at 3.74. that kind of volatility is really something to scream from the headlines, because that is a very big deal. as for bitcoin the rally continues. it is at 27, nine. earlier it was over the 28,000 mark. volatility all over the place. that is the markets. now this. back in 2008, they're was an intense debate about bailing out the banks. now we're not in that dire crisis situation at this point but we have seen buyouts of troubled banks, some backstopping of banks, pledges of insurance for depositors and pledges of really, really big money still to come if needed, what would we do if things really got out of control as they did 15 years ago? maybe a little history is appropriate here. when a slide began all those years ago, a bailout bill was presented to congress. opposition was intense why

people asked she had we bail out banksters as they were called? the bill was rejected. the market dropped like a stone. very quickly the politicians reversed course. voted for a full bailout. faced with a bail or crash decision, politicians voted to bail. the calculation was bailouts are bad, but a whole lot worse. i would suggest if our current bank crisis heads south, we were faced with a bail or crash decision, the politicians would vote to bail. that is a tough call for president biden because the main fault lies here with the federal reserve, let's not forget his massive spending. fed printed too much money too long. the government spent too much for too long. bailout decisions are political decisions. politics demand as fix. you don't go into any election with a economic crash on your hand. complex situations, crises

risks laying in the weeds. we could get there. let's not be naive. stuart: doesn't look like we're getting there at this point. could you say that the crisis is winding down, stablizing just a little, softening a little? >> it is absolutely stablizing. youseen ubs buy credit suisse, two billion dollars a third of the market cap on friday. stuart: right. >> we're seeing banks that need to get bought, assets, that need to get sopped up get sopped up. you're seeing all those high-tech companies get their cash back from the, get their cash saved from the initial issue with svb. so we're seeing a immediate stabilization of the system today. i think the big risk is, if you look at some financially weaker banks that can't just sell assets at losses in order to you know make sure if there is a bank run or something, you can't get a bank run, if you have that, some of the financially

weaker banks with not freight balance sheets having to sell things, that is when there could be hit to economic activity because then you would see a hit to loans in the economy. stuart: supposed the federal reserve on wednesday afternoon comes out says we're raising rates, 25 basis points. that is what the market is expecting, what impact on banking crisis. >> i don't know if actual 25 basis point increase in the fed funds rate will have a huge impact. actually i think the fed needs to look really carefully at the banking issue in the next few month as well as just inflation. this is no longer business as usual for the fed right now. by the way fed discount window was like $150 billion roughly. that was kind of on par with what we saw in the financial crisis. so i think with the big market in economic risk is right now is if the fed tightens wae is a lif bank run deposit pulling activity and less lending going

on, a little bit of hit to economic activity while the fed keeps tightening really aggressively. you see a lagged impact of all of that in the next few months, to me that is the big economic risk. stuart: okay. last question, supposing things really start to fall apart like they did in 2008 and we are faced with a question, bailout or let them crash, i say no politician will let them crash, all of them, republicans, democrats say bail them. what say you? >> i think the most important point you made in your intro a few minutes ago was that president biden presumably would like to get reelected. this is a moment where he clearly, would have to go with bail than crash. stuart: rock and a hard place like the fed. >> it is not an easy situation. but, i would have to say biden will err on the side of bail. stuart: jacobson thanks for joining us, sir.

>> thank you. stuart: oil prices down to 15-month low, that was friday. at one point goldman sachs thought prices could hit $100. they're hedging that bet because it is 65. lauren: they now see brent averaging 94 next 12 months. that is down from the call of 100 that was one of the more bullish calls out there. it seemed possible at the time. goldman sees potential recession because of this banking crisis. that would outweigh the resurgence of demand from china. cheap gas in the future. stuart: got some stocks moving this morning. financials, that is interesting, most are on up side, ones on the screen. what about enphase energy? i saw that go up. lauren: 6 and two third's percent, skole solar power equipment-maker. they are a beneficiary of the inflation reduction act. they say the stock is going up 22% to $225.

stuart: here we go bed, bath & beyond. lauren: well below a dollar. removed from the s&p 500, s&p small cap 600. announced a reverse stock split that signals trouble. the board is hoping would push the higher. it doesn't work. stuart: foot locker, up, sideways. lauren: nice gain of almost 5%. benefiting from increase in foot traffic, improved inventory when the sales rose in the fourth quarter. stuart: overall, dow industrials up 338 points as we speak. lauren: good. good. sigh of relief at least right now. stuart: when i woke up this morning looked to futures they were down about 150. you have a big wing here. >> ubs was tumbling. credit suisse was tumbling. nothing was working regulators were doing. stuart: mike pence blasted the manhattan d.a.'s office over former president trump possible indictment.

an arrest and indictment, this benefits trump certainly in the short term amongst republicans. what about the long term. >> well, i think it goes to the heart of what republicans and conservatives are concerned about, there is a two-tier system of justice. you look in new york city. look out across the country. they don't go after the bidens where they're taking money from chinese interests while in office and donald trump is paying somebody to deal with a nuisance charge. the person who pays somebody gets charged and the person who is out take enriching their family from their public office doesn't even get looked at. that is what the heart of what the concern is, two tier system of justice. stuart: i think there is a real concern here that the neutrality of the court system is being undermined badly because if you go forward with a political indictment of a former president who is currently campaigning for

the presidency, you just switched the judiciary to become a political machine. i think we'll be bearing the consequences of this a long time to come if bragg does what he says he is going to do? >> bragg campaigned on it. the prosecutor campaigned on it. they said they were going to get donald trump at all costs and this is what they have come up with. it is an absurd charge. it is not something -- how is it that they charge him with a state violation on a federal race? that makes no sense. if they were going to do something, it would be the federal level, not the state level. so i think this is all geared just getting trump, embarrassing trump, but ultimately i think it backfires. stuart: bring you into the bank bailout question. >> sure. stuart: let's suppose that the banks really get into much more serious trouble like in 2008. should we bail them out or let them crash? , in your opinion? >> i think, i think you hit it spot on two points, stuart.

[ horn honking ] there's a lot of buttons and knobs in here. stuart: on market this morning the dow up 300. nasdaq down eight points. quickly look at interest rates. this tells a lot about the story of the morning. the 10-year treasury, starting with the two-year. the two-year treasury yield has gone back up to 3.91%. this is an extraordinary turnaround. early this morning there was a flight to safety because of the banking crisis into these treasurys which put the yield down. same story with the 10-year. earlier this morning a flight into the 10-year which pushed the yield all the way down. that has come off. the flight to safety is not so extreme now. yields are going all the way back up again. this tellings you something about state of play in the banking crisis. lauren seeing movers, oh, amazon
