's speech at 12:40 eastern time. what he says could move the markets, investors not doing much on wall street in advance of that speech, that was down 140. lauren has some movers, the cruise lines are back. lauren: look at royal caribbean up 6%. it was up 9% moments ago, smaller than expected in the fourth quarter. they are losing less money. pent-up demand for leisure travel remains solid, occupancy rates 95%. stuart: mark murphy wouldn't be

caught dead giving money to a cruise line unless you were going to buy the cruise ship yourself? >> hard to predict what the ups and downs of demand will be in the cruise industry and how they will make money or lose less money, cruise ships and airlines are not something i ever figured out. i stay out. stuart: tyson foods reported yesterday. lauren: goldman sachs downgraded them to neutral. sharp deterioration and profitability, most notably in the chicken sector. we one nike and home depot are both down. lauren: both down 2% and that is weighing on the dow jones industrial average. i don't have reasons each are down but they are a big reason the dow is down. fishermen sounding the alarm t over wind turbines off the what are fishermen telling you?

>> reporter: they are telling me these offshore wind farms are threatening their bottom lines and it is only in the surveys to win develop and happens we will sit at the grocery store with prices and availability around the dinner table. we are at a commercial fishing. they fish for everything from crabs to scallops to squid and they are already having to change some of their roots because of the development and surveying of offshore wind farms. when the roots are longer it is dangerous during bad weather and more expensive because of the cost of fuel. i will show you a map of where these outlands for development exist. it happens to coincide with where scallops exist. this is a scallop boat, this captain has been on it for 40 years, he knows all of the spots, scallops are sensitive to sound because they reside on the bottom where there is no light. these survey boats used for wind turbines even it sound. the 40 a fisherman knows all the spots but because of the

offshore wind and concerned about the breakneck speed of this moving forward. the white house has ambitious goals for 2030, they feel it is too fast. stuart: thank you very much. on a related note, those wind turbines are killing bald eagles and literally thousands of other birds. the executive director of the american eagle foundation joins me now with challenger, the bald eagle. welcome to the program. i have a nasty question. how come the greenys don't kill about killing eagles? >> it is quite sad when you think about it though we support education and research into renewable sources of clean energy. we can't support the fact that wind turbines are killing thousands of birds a year particularly species like the bald eagle and the california condor. we one can nothing be done

about this? no way of changing the turbines to stop this from happening? >> to the point you made earlier we need additional research. the fabrication and installation of wind turbines, that's not green. the fact that we have to figure out how to recycle them once they come down, once their shelflife has expired, where does that go? what does that look like? it is very discouraging to think after we spent so much time in the 80s unifying the nation to bring the species back at that they could be at risk over wind turbine energy. stuart: any idea how many eagles have been killed by offshore wind farms generally? >> there is not an exact number. we do know that several power companies were fined over the

past few years, killing 500 bald eagles on their farms. that kind of number is staggering. stuart: do you think, i am trying to wrap this into a question. do you think environmentalists care more about saving the planet than killing eagles and other birds? >> that's a great question but saving the planet mean saving our wildlife. saving our ecosystem. birds of prey play a very significant role in that ecosystem particularly vultures. stuart: they do indeed. the american eagle foundation, thank you for joining us. appreciate it. >> thank you for having us and for challenger. stuart: thank you to challenger as well. texas is the latest state to threaten the administration with a lawsuit over new conservation rules. what are the rules?

>> they impact the business of landowners and farmers. the catalyst is the prairie chicken, the government just listed that as endangered or threatened. as a result fish and wildlife and department of the interior are posing restrictions, many on farmers in land as suspected. mandating different grazing plants for cattle to protect the chicken, and energy infrastructure to protect the breed. you have the state attorney generals from texas, oklahoma and kansas to sue, they say this is executive overreach and state management can handle this issue protecting the breed just fine. of the one the green push from the white house. >> the screen says it best, going green, losing green, a lot of times these people just one -- run with it, wind turbines, the manufacturer of

wind turbines i don't know how helpful that is for the overall environment so the overreach should be on the stateside, to a different degree it should be on companies to do what's right, nobody wants to destroy the planet, nobody is destroying the planet i don't believe. there was a big thing a couple years ago with emissions from cows destroying the environment, one of my kids came home from school laughing about that asking if that was a real thing and i had to say yes, that is a real thing. a lot of times what people want to ultimately save the planet, makes no sense. blue when you should see what dairy farmers going through in new zealand where they are going to tax cows burping, they are going to tax it heavily. i'm not sure how much but some farms have to cut the number of cattle they have got a that interferes with probability.
