is down just like is that, down up 13, the nasdaq is up five. it is a real mixed bag this morning, no clear trend. the 10 year treasury well below 3.5%. oil, that is important, it keeps going up after opec said they would cut production. we are at $81 a barrel. gasoline is at the same price averaging $3.50 for regular, waiting for it to go up along with oil. bitcoin, $28,100 per coin, not much movement. the latest on job openings, this to everybody else is called the jolt report, bottom of the screen, jolt report. lauren: a huge drop, 9.91 million jobs open on the final day of february. the expectation was 10.4 million.

january number not being revised was 10. 8 million so there you have it. less than two jobs open per one person looking good but the job market is tightening. stuart: the job market is not so strong, there's not so many open jobs available as there were last month or the month before. i call that a mild positive for the market and that is the way stocks have reacted, not much, a little bit more of again for the dow, a little more of again for the nasdaq. now this. it is a question that won't go away. will president biden run for a second term? he appears to be putting off the decision. politico says he won't decide until the summer or the fall. i don't think he's going to run. i say this for several reasons. first, he's too old, he's 80 now and showing all the signs of physical and mental difficulty. he turns 82 in 2024.

the aging process doesn't reverse. in poll after poll, a large majority of voters thinks he's too old for a second term. half of all democrats say the same thing, too old, he lost his own party because of his age. second, he has a record of failure. tough to get reelected when you can't showa win. crime, education, the border, the china threat, the new world order threat, energy policy, inflation, where's the win? biden doesn't have a record that merits a second term. and i don't think the democrats or the country want to risk a kamala harris presidency. likelihood of her moving into the oval office goes up the older the president gets. the veep is one more reason president biden won't run again. it is actually the democrats who have to pull the plug on a second term, trump and the gop have nothing to do with it, too old record of failure, kamala. eventually democrats will make the call you can't run.

second hour of varney just getting started. ♪ gentlemen on the right-hand side of the screen, that is ben domenech but i don't think he's going to run, do you? >> that is a bold bold statement i think on your part. i think in terms of the argument on paper your argument is quite strong and that is one of the reasons so many democrats were in anticipation of a very buddy midterm. already starting the conversation what they were going to do after joe, what their plans look like but by having democrats over performing the midterms the way they did, that put those people inviting whisper campaigns, engaged in conversation about how they were going to leapfrog

kamala on the ticket given how terrible her track record has been, that put a record scratch stop to their conversation and now the conversation is more can we replace joe? is it even possible politically? i think the longer he goes without announcing the more people are going to come around to your opinion and come to the conclusion he's not going to run. my own perspective is he's going to run because they have no one to replace him with that makes logical sense. they wished they could replace him with kamala originally but now she's been such a disaster they can't afford to do it. stuart: what about gavin newsom? he is running whether he declares or not, he's campaigning in red states. >> he's acting like he's going to be running but the problem with gavin newsom is so many problems associated with california and the california democratic experience he doesn't have that wonderful

story to tell in terms of taking to the nation i will bring these wonderful things, people think of california and associate it with lawlessness, san francisco, covid lockdowns, backwards policies, bankrupt government, that's not something democrats are ready to explore on the national stage, not replacing a diverse woman with a white man. stuart: i am with you on that one. to change the subject did you see this? nancy pelosi sat down with hillary clinton at columbia university claiming hillary used to be the person putin feared the most, role tape. >> it was her clarity, the present leader of russia that made him turn around and ensure in an illegal way, come out against her in her campaign.

our democracy, by vladimir putin, because the person he fears most in terms of his lack of democracy in russia. stuart: sounds like a rewriting of political history. >> someone bringing the office depot button, poorly translated reset on it is not a sign of strength which is something hillary clinton was known for in terms of relationship with russia. this revisionist history that nancy pelosi is engaged in, to what we see happening today, the indictment of donald trump, the left has never gotten over the fact that hillary last and she deserved to lose, she was a bad candidate, a handful of facebook ads run by russian trolls, not the difference that

the progressives with johnson, a disaster for city that is suffering, maybe he can stop the rot but i'm not looking forward to any of those candidates however the winner may be to turnaround that aircraft carrier, the den of iniquity. people won't go downtown anymore or go to nightclubs or dinner. women that do don't carry purchase, they take their credit cards out, and they carry one thing. they take the rings off. it's that bad. i would love to see chicago come back but whoever is elected there, i'm shocked it is as close as it is, shows the teachers unions -- should run away with it. if that's the case, yeah. stuart: jpmorgan's chief executive, jamie dimon, says the banking crisis is not over saying, quote, even when it is behind us there will be repercussions for years to

