we're now just five hours away from the end of title 42. migrants already flooding across the border. experts predict it's only going to get worse. does president biden have anything close to the a plan? everyone knows this is a crisis. everyone except maybe the white house. 10,000 people a day have been apprehended crossing into the u.s. just this week. record numbers by any measure, but at midnight tonight all bents are off, folks. that's when title 42 officially comes to an end. further last two years -- for the last two years it has allowed the feds to deport migrants, in other words, the administration has had two years to plan for its end. earlier today reporters asked homeland security chief alejandro mayorkas why they weren't ready. watch. >> reporter: given the fact that you've had nearly two years to to prepare for this moment, how can chaos be the expectation? >> well, i have said for months and months that the challenge at the border is and is going on

the very difficult, and we have spoken repeatedly about the fact that that difficulty may actually only increase at this time of transition. it is going to the take a period of time for our approach to actually gain traction and show results. kennedy: all right. i've been saying for months and months, what about the years you've had? you've been in your job for years now, but here's where things get insane. the administration reportedly going to allow migrants who get into the u.s. to go free, and they won't be tracked. what a plan. technically, they are supposed to self-report to i.c.e. within 60 days, but no one's going to do that. [laughter] and news obviously spreading quickly south of the border. >> translator: well, we're all going to take a chance. we'll see. we are all going swimming later, so we're all going to risk it and see what happens. kennedy: take a chance, take a chance, take a chance. what do we do now?

here with me, california republican congressman, carol issa -- darrell issa is back. congressman issa, welcome back. >> thanks, kennedy. can. kennedy: you know, you look at this, you look at the number of people, you take into account where they're coming from, what they've heard, and, you know, what awaits hem on the other side, of course they're willing to take a risk. but did it really have to come to this? >> well, kennedy, it didn't. if they had, if this administration had simply continued with the remain in mexico policy, continued with finishing up the wall, not breaking it open and then begun other ideas that they might think would have improved immigration, they would have had something to do. even what they're saying is now their plan, they could have started overlaying title 8 a year ago if they wanted. you might remember, kennedy, a year ago they were in court fighting to get rid of title 42. kennedy: yes. and they've had men -- plenty of

time. as you know, the democrats were in power in congress. they could have consulted with the homeland security secretary and maybe hatched a plan then when they had the power and they had the numbers. but now secretary mayorkas is blaming congress, and the congressman who has a district on the border, how do you feel about that? >> well, i feel that the man who told us the border was sealed while millions came across the border swamping the border patrol, that they're just not telling the truth. and the worst part is every day -- and you see it -- people in countries all over the world make applications that they don't even get looked at for months or years to come here legally. where is the fairness in that? kennedy: well, i don't understand where the coherence is in any of this. because we're hearing a number of things from this administration. i know dhs has put together an

app that is spotty at best. it only works a couple hours a day, and it only takes about a thousand applications. they're telling people that they have to go through that process, that that is step one. but what they have to do once they get there is very complex, it's very confusing. for a lot of points on the journey to the border, they don't have internet access. they might not have phone chargers. and they're also saying that, you know, they're going on the really tough using title 8, heir going to send people back -- they're going to send people back. if you're seeking asylum but you come in illegally, you can no longer seek asylum. there's so many confusing elements. is there a way to streamline it and make it more understandable for people here and people who are trying to come here? >> kennedy, i think the administration has streamlined it. everyone knows you can go on the internet and know what you have to say. you come, you say what you have to say whether it's truthful or

a lie, and they let you in and you disappear, and your life is good for years. it's that simple. so where you get into problems is if you try to apply using the systems they put in place that don't work and take forever. but, you know, the fact is there are real, there are over 100,000 million people who are technically refugees in this country. very few of them have showed up at our border. most of those showing up at our border are people who have family or relatives here, they've heard about a better life, and they're coming to get it. and that may be the american dream, but our border is an american nightmare. ken and also that's not what asylum is. and i think the word is being misused. and, you know, people may show up claiming asylum and maybe we have to be a little bit better about defining what that means. because it's supposed to mean something specific. it is suppose to be a safety net for people who are fleeing real persecution where their lives

are in danger. you know, maybe it's the religious, maybe it's political, but a vast majority of people who are claiming that who come to the southern border don't qualify. >> well, you're exactly right, kennedy. the most common thing people are claiming is that they're afraid of the cartels, that they wouldn't do drugs or join somebody, and that's why they're in fear of their life and they're coming here. it's a standard story from over 50 of the 100 countries here. but i was there when a very tall 42 or 43-year-old russian told me that he disagreed with putin's policies, so he feared for his life. he happened to also be draft age. but the fact is, kennedy, we could take 2 million or 3 million needy people. we can't take everyone, and we can't take them without a system, and that's where we are ott today. and my district is at what used to be a border, but america has no border if we can't do something about -- kennedy: no, and i've said the

this last couple nights, but people in congress who live and work in border states, they're the ones who have to get together and come up with practical solutions, because the white house isn't doing it, homeland security isn't doing it, cbp isn't allowed to do their job. congressman issa, thank you for all of your insight. i appreciate it. >> thank you, kennedy. kennedy: well, the biden administration is happy to place all the blame on congress for doing nothing about the border, but that's just not true. the house today passing the secure the border act which would resume border wall construction and reinstate trump's remain in mexico policy. but, of course, it's the federal government, it's not a perfect fix. two republicans voted against the bill. the major reason being the proposed national e-verify system. if you've read about that, you know how incredibly problematic it can be. it requires employers to check citizenship status. my next guest says this would give the federal government way too much power over your privacy

