news contributor tulsi gabbard. welcome back. >> thanks, kennedy. kennedy: so how much responsibility does anthony fauci bear for what has happened, the fallout from covid? either in terms of the virus manipulation itself or the cra the cone january lock counterthat have altered and ruined so many livesesome. >> well, there's no question that he bears serious responsibility with this pandemic. but first, let's just set the stage so that we're all on the same page. fauci is not a legitimate scientist. his so-called science is tainted by two very specific things. number one is his political bias. it came through in everything that he said and the decisions that he made. and number two and maybe even more importantly is his own selfish interests in trying to cover his own butt and run away from that responsibility that he carries. where we stand now, what congress should be focused on is preventing another pandemic. and so we know two things.

number one, this thing, covid either came from a wet market or, more likely as all signs are pointing to, it came from a lab leak that was conducting this dangerous gain of function research. now, congress and must take action immediately to do two things. number one, stop all funding, stop all u.s. funding for this dangerous gain of function research whether it's occurring here in the united states or in any other part of the world or other research like it that could result in another pandemic. and number two, work with other countries, pressure other countries like china, vietnam and thailand and others that have these wet markets to get rid of them. this is the action that congress should be focused on antibiotic thing rather than political grandstanding in order to protect the best interests of the american people and prevent another pandemic like this from occurring. kennedy: one of the things that will keep that from happening is xi jinping is personally and politically very invested in traditional chinese medicine, and a lot of the cures come from

wet markets like that. and, you know, part of it is i'm going to say science loosely, another big part is superstition. but he is so personally invested in that, that i think he's going to preserve any avenue to move traditional chinese medicine forward. so that's problematic. also i don't know if china has been appropriately shamed for whatever reasons. are you confident that we will not see another pandemic like in our lifetime? >> we can only know that we will not see another pandemic, i think, first of all, no one can guarantee that, but i think this is exactly why our leaders, our leaders here in the united states must be focused on taking action to prevent another pandemic like it. and there are very specific actions just based on the information that we already know today to be able to do that. we've heard rand paul, he has tried over and over again to try to expose this gain of function research that is funded by the united states here and around

this, you know, attorney-client privilege, right, in the way -- and demand that somebody's attorney testify. so these are, to my mind, unserious attempts, not sort of rising to the level that you would expect for the violation of as important a democratic rain small r republican norm of not prosecuting your domestic political opposition, right in so avoiding even the appearance of weaponizing the rule of law against your political opposition is so incredibly important that we haven't done it for 250 years. and this kind of tiki-tack sort of charges, i think, underscores the real possibility that this is political. and regardless of whether it is or not, it sure looks that way. that is extremely bad for the rule of law, for confidence in our rule of law and our ability to move forward as a country. so i think this is very, very serious stuff. kennedy: yes. it's a tale of who to the legal systems, doug. unfortunately, it's not just the haves and have nots, it's the left versus it is the right.

so tell me about this attorney-client privilege piercing. >> sure. kenmen because we've always held that that is very sacred. like a murderer can basically go to his attorney and say, bro, you should see how bloody that crime scene was, and the attorney doesn't have to divulge that. so if trump lied to his attorney and said, yeah, it was hush money, don't worry about it, or, yeah, those records or, why does that mean the attorney now has to testify against his or her client? >> sure. the law in this area, kennedy, is well settled, that if there is an actual commission of a crime that a lawyer arguably knows about, the attorney-client veil can be pierced. and what clearly the justice department special prosecutor jack smith did was went before a judge and made that case that donald trump obstructed justice. now, whether that's the case or

not, we don't know. but that's what's being litigated now in the d.c. circuit. kennedy: yes. and, robby, let's talk about the documents case. as you have said in the past, we are overclassifying things. so if you're going to to the ensnare a former president, then don't you also have to charge every former vice president, every member of congress past and present and anyone else who might have misplaced documents? >> absolutely. i think all americans, not just republicans or conservatives or trump supporters, have begun to understand the difference between procedural crimes like obstruction of justice, etc., that they can always get someone on if they try hard enough and actual, serious criminal behavior. i don't think a former president or current president should be above the law, so they are free to pursue whatever they want. but let's talk about what was actually wrong here9. in the documents case supposed hi he a had classified documents