come. do you agree with that? >> i do agree with that, the banking crisis, the pandemic, the way he handled the pandemic of children going back to school, we are in dire straits. how great a situation we are in right now is what they are trying to tell us every day. 44% of americans have a second job. we've got 60% of americans working paycheck to paycheck, 18 million americans classified as in abject poverty. that's the rate -- white shining city on a hill we are supposed to be living in i would hate to see if something goes bad. all the things i see lining up are not good and we are whistling by the graveyard when it comes to valuations of these companies. i am terribly pessimistic. we need a klinzing, a great

feeling out the lawmakers. how are they reacting to this? >> reporter: the chairs of two very powerful house committees, oversight and judiciary just but our statement about a possible gag order against donald trump bleachers what they had to say, this is from congressman jim jordan and james comer, to contemplate stifling the speech of the candidate is at odds for everything america stands for. we know about two lawmakers showing their support for the former president by going to new york city. congressman george santos just arrived at an event that marjorie taylor green will be at right by the courthouse. as possible she will be joined by other lawmakers as well. others say this indictment isn't just about the former president. take a listen. >> this is what republicans do,

failed states do, we can't let the justice system be politicized. if this could happen to donald trump, somebody with 100% name id, it can happen to anyone, any agency can it has been weapon eyes to. >> as we await the former president's arrival in the next 40 minutes or so, democrats are mostly remaining quiet today and have been for the last few days. the initial reaction from progressives was celebratory in nature. democratic leadership in congress said let the process play out and it seems that is what they are doing, waiting to see how this unfolds today just like we are before chiming in. stuart: thanks very much. trump hired a new defense attorney, the lawyer who got the case against paul manafort dismissed back in 2018.

greg jarrett is a legal analyst for fox with us now. we just heard trump wants to move the trial to staten island, what are the chances of that at the last minute? >> there will be a flurry of motion this and among them, judging by donald trump's remarks, not only challenging the judge and demanding he be disqualifiers to or accused for cars, buyers and political connections but also to change the venue to a venue that is perhaps more representative. stuart: can trump at this point change the venue, what are his chances? >> that doesn't change the judge. stuart: what are his chances of changing the judge? >> it will be up to the judge

whether he will grant the motion to recuse himself, you could take that up on appeal, and her to yakitori appeal as well as the venue. the strongest case is to knock this out because the statute of limitations expired long ago. the predicate crime here appears to be a misdemeanor that has a 2-year statute of limitations, that expired 5 years ago and i don't see that it is expended or told him his lawyers say, if you read the language of the statute, it says you can't find a defendant whose out of jurisdiction, everybody knew where donald trump was, and the fact that they filed an indictment against him while he is outside the jurisdiction means that they could have done it earlier when he was also outside the jurisdiction so three motions,

venue, judge, statute of limitations will be the immediate motions. stuart: a gag order is pretty standard you don't want the defendant to walk out of the court and badmouth the court and badmouth the witnesses and all that. a gag order is standard. will that apply to trump ended up it is applied to trump can he make his speech at mar-a-lago tonight? >> those gag orders are to gag others rather than the defendant. the most extreme version is to gag the defendant, that is an egregious, blatant violation of the first amendment, he has every right to proclaim his innocence and amount his defense in the court of public opinion. sadly though, most defendants don't challenge such a gag order and when they do, trial takes place before it can be litigated and appealed, so i don't think this judge would be

unwise enough to issue a gag order on donald trump but you never know. stuart: here's what we are expecting, there would be no change of venue, no change of judge, probably going to be some argument about a gag order and no recusal or getting rid of alvin bragg, this thing will go straight down the line as planned, isn't it? >> i think that is what alvin bragg has been counting on. a biased judge, biased jury, and an incredibly biased case. most americans see through this. they are not easily fooled, they are smart, look at trump's poll numbers, they have shot up, his coffers are filled with campaign funds as a consequence of this, a whopping 76% say this is politically motivated according to the most recent cnn poll. most people look at this and say are you kidding me?

