>>ou can imagine donald trump and his lawyers are hammering out that battle plan at mar-a-lago in palm beach. the secret service is also preparing to take donald trump to manhattan next tuesday for his arraignment. there are reports he's facing 34 counts of alleged business fraud. but on the face of it, it's just a misdemeanor. but it can be upgrade to a felony if fraud is committed intentionally. prosecutors investigating 150,000 in payments to "playboy" model karen mcdougal. the indictment remains sealed. andy biggs the republican from arizona says he believes the case as it stands doesn't have any standing.

combative by all reports. i am sure that was an understatement. liz: joining us, former whitewater counsel sol wisenberg. first to you, sol. 34 counts of alleged business fraud? that seems excessive? it seems like overkill. are we wrong, sol? it sounds like this case is weak that they need 34 counts? it seems over the top. >> the number of counts can be easily manipulated. and it isn't necessarily an indicator of anything. you have federal prosecutors who all the time bring 9-count mail fraud and wire fraud indictments. and conspiracy is added. to me that it's got a lot of

counts is meansless. the question is what is the essence of the charged crime. this whole idea of putting the indictment under seal, then announcing it and then it's going to be unsealed at the time of the arraignment. that's not a feature of new york law. they didn't have to put this indictment under seal, and they didn't have to announce it after they put it under seal. to me you have to question why did you do it that way? is there something you haven't told anybody about, a completely separate crime you found and you want people to comment then look foolish about it? who knows. we know this office is already engaged in misdirection by making people think there wasn't going to be an indictment this week, then there was one. i'm curious to see what the indictment is going to say. liz: why have the indictment sealed? what is the documentary evidence

the public has not seen for their case? >> li -- >> i was a federal prosecutor for years. there are a reasons why you add a lot of counts. sometimes it's just the nature of the statute. but other times it's the war of the optics. and you want a jury eventually to believe the more counts there are, there may be more criminal behavior. let's face it. those of us who have been prosecutors have added counts to put more pressure on the defendant and to make the case to be stronger than it is. if it's strong, we'll see that when it comes out. as to sealing it. it's odd they are doing it. but i think they are doing it so

it doesn't get away from them too soon. they want to get the former president arraigned. they want him booked and his photograph taken. then they will deal with the aftermath of how weak the case is or isn't. liz: right now it's about the court of public opinion. former attorney general bill barr reacting on kultd low saying they are shoe horning a state misdemeanor into a federal criminal tell any. that misdemeanor -- criminal felony. that misdemeanor had already expired on the statute of limitations. >> they take the misdemeanor which has a problem with the statute of limitations and try to shoe horn it into a felony by claiming the reason the documents were falsified was to cover up another crime. they are assuming the payments were a campaign fines violation

because they were a contribution to the trump campaign. this is an abomination. the epitome of the abuse of prosecutorial power, to bring a case that would not be brought against anyone else. they are going after the man, not a crime. liz: what do you think, sol? >> your viewers need to understand that this application of the law, the new york state law, this particular application, not only bootstrapping it into a felony which you can do under statute. if you commit this misdemeanor in order to further or hide another law, it can be a felony. but what is the law they are saying he's trying to hide? it's a federal campaign finance violation the federal government already declined to prosecute. this law has never been tested

in the new york court. this application of this law. so draw your own conclusions. liz: what sol just said. we have chuck schumer, we have nancy pelosi out there saying this is holding trump accountable on a case that could be tossed because there are so many holes in it. fbi director james comey. pelosi tweeting she thinks trump is guilty until proven innocent. and james comey saying, it's a good day. they took an oath to uphold the law. so this is an odd tweet higher. what do you think of all this? >> this is their day. this is what they have been waiting for. let them celebrate it. the wheels of justice grind

he will tell you what's going on. dr. marc siegel. doctor, what do you make of that story? why isn't the cdc picking up on the w.h.o.'s recommendation? >> one of the reasons is the w.h.o. recommendation is about resources. in other words, you have a country that's poor or can't afford vaccines or getting a limited supply. that supply needs too go to those who need it the most, the elderly, those who are obese, those with high risk symptoms. those are underlying diseases. the younger population aren't generally in that group and healthy young people aren't at high risk. so i'm for what they said, and i think the w.h.o. should have said that months ago. we need to prioritized things. we are coming into an era where