that he shouldn't have which biden had and pence had, everybody else, and that's because everything is classified because government bureaucrats want to hide from the american people what they're actually doing. and right now we're making an effort, congress passed the law, biden signed it, to declass pie the origins of the covid pandemic, and i want to know what led the energy county to make their conclusion that it might have been a lab beak -- leak, but i know there's going the to be all these redactions. that should be the bigger scandal here, not what box had or trump had or biden had -- kennedy: and when you have a unanimous vote in congress imploring the president to declassify this information and the president waffled -- even though he signed the bill into law, but he waffled on it for a little while. even they wanted to see the goods. i would like to see even more of the goods, and that does not make me a political pervert. but let's go further into political perversion.

desantis hasn't announced an official run, he's widely expected to the. are these guys on a campaign collision course? i kind of hope so, inez. it's getting a little boring around here. >> yeah. you know, the most disappointing thing about this entire situation is i didn't realize that trump workshopped his nicknames. i really thought that they sprang from his head like iowa three that from the head of zeus. i thought they were spontaneous, and we found out that they get vetted by committee. that's really disappointing to me just as an aside. [laughter] it's not even the best of the nicknames, i feel like tiny d was the obvious choice of the ones he released. this is clearly the start of the primary season. really i think it's going to come down to these two. i don't think that what trump has been tweeting or truthing about desantis is at all accurate. even if you favor one or the other, obvious that desantis has been a leader, a real leader in the republican party. he has been the best governor in

america, and he's proven that on such a range of subjects. i'm really impressed with some of the policy moves he has made targeting the power of the institutional left. and i don't know that these kinds of, oh, he wasn't a very good governor or especially attacking him on his covid record is really the best way for trump to go. kennedy: i think you're right, inez, and i i think that could be turned around, and any candidate can go after the former president on his covid record. you know, that's shooting fish in a barrel. but i want to read you this quote from the piers morgan interview and get your reaction, if you would, doug. he said, i want other republicans to do well. i want them to eclipse me. we're setting a great standard in florida, have everyone up their game. i thought that that was a very solid quote if him. your thoughts. >> yeah. i think ron desantis is on firm ground when he distinguishes himself personally from trump, makes the case that the he has been supportive of

the party, not just out for himself, and that that he represents consistency and coherence where with trump you get chaos and uncertain i the. so that -- uncertainty. so that's the approach i would take if i was ron desantis. but as a democrat, i'm not supporting trump or desantis. kennedy: all right. so, robby, obviously it looks like it's going to be a very crowded field. that seems to favor donald trump. do you at any point see republicans getting together and agreeing to stay out of the race or to get out early to give desantis a better shot? >> they certainly should do that if they really want to beat trump. if it's a crowded field like in 2016, yes, donald trump will walk to the nomination. i predict that won't exactly happen. i think it will be more of a showdown between trump and desantis in which point desantis the will be able to make, i think, an electability argument more than anything else. we had a midterm a couple months ago where desantis was dethe

kennedy: half a million students locked out of the classroom again as the l.a. unified school district closed due to the a strike. parents are desperate, but the teachers, hey, they're dancing mt. streets. yeah. ♪ ♪ kennedy: freedom, yeah, so ironic. let's destroy the freedom of working parents and kids who are now wandering the streets like little homeless urchins. the striking employees demanding a pay raise and more hours. the district says it will bankrupt them.

when everything else opened up because of the crazy so-called public health director there in los angeles, they have these ongoing disruptions because if any single child had a covid case, they sent the whole class back. so that's been going on for ages, and now you have this strike. and by the way, it's not the teachers who are strike thing, it's support workers -- strike thing, it's support workers. i think wanted a 30% pay increase. the teachers then came out on strike in solidarity, they a say. so first of all, there's the absolutely cruel i the, the teachers made no effort to try and keep the schools going with online classes or anything like that. no, they just went out on strike as well and showing what cruel i the they have, total contempt for the kids -- cruelty for the kids. here's the point that the everyone needs to understand. for decades now the teacher unions in los angeles, throughout california have demanded luxury pensions and health care -- kennedy: that's right. >> -- as part of their package. that has added up now to billions of dollars with a b, billions of collars.