stuart: the markets this morning, some reading, the dow that 90, nasdaq is down 10 points, lauren is back looking at the movers, why is caterpillar down 3%? lauren: the biggest decline are on the dow jones. you could attribute this to the factory orders following a steeper 0. 7% in february, down 3 of the last four months of economic slowdown. stuart: ev go. lauren: that's the name of the coming of the charger people, it is up to present today. it is up 60%, they got more than $6 million in funding from

announcement to cut production experts believe gas prices will continue to rise as oil prices rise. look at this graphic from aaa, the chart that shows where gas prices are, two thousand $0.50 today, the top two lines on this graph are gas prices this year and last year. the bottom 3 lines of those, the top one was when president biden came into office and you see the prices started to rise instead of focusing on this, today the biden administration announcing one billion dollars in spending for rural energy program through the inflation reduction act. the energy secretary says it gives money and tax credits to close minds and build wind farms on mine sites with other conversion projects. treasury secretary janet yellen pushing the spending not talking about any inflation reduction. >> of course the inflation --

services moving forward. >> the inflation reduction act has spending throughout the next ten years, gas prices -- stuart: a lot of wishful thinking. right now, oil is around $80.57, the price of gas unchanged, $3.50 per gallon. patrick dehan is with me. i think gas prices are going up from here because opec cut production. i've been wrong about gas prices before. and i right this time? >> in the next few days with gas prices accelerating with opec production cuts. stuart: you when you say accelerating up to cents, $0.03, $0.04 per day. >> the problem will be on the

cusp of that, 5, $0.15. the increase is only a nickel but we see signs that states will go up big. jumps in the state of ohio where prices are jumping 20-$0.30 spreading through the midwest into florida, those are bellwethers that move first. stuart: you've got stations in ohio which bumped the price, 20 or $0.30 a gallon. stuart: some state in the midwest and the state of florida engage in price cycling. they see big corrections. ohio is seeing those stations go up 20-$0.30. in the next 24 hours we will see the same happening in indiana and michigan where states could get closer to $4 in those states. a 30% bump, that is what the rest of the nation may see, the national average rising $0.15

over the next week or two. stuart: that is news and a half. tell me about diesel, farmers using heavy machinery watching this show. diesel -- lost my notes, up $4.20 a gallon. where is that going? >> good news for the farmers and truckers, diesel prices moderate. if you look at the price of diesel, it is not unusual, gasoline demand is going up, maintenance kicks gas supplier, and the national average for diesel looking at numbers here, the median price, the average price for diesel continuing, a part of opec cutting oil production or if there any refinery hiccups that will change.

the latest numbers after last year, look at the latest numbers up tremendously, particularly property crimes. last year it was bad. the only thing down was murderers. corporate headquarters keeping an eye on that story, they shut this down because they are planning layoffs and mcdonald's is one of the company sticking it out here. many companies left chicago in the wake of crime. tyson, boeing, caterpillar, citadel, and the mcdonald's ceo was very open about how much of a challenge operating in chicago is with crime and the threat of higher taxes.

>> it has become difficult to operate a global business out of the city of chicago in the state of illinois. >> reporter: the candidates operate two wings of the democratic party, the former school ceo and budget chief in chicago says crime is the main thing we deal with. the handcuffs out to come of the police. his opponent in the progressive left wing of the party says we need to spend more money on social programs, divert some from the police, backed away from the defend the police pledge, but says we got to spend more money, tax the wealthy and tax business. which candidate the business community backs? >> if we want to create jobs and grow the city of chicago, we need a pro growth environment and we can't have that if we are not addressing public safety and raising $1

leaders, the service employees union, that's a lot of political muscle for turnout. the traditional turnout in chicago dropping 35% so i wouldn't count brandon johnson out yet. if i was one of those business interests i wouldn't be shopping the campaign course yet. stuart: do you think this might be a time chicago retreats from identity politics. lori lightfoot got in on the strength of being black gay female, are we over that in chicago? >> i don't think so. even if alice wins, the victory will be narrow. brandon johnson and the closing days of this campaign framed the race as white wealth versus black labor. as long as they are dominant identity politics will be certainly part of the landscape.

it is getting rowdy down there, what happens, out of the courtroom after his arraignment and makes comments. he might do that. what happens? >> maybe he does it before. if he gets a gag order from the judge, tending to not say that, conventional wisdom is he won't do that. his attorneys might like that. might make it easier but may be he says i will get a chance to get detail. gives us a chance to control the narrative. he might do that but i also think that the nypd is better than the capital police and they have been warned. everyone is in uniform, they know how to line them up. they have people infiltrating in the pro trump crowd and the anti-trump crowd. there was a desantis appearance