and private business even if you're here working legally. so why is a national e-verify system a threat to your personal freedomsome joining me now to discuss with all the answers, kentucky republican congressman thomas massie. all right. let's get sassy with this, because you're absolutely right about e-verify. i'm curious why a lot of republicans think that this is the great band-aid. >> well,, first of all, thanks for having me on, kennedy. it's been so long, i was starting to wonder if you were all tuckered out. kennedy: okay, all right. [laughter] congressman. >> the problem with this e- verify is it's like the patriot act or any other background check system, the no-fly list. ooh i'm sure everybody's got a good reason when they put it many place, but if you give the federal government more power, they're going to the abuse it. how did joe biden force millions of people to get vaccinated? through their employment. that was his enforcement mechanism. he took a bureaucracy that

already existed which was osha, and said we're going to the use osha to make sure employers force their employees to get vaccinated. in the next pandemic it may become v-verify. kennedy: yes, absolutely. and frankly, i'm surprised that republicans who often the limiting the -- who talk about limiting the power of the federal government and the ones up in arms about the vaccine mandates, especially the ones that were foisted on employers with more than a hundred workers, how they're fine with e-verify when, you know, you can use e-verify with someone else's credentials and, you know, work legally. you could also have same name as another person, and you are told that you can't work even though you are in the country legally. you know, there are a number of ways that this system can go sideways. i'm just surprised that formally limited government republicans, this is their ultimate fix. >> you know, i'm on the weaponny ifization committee --

weaponization committee. why would we give the federal government another weapon in their arsenal? and you're completely right, this isn't going to stop the magnet of people coming here. first of all, they actually -- they amended this bill. we wanted -- i wanted to amend it to apply to welfare recipients, not workers, but they said that wasn't germane, and they didn't allow my amendment. but they did amend it to indicate to the people who were nervous about ag, you know, the supply of ag labor to ameliorate their concerns, they added an amendment at the last second yesterday that said, well, when we enforce this, we really need to look at whether it should apply to ag workers or not. so they're basically signaling that this wouldn't apply to the ag workers. and like you said, there's basically what this would do in addition to giving the federal government too much power is it would raise the price of fake credentials. because in the states that have tried this, that's what's happened. people still get a fake birth certificate and social security number -- kennedy: of course. >> -- and go to work. can. kennedy: yeah. they figure out ways.

you could have a thousand people using the same social security card. good job, color printer. mayor victor previno. welcome, sir. >> thank you for having me. kennedy: i understand that you are incredibly busy, thank you so much for taking time. how are you dealing with this many people? do you have the resources? do you have places to house people? what is the plan? >> well, laredo's a little bit different, but we are seeing some historic challenges here on our border. and laredo continues to be one of the safest cities with the second lowest illegal border crossings in the country. but we have been informed that we will be receiving transfers from brownsville and el paso, texas, that are currently overwhelmed. so our fear is that we will also be overwhelmed when the transfer of migrants gets here. and with the expiration of title 42 the, i grew up here on the border, and as a doctor i'm in the remember the. s every day, and i'm concerned that too many migrant transfers can cause stress in our already

stressed medical infrastructure. we don't have a pediatric intense intensive care unit, and the arrival of family units, i don't want to see a child get gravely ill and not be able to treat them. so at this point we're boarding up like a hurricane is coming. the challenges will be made to balance the resources of our community and the humanitarian efforts that these migrants might need. but at the end of the day, we're treating, we're handling federal problems that are becoming now local problems for our border community, and that's what we are at this point. kennedy: so do you feel betray by alejandro mayorkas? because, you know, he says that the border is secure but it's really these texas towns that are having to pace the brunt -- face the brunt of the onslaught. and these are numbers that anytime, it doesn't matter how equipped you are, you can only deal with so many people. do you feel betrayed by him? >> well, i think this is an

american problem, these are immigration reforms that should have been done sometime back to the avoid this situation. but now that we have a situation here, even's trying to help, of course, we're getting troops, but the troops will only assist the cbp officers. they won't do do any processing. so that is something that is left up to the cbp officers and after that they're turned in to the mgo areas -- ngo areas that can only handle about 500. 1500. and the rest could end up on the street. so that is where the city needs to step in, and we have enacted the declaration of disaster for that same purpose, to activate our emergency plan to help set up units, to help set up areas where the migrants can stay and be housed temporarily. and then hopefully we can try to start dealing with this situation. kennedy: yeah. but the difference between what you're dealing with and what you're born to be dealing with because now that title 42 the is

lifted, there's no end in sight. with a hurricane, you have to hunker down and you have to try and withstand the storm or evacuate if you can. and then you get to come back, survey the damage and move on. but this may be ongoing for some time, and you brought up families and, you know, a lack of pediatric intensive care. i wore worry about kids who are coming over by themselves. what do they do when there's nowhere to the house them? >> that is true. and the problem is that they travel at least 2700 miles and for sure they're going to have some illnesses, some conditions that we're going to have to deal with when they come here. and to top it off, our emergency rooms have to wait, the ambulances have to wait about 1-2 the hours before they can get any patients inside the emergency room as the situation is now without the transfer of migrants. so that will just add fire to the problem. kennedy: all right. well, stay safe. you -- it sounds like you have

college and he didn't work for goldman sachs. >> exactly. if you go online, there are many companies right now that for $40 or $50 would have resolved all of those issues very quickly. however, in order for them to do so, they need a waiver signed by the person on whom the background check is being performed. and therein is the rub, most political candidates aren't asked for a background check, and when they actually get elected to office, for example, to congress, there are very stringent rules about fbi background checks and other checks through which, for example, chiefs of staff must go through. however, the elected official themselves does not have to actually go through that process -- can. kennedy: no, but that wouldn't have worked at home depot. >> right. somebody flipping your burgerings cough -- burgers could have a background check performed on them four times a year because they want to make sure there are no convictions related to children or anything like that a because of the nature of the restaurant.
