i'm elizabeth mcdonald, the evening edit start right now. ♪ ♪ ♪ >> welcome to the show, check your money up. contagion fears of banks collapsing. sales on homes rose, look at that 14 and a half in february as prices fell. prices dropped for the first time in 11 years for existing homes down about 0.2%. median value just so you know 366,000, median price nationwide. the federal reserve today began two-day meeting talking rate hikes possibly out tomorrow. we are staying on the storm and this, government sources had told fox news president trump could be arraigned next week after the president said he could be arrested today. we have the holes growing bigger and bigger in this case from the manhattan da.

grady trimble in capitol hill with more. >> liz, you're right, this is the day former president trump said he would be arrested and it still hasn't happened even though that grand jury in new york appears close to a decision a source does tell fox that an indictment if it happens will happen this week. the grand jury still has to hear from another witness and still part of delay. in a video posted to truth social, he went after stormy daniels and progressive district attorney alvin bragg. here on the hill house republicans led by judiciary chair jim jordan and at the direction of house speaker kevin mccarthy they're also targeting bragg, they say the indictment is politically motivated and they want bragg to testify before congress and they are looking whether the da used federal money for that

defendant or the prospective defendant had any name other than donald trump he would no be a prospective defendant. there's no way that alvin bragg would bring this to anyone else. it's inappropriate for congress, this is not a justice department prosecution, this is a sovereign state. it's a municipal prosecutor, they don't have oversight authority of him, over him, they don't have any business subpoenaing him to come explain himself. so criticize him, yes, cut off the money from the states, i don't think they should be giving money to progressive prosecutors, but they don't have any business making state official come explain -- liz: could house judiciary say to the white house, we want your communications with the manhattan da? >> sure. yeah, absolutely. liz: let's move onto tom deprie,

michael cohen legal adviser said he testified that michael cohen is a serial liar. he's saying his client sun reliable and saying also the manhattan da alvin bragg does not want to get to the truth and there's no clear signs whether costello's testimony will get to the trajectory. >> that whole thing was intriguing to me. the trump team called costello to rebut cohen and i bought costello will rebut cohen. apparently delaying filing this indictment which makes me wonder whether there is something going on behind the scenes. i think the da has to grapple with two things. one he does not have the strongest of legal cases, the theory is a bit actinuated and star witness is michael cohen which has got to give any prosecutor cold feet. liz: convicted of lying to

would get you a get out of jail free card and you respond to us, i do not have any information on donald trump. and he said it many times during the two-hour meeting. i swear to god, bob, i don't have anything on donald trump. liz: what do you think, andrew? >> well, i think everybody knows that cohen is not a credible witness. i presume that the district attorney thinks that he can make the case if he actually does think he can make the case because it's in the documents and that nothing that is important to prove hinges on cohen's credibility but i would point out to people that the federal prosecutors in my old office, bob costello's office had case first and they decided not to proceed with the case against donald trump i think precisely because of the things that we are talking about, the quality of the case and the quality of the main witness. liz: so democrats we are hearing two sources saying, tom, that

they're concerned that this is a really weak case. this case is about elevating to a felony of books and records misdemeanor that the trump administration falsely recorded the payments to stormy daniels as legal expenses. they were referencing a legal retainer with michael cohen that didn't exist. again, what do you make of democrat officials and trump critics have deep concerns about the legal merits of this case. >> that should have been a big red flag to the da in my opinion. i mean, when you have people who are tranche opponents of former president trump warning you off this case saying don't bring this case, this is a bad idea, you think that might have been a caution flag but he seems determine today plow ahead even though as andy noted federal prosecutors and others have looked at the same evidence and decided to take a pass on it. i don't know what the da thinks he saw that the other very talented experienced prosecutors all apparently missed. liz: federal election commission dropped it. alvin bragg, deputy attorney