that money could be used to to raise the pay of the support workers, the teacher unions claim they're in solidarity with their comrades, the support workers. but, no, they keep all the money for themselves for their luxury pensions and health care, meanwhile they preend they're in solidarity. the whole thing is so disgusting. kennedy: it is. and i talked about it last night, the state of california suffers from this illness, and that is unfunded pension obligation. that's what happens when you have a mono-party state and a teachers union with their rich membership dues only donate to democratic campaigns. and once they get democrats in office, they look over their shoulders as they write those laws and agree to those pension increases -- >> yes. kennedy: -- that they simply cannot pay. and you're absolutely right. now, a lot of people are like, well, $30,000, that's too little. that may be the case, but did these support workers know that? what about the part-time ones, and what about the fact that

they don't work 12 months out of the year? >> exactly. look, they knew going into this, many of them like the terms and conditions in the sense that you get long summer breaks and so on. i think everyone should be entitled to the a living wage who works full time, but the way to get there is not this kind of thing with strikes, nor is it to force employees to pay more. start by cutting their taxes. that would give them more money to spend on their living expenses. and they don't even think about that. it's always spending more public money, bankrupting the state. they never think about reducing these perks that the teacher unions get which are way in excess of any other state. it's total corruption. it's pay to play. kennedy: yep. >> if this was going on in the private sector with businesses getting money, getting these fairs in exchange to the scale that's happening with our public schools, there'd be a total outcry, but it's just normal behavior for the democrats. kennedy: elizabeth warren would be having a litter of kittens every single day if this were

fear now that buster 's dad alex is behind bars. and smith's death is not even the only one with bizarre ties to the disgraced family. how many layers does this rotten onion have? the party panel is back, ines, doug and robby. so, robby, let us begin. this case of stephen smith has been so tragic for his family. his mom has been able to raise $80,000 partly through the series on netflix and hbo max that that the highlight the way that his son -- her son, rather, was murderedded and discarded in the middle of the road. and almost everyone that law enforcement interviewed, they talked about buster murdaugh. will we finally see some justice here? >> i hope so. you know, what we're hearing now is there wasn't actually a lot of evidence that it even was a hit and run, out looked more like a murder by some blunt force trauma maybe staged to

look like it was a hit and run. and they never talked to any actual suspects, but there was all this chatter that murdaugh might have been involved. you know, i think -- i mean, there's no silver lining to this horrific murder that alex murdaugh was part of and he's, you know, being held accountable for. but but the increased notoriety of the family has led to more media attention of the previous potential victims to this familo absolutely deserve justice. the nanny, the young woman in the boating accident and stephen smith. so i really hope that at least something positive can come out of the media's understandable interest in a really, you know, salacious and, frankly, unbelievable that so many, one family could be involved in so many very serious potential murders, and today demand and deserve justice. kennedy: and, doug, hope any they will also exhume the body of gloria satterfield,

housekeeper that robby alluded to. her family, there was a $4.3 million insurance settlement because of her death that alex murdaugh stole. and he committed that in the double murder trial. so they want answers as well. does everything lead back to the family, or is it just some really unfortunate -- >> everything i see leads back to the family, kennedy. the insurance policy, death of the housekeeper, the death of stephen the smith. we clearly have probable cause to investigate the murder again, and i think it was a murder x to investigate through the exhuming the body of gloria satterfield. clearly important, and this family looks like really incredibly evil people who deserve a very, very bad outcome

for the crimes that at the very least we've already seen the father, alex murdaugh, convicted of. kennedy: yeah. and, ines, you know, we've seen families with privilege, you know, particularly in our political landscape. but there's something about family. people are so interested in justice. do you think it's unfair to speculate the way people have been about buster murdaugh? >> look, i don't know that it's unfair. there certainly seems to be a lot of suspicious quince kenses around in this family -- coincidences. my worry is twofold, i think. one, the power that we give to to pop culture and netflix, right, by sort of digging up these true crime stories. it's very easy -- in this case i think there is a pretty strong case which is why the father was convicted quite quickly by the jury. but i do worry about that social dynamic of these kind of viral netflix shows about real crime and, obviously, the producers