general. let me check this in the new york attorney general office, helped supervise lawsuit against the trump foundation, 2 million-dollar settlement out of that. that office won criminal tax fraud against the trump organization. this is the manhattan da and he's picking up on this. where does this go? >> well, you know, liz, the system that tom and i came from is a system where prosecutors are appointed by the president and have to get vetted by the senate to make sure they are not going to use authority in partisan, political way. in the state system, these are elected positions. i think we'd be better thinking of alvin bragg as elected progressive democrat than as law enforcement official and what he's doing i think is atrocious law enforcement but probably good progressive politics in man manhattan. liz: important position thaw you described his position in the system. there's this too, tom. final word. democrat candidate john edwards

acquitted of campaign finance charges in 2012. remember, when he gave money to pregnant mistress. if the indictment alleges hush money violated campaign finance laws, then wouldn't the trump lawyers argue that it fails what is called irrespective test and trump would have paid daniels anyway regardless of the campaign to avoid embarrass member because he was a public figure. >> this has echoes of john edwards case. i think what it tells you that jurors take a common sense approach. no matter what arguments the prosecutors put out there, the jurors look at the conduct and they say, look, what really was going on here. we want to get to the bottom of this, we want to do justice and we don't necessarily agree with the story that the prosecutor is spinning and that's the conclusion in the john edwards reached and may be the case that result that the jurors in a potential trump case reach.

liz: you guys were terrific tonight, thanks for helping us out. >> thank you. liz: the federal reserve kicked off two-day meeting. it's dealing with major economic issues, inflation, bank closures, will they raise rates and by how much and could that clobber banks even more and your wallets, edward lawrence live at the white house. >> we are talking about the market believes 25 basis points will be the move tomorrow but we were talking two weeks ago about 50 basis points. so the landscape of all this has changed. meanwhile inflation is still rising. still causing problems in the economy. the feds preferred method rose last month and that's what americans are dealing. the house financial services committee will hold first hearing on the failed banks this week next week. >> we have individual banks who

were not following the proper regulatory framework and regulators who whether -- we don't know why but we are going the find out were not holding the banks to the standards that they should have been held to. >> the secretary saying she's on the same page and she always wants to look to see if regulations need to be strengthened. >> we are currently focused on this situation at hand, but we will need to re-examine our current regulatory and supervisory regimes and consider whether they're appropriate for the risk the banks face today. >> the secretary went further in her americans bankers association speech saying that she possibly could lack at covering more ensured accounts at other smaller banks to ensure stability and that's a change from what she testified last week. liz: edward lawrence, thank you so much. we need this guy on the show.

congressman greg steube. when secretary yellen says fdic may temporarily expand, covers uninsured deposits, doesn't that mean more bank crank-ups and more banks will gamble with the deposits and then expect a bailout and taxpayer wills have to foot the bill for that for their wrongdoing? >> yeah, that's certainly not what i support. i don't think that's what mr. mchenry the chair of the financial services committee support, i know republicans don't support that, speaker mccarthy don't support that. there's a lot of support in the caucus to not increase bank bailouts or allow for bank bailouts. this is a situation where he don't need more regulation, we have plenty of regulation on banks. we have a situation where the regulators weren't doing their job for whatever reason and i'm glad that chair mchenry is bringing in these individuals to ask them why they weren't going their job. the last thing the american people think they should be doing is bailing out banks and wall street for making bad decisions. liz: yeah, so, you know, the

treasury secretary is saying, we need to back-stop uninsured bank deposits because if we don't banks will collapse and cause everybody's banking fees to go up. banks are going to crank up and collapse if they make wrong-way bets. look at silicon bank, they got a government rescue. laura, look at this, she got over $7 million after she left silicon valley bank. she oversaw the bond buying spree that left the bank vulnerable to run a deposits, locked up the balance sheet with bad investments and after she left they had no chief risk officer for eight months. roll the dice, let's give the bill to the taxpayers? >> yeah, no, absolutely not. that's absolutely not what should happen and i don't think we should bail out especially people like that who make decisions and get $7 million and leave and their decisions are left in the wind fo depositors.

there's not going to be support in the conference for that. i'm very happy that chair mchenry will bring people in and we will get questions as to why the regulators at the fed and otherwise were not doing their job. liz: i've been covering bank crises since the 80's, the 2007, the dotcom bust, then in 2007-2008, congressman, nobody ever said back up uninsured deposits ever. this is because of a few banks that made bad bets and all of a sudden the biden white house gets the change the rules that have been the gold standard forever when fdr says do not ensure bank deposits, bankers will roll the dice and ruin things. so where do you go from here, congressman, will you guys try to stop this push that's now -- it's moving that could happen? what do you think? >> well, we will absolutely in the house and chair mchenry, we

declassifying u.s. intelligence of the covid pandemic coming out of china. what do you expect the dni will release about china's wuhan labs? >> not much really because when you talk to senators who have been looking for this information, they have been saying the government is not turning over basic information about which grants went to which labs, stuff that is not classified, so as long as there's a lack of cooperation among those involved, those that are still working and loyal to dr. fauci, i don't think we are going to see a lot of new information. liz: doctor, it still has not been found in nature, no infected animals found, no variants of the virus. what's going on here? >> it's not for lack of looking. they've looked in almost every species that could be transmitting it. it's clear, there's about 20 great reasons why somebody should be completely convinced.

fairfax county officials downplayed i hate to say this guys, brace yourself, sexual assault of a 12-year-old, seventh grade girl by older boys between classes, what's going on in virginia? >> isn't it horrifying? we were talking about doing march madness district and fairfax is a strong contender. this is a district that over and over again has prioritized micro-aggressions over student safety apparently for years. like you said, almost a decade and so it's tragic that the lawsuit had to be brought but as the victim's family said they are seeking justice not only for their child but the dozens of others who they believe have been assaulted. liz: okay, how in the world can democrats push back in parental rights and education. do you really need academic degree to know what's right to protect your children and what's common sense for your own child? the democrats do not have a leg to the stand on with this. let's listen to the attorney who is representing the victim here, watch this.

>> well, this is a district right that during shutdown they did demands to reopen, they demanded universal health care, moratorium on charter schools. this is a naked shakedown and student achievement, look at the numbers in the district. reading, writing, math, those children are not learning. it's absolutely rich that this district says they prioritize children when the numbers do not bear that. liz: parents they don't have academic degree, they can't weigh in on what's going on in schools. do you need a degree, really, when it's about protecting your own children, how about they get a degree in common sense, how about they get a degree in what's thinking about what's right for children first. >> they've learned the words riot and resistance. i mean, that's insult to injury when you look at children in the school district are doing and who does that impact the worst, low income and minority

amount of income. if you or i didn't pay our taxes in anything close to that figure of almost $2 million, there would be criminal charges. you wouldn't just be writing a check. if you write a check that big, you made a lot of money not just the 1 million we are talking about and he made it in russia. he made it in ukraine, he made it in china. the air is that vice president biden specifically asked for authority and made visits. liz: so who in the house, which house democrats are basically, you know, talking to the white house about this to push back on what house gop is doing here? is it just jamie raskin or others? >> i think it's the entire team. the idea of denial and try to run out the clock has been -- to be honest every president tries it when there's two years left and, you know, under president trump you saw some very quick action, you saw the courts working incredibly quickly. well, under republicans historically we can wait two

years just to get a decision on a contempt. so this is one of the things that james comer and jim jordan are dealing with, is they have to move quickly because if we go all the way to the courts we can't expect the courts to give us the speedy results that they gave the democrats against president trump. liz: you know, it's also tangled web of off balance sheets, companies and bank accounts losing money in and out. also foreign lobbying violations that the laptop emails and texts confirmed or rather purposely using companies to register as foreign lobbyists. >> well, this is one of the laws that is least obeyed but selectively prosecuted and it's infuriating that one person will be prosecuted for failure to register as a foreign lobbyist even when they might be direct investors in a company or whatever and others get a complete pass on clear foreign