come to some conclusions of their own, and hen they kind of sway the public. i don't know that it's the greats environment for justice. the other thing is something beyond this case i think we're going to have to deal with, and that's the unreliability of certain technological evidence, right? especially, you know, for example, a phone pinging a particular cell phone tower. it's much less reliable than we actually think it is. i do think that we're going to have to develop standards over time because in this case that evidence, you know, is sort of presented by the prosecution as ironclad, as though that technology is sort of perfect. and it really isn't. and in a case like in that relies on circumstantial evidence, a lot of which is digital, i do think we -- this case aside, i think we need to develop stronger norms about understanding in the same way that we did, for example, with direct testimony, right, where we now understand that some of the eyewitness testimony, actually, some of the least reliable evidence over time.

kennedy: is the manhattan district attorney getting cold feet? oh, alvin bragg. canceling today's grand jury session into former president trump's hush money investigation, and it comes amid word a, quote, major dissension in the d. a.'s office. that's not surprising since the progressive d.a. has been accused of turning the case into

you know, domestic terrorists or a rogue progressive d.a. going after a former and potentially future president, what is most egregious to you? >> well, i i i think all of it. i mean, these agencies are supposed to serve we, the people. instead it seems like they're targeting the american citizen. and the one you bring up, we just released a report yesterday about the targeting of parents who show up at school board meetings to add slow tate for their sons -- advocate for their sons or daughters. in the northern cricket of georgia, that, in fact, was done. democrats said there was no coordination between school board groups and the government prior to the letter being sent asking for them to get involved. yes, there was. the school boards groups talked with the white house, the justice department and the department of education before that letter was ever sent that prompted merrick garland to issue the them ran couple. and, of course, democrats said this was widespread, it was all

across country. no, it wasn't. in fact, one u.s. attorney, a democrat u.s. attorney in the biden administration said that this was a manufactured crisis. this was, the local law enforcement said what are we doing? this is not a federal issue. if there's real problem, we'll handle it at the local level. so, yeah, that is a great example and, of course, what you have alvin bragg attempting to do, maybe going to do in the district attorney's office in manhattan. kennedy: yeah. it's unsafe here in new york. people are not prosecuted, people operate and is harm each other with impugn i. they know that, you know, at most they're going to get a ticket. most violent felonies have been downgraded to be the misdemeanors, but here you have a misdemeanor that's being upgraded to the a felony. so do you -- now, the former president says he thinks that there will not be an indictment. do you share that view? >> i don't know. i mean, it's sort of been back and forth over the last couple days, we'll see. but you're right, the felony cases he brings, he loses half

of them. his main witness, if he brings the action, is michael cohen, a guy who went to prison for lying who came in front of the oversight committee, by the way, is and lied six times in front of congress. that's his star witness. so i think you know this is a poor case and a case that should never happen because the department of justice wouldn't bring it, the federal cricket in new york wouldn't bring it -- district, psi cannes, the former d.a., wouldn't bring it, and even alvin bragg wouldn't bring it a year ago, and he didn't decide to bring it until president trump says he's going to run for president, now we're going to go after him because the left says i should? that is selective prosecution, and the country understands that, and that is not how our system is supposed to work. kennedy: yeah. even the part of the country that doesn't support the former president. they understand that that doesn't look right. and that is something that could help him. you know, people look at him and are like, man, you know, at least he's fighting for us, because the whole world seems to be fighting against him.

[laughter] no, no, i wouldn't. in fact, some people say we're in some kind of wrestling here in congress every day. but, no, i'm old. i'm not going to do any more of any kind of wrestling. but we are going to, we are going to try to wrestle with these agencies that we think have been going after the american people. and the other thing that bugs me, kennedy, is think about it, with when were any of these bureaucrats across these agencies, when was nina jankowicz, when did the she ever put her name on a ballot, get elected to concern when did fauci ever put his name on a ballot? kennedy: or alejandro mayorkas. >> at least mayorkas had to get confirmed, but i don't think fauci ever had to get confirmed recently in front of the senate, certainly. so that's a, that's a problem i
